FEBRUARY 25, 1986 - MINUTES
The regularly scheduled Andover Planning and Zoning Commission meeting
was called to order by Chairman Don Jacobson at 7:30 P.M., Tuesday,
February 25, 1986 at the Andover City Hall, 1685 Crosstown Boulevard
NW., Andover, MN.

MOTION by Pirkl, seconded by Rogers to approve the minutes of February
11, 1986 as amended. Motion carried.
HIDDEN CREEK PRELIMINARY PLAT PUBLIC HEARING (COMM. #10-85-3)
John Peterson, Good Value Homes - stated that several years ago they
purchased 188 acres south of Bunker Lake Boulevard and have not been
able to develop it because there was no sewer or water service available.
Now the city plans to bring sewer and water into the area this summer.
The property is now able to be developed to an R-4 density, which is
single family residential. Mr. Peterson noted that this parcel is more
intensely planned than any parcel they have ever developed. They have
received direction from the Park Board, City Council, Planning and Zoning,
Anoka County Highway Department, Department of Natural Resources, TKDA,
the Corps of Engineers, traffic analysts from TKDA, the City of Coon
Rapids and the Watershed Board. One of the primary issues was the
proposed relocation of Crooked Lake Bou~avard. The way it is drawn
on the plat is satisfactory with the County if the City can get the permits.
There is a property owner whose home is in the way and Good Value is look-
ing at acquiring the property. Mr. Peterson also noted that the parcel
that they have chosen for park property is open with no low land. They
worked hard to get lots around the ponds, and lots that back up to the
creek so that the people can take a canoe out of their garage and go
right down the creek. Good Value has met with Jim Johnson from TKDA and
Jim Schrantz and there seems to be some problem with the cul-de-sacs.
136th Lane was put in to eliminate the number of accesses onto the county
road. 135th Court is a cul-de-sac because it would have to go through
a pond if it was brought through. The first phase of the plat will be
the lots around the park.
Chairman Jacobson opened the public hearing at this time.

without a number on it is. Mr. Peterson explained that they will ask
that that property be rezoned to commercial. Mr. Bever felt that a
commercial piece of property in that area would lower the value of his
property.
Commissioner Rogers noted that the legend shows there are 177 lots in the
plat but he counted 178. He asked if the fire station is going to go in
the property shown as park.
Mr. Peterson stated that they are leaving it up to the city to decide
what they want to do with the park property.
Mr. Rogers asked if there will be berming or fencing along Bunker Lake
Boulevard. Mr. Peterson stated that it will be bermed. He also noted
that they have a disagreement with the Park Board. Good Value has
proposed to give the land, grade and seed it, add berms along Bunker and
put in posts and cables. The Park Board has given them some conditions
that they cannot live with.
Mr. Rogers asked if there will be a tot lot in the plat somewhere. Mr.
Peterson stated that when they plat the easterly two forty acre parcels
they will give land and perhaps there will be a tot lot there.
Commissioner Apel noted that his only concern would be getting approval
from the DNR to go through the wetland with the road.

DeWayne Olson, enqineer for Good Value - noted that they have had
favorable comments from the DNR and the Corps of Engineers. The permits
have been applied for.
Commissioner Pirkl noted that the idea of having the commercial area
next to residential bothers her. Mr. Schrantz noted that the commercial
area will need to provide a buffer from the residential area.
Mr. Peterson stated that their largest subdivision has an area zoned
commercial and they have put fencing around it to buffer it from the
residential area.
Mr. Jacobson noted that on the legend it should say that the property
will be served by municipal sewer and water. Also, the number of lots
should be counted to make sure the correct number are shown on the plat.
Lots 37 and 38 in Block 4 should be checked to make sure that the front
footage requirement is met. Lot 13, Block 4 doesn't look like it will
meet the frontage at the setback line. Hidden Creek Court should be
Hidden Creek Drive. Mr. Jacobson suggested taking Lots 1 and 2, Block 2
and making them into parking for the park; otherwise there will be a
lot of traffic at that intersection with the fire station and park in
the same area. The walkway between Lot 7, Block 2 and Lot 7, Block 3
should be widened to 20 feet. Xavis Court should be changed to Xavis
Street.
Regarding the ponds, Mr. Olson stated that the DNR wants them to keep the
water level where it is now. There will be easements for the city to
do maintenance on the ponds.

Chairman Jacobson also noted that the plat should indicate where Phase
I will be. A letter from the county highway department should be pro-
vided stating that they have no problem with the accesses onto the county
roads. He also stated that originally 135th Court was a through street
and asked if making it a through street again would cause the loss of
any lots. Mr. Peterson stated that there was a problem making that
corner work with the wetlands and providing enough high land.
Mr. Jacobson stated that Lot 48, Block 4 should be checked to make sure
it meets the frontage requirements. Also Lot 49 should be checked.
He also noted that the setbacks along county roads are different than
those for interior lots. That should be indicated on the legend. The
width of proposed Crosstown is 50 feet from centerline; he asked if that
is the right-of-way. Mr. Olson stated yes, the county agreed with that
as it gets greater to the north.
Mr. Jacobson explained that when they come in for the commercial piece
of property they should ask for a PUD.
Diane Nutt, 2410 Bunker Lake Boulevard - asked how eminent domain works.
Mr. Schrantz noted that if the developer cannot obtain the property for
the street, the city can have it taken by condemnation. However, it is
not the city's intention to do that.
Cecil Heidelberger, 15955 Nightingale Street N.W. - asked if the property
would all be platted within the next year. Mr. Peterson stated no.
Commissioner Vistad asked if the trees will be preserved when the streets
are put in. Mr. Peterson stated that they are making a substantial
effort to preserve all the trees that they can.
At this time, the Commission recessed so that the new Commissioners could
be sworn in by Mr. Schrantz.
Chairman Jacobson noted that the property owner south of the plat needs
to be shown.
Mr. Schrantz explained the different choices for the north/south collector
street noting that the way it is shown on the plat will eliminate a lot
of traffic going north on Crosstown from Bunker by the Speedy Market.
The Cities of Coon Rapids and Andover have discussed an east/west street
going to Hanson; perhaps it will be 133rd Avenue. If that happens, then
133rd Lane should be extended to go out to Verdin Street. He also noted
that Hidden Creek Drive is about 512 feet long and will require a variance
as it is a cul-de-sac and the maximum length of a cul-de-sac is only
500 feet. The Park Board will have to decide what they want to do with
the park.
Mr. Jacobson felt that 135th Court should be a through street rather than
a cul-de-sac. Commissioner Apel thought that the reason for it being a
cul-de-sac is because there is a chance that you could disrupt the water
flow in the ponding area.

Mr. Olson noted that the Corps of Engineers has been more restrictive
than the DNR as they control all wetlands; they would make it very

difficult to extend the street.
Leslie Bever asked if Good Value gets commercial zoning on the one
piece of property would he be able to have his property zoned commercial
also. Mr. Jacobson stated that he would have to apply for a rezoning
and go through the same process as Good Value.
MOTION by Rogers, seconded by Apel to close the public hearing. Motion
carried unanimously.
Chairman Jacobson noted that the areas needing fill need to be shaded on
the plat.
MOTION by Rogers, seconded by Apel that the Andover Planning and Zoning
Commission recommend to the City Council approval of the preliminary
plat of Hidden Creek being developed by Good Value Homes, legally
described as: 'The Northeast Quarter of the Southeast Quarter, except
the North 264 feet of the East 165 feet thereof; The Southeast Quarter
of the Southeast Quarter; Lot 12, Auditor's Subdivision No. 137; That
part of Lot 1, Auditor's Subdivision No. 137 that lies Easterly of the
following described line; Commencing at the Northwest corner of Lot 1,
said point being the Northwest corner of the Northwest Quarter of the
Southeast Quarter of Section 33, Township 32, Range 24; thence East
along the North line of said Lot 1 a distance of 690 feet to the actual
point of beginning of the line to be described; thence South at right
angles to said North line a distance of 290 feet; thence west at right
/ angles to last course a distance of 120 feet; thence South at right
angles to last course a distance of 275 feet; thence Southeasterly
deflecting 16 degrees 30 minutes to the left for a distance of 784 feet
and to the South line of said Lot 1 and there terminating; all above in
Section 33, Township 32, Range 24, Anoka County, Minnesota.', for the
following reasons: 1) It is in conformance with the Comprehensive
Plan; 2) the plat has been reviewed by the Andover Review Committee;
3) The Anoka County Highway Department has reviewed the plat; 4) We
have received the Park Board recommendation; 5) The plat meets City
ordinances with a variance for Hidden Creek Drive, which is a cul-de-sac
that exceeds the maximum 500 foot length. It should be noted that a
public hearing was held and there was no opposition. It should also
be noted that when Phase II is ready to be platted, the developer needs
to go before the Council.
Motion carried unanimously. This will go to the City Council on March
20,1986.
ORDINANCE 8 AMENDMENT, CONT. (COMM. #1-86-7)
Chairman Jacobson explained that the City Council suggested that we
have a new zoning district to deal with cluster zoning by PUD. This
area will be known as an R-l transition area. The semi public space
could be kept in the ownership of the landowner. The Council has
provided us with a map showing which area of the city will be zoned
R-l Transition Area.
