REGULAR PLANNING AND ZONING COMMISSION MEETING - MINUTES
DECEMBER 8, 1987
The regularly scheduled Andover Planning and Zoning Commission meeting
was called to order by Acting Chairman Don Jacobson at 7:30 P.M., Tuesday,
December 8, 1987 at the Andover City Hall, 1685 Crosstown Boulevard N.W.,
Andover, MN.

Approval of Minutes - November 24, 1987
MOTION by Vistad, seconded by Bernard to approve the minutes of November
24, 1987 as written. Motion carried.
Brandon Construction Sketch Plan
Todd Haas - noted that the plat shows 4 lots on 144th Avenue. The City
Council, in their review, approved the layout of this sketch.
Commissioner Bosell explained that if they are going to go with the Andover
Review Committee sketch plan, Outlot A needs to be calculated. Lots 2 and
3 need to have 13,000 square feet. Also, the entire plat falls under the
jurisdiction of Ordinance 71, the Shore land Management Ordinance.
Acting Chairman Jacobson stated that Outlot A is only 40 feet wide.
suggested making it the full width for a street now so that if the
property is developed there will not be a problem in the future.

Commissioner Bosell suggested combining all of the outlots to make one.
Mr. Haas noted that the ordinance allows ,for future development by platting
a half street.
Mr. Tollefson, the developer, stated that the Council has asked for the
forty feet as right-of-way.
Mr. Haas stated that water is at the edge of Lot 4. He also noted that the
city is trying to get berming in all of the urban plats.
Commissioner Vistad noted that he doesn't want to see berming in this plat
as there is already a lot of traffic on Round Lake Boulevard and it will
be difficult for the people trying to get out onto Round Lake Boulevard
to see oncoming traffic.

Oak Bluff 2nd Addition Preliminary Plat. Cant.
Chuck Cook, developer - noted that the Council was concerned about a wet
pond and asked for a cross-section of the ponding. The slopes in the
ponding area have been modified. There will also be an emergency overflow
outlet. The normal drainage goes towards Hanson Boulevard via an under-
ground pipe.
Mr. Jacobson asked how much water will be in the pond at all times.
Mr. Cook stated that the pond will be six feet deep~ the water outlet is
at 886.
There was discussion on whether city personnel would be able to get to the
pond for maintenance as there is no easement to it. It was noted that
legal counsel has said that the city can go in if need be.
Commissioner Vistad noted that the building pad is at 890 and the proposed
overflow is 892. If you have a lot of water, you will have water seeping
into the ground and into the basements.
Mr. Haas noted that the developer is only required to build one emergency
outlet and he is providing two.

Mr. Cook stated that at 886 they have positive drainage. If we have
excess of a 100 year storm the water level might go up temporarily.

Mr. Jacobson noted that the Council requested that one of the drainage ease-
ments be vacated when the plat is done and he asked which one will be
vacated. Mr. Cook stated that they are going to vacate all of the drainage
easements on outlot B and create new ones.
Mr. Vistad noted that the statement regarding the side yard setback should
be corrected to state that a six foot setback is only allowed on the garage
side.
Commissioner Bosell noted that the drainage pipe between Lots 11, 12 and 13
needs to be extended. Mr. Cook explained that that will be designed by
TKDA.
Commissioner Bosell asked if a letter has been received from United Power.
Mr. Haas stated that it has and it tells the location of their easement,
what rights they have and also talks about berming. UPA would like to
review the berming along Hanson Boulevard.

Ms. Bosel1 noted that the property owner on the north end of the plat is
not identified. Also, the restrictive covenants need to be submitted to
the city. She asked if this plat is going to be done in phases.
Mr. Cook stated yes, for Phase I they will cut it off between Lots 6 and
7 on the west, come down the center of the plat and include Lot 12, Block
4 and the three lots on Bluebird and Crane.
Ms. Bosell also noted that Lot 22, Block 4 is a butt lot. The ordinance
requires two tiers of lots and Section 9.06 says butt lots are to be
avoided.
Mr. Jacobson stated that the typical lot should show the required setbacks
and should be labeled as a typical lot.
Mr. Haas suggested that the developer make the corrections and come back
to the Planning Commission on December 22nd as this won't go to the Council
until January 5th.

MOTION by Bosell, seconded by vistad that the Andover Planning and Zoning
Commission recommend to the City Council approval of the preliminary plat
of Oak Bluff 2nd Addition as proposed on the revised drawing dated
December 2, 1987. The plat ahs been reviewed by the Andover Review
Committeee and the plat is subject to the comments of that committee. It
should be ntoed that there are no variances required in regard to the
preliminary plat. The plat has been reviewed by the Anoka County Highway
Department and has received their approval.

The plat is subject to final development of the drainage pond as proposed
and designed by TKDA.
The plat has been reviewed by UPA and clarification as to what can occur
in their easement is noted in their letter dated December 7, 1987. The
plat is in compliance with their requirements.
The plat is not subject to additional park dedication fees as that require-
ment was satisfied in the development of Oak Bluff.
The plat is subject to the following housekeeping items being done: 1) the
property owner immediately north of the plat in the section noted as R-4
needs to be identified; 2) on the legend the side yard setback needs to be
corrected to reflect the language of Ordinance 8, Amendment NN and the
addition of typical lot should be made along with setbacks being added to
the typical lot.
It should be noted that a public hearing was held. At the original hearing
concern was on the size of the lots. The developer has increased the
original sizes. It was also noted that there was no public at this meeting.

Street lighting will be provided by the developer as required.
The Planning Commission looked at three possible butt lots and didn't find
they are a detriment pursuant to Ordinance 10, Section 9.06(d).
The applicant was advised to petition for city sewer and water.
Motion carried unanimously. This will go to the City Council on January
5, 1987. (It will be reviewed by the Planning Commission at their December
22nd meeting.)
Fencinq Desiqn Standard
Daryl Morey, City Planner - stated that other cities do not say what kind
of fence a person has to build: however, Maple Grove specifically states that
it has to be of masonry, brick or wood construction. Mr. Morey noted that
he incorporated that wording into a proposed amendment to the ordinance.
He also added a section for dumpster enclosure or screening.
Discussion was on whether a person could have trees and shrubs in lieu of
a fence.
Commissioner Bosell stated that if you are not going to have exterior
storage, a fence is not required.

Mr. Morey should look at the ordinance to eliminate the problem of a six
foot fence needing to be 10 feet from the property line.
Ms. Bosell suggested putting the language under Refuse Container Screening
in Ordinance 8.
MOTION by Vistad, seconded by Bosell to adjourn. Motion carried.
