MINUTES
The Regular Meeting of the Andover Open Space Advisory Commission was called to order by
Chairman Deric DeuscWe, September 9,2009, 7:00 p.m., at the Andover City Hall, 1685 Crosstown
Boulevard NW, Andover, Minnesota.
Commissioners present: Jody Keppers, Jim Olson, Winslow Holasek, Bruce Perry and Kim
Kovich (arrived at 7:06 p.m.)
Commissioners absent: Gretchen Sabel
Also present: City Planner, Courtney Bednarz

Motion by Commissioner Perry, Seconded by Commissioner Olson, to approve the minutes as
presented. Motion carried on a 5-ayes, O-nays, O-present, I-absent (Sabel) vote.
PROPERTY NEGOTIATION UPDATE
Commissioner Olson stated that he believed the Council agreed with the Commission in regard to
the property. He stated that the Council advised that they would like to move forward on the
negotiation of the property.
Commissioner Holasek stated that the Council recognized that the property was attractive and that it
may not stay available for long.
City Planner Bednarz stated that the Council gave him the direction to make an offer ofthe appraisal
amount of the property. He stated that the property owners were happy to continue to live on the
property but stated that they would review the offer and get back to the City. He advised that the
City would now wait for the response ofthe property owner.
Commissioner Holasek stated that the Council did not want to offer too high of a price as it may then
0 set a precedent for the future.

2009 SITE SELECTION PROCESS UPDATE
City Planner Bednarz stated that in regard to the property on Coon Creek the owner may wait to sell
until the sewer and water hook-up occurs to obtain a higher price. He advised that the Commission
should keep the idea of future sewer and water hook -up in mind when pursuing a piece of property.
He stated that property of that type would be developed in the future and thought the Commission
should ensure whether or not an open space parcel would fit into that future development. He stated
that the property owners did not want to tie their hands at this time.
Commissioner Keppers thought that a process could be developed for working with future
development to determine if a parcel could remain as open space within the future development.
Commissioner Olson questioned ifMUSA was available currently for that area or whether it would
occur in 2020.
City Planner Bednarz stated that a portion of the property was included in the MUSA, and another
portion was not included in the MUSA. He was unsure when the MUSA would change. He advised
0 that the owner of the t-shaped property hoped that his property would be included in the MUSA. He
reported that the Slyzuk properties were also included in the MUSA.
Chair Deuschle stated that the Commission had spent a lot of time looking at properties that may not
be available for acquisition in the near future. He was unsure of the best method to move forward in
that respect, he did not want to start drawing up plats.
Commissioner Keppers commented that the asset for the Commission was that property values were
low in the current economy.
Commissioner Keppers questioned how the Commission would begin work on conceptual models or
sketches.
City Planner Bednarz stated that there may be an opportunity for the Commission to review areas
that ranked high but the owners were not interested in limiting options prior to development. He
stated that while the Commission may not want to draw up plats, they could discuss what kind of
preservation may make sense so that the Commission would be ready to make a recommendation
when the development process begins.
Chair Deuschle agreed that it would benefit the Commission to be proactive in this process.
0 Commissioner Olson questioned if the Planning Commission could force a developer to create a
parcel of open space within the plat.
City Planner Bednarz stated that the city could be able to either collect park dedication funds or
obtain ten percent of the land as park dedication. He advised that the Planning Commission and the

City Council would likely appreciate the recommendation of the Commission on preservation related
ideas. He explained the sketch plan process that the City would normally take in regard to
development and where in the process he believed the Open Space Commission could be involved.
Commissioner Keppers questioned how often a developer is in contact with the City prior to
development beginning.
City Planner Bednarz stated that in most circumstances the developer would conduct a meeting with
the City prior to beginning conceptual plans.
Commissioner Kovich suggested possibly choosing a few parcels that the Commission had interest
in and moving forward with creating conceptual ideas.
Chair Deuschle questioned when the last open house was held.
City Planner Bednarz advised that the last open house was approximately one year ago, in September
of2008.
0 Chair Deuschle stated that he would also like to review the comprehensive plan, specifically in
regard to open space, prior to the meeting next month.
City Bednarz confirmed that during the next meeting the Commission would review materials
already in their possession in regard to high priority parcels, along with the open space portion of the
comprehensive plan.

Chair Deuschle questioned if movement had occurred on any other properties, such as the golf
course.
City Planner Bednarz advised that staff is maintaining contact with the property owner, whose
intention was to determine the buildable portion of the property. He advised that the property owner
had previously submitted a request to rezone the property from open space to medium density
residential. He stated that the request was not well received as there was not a plan for the
0 development nor an idea of what type of homes would be built on the property.
Chair Deuschle stated that the situation might be a chance to negotiate with the property owner as a
portion of the property is wetland. He stated that better price could possibly be obtained for the
property; or a trade-off could occur between the City and the property owner in regard to the amOlU1t
of open space versus the type of development to occur.

Commissioner Keppel's questioned how much leverage the property owner would have in regard to
rezoning of the property.
City Planner Bednarz stated that the City Council would ultimately make that decision. He advised
that the property owner is currently running the driving range and has discussed wetland mitigation.
He stated the City would not be comfortable rezoning the property without an idea as to the type of
development. He stated that the website had been updated with the suggestions made by the
Commission at the previous meeting. He reported that the September newsletter had also been sent
out.
Motion by Commissioner Kovich, Seconded by Commissioner Holasek, to adjourn. Motion
carried on a 5-ayes, O-nays, O-present, I-absent (Sabel) vote. The meeting adjourned at 7:40 p.m.
