CITY of ANDOVER SPECIAL PLANNING & ZONING COMMISSION MEETING August 18, 1987 - Minutes The special Andover Planning & zoning Commission meeting was called to order by Chairman Marjorie Perry at 6:00 pm, Tuesday, August 18, 1987, at the Andover City Hall, 1685 NW Crosstown Boulevard, Andover, MN. Commissioners Present: Commissioners Absent: Also Present: Bosell, Jacobson, Vistad Jovanovich Todd Haas, Assistant Engineer: Daryl Morey, Planner The meeting minutes of August 4, 1987 were reviewed. MOTION: (JACOBSON/BOSELL) To approve the minutes as written. Motion carried. (Perry and Vistad voted present.) Rezoning of the Andover Commercial Park: Daryl Morey, the City Planner, advised the commission that since the last meeting he has listened to the comments of those at that meeting plus other input and has revised a list of uses to be allowed in the commercial park area. c) Also for informational purposes he has prepared an expanded list combining the existing GB and LI Districts and came up with a whole new commercial park district. The existing General Business District list of uses was discussed and changes were made to this list based on the comments from the last meeting. Also I have changed some special uses into permitted uses. Commissioner Vistad asked what had been eliminated from the present GB District? Daryl Morey responded that automobile sales had been split into two categories: new vehicle sales and used vehicle sales. It would be a permitted use for new vehicle sales but a special use for used vehicle sales so as to allow the City more control on the used vehicle sales. There were some other items added or clarification made to already existing uses. Chairman Perry asked about the commercial park district name and adopting some criteria as opposed to being zoned GB or LI. The district provisions would still have to be drafted. Commissioner Vistad felt that we should not be adding another zone but instead clean up the zones we already have. The commercial park district has so many duplications in it. /-- -'\ \...-J u u Page Two Planning Commission Meeting August 18, 1987 \ / Commissioner Bosell pointed out that it appears that the City Council is looking to have the area zoned all the same - one district. Commissioner Jacobson asked if the use "retail sales of goods and services" wasn't too general. Commissioner Bosell pointed out that we could amend our definition of "retail shopping". Daryl pointed out that Blaine went so far as to list very specifically what was included in retail sales. Commissioner Jacobson was concerned about so many special uses, taking to heart some of the comments of M. R. Olson from our last meeting. He felt the list should be shorter. What is allowed should be pretty open as long as the exterior of the building is real specific and firm, as well as exterior storage being controlled. \ -) The discussion then centered around the liquor license and whether it should or should not be allowed. Commissioner Jacobson was concerned about the liquor license only, not in conjunction with a restaurant, etc. Commissioner Bosell pointed out that Ordinance No. 56 sets out very specifically where and what can be had in conjunction with a liquor license and the simple inclusion of liquor license is proper. Commissioner vistad asked if we were trying to exclude such businesses as the Skywood Inn in Fridley which basically almost didn't make it because of the liquor license issue. Most businesses desiring to have a meeting at a facility such as that wants to have liquor available. Commissioner Jacobson was more concerned about just a bar, not the liquor store type establishment or restaurant. Chairman Perry thought it should be decided whether the district is going to be one zone or two zones before we discuss this issue further and what should go into the district. She thought the uses should be a little heavier that those on the commercial park list because we are not going to be able to attract some of the businesses we would like to just because of where and who we are. We also don't have a major thoroughfare serving the City. Commissioner Vistad felt that the restaurant demand is going to be there because of the development in the area. A poll of the commission was had as to whether the district should be zoned one zone or two. The results were four in favor of one zone, none in favor of two zones. Next the commercial park district permitted and special uses handout was discussed as to what should be included, etc. One concern had to do with used vehicle sales. After much discussion a poll of the commission was had and the vote was four in favor \ i / u u Page Three Planning Commission Meeting August 18, 1987 \ ) of requiring a special use permit for used vehicle sales, none in favor of the use being a permitted use. Also, "agencies selling or displaying recreational vehicles, boats and marine equipment" should be moved up to permitted uses and the remainder of that use be eliminated. Assembly operations was then discussed. Daryl felt it could possibly fall under the limited manufacturing definition and would include a low production type of operation and assembly as opposed to pulling parts together for assembly. , ) The discussion was continued to later in the meeting so that the Andover Commercial Park Sketch Plan could be discussed prior to the departure of Commissioner Jacobson. Concern was expressed about the number of outlots that are being brought in with the plats. More particularly Outlot C on this plat. The question was asked as to what this parcel would be used for. Todd Haas advised that it would probably become part of a drainage pond which abuts this parcel and is located in Hidden Creek. The discussion then centered around whether Outlot C should be combined with Lot 3 and set aside as dedicated easement for drainage and utility purposes rather than a separate lot. Concern was also expressed as to the liability inherent in the City owning the outlot and pond. Outlot C has no possible use to it as platted. Also, the number of front feet along the street was of concern to the commission, especially as it would pertain to assessments. The commission also felt that some of the lots should be larger to allow for uses that require more space rather than having to buy two or three lots, combining them and then developing them. The question was also asked as to whether or not the lots would be sold or leased. Daryl felt that it City would be selling the lots - he is presenting the TIF policy to the Council tonight. Commissioner Jacobson left the meeting at this point (7:40 pm). Simplified Platting Process: Commissioner Perry spoke with Commissioner Jacobson prior to his departure and wanted to carry to the commission his comments. He felt that there were no items on the preliminary plat checklist which could be eliminated to change the procedure for small development platting and/or commercial lots. Both Chairman Perry and Commissioner Vistad agreed with Commissioner Jacobson's observation. At this time, Chairman perry left to appear before the City Council, however, the special meeting continued. Commissioner Vistad spoke with a Ms. Turner from Coon Rapids in regard to a simplified platting process and she said they did not \ : o u Page Four Planning Commission Meeting August 18, 1987 .) change their requirements but simply agreed on certain items that would not be required. Nothing is written down, however. Daryl Morey felt that some thing could perhaps be eliminated over a period of time. For example, the list of property owners within 350 feet. perhaps the city, once we have property profiles on the computer, could provide that list instead of each applicant having to provide that list. Commissioner Bosell pointed out that one of the reasons the City does not provide that service is to protect itself from the possibility of not including someone that should be included. The burden should be on the applicant. Commissioner Bosell presented the suggestion that on small plats, perhaps the requirement of going all the way through the preliminary plat procedure, then the final plat procedure could be shortened into one step, if it met specific criteria. Commissioner vistad suggested that if the proposed plat did not create any new roads (it was felt that road alignment has become a major concern and the reason for many changes) that this small plat could be handled in a one step process. The other item discussed was the number of lots, however, it was felt that any number picked would be arbitrary. To adapt this change would require amending Ordinance No. 10, Section 7.02, (g, h and i). .~ Commercial Lot S~lit: It was generally felt that instead of a lot split, the dlvision of a commercial piece of property be handled by the simplified platting process described above; i.e., they would be creating no new streets and said plat would meet all the provisions of Ordinance No. 8 and 10 as it applies to lot sizes, uses, etc. One reason for recommending this process rather than a variance to the platting ordinance is the notification requirement that goes along with a plat and a lot split. The commission felt that this notice process was important to allow the adjacent property owners an opportunity to know what is proposed and express concerns if there are any. Rezoning of Andover Commercial Park continued ... The discussion again centered around specific uses contained on the proposed district prepared by Planner Daryl Morey. The question was raised as to why the item "antennaes in excess of 35' in height" was there and perhaps should be changed to "any structures in excess of 45' in height" since the building height requirement was 45'. It was felt that before this was amended since it is out of the original ordinance, some research should be done as to why it was included in the first place and what it really means. The consensus of the Commission was that it would stay where it was until the public hearing at which time it could be discussed further. \ ) \ I / \ , I ': , /- \ \.J U Page Five Planning Commission Meeting August 18, 1987 Daryl Morey pointed out that in a couple of areas as it pertains to the commercial park that the Ordinances are not clear. More specifically, in #8, Sec. 8.08, 3 as it pertains to curbing - the second half of the sentence is repeated and then never completed and it is unclear exactly what is meant by that section. He would like to see the City require curbing around the entire parking areas that will be included in the commercial park area. It was agreed that that section needs to be re-written so that it makes sense. Also the ability to place parking within 5' of the right-of-way line was of concern to him.
