MEETING MINUTES
JUNE 07, 1990
The regularly scheduled meeting of the Andover Park and Rec~~ption
Commission was called to order at 7:30 p.m. by Chairperson Jeff Kieft~r on
Thursday, June 07, 1990 at the Andover City Hall Offices, 1685 Crosstown
Blvd., Andover, MN.
Commissioners Present: Chairperson Kieffer, Jim Lindahl, Darrell Delarco,
Marc McMullen, William Mamlock
Commissioners Absent: Tom Anderson, David Woods

RESIDENTS FORUM
1) Rick Ramseyer, 3420 152nd lane, Andover, represented Josh Ramseyer,
Scout, who proposed putting in a bluebird trail in Kelsey Park at an April 05,
1990 commission meeting. Plans of the bluebird house and proposed trail in
the park were submitted to the commissioners for examination. The project
consists of placing twenty-four houses along a "trail", Jeff cleaning out the
houses periodically, and a sign erected in the park explaining the project.
Chairman Kieffer volunteered to supervise. He also suggested that pegs be
installed inside the opening of the house to discourage predetors. A permit
from the park board would be issued, so that the Ramseyers could use a small
lawn tractor to haul things for the project into the park.
2) Melanie Deluca reported that there are 1,567 registrations in the
Andover summer program. This figure surpasses all districts. The program
begins June 18th, 1990. A full report will be given at a later time.

APPROVAL OF MINUTES
Motion made by Lindahl, seconded by DeLarco, to approve the minutes of the
May 03, 1990 Park and Recreation Commission meeting. Passed unanimously.
ADD TO THE AGENDA
Chairman Kieffer added Park Dedication (#9) to the agenda.
ED FIELDS LOT SPLIT PARK DEDICATION
Ed Fields was not present. Frank Stone recommended moving the issue
forward.

Motion by McMullen, seconded by Lindahl to adjust the agenda and proceed
with discussion of Park Dedication, #9 on the agenda. Passed unanimously.
PARKDEDICATION
The commission discussed re-writing the ordinance concerning lot
splits/metes and bounds. It has been challenged by Eugene Brown and
discussed in a special meeting with the city council and commissioners, which
occurred May 29, 1990. Chairperson Kieffer stated that, according to the city
attorney, it is illegal to charge 10% of market value plus an appraisal fee.
Commissioner McMullen thought that the park dedication should be 10% and
have the city pay one assessor fee, rather than change the ordinance. The city
council and Chairperson Kieffer had agreed that a set fee would be easier to
work with. Chairperson Kieffer said that decisions reached at this time would
be based on what is already written. The ordinance would be placed on the
city council agenda for June 19, 1990.
Motion by McMullen, seconded by Mamlock, to deduct at the time of closing,
the cost of the appraisal for one time and in discussion, if there is a question

on the amount of appraisal, a second appraisal would be borne by the owner,
with the concurrence of the city attorney. Passed unamimously.
Discussion: It was felt this would be a fair method of arriving at fair prices and
refers only to metes and bounds and lot splits. Chairperson Kieffer added that
city council did vote to conceive the feasibility of the city attorney drafting an
ordinance, in determining park dedication, using a flat fee or 10%.
Motion by DeLarco, seconded by McMullen, regarding the Ed Fields Lot Split
Park Dedication and the owner's absence at this meeting, to use the ordinance
as written at this time, placing the money in escrow until a decision is reached
by council.
KEN SL YZUK METES AND BOUNDS LOT SPLIT

In addressing Ken Slyzuk, Chairperson Kieffer reiterated that the commission
was in the process of possibily changing the ordinance on park dedication, but
that at this time, an appraisor would be hired, and park dedication would be
10% of that figure. Ken Slyzuk, 15211 Nightengale St., Andover, argued that
the ordinance on park dedication did not treat him fairly. Title was to be
transferred within his family. He requested a copy of Ordinance 10, Section
9.07. Commissioner DeLarco suggested that, if Slyzuk questioned the value of
his land, the city would hire an appraisor and he would pay that fee plus 10%
for park dedication. Under the circumstances, pending the change proposed,
the appraisal fee would be deducted off park dedication. Subsequent
appraisals would be borne by Mr. Slyzuk. Commissioner McMullen added that
Mr. Slyzuk could place the money in escrow (re: Mr. Fields) until a decision
was made by council .
After further discussion, Commissioner Lindahl suggested Mr. Slyzuk take
issue with the city council. Mr. Slyzuk stated that he thought his permit was
pulled before the ordinance was changed. Commissioners suggested he
contact the city attorney concerning the ruling. Mr. Slyzuk said that he
couldn't record transfer title of house until park dedication is paid.
Chairperson Kieffer advised "holding off" if he disagreed, pending the change
in the ordinance.

KEN KOBS SKETCH PLAN
Ken Kobs, 12179 Mississippi Drive, Champlin, presented a sketch plan on land
acreage by 168th and Tulip. Approximately nine lots are involved, 33 acres;
the commission would get 10% of the land. Frank Stone recommended
looking for a more centralized location for a park in the area.
Motion by McMullen, seconded by Mamlock, to accept money in lieu of land
for park dedication. Passed unanimously.
Discussion: Commissioner McMullen noted that future park boards should
designate something in that area as park land. Chairperson Kieffer clarified
that, as a developer, Kobs would be paying 10% plus an appraiser fee.
A question arose from a resident concerning possible usage of county
assessment in determining park dedication. Discussion followed.
, ) GENTHON PONDS SKETCH PLAN
A representative for Genthon Ponds presented a sketch plan. Much of the 40
acres is wetland; approximately 13 lots will be developed. Ham Lake has a
park near the area. The commissioners did not see potential park land in the
area. Commissioner DeLarco said that if the property is purchased within 6
months, it would be feasible for the commission to base park dedication fee on
the purchase price of the property. Checking with Todd Haas or the city
attorney was recommended.
Motion by Mamlock, seconded by McMullen, to accept cash in lieu of land in
Genthon Pond, advising Todd Haas to check the purchase price of the
property with the city attorn~y to se~ if the commission could use that rather
than an appraisal to determine park dedication. Passed unanimously.

APPROVE SOFTBAll TOURNAMENT APPLICATION
GREG ERICKSON
Commission Kieffer requested an up-date on the typed application form for
tournaments: list all four fields, at $150 a field.
Motion by Mamlock, seconded by McMullen, to accept application by Greg
Erickson for June 23 and 24 for city park ball fields at $150jfield, a total of
$450 for fields 1,2,3. Passed unanimously.
Discussion: Recommendation made by Frank Stone, that a lawn tractor, not a
3-wheeler be used to drag or maintain the fields. Chairperson Kieffer
recommended, in addition to the motion: city staff to notify sheriff's
department of the tournament.
CHAIRPERSON'S REPORT

Chairperson Kieffer reported that a resident complained of people using his
front yard to get to Terrace Park. Chairperson Kieffer advised that Terrace
Park should be given priority for a parking lot next year. There is no sidewalk;
the only parking is on the street. Frank Stone suggested that the commission
draft plans, so the parking lot can be included in next year's budget.
Re: Hockey Rink. Commissioner McMullen stated that an original plan allowed
$10,000 for two hockey rinks. He suggested that two rinks should be built, as
the bid was low, $4800 for one rink. Chairperson Kieffer said there was not
too much interest expressed in a hockey league, that it might warrant building
only one, and use the remaining money on something else. He agreed it was a
good price, but that the money would come out of dedication.
After discussion, the commission decided to check out the feasibility of the
bid, to see if the price quoted for one rink would apply for two (at $4800 each),
and subsequently figure out where to put it.

Frank Stone informed the commission that the striping of baseball fields would
begin on Friday or Monday of that week.
Motion by Mamlock, seconded by Lindahl to adjourn the meeting at 9:30 p.m.
Passed unanimously.
