MAY 27, 1986 - MINUTES
The regularly scheduled Andover Planning and Zoning Commission meeting
was called to order by Chairman Don Jacobson at 7:34 P.M., Tuesday,
May 27, 1986 at the Andover City Hall, 1685 Crosstown Boulevard N.W.,
Andover, MN.

TERRY HANSON SPECIAL USE PERMIT, CONT. (COMM. #4-86-8)
Steve Erickson - stated that they changed the exit - it is now 71' from
the asphalt along Round Lake Boulevard. They considered flipping the
plan as suggested at the last meeting; however, if you're driving past
posts, it's easier to turn going left. The traffic flow is more
difficult with right hand turns.

At this time, Chairman Jacobson reopened the public hearing.
Commissioner Vistad stated that the setback adjacent to a residential
district should be 35 feet. The future building would not meet that
requirement. It was noted that this is under Ordinance 8, Section 4.14.
Mr. Erickson noted that in conversations with the city, no one ever
mentioned the 35' setback.
Commissioner Bosell stated that Section 6.02 does not deal with the
35 foot setback. It's in a different part of the ordinance that she was
not familiar with.
Commissioner Vis tad asked about the projected car count.
stated that the average car count in the summer is 6 cars
in the winter it should be 10-12 cars per hour.

Mr. Vistad asked what the noise factor is. Terry Hanson, Typhoon Car
Wash - stated that because it's a concrete structure, there should be
no problem with noise and that the noise level will meet OSHA require-
ments.
~__ Commissioner Rogers asked what will happen to the existing structure
,~ when the full service expansion is built. Mr. Erickson said that it
will stay there. There are people who only use self-service and people
who only use full-service. Theri plan for the expansion is either full

service or 4 more self-service bays. This will depend on the market.
Mr. Rogers asked how they will control the lighting going back to the
residential area. Mr. ERickson stated that there are numerous ways
to control the lighting. You can either shield the lamps or lower the
light fixtures. The lights will be on a timer and will shut off auto-
matically.
Mr. Rogers asked if a maintenance person will be there once a day or
weekly. Mr. Erickson noted that someone will be there daily to clean up,
dump the garbage and to close up.
Commissioner Jovanovich asked where the employee parking will be if
Phase II is done. Mr. Erickson stated that it will be on the west side of
the building.
Commissioner Bosell noted that pursuant to Ordinance 8, Section 4.21, if
the fence is not maintained, the city can have it removed. She also
noted that a screening plan, including landscaping, needs to be prepared.
Also, the lighting needs to be taken care of and that they will have
to be careful in regard to any type of nuisance being created.
Dick Martin, 3552 - 14lst Lane N.W. - asked if the lot is big enough for
this operation.
Chairman Jacobson stated that the use is allowed by ordinance but there will
need to be some variances for setbacks. Phase I will fit on the lot.
James Norman, 3503 - 140th Lane N.W. - asked what would happen if one
of the members of the Commission had a conflict of interest. Mr.
Jacobson stated that they would step down and sit in the audience.
Mr. Norman asked if anyone does have a conflict of interest in regard
to this item.
Mr. Jacobson didn't feel anyone did.
Mr. Norman presented a petition with over 100 signatures opposing the
car wash. The reasons for the opposition were that it will cause an
extreme traffic problem; cause serious traffic accidents; 140th Lane
would be unable to handle the volume of cars; there will be congestion
because of Bill's Superette; noise and pollution would be increased
dramatically; there are at least 6 school bus stops in close proximity
to the proposed car wash; the property values in the area would go down;
the proposed car wash would be an eyesore and a detriment. They felt
that an environmental impact statement should be prepared.
Mr. Jacobson read a letter from David Anderson, 14030 Silverod Street
N.W., noting his opposition to the car wash.
Ed Scott, 14042 Rose Street N.W. - stated that he has lived there since
the project was started. The kids in the neighborhood are two and
three years old and they are always going to the park. He stated that
they have to walk on the road because there are no sidewalks. The way

the city operates, you're not going to make the car wash take care
of their fence. Bill's already trashes up the neighborhood with paper.
He also stated that he is tired of calling the city to mow the park,
plow the roads and fix the roads.
Chairman Jacobson asked how much it will cost to wash a car. Mr.
Erickson stated that the average car uses 2 cycles which would cost
$2.50.
Mr. Vistad asked what the car count will be when the full service part is
built. Terry Hanson - stated that he could not give a figure on that
The expansion is at least two years away. He also said that the full
service area will have six to eight employees.
Larry Banhorn, 14058 Silverod Street N.W. - stated that he worked for a
car wash for two years and on a slow day they had 375 cars per day and
on busy days that number could double. He asked if the water will be
recycled in the full service wash.
Mr. Erickson stated that it will depend on the cost of the water and
how the city feels about using recycled water.
Mr. Banhorn stated that 70% of the car washes recycle their water.
Mr. Hanson noted that he only knows of one in Minneapolis that recycles
their water. He didn't feel that they would be doing this.
Tim Casey, 3517 - 140th Lane N.W. - felt that the peak period for the
car wash would be in the evenings and Saturday mornings. He asked what
they will do when the water does onto the street and freezes.
Ed Scott - stated that kids are always goofing around that area with
their cars. He also noted that he moved to Andover because it's quiet
and that with a car wash, it will be noisy.
Mr. Schrantz asked Mr. Hanson what the peak hours are for a car wash.
Mr. Hanson stated that Saturday afternoons are the busiest. Mr. Schrantz
then asked how many cars they can process in one hour. Mr. Erickson
stated that the maximum would be 60 cars per hour. Mr. Schrantz express-
ed concern with people exiting onto Round Lake Boulevard.
Sally Norman, 3503 - 140th Lane N.W. - asked what will happen when the
road gets icy.
Mel Kitzberqer, 3548 - 141st Lane N.W. - concerned with a car going
through the fence when the road is icy.
Tim Casey - questioned the environment, the air quality and the noise.
Mr. Jacobson explained that we do have a noise ordinance and a nuisance
ordinance.
Dick Martin - again expressed concern with the school buses letting
the kids off on the street.

MOTION by Pirkl, seconded by Vistad that the Andover Planning and
Zoning Commission recommend to the City Council denial of the Special
Use Permit requested by Terry Hanson for a car wash on Lot I, Block
I, Andover Community Shopping Center for the following reasons: I) the
proposed use will be detrimental to the health, safety and general
welfare of the communtiy; 2) it will cause serious traffic congestion;
3) It will seriously depreciate surrounding property values; 4) it is
not in harmony with the Zoning Ordinance; 5) a public hearing was held
and there was opposition; 6) the proposed use is not the best use of
the land.
Discussion: Commissioner Rogers asked if the county could do a traffic
study on 140th and Round Lake Boulevard. Mr. Schrantz noted that the
count is 8400/day on Round Lake Boulevard and 500/day on l40th. Mr.
Jacobson questioned the statement in the motion that it is not in harmony
with the zoning ordinance. Ms. Pirkl stated that she put that in the
motion because of the 35 foot setback from a residential area.
Vote on motion: Yes - Pirkl; No - Bosell, Jovanovich, Pirkl, Rogers,
Vistad. Motion fails.
MOTION by Vistad, seconded by Rogers that the Andover Planning and
Zoning Commission recommend to the City Council disapproval of the
Special Use Permit requested by Terry Hanson for a car wash on Lot
I, Block 1, Andover Community Shopping Center for the following reasons:
I) the proposed use will be detrimental to the health, safety, and
general welfare of the community; 2) it will cause serious traffic
J congestion; 3) a public hearing was held and there was opposition.
Vote on Motion: Yes - Rogers, Vistad, Jovanovich, Pirkl; No - Bosell,
Jacobson. Motion carried. This will go to the City Council on June
17, 1986.
WOODLAND TERRACE 5TH ADDITION PRELIMINARY PLAT PUBLIC HEARING (Comm. #
5-86-1)
Chairman Jacobson noted that on the legend it should say the present
zoning is R-4, not proposed. The setback line should be measured at
40'; on the plat it is shown as 35 feet. Council did not have a problem
with that setback. He asked if they plan to construct 133rd Avenue and
blacktop it. Byron Westlund, Woodland Development stated yes.
Commissioner Bosell asked about the park dedication. Mr. Westlund stated
that the Park Board has agreed to accept cash in lieu of land.
Chairman Jacobson opened the public hearing.
MOTION by Rogers, seconded by Jovanovich to close the public hearing.
Motion carried.
MOTION by Rogers, seconded by Jovanovich that the Andover Planning and
Zoning Commission recommend to the City council approval of the pre-
liminary plat of Woodland Terrace 5th Addition, legally described as
the East 355.00 feet, as measured parallel with the south line of Lot
I, Block I, Weise's Second Addition according to the plat thereof on

file and of record in the office of the County Recorder, Anoka County,
Minnesota, for the following reasons: I) it is in conformance with
the Comprehensive Plan; 2) The City Engineer has reviewed the plat; 3)
The Park Board has agreed to accept cash in lieu of land; 4) the plat
meets the ordinances with the following exceptions: a) a variance will
be granted for a 40' setback at the property line rather than the
required 35'.
Approval of the plat is contingent upon the following: a) 133rd Avenue
shall be constructed to city standards; b) all of the lots will front
on interior streets (Silverod Court).
It should be noted that a public hearing was held and there was no
opposition.
Motion carried unanimously. This will go to the City Council on June
17, 1986.
ASSEMBLIES OF GOD CHURCH VARIANCE (COMM. #5-86-2)
Chairman Jacobson noted that they are requesting an identification sign
which will be "V" shaped. The variance is because the sign is 32 square
feet (Ordinance 8 allows 24 square feet) and because the sign will be
12 feet high (Ordinance 8 allows 10 feet).
There was discussion on whether a variance is required for the height as t
the sign section of the ordinance says 'not over 10 feet above grade
except as otherwise provided herein'. It was felt that perhaps that
applied to the 45 foot limit.
Pastor Hale asked for a decision on that part of the ordinance.
MOTION by Jovanovich, seconded by Rogers that the Andover Planning and
Zoning Commission recommend to the City Council approval of a variance
requested by the Anoka Assemblies of God Church at 3210 Bunker Lake
Boulevard to construct a 32 square foot sign that will be 12 feet high.
The Commission found that there was some disagreement as to whether
34 feet in height for a sign was permitted or if it is limited to 10 feet.
If 45 feet is allowed, no variance will be required; however, if 10'
is the limit, the Commission will approve a variance for two feet. The
City Attorney is requested to research this item.
Approval is recommended for the following reasons: I) The location
of the sign is set back a distance from Bunker Lake Boulevard because
of the service road which is a hardship due to the land.
The variance will be for the sign shown as Sign "A" on the material
provided by the church.
Motion carried unanimously. This will go to the City Council on June
17, 1986.

Commissioner Bosell noted that Grace Lutheran Church has not obtained a
permit for their sign.
MOTION by Bosell, seconded by vistad to request the City Attorney to
send a letter to Grace Lutheran Church in regard to a sign permit.
Motion carried unanimously.
ORDINANCE 8, SECTION 7.03 PUBLIC HEARING (COMM. #5-86-3)
Chairman Jacobson opened the public hearing and noted that there was
no one in the audience for this item.
MOTION by Rogers, seconded by Pirkl to close the public hearing. Motion
carried.
Commissioner Bosell asked how a site becomes placed on the historical
register. Mr. Jacobson stated that the Historical Society comes out
to look at it and they research it.
Commissioner Bosell suggested taking R-4 out of the ordinance amendment
as she felt that this should be allowed in R-I, R-2 and R-3 districts
also.
MOTION by Rogers, seconded by Pirkl that the Andover Planning and
Zoning Commission recommend to the City Council adoption of an amendment
to Ordinance 8 as presented with the following being added: 'Documenta-
tion showing the structure has been so designated shall be provided at
the time of the Special Use Permit Application.'
Motion carried on a 5 yes, I no (Bosell) vote. This will go to the City
Council on June 17, 1986.
ORDINANCE 8, SECTION 8.07, CONT (COMM. #3-86-5)
This item will be continued to the next agenda.
Chairman Jacobson suggested that we initiate a rezoning of the Conroy
property back to R-4 from Neighborhood Business. The Commission agreed.
This will be disucssed at a public hearing on June 10, 1986.
MOTION by Rogers, seconded by Pirkl to close the public hearing. Motion
carried unanimously.
