Adjournment o o ''\ '---./ (...)^~"" " ,...:. ,~ , CITY of ANDOVER SPECIAL PLANNING & ZONING COMMISSION MEETING 19 July 1988 The Special Meeting of the Andover Planning & Zoning Commission was called to order at 7:35 pm by Chairman Marge Perry, Tuesday, July 19, 1988, at the Andover City Hall, 1685 NW Crosstown Boulevard, Andover, MN. Commissioners Present: Vistad, Pease, Jovanovich, Bosell, Perry Commissioners Absent: Jacobson, Bernard Also Present: Daryl Morey, City Planner, Charlie Veiman Charlie Veiman spoke to the Planning Commission about the need for senior citizen housing within the City. Housing for senior citizens began with a program with the churches using the pastors as resources and had people sit in on meetings which gave some insight as to the needs. Marketing, architectural design, financing, building of the building, and management was discussed in an presentation by Dick Brustad. The churches involved in this first phase were st. Paul's Catholic Church, Glen Cary Lutheran Church, Our Saviour's Lutheran Church, and Friendship Baptist Church. Then the pastors and the cities of Oak Grove, East Bethel, Ham Lake and Andover determined who could represent both factions (church and city) in the group, called The Development. Now the job is to get as much information as we can from marketing, surveys, architects to study. Ham Lake has a $13,000 grant which can be used only for marketing, surveys, etc. but none of the money can go toward the building of a building The Andover City Council has been asked if they would contribute monies and they have said yes (approximately three months ago). We are going to meet once or twice a month so that we can generate more and more interest and information. It is going to be one to one and a half years before we have really gathered the facts and figures and what we are going to do. Until we find out from the senior citizens what they want to do, we are assuming a lot of things. (] Mr. Veiman has contacted the Andover Senior Citizens and the church of st. Paul to find out what they really want. There are three phases of financing available: o o Page Two Planning Commission Minutes 19 July 1988 ,- '1 ,---,' HUD - low income persons receIvIng social security with a fee set at 30 percent of income for heat and water/sewer. They pay for their own electricity and telephone. That's the lowest rate in st. Paul. HUD money is very hard to come by, however. FmHA - In this category you have strictly a rental unit. If the survey reveals that we have senior citizens that could afford $4-600 a month rent, such a project could be sought which would include underground parking, dining facilities, etc. If a senior has a home to sell they can trade that for a unit, paying only association fees. First we have to get our marketing information before we can digest it and come up with something intelligent. He asked that the Planning Commission look ahead so that the city is ready for this type of housing because we have utilities available. Metro financing is regulated by the availability of utilities. The number of units will be revealed by the study. Marge Perry asked if amenities such as shopping, transportation, etc. are considered as far as needs, to which inquiry Mr. Veiman responded yes. Wayne vistad pointed out that the funding is becoming less available because of the reduction in the ratio of those using social security monies as opposed to those working persons contributing to social security. By 1990 the ratio should about about 3 to 1. Mr. Veiman said there are several church organizations that do this non-profit. We also have to be careful with the developer because they are in the business for a profit. r "\ \..~ The question was asked as to how much area would be needed at this particular time. A forty unit building would need a large area like Camelia Rose/Margaret Place. Mr. Veiman will up date the City as to things that are happening in this regard. Multiple-Family Dwelling Zoning Districts: City Planner Daryl Morey reiterated some of the problems encountered in 1980 when the rezoning of the southern part of the city occurred. Chairman Perry pointed out the fact that where Red Oaks 6th Addition is proposed it is zoned LB and the developer is requesting that it be changed to single family. Commissioner Bosell brought out the fact that the Ordinance allows for a PUD development and it seems to be that PUD's are allowed in all residential districts. Chairman Perry felt that without identifying a specific area, the area within the MUSA boundary is going to be so impacted and in such demand that the available property will be gone. o 0 Page Three Planning Commission Minutes 19 July 1988 , , ~J Commissioner Vistad felt we could offer incentives to the developer so that they will do that sort of project with the City. Until the study is done in relation to how much space we need, we don't know how much area we need. Should we seek the direction of the City Council in relation to rezoning an area to accomodate multiple dwellings with the expectation that within two years there will be a request for senior housing or do we want to make the recommendation that nothing be done and have the developer come in under a PUD? If we were to propose a district designated as senior housing- handicap district, would the City then be forced to purchase that property? The City Council should be asked for direction and also the City Attorney as to whether we can rezone a piece of property knowing that it won't develop for a certain length of time. Can that be construed as taking? City Planner Daryl Morey felt that in a PUD you could have some sort of retail facility within the unit (like Chandler place in New Brighton) such as a co-op store. It was thought that Meadow Creek Church should be contacted by The Development Group as well as the Anoka AssemblIes of God Church. These two churches hold a considerable amount of land and perhaps they have plans in place that we are not aware of that would meet these housing needs. This will be continued contingent upon the recommendation of the City Council and based on the interpretation of the City Attorney. High Risk Sexual Conduct Ordinance: Daryl Morey has requested direction from the City Council and it is that we hold a public hearing on the Minneapolis Ordinance. He noted that the Planning Commission has expressed concern because of the lack of information available about the complaints arising out of the present use. It was felt that the Minneapolis and Indiana Ordinances should be tested before we adopt an ordinance. Marge Perry spoke with City Attorney Bill Hawkins before the meeting and he indicated that he thought if the City indeed is interested in adopting that Ordinance, this would be the time to do it because we could go in on the shirt tails of the other two cities and allow them to bear the expenses of the Court proceedings and we would benefit from their cases. The other thing is that he has not researched carefully the most recent findings on whether or not a City can exclude those pornographic activities from all areas of the City or whether they must allow them within some districts. His clerk is on vacation but when he comes back, some research could be done. o Mr. Hawkins also felt that urgency is not an issue as over the past twenty years there has been only one business within the City and no other requests have been made. o 0 Page Four Planning Commission Meeting 19 July 1988 . \ '_6) Wayne Vistad said the pressure is now here because Minneapolis wouldn't allow the use. The Minneapolis Ordinance set guidelines based on the risk factor and that they needed to be controlled and monitored. The Ordinance removed some of the design features within the structure. It does not stop them from having that use. There is no additional information available as to specific complaints. Commissioner Vistad felt that if the issue arose we would have the ordinance on the books to stop it and correct it. Chairman Perry asked why the health, safety and general welfare statement of the ordinance couldn't come into play here? City Planner Daryl Morey talked to Susan Strand, Anoka County Public Health nurse, and she released one piece of information. She has found out from a professional that there is an employee of the Vapor's who has AIDS and has been engaging in high ri~k sexual conduct on the site. That is the only information we have. The request to the Commission would be that we hold a public hearing once the issues are identified so that we know what we are going to deal with. Commissioner Vistad feels we should have the ordinance in place before the fact. Chairman Perry felt that no matter what safeguards we try to build in, something will happen that we may not want. This item should be continued until we get the direction from the City Council and the City Attorney. The amendment to Ordinance 8 should be continued until this matter is resolved also. Future NB Zoning Districts: The issue is proposed NB sites within plats. It was felt that the City needs additional NB zones, but where? Commissioner Vistad felt that they are convenient and whether they are successful or not is the responsibility of the developer, not the City. /- '\ '- ~( Commissioner Bosell pointed out that the previous Comprehensive Plan had a specific service area for neighborhood business districts that perhaps should be reviewed. Market studies should be required to support the proposal. The current Comprehensive Plan requires that any new zoning be part of an integrated development plan rather than an isolated spot zoning. In addition to the market study, we should ask what the finished development is going to be of the area. The needs of the City are to be utmost in our planning. It was felt that an article should be written for the newsletter inquiring of the residents what their shopping needs are as it o u Page Five Planning Commission Meeting 19 July 1988 o pertains to convenience centers, where they should be located and the types. Also, the distance they are willing to travel to this shopping area. The other concern centered around the size of the area required being two acres. Is that district size appropriate in the urban area? The two acre size does restrict speculation for the person who wants to develop and run. Daryl Morey feels it goes beyond what the ordinance says. It depends upon the staff and what they tell the inquirer. A review of the Comprehensive Plan should be done to see what it says and the former plan and determine where we are heading, an update on the existing NB zones that are not developed, where they are and their size. Melanie DeLuca from Community Ed should be asked whether they have done a survey with this type of information on it from the people in Andover. R-4 Rezoning Criteria/Issues: This matter is continued so that Commissioner Jacobson could be present. Ordinance 10 Amendment pertaining to Concept Plan: The City Council has requested that we look at it again. Copies of the proposed EAW/EIS amendments should be provided to the Commission. Commissioner Bosell felt that the part of the ordinance that requires all contiguous property be platted be changed and that the concept plan include all contiguous property. Background materials will be provided to the Planning Commission in this regard for further consideration. Daryl Morey advised the Commission that the materials received this evening are from various communities as it pertains to landscaping requirements in the commercial areas. This would be a future agenda item. Grading & Filling Permit Review: The Commission consensus was that the Plymouth Ordinance was the best. Daryl Morey will be looking to incorporate these sections into the appropriate Ordinance. ~) The matter of the Planner, the Commission Chairman and the Zoning Administrator all attending the City Council meeting was discussed with the Council. It was felt that the residents seemed not to be favorable to staff recommendations and the Council would like the Chairman to be at these meetings. o 0 Page Six Planning Commission Minutes 19 July 1988 -, ~~) The meeting was adjourned at 10:10 pm to Mansetti's Pizza Parlor for the purpose of wishing our departing Planner Daryl Morey the very best in his job venture with the City of Lakeville.
