PLANNING AND ZONING COMMISSION
MEETING MINUTES
DECEMBER 13, 1988
The regularly scheduled Andover Planning and Zoning
Commission meeting was called to order by Chairman Marjorie Perry
at 7:30 p.m., Tuesday, December 13, 1988, in the Council Chambers
of Andover City Hall, 1685 Crosstown Boulevard N.W., Andover,
Hinnesota.
Commissioners present included Bev Jovanovich, d'Arcy
Bosell, Becky Pease, Don Jacobson, Chairman Marjorie Perry. Also
present was City Planner, Jay Blake.
APPROVAL OF MINUTES
The following corrections were made to the November 22, 1988
minutes:
On page two, there is a typographical error in the second to
the last paragraph for the word "property." Also, on page four,
the word cold should be corrected to read "could."
On page five, the fourth paragraph should be corrected to
read, "Hs. Bosell noted that the PCA accepted the recommendation
of the PCA staff. That gives the PCA Commissioner authority to
issue an order which allows the State to go on the site and
remove the tires."
A HOTION was made by Commissioner Pease, seconded by
Commissioner Jovanovich to approve the minutes of November 22,
1988 as amended. Hotion carried on a 4 yes, 1 present vote.
PUBLIC HEARING: NORTH SUBURBAN CHURCH OF CHRIST. SPECIAL USE
PERt-lIT
Chairman Perry stated that Jay Blake had advised her that
the North Suburban Church of Christ had withdrawn their request
for a special use permit because of neighborhood concerns and
also because of the cost of renovating that house into a public
building.

GOLF CART/MOTORIZED WHEELCHAIR ORDINANCE
Jay Blake noted to the Commission that he did make a number
of corrections to this ordinance -- he added the words on public
roadways to the title of the ordinance, he deleted the definition
of public lands, on page two he deleted some wording in regard to
the operation of the special vehicle not being allowed between
sunset and sunrise, and added a number 5 to the last paragraph on
page two in regard to vehicle make and model.
Commissioner Jacobson felt that on page 1, section 3, items
A and B should be combined. It was agreed to make this
correction to read, "No person shall operate a special vehicle
within the right-of-way of any trunk, county state aid or county
highway, or city street or public lands or property within the
City of Andover, except as allowed under Section 4 of this
Ordinance."
Mr. Jacobson asked if the definition of wheelchair (on the
1st page of the ordinance), with the wording "or similar device"
was pulled from the State Statute, and that those two words may
pose some future problems.
Ms. Bosell recommended that on page one, section 1B, should
be revised as follows: "Physically Handicapped - any person who
has sustained an amputation or material disability in any manner
rendering it both difficult and burdensome to walk, as defined by
M.S. 169.345." Also then page two, section 4C, item 5 should be
revised to read, "Operation limited to persons identified as
handicapped."
Mr. Jacobson also had a concern regarding the fact that
there was no wording indicating a minimum age to obtain a permit
of this type. Ms. Pease recommended that the age of the
applicant be included on the application form. Mr. Blake
indicated that Attorney Hawkins would be reviewing this document
to make sure it meets the legal requirements.
Commissioner Pease stated that a correction should be made
on page two, section 4B, last sentence to indicate that the
permanent record of all special operator's permits will be
maintained and annually reviewed by the City Clerk (not by the
Planning and Zoning Commission.)

Ms. Bosell suggested that on page 2, section C4, item 5,
should be corrected to read, "Applicant must provide physician's
verification of handicapped status and ability to safely operate
a special handicapped vehicle." Also an item 6 should be added
to read, "Applicant must provide the vehicle make and model."
Then, the old number six would become number seven now.
Mr. Jacobson also recommended to revise on page 2, section
4B, to delete the words daylight hours and insert instead the
words specified hours.
Also, on page 3, in the signature area, the name of the
mayor's name should be corrected.
A MOTION was made by Commissioner Jacobson, seconded by
Commissioner Bosell that the Andover Planning and Zoning
Commission recommends to the City Council adoption of the
ordinance adopting regulations for the operation of golf carts
and motorized wheelchairs by handicapped citizens on public
roadways within the City of Andover. The Planning and Zoning
Commission, after lengthy study, has determined that the above
mentioned ordinance is reasonable and proper for the
transportation of handicapped people within the City of Andover,
and would not have an adverse effect on traffic flows on any city
roadways. A public hearing is not required. The Commission
finds that the adoption of this ordinance while benefitting a few
people in the city, will provide access for the handicapped, an
option that might not be available without this ordinance and
recommend adoption by the City Council.
No discussion. All voted yes, motion carried unanimously.
This item will go to the City Council on January 3rd.
ORDINANCE 10 GENERAL AMENDMENTS
Jay Blake brought to the Commission's attention the memo
from Frank Stone enclosed in the meeting packet, indicating Mr.
Stone's concern regarding the cul-de-sac size. Mr. Stone
indicated in his memo that he would like to see this section stay
as written, as the larger cul-de-sac allow for easier snow-
plowing during the winter season. Also, there was a concern
raised by Mr. Sowada that some fire department equipment might
have a difficult time in smaller size cul-de-sacs.

Also Mr. Blake indicated that John Rodeberg suggested that
Andover try to preserve the 13-1/2 feet right of way for
utilities.
Ms. Perry asked Mr. Blake what other cities use as standard
size for cul-de-sacs.
Ms. Bosell stated that there seems to be a problem in that
developers are preparing plats and showing the right of way that
the city requires, but that the street plans are prepared by TKDA
(and inspected by the city engineers, and public works
department). The as-builts do not meet the city standards for
cul-de-sacs.
A MOTION was made by Commissioner Bosell, seconded by
Commissioner Jovanovich that the Andover Planning and Zoning
Commission recommends to the City Council enforcement of
Ordinance 10, Section 99.03G pertaining to cul-de-sac width and
that the engineering firms designing the street layouts adhere to
the 100-foot cul-de-sac as required in that Ordinance.
It was further recommended that this section be modified to
read, "as presented by the staff. as it pertains to measuring the
maximum length of the cul-de-sac." All voted yes, motion
carried.
This item will go to the City Council on January 3rd.
Mr. Blake also reviewed the minor city street and municipal
state aid street right-of-way minimum width.
A MOTION was made by Commissioner Jacobson, seconded by
Commissioner Pease that the Andover Planning and Zoning
Commission recommends to the City Council adoption in the change
of Ordinance 10, Section 9.03 in the Classification of Right of
Way of Minor City Streets to conform from 50 to 60 feet and Right
of Way Municipal State Aid Streets to conform to 66 feet. The
Commission finds that State Statute 8820.2500 subp.3 is greater
than what has been required by the city and this change would
make the city in compliance. All voted yes. Motion carried.
This item will go to the City Council on January 3, 1988.

A MOTION was made by Commissioner Bosell, seconded by
Commissioner Pease to table the remaining sections of this
ordinance (Metes and Bounds Description) until the next regularly
scheduled Planning meeting. All voted yes. Motion carried.

SCHEDULING OF NEXT PLANNING AND ZONING MEETING
Because there were no new agenda items at this time, it was
agreed to reschedule the next Planning and Zoning Meeting to
January 10th.
SIGN ORDINANCE. SECTION 3.02 DEFINITIONS
Chairman Perry stated that because the sign ordinance was a
large one, that the Commission would be reviewing this the
ordinance in sections. The definitions would be covered as the
first item of discussion.
Jay Blake suggested that the definition section of this
ordinance should be placed in the beginning of the ordinance.
The following corrections were made to the draft of this
ordinance:
Under Section 3.02 Definitions, first page, it was
recommended by Mr. Jacobson to delete the lot frontage paragraph
from the ordinance.
Also on the first page, it was suggested to delete the word
figure in the last sentence of the section titled Sign Area.
On the second page, it was recommended by Mr. Jacobson to
combine the Sign, Unsightly and Sign, Unsightly Painted
sections.
Also, it was recommended to delete on the top of page three,
the Sign, Ground sentence.
On the Sign, Illuminated paragraph on page three, it
suggested by Ms. Bosell that it be revised to read -- "Any sign
which has characters, letters, figures, designs or outlines
illuminated by electric lights."
It was also agreed to combine the Sign, Identification
paragraphs.
Under the Sign, Wall definition, the words exposed face or
should be changed to read exposed face of.

On the memo from Jay Blake, the following corrections should
be made:
Under Changeable Message sign, the wording should be revised
to read, "A sign which has a reader board where copy changes."
It was agreed to leave the free-standing sign, the portable
sign, the address sign, and the abandoned sign definitions in the
current ordinance.
It was suggested to change the Motion Sign paragraph to
read, "The definition is the same as Andover's Motion (instead of
Revolving) Sign."
It was also agreed to revise the Bench Sign definition as
follows: "A sign which is affixed or engraved to a bench at a
bus stop."
In addition, it was recommended to delete the institutional
sign definition from the ordinance.
A ~OTION was made by Ms. Bosell, seconded by Commissioner
Pease to continue this discussion on the Sign Ordinance at the
next regular Planning Meeting. All voted yes. Motion carried.
ADJOURNMENT
A MOTION was made by Commissioner Bosell, seconded by
Commissioner Jacobson to adjourn the Planning and Zoning
Commission meeting at 9:30 p.m.
