Emmerich Lot Split Shore land Management Ordinance Amendment Public Hearing Helicopters/Heliport Corner Lots Retail Sales/Round Barn Ord. 8 Amendment Discussion (.J l~ ( -, '0 CITY of ANDOVER REGULAR PLANNING AND ZONING COMMISSION MEETING FEBRUARY 11, 1986 - MINUTES The Regularly Scheduled Andover Planning and zoning Commission meeting was called to order by Chairman Don Jacobson at 7:30 P.M., Tuesday, February 11, 1986 at the Andover City Hall, 1685 Crosstown Bouelvard N.W., Andover, MN. Commissioners Present: Commissioners Absent: Also Present: Apel, Jovanovich, Pirkl, Vistad, Rogers Bosell Tony Emmerich Approval of Minutes January 28, 1986 MOTION by Rogers, seconded by January 28, 1986 as written. (Pirkl, Vistad) vote. Jovanovich to approve the minutes of Motion carried on a 4 yes, 2 present Tony Emmerich Lot Split (Comm. #1-86-2) ,.-\ "J Because Mr. Emmerich is only moving lot lines and not creating any new lots, the Commission felt that a lot split is not required. It was noted that the lots either meet or exceed the requirements for the zoning district as far as width, depth and square footage. MOTION by Rogers, Zoning Commission is not necessary. seconded by Vistad that the Andover Planning and feels that a lot split as requested by Tony Emmerich Motion carried unanimously. Shore land Management Ordinance Amendment/Public Hearing (Comm. #1-86-3) Chairman Jacobson stated that there are two changes being made in the ordinance in order to comply with the Department of Natural Resources' requirements. One is to change the shoreland district to 1000 feet rather than 300 feet and the other is to change all of the lakes in the city to Recreational Development Lakes. Chairman Jacobson opened the public hearing and noted for the record that no one was present. MOTION by Rogers, seconded by Apel to close the public hearing. Motion carried unanimously. (j Commissioner Pirkl asked if this is mandated by the State. Mr. Jacobson noted that the 1000 feet is but not the classification of the lakes. He also noted that the City Council said that everything should be recreational, not general development. However, Crooked Lake should be left as a General Development lake as all of the lots are built on and the only time it would change would be if a house burned down. ~ ~ Regular Planning Commission Meeting February 11, 1986 - Minutes Page 2 (Shoreland Management Ord., Cont.) MOTION by Apel, seconded by Rogers that the Andover Planning and Zoning Commission recommend to the City Council adoption of Ordinance 71A with the following changes: That the General Development lake section include only Crooked Lake and that Recreational Development would include the rest of the lakes. The reason that Crooked Lake should be General Development is that it is basically fully developed. By having the other lakes designated Recreational Development we would have an opportunity to develop them to some extent. The 1000 feet is specifically because it was mandated by State legislation. Motion carried unanimously. Helicopters/Heliports (Comm. #1-86-4) Chairman Jacobson explained that the Council wants to know if something should be done to regulate helicopters in the city. Commissioner Apel agreed that something should be done but maybe not at this time. Commissioner Jovanovich asked about hot air balloons and ultra-lites. Commissioner Vistad felt that there should be an ordinance because of the noise and the fact that the person with the helicopter lives in a high density residential area. Commissioner Rogers felt that we should set a date and have staff do some more research on this and in about 90 days or so have it on the agenda. It was suggested that the following memo be sent to the Council: 'We believe we should be looking at an ordinance or some way of regu- lating helicopters. We will begin to work on it, but it will take some time. Late summer or early fall we will ahve something to present. The Zoning Administrator is requested to research this to see if there are any cities that have an ordinance and get that information to the Commission. This item will then be on the Planning Commission agenda the first meeting in June.' Corner Lots (Comm. #1-86-5) Chairman Jacobson stated that it would be his suggestion to Bosell draft the ordinance so we can hold a public hearing. be on the agenda for a public hearing on March 11, 1986. have d'Arcy This will Retail Sales/Round Barn (Comm. #1-86-6) Chairman Jacobson noted that this business lS ln a residential area and according to the ordinance, retail sales of this type are not allowed in a residential area. Commissioner Pirkl asked where there is property that is zoned for this use. Commissioner Apel stated that the property to the west of this and the property across Bunker Lake Boulevard are zoned for this use. Mr. Jacobson felt that once we allow a use like this we are going to have a hard time denying others. If this goes through as a Special Use Permit, M.R. Olson could come in to apply for a Special Use Permit for his used car lot. He noted that we do allow some home businesses such as beauty shops, photo studios, etc. by Special Use Permit. The following memo will be sent to the Council: 'We have considered the matter and it's the unanimous feeling of the Planning Commission that the best way of dealing with the Round Barn is to require a re- zoning of the property. We are not saying it would be approved, but we should have the owners make the request. We considered the Special Use Permit in extreme cases but felt that it would be fraught with difficulties and problems.' This will go to the City Council on March 4, 1986. Ordinance 8 Amendment Discussion (Comm. #1-86-7) Chairman Jacobson explained that a developer brought in a plat that met the 2~ acre requirements; the Council looked at it and said that because it's on Hanson Boulevard and sewer might be available to that area in several years, something different should be done. The main reason for wanting something other than 2~ acre lots is because in Coon Rapids, they brought sewer into an area where there are large lots and they were assessed $50,000 to $60,000. They suggested that perhaps the developer could build on smaller lots in the corner of the property and leave a lot of green space around them. He also noted that Council wnats to create a new zoning district that would allow for a cluster development. In order to create a new district we have to make a change to the ordinance. The Council has given us a map showing where the district should be. Chuck Cook, the developer of the property in question, stated that there are other cities that are using this concept. He also noted that d'Arcy Bosel1 suggested that he do his development under a PUD. Mr. Jacobson felt that a PUD might not work, but density zoning might. Density zoning would allow smaller lots but he would not get any more lots than with a 2~ acre subdivision. Mr. Jacobson stated under density zoning you can cluster the houses but all of the land you're not using must be put into public, semi- public or green space. Mr. Apel asked if we could vary from that requirement. Mr. Jacobson stated that it might be better to come in under a PUD and vary from the two or more uses or structures requirement. He said that at the next Council meeting he will tell them that a PUD would be best because we can't get an ordinance done soon enough. In the meantime the Planning Commission can gather the data for cluster developments and get an ordinance together. Mr. Cook asked how many lots would be allowed. no more than 25 would be allowed. Conference MOTION by Apel, seconded by Jovanovich that we authorize anyone on the Commission to attend a conference regarding planning and zoning to be held on February 21, 1986 and one to be held on March 13, 1986.
