REGULAR PLANNING AND ZONING COMMISSION MEETING - MINUTES
DECEMBER 22, 1987
The Regularly Scheduled Andover Planning and Zoning Commission meeting was
called to order by Chairman Marge Perry at 7:30 p.M., Tuesday, December 22,
1987 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover,
Minnesota.

MOTION by Jacobson, seconded by Bosell to approve the minutes of December 8,
1987 as corrected. Motion carried on a 3 yes, 2 present (Pease, Perry) vote.

Todd Haas - noted that on the legend the side yard setback needs to say
10 feet. He stated that all of the other items mentioned at the last
meeting have been taken care of.
This will go to the City Council on January 5, 1988.
Ordinance 8 Amendment Public Hearinq
Chairman Perry opened the public hearing.
Daryl Morey - explained that Mr. Gearhart approached him about the
possibility of constructing a funeral home on the vacant lot that is
presently owned by Grace Lutheran Church. The property is currently zoned
R-4 which does not allow a funeral home. The proposal is to rezone the
lot to Neighborhood Business which would extend the current Neighborhood
Business district to the west. Looking at the intent of the Neighborhood
Business district zoning, to have this zone act as a buffer between
residential and a more intense district (Shopping Center) it would be more
compatible than some uses allowed in NB, such as a fast food restaurant.
Ordinance 8 amendment, the rezoning and lot split that are on tonight's
agenda are all inter-related. The amendment to Ordinance 8 proposes some
housekeeping type changes for Limited Business. In Neighborhood Business
a couple of uses have been added, such as mortuary and funeral homes, dental
clinics, financial institutions. Retail shopping was changed to retail
~ ~ stores emphasizing the sale of convenience goods and personal services.

Commissioner Jacobson asked why liquor license is listed under Neighborhood
Business as a Special Use. Mr. Morey indicated that was a mistake and

MOTION by Jacobson, seconded by Bosell that the Andover Planning and Zoning
Commission recommend to the City Council adoption of an amendment to
Ordinance 8 as presented with the following changes: under Permitted Uses
in Neighborhood Business, strike 'and personal services' from retail stores;
under special uses in Limited Business, strike the work 'private' from clubs
and lodges and strike 'two-family dwellings'; under special uses in Neigh-
borhood Business, strike 'liquor license'.
Discussion: Commissioner Bosel1 didn't feel we could strike 'and personal
services' from retail shopping because we recently changed the definition.
By taking out personal services we would be eliminating tail@r shops, barber
shops and beauty shops.
Mr. Morey suggested adding a definition for personal services.
Commissioner Vistad suggested adding exclusions from this as we would have
a very big list if we added businesses that could be included. Mr. Morey
felt that the exclusions could get rather lengthy also. He noted that other
cities have the following in their ordinance: 'and other similar uses as
determined compatible by the city or Planning Commission."

Mr. Jacobson suggested holding this over to the next meeting to allow Mr.
Morey time to develop a list of exclusions.
Commissioner Jacobson withdrew his motion; Commissioner Bosell withdrew her
second.
This item will be continued to the January 12th meeting.
Grace Lutheran Church Rezoning Public Hearing
Chairman Perry opened the public hearing.
Mr. Morey stated that what we plan to do with the rezoning is to make it a
continuation of the Neighborhood Business district to the west so we have
some continuity. The area proposed for rezoning meets the ordinance
provisions for an NB district.
Tom Gearhart, 890 River Lane, Anoka - stated that he owns a similar funeral
home in Coon Rapids and is involved in another one in Anoka. They are
proposing to purchase this land for the purpose of building another funeral
home. This will not happen within the next six or months however. Mr.
Gearhart stated that he would not want to purchase this property if it could
only have a funeral home on it in the event he would sell the property.

Commissioner Jacobson asked if a 1.2 acre site is big enough for parking
spaces and the building. Mr. Gearhart stated that the two other funeral
homes he has are on much smaller pieces of property. The one in Coon Rapids
is on less than one acre and has 33 parking spaces.

Mr. Morey noted that the church would be required to add another 22 parking
spaces or we can work with Mr. Gearhart for a proposal for a funeral home
and provide a parking lot arrangement between him and the church so the
extra parking stalls the church needs would be provided.
Mr. Gearhart stated that he will not enter into an agreement that he will
provide 22 parking stalls for the church because he is not sure what he is
going to do in the future.
Commissioner Bosell didn't feel that we could require Mr. Gearhart to
provide parking for the church.
Mr. Gearhart noted that in talking with the Pastor of the church, he said
that if they can use his parking lot on Sundays, Mr. Gearhart could use
the church's parking lot during the funerals.
Marnell Wilber, 3510 - 136th Lane N.W. - stated that they are opposed to
rezoning the property if it will be used for something like a Burger King.
She asked if the traffic from the funeral home would be allowed to go on
the residential streets in Chapman's Additions.
Mr. Morey stated that the traffic will not go through the residential area.
He noted that the frontage road would be extneded from the office building
to the east.
Todd Haas noted that there is a Council motion to bring a street from
Chapman's Addition up to Bunker Lake Boulevard so the people can get to the
shopping center without using the County roads.
Sharon Widmark, 3501 - 136th Avenue N.W. - stated that her concern is
a restaurant going on that parcel if Mr. Gearhart decides not to build a
funeral home.
Dale Strassberq, 3422 - 136th Lane N.W. - asked what would happen if there
was a funeral and a wedding at the same time. Also expressed concern about
what would go there if a funeral home is not built.
Mr. Gearhart stated that in his studies, he has determined that he would
probably only have about 20 funerals a year as Andover is a young community.
Commissioner Vistad felt that if the city is going to extend a street up
through Chapman's Addition, it would be a waste of time to rezone this
property. Mr. Haas stated that this issue can be brought up before the
Council.
Mr. Morey explained that Ordinance 8, Section 4.17 states that a number of
conditions must be met before a property is rezoned, including the submission
of a plot plan.
Ms. Bosell stated that the plot plan could be a conceptual layout; it would
/ not have to be an elaborate drawing.
MOTION by Vistad, seconded by Pease to close the public hearing.

Dale Gelling, 3432 - 136th Lane N.W. - stated that he has a problem with the
church limiting themselves with the sale of this property. He asked if the
church is near their limit as far as how much parking space they have. He
also felt that the city is adding too many things in the Neighborhood
Business district.
Commissioner Vistad withdrew his motion to close the public hearing;
Commissioner Pease withdrew her second.

what this may do. They might want to rethink it.

joint parking. She asked Mr. Gearhart if he would be willing to submit
drawings showing a proposed funeral home. Mr. Gearhart stated that he would
be willing to do that.
This item will be tabled to January 12, 1988.

This item will be continued to January 12th to coincide with the rezoning
request from the Church.
Cable Coverage of Meetings
Commissioner Jacobson noted that he asked the City Council if they would be
willing to have their meetings televised on cable and they agreed to try
it for six months. He suggested that the Planning Commission agree to do
the same.
MOTION by Jacobson, seconded by Vistad to televise the meetings for a period
of six months. Motion carried.
The Chairman declared the meeting adjourned.
