REGULAR PLANNING AND ZONING COMMISSION MEETING-MINUTES
JUNE 9, 1987
The regularly scheduled Andover Planning and Zoning Commission meeting
was called to order by Chairman Maynard Apel at 7:30 P.M., Tuesday,
June 9, 1987 at the Andover City Hall, 1685 Crosstown Boulevard N.W.,
Andover, MN.

Page 2, last paragraph, the following should be added: "A major issue
is the size of the lot is not going to change if it stays as is or
becomes two single family units."
MOTION by Vistad, seconded by Jovanovich to approve the minutes of
May 26, 1987 as amended.

Loretta Mason Special Use Permit, Cont.
Loretta Mason stated that she called the building inspector and he
said that they would have to put a double wall in the garage. The
people who are buying the property have said that they will do the work
themselves.
Commissioner Bosell explained that at this time we do not have a vehicle
with which to deal with this request. An amendment to the ordinance
was adopted to allow for multiple conversions and then it was inadvertent-
ly deleted. Ordinance 8N, adopted in 1981, was the vehicle by which we
could convert a twin unit to single family units. The City Attorney
has suggested that the Planning Commission deal with Ms. Mason's
request and send it to the City Council but have them hold off on making
a decision until the ordinance can be amended to put in what was taken
out.
Commissioner Vistad suggested to Ms. Mason that she have the survey done
on the property as soon as possible as she will need it for financing.
MOTION by Vistad, seconded by Jovanovich to close the public hearing.
Motion carried unanimously.

MOTION by Vis tad that the Andover Planning and Zoning Commission
recommend to the City Council approval of the Special Use Permit
requested by Loretta Mason to split the double bungalow located at 3555-
134th Avenue N.W. into two single family units for the following reasons:

1) It will not be detrimental to the health, safety or general welfare
of the community; 2) It will not seriously depreciate surrounding
property values.
A public hearing was held and there was no opposition.
The request to have the double split into two single family units with
a zero lot line is subject to a common party wall; the UBC requirement
of a one hour fire rating for the party wall if required by the Building
Official; there will be no openings in the party wall; the owner of
the property shall be required to file covenants with the County Register
of Deeds and provide proof of such to the city.
Motion dies for lack of a second.
Discussion: Commissioner Bosell felt that Ms. Mason only needs to
comply with the requirements set forth by the Building Official.
Chairman Apel noted that the party wall agreement is acceptable and the
fire wall will have to be acceptable to the building official.

MOTION by Vistad, seconded by Jovanovich that the Andover Planning and
Zoning Commission recommend to the City Council approval of the Special
Use permit requested by Loretta Mason to split the double bungalow
located at 3555 - 134th Avenue N.W. into two single family units for
the following reason: 1) A hardship is created by the property and
there is no way to enlarge the parcel as it is bordered on two sides by
streets and two sides by lots that belong to someone else.

Approval is subject to the following: 1) A party wall agreement shall
be provided to the City; 2) Construction of a fire wall and approval of
said wall by the Building Official; 3) A survey establishing a zero lot
line.
The following variances will be granted: 1) Lot depth - the existing
lot is 100 feet deep and the ordinance requires 130 feet; 2) Lot width -
the width is 150 feet and when split the lots will be 75 feet wide.
The ordinance requires 80 feet.
Motion carried unanimously. This will go to the City Council on July
21, 1987.
T.P. James Company Variances
Kick Kvanbec, T.P. James Company - explained that he was before the
Planning Commission approximately six weeks ago regarding the addition
to the Speedy Market and there are four items that need clarification:
1) on the original plan a 10 foot variance was required for the green
area. That was denied by the Council. In lieu of that variance, they
'\ had requested that the parking stalls be 9x18' rather than 10'x20'.
,) This was not dealt with at the Council meeting; therefore, a variance
is required; 2) The width of the two driveways is proposed to be 35
feet and the permitted width is 30 feet. This will require a variance;

3) A 10 foot variance is required at the corner of the gas pumping
facility to encroach on the green space. This would allow a pass
through lane for traffic; 4) The canopy over the gas islands encroaches
on the front yard setback by 14 feet.
The Commission didn't see any problem with the variances for the canopy,
the size of the parking stalls or the driveway width. Regarding the
encroachment on the~green space, the Commission requested that a drawing
be provided showing exactly how much space would be involved in the
encroachment.
MOTION by Vistad, seconded by Jovanovich that the Andover Planning
and Zoning Commission recommend to the City Council approval of the
request of the T.F. James Company for variances as follows on the
property at 13725 Crosstown Boulevard N.W. (Speedy Market): 1) A
variance for the width of the driveways on Bunker Lake Boulevard and
Crosstown Boulevard pursuant to Ordinance 8, Section 8.08 (D)(l). The
size will be increased from 30 feet to 35 feet; 2) A variance for the
parking stalls from 10'x20' to 9'x18' pursuant to Ordinance 8, Section
8.08 (C)(3); 3) A variance for the canopy over the gas pumps encroaching
into the front yard setback by 14 feet pursuant to Ordinance 8, Section
6.02; 4) A variance on the entrance from Crosstown of an encroachment
of asphalt in the 20 foot green area of 10 feet on the southwest corner
of the entrance pursuant to Ordinance 8, Section 8.04).

Reasons for approval are as follows: 1) The variances will not
adversely affect the existing or potential use of adjacent land; 2) The
variances are necessary to the reasonable use of the land; 3) The
variance for the encroachment on the green area will increase safety
in that area.
Motion carried unanimously. This will go to the City Council on July
16, 1987.
Biq Wheel Auto Landscape Plan
Todd Haas, Assistant City Engineer - noted that the applicant on this
is the Andover Review Committee. The request is to allow landscaping
in lieu of fencing as required by ordinance for the Big Wheel Auto
store. The Planning Commission needs to approve this request; it does
not require action by the City Council.
MOTION by Bosell, seconded by Jovanovich that the Andover Planning and
Zoning Commission recommend to the Andover Review Committee that the
proposal as submitted in the document dated June 9, 1987 in regard to
the Big Wheel Auto store has been reviewed by the Planning and Zoning
Commission. The Planning Commission finds that landscaping in lieu of
fencing is acceptable and agrees with the planting schedule that has
been proposed.

Rezoninq of Commercial Park/Discussion, Cont.
The Commission discussed uses that they felt should be included in
the zoning district that will be used for the Commercial Park. The
district should be something that is heavier than a Neighborhood
Business district, with restaurants, recreation centers, limited
manufacturing, etc.
Chairman Apel will prepare a list of possible uses for the next
meeting.
MOTION by Bosell, seconded by Jovanovich to adjourn. Motion carried.
