REGULAR PLANNING AND ZONING COMMISSION MEETING
July 24, 1990 MINUTES
The Regular Bi-Monthly Meeting of the Andover Planning and
Zoning Commission was called to order by Chairperson Rebecca
Pease on July 24, 1990, 7:32 p.m., at the Andover City Hall,
1685 Crosstown Boulevard N.W., Andover, Minnesota.
Commissioners Present: Bill Coleman, Ron Ferris, Steve Jonak,
Bev Jovanovich, Randall Peek and
Wayne Vis tad
Others Present: d'Arcy Bosell, City Zoning Administrator;
Todd Haas, Assistant City Engineer;
and Ray Sowada, City Tree Inspector
REVIEW AND APPROVAL OF MINUTES
Ferris requested that on page two, the last sentence in the
second paragraph be corrected to read "encroach into the side
yard setback."
~ MOTION by Coleman and seconded by Jonak to approve the Minutes
of the July 10, 1990 Meeting, as corrected. Motion carried
unanimously.
PUBLIC HEARING: ORDINANCE NO.8, SECTION 8.08, PARKING REQUIREMENTS
The Commission reviewed the latest draft of the proposed amendment.
The following corrections and changes were recommended:
Under Section E, 3, (e) the word "five" should be
corrected to read "ten".
Under Section E, 3, a new (f) should be written to
address minimum residential curb cut standards of
five feet.
Under Section E, 3, the current (f) shall become (g)
and the current (g) shall become (h).
Under Section E, 3, language should be added for a
minimum of five feet from side yard property lines
in Districts R1, R2, R3, R4 and R5.

PUBLIC HEARING
The Public Hearing portion of the Meeting was opened. There
were no responses.
MOTION by Ferris and seconded by Vistad to close the Public
Hearing. Motion carried unanimously.
The Commission discussed surfacing on exisiting and proposed
businesses. It was decided to change Section E, 6, to read
"All driveways, off-street driving, loading, parking and storage
areas shall be surfaced in accordance with the standard specifications
as adopted by the City and on file in the office of the City
Engineer."

MOTION by Ferris and seconded by Jovanovich that the Andover
Planning and Zoning Commission recommend to the City Council
that with the changes discussed here(that Under Section E,
paragraph 3, (e) the typo will be changed to read "ten and
10"; that page 4, paragraph 6, the opening sentence will be
worded to the effect of including storage areas; that a
paragraph would be added under Section E to discuss residential
and the paragraphs will be re-lettered) approval of the
changes to Ordinance No.8, Section 8.08r Parking Requirements.
This will be passed on to the City Council for their review
on August 7, 1990.
A Public Hearing was held and there was no representation either
for or against.
Motion carried unanimously.
2466 N.W. 134TH AVENUE (RAMSEY) SIDE AND REAR YARD SETBACK
VARIANCE
Bosell stated that no action is required by the Commission
on this request. This is a storage shed that has been erected
in a drainage easement. No variances are allowed for this
since the structure may affect direct flow of storm water
for this area, which in turn may affect other structures within
the drainage area.
The owner, Mr. Robert Ramsey, has been notified of this and
his fees will be refunded to him. and he is required to move
the shed.
) The Commission took no action on this item.

KEN HElL SKETCH PLAN DISCUSSION
Haas reviewed the proposed sketch plan with the Commission and
reviewed with them the comments of the Andover Review Committee.
This property is in the MUSA area, and Mr. Heil is preparing
to subdivide his land into eight lots in addition to his current
dwelling when sewer and water become available.
Lot 5 will require variances to allow the lot to front onto
Andover Boulevard and to allow for the current 23 foot setback
versus the required 40 feet.
Lots 2 and 8 of Block 1 will require variance for lot depth
from Ordinance 8, Section 6.02 as the lot depth mean is less
than 130 feet.
Haas stated the Andover Review Committee has some problems
with Lot 7 for drainage and utility easements because of all
the tree stumps on this lot at the current time. Mr. Heil
stated it will be no problem to remove these so that the lot
could be considered to be buildable.
,/ The Andover Review Committee has recommended that Mr. Heil
go with this plan. There were no additional concerns expressed
by the Planning and Zoning Commission. This item goes to
the City Council on August 7, 1990 and to the Park Board on
August 2, 1990.
ORDINANCE NO. 23 AMENDMENT: RAISING AND KEEPING OF EQUINES
(HORSES)
Bosell stated that after discussion of proposed amendments
to this Ordinance last fall and winter by the Planning and
Zoning Commission and input from the Public, an Equestrian
Council was appointed to review this matter. This agenda
item is to review the amendment proposed by the Equestrian
Council.
John Bills, 14367 Prairie Road, is the Chairman of the Equestrian
Council and reviewed the proposed amendment with the Commission.
Other people involved in the drafting of this document are
Ernie Trettel, Don Eveland, Debbie Menth, Sharon Orstad and
Carol Almedia.

The Commission reviewed the proposed amendment at length with
Bills and recommended the following changes:
Under Section II, more than 5 acres should be
restricted to 2 horses per acre.

Under Section IV, wording should state a minimum
shelter requirement of 8x10 feet per horse.
Under Section VI, wording should be added to the
effect "Manure shall be stored in proximity to
the rear of the shelter."
Under Section IX, C and Section X, C, clarify
the conflicting statements.
Under Section XII, add wording that anyone with
less than five acres or more than twenty horses
needs to go through the Equestrian Council and
the permit process.
Add a sunset clause that if the permit is not used
within one year it is revoked.
Address a one year retroactivity.

Other concerns expressed by members of the Commission included
if the stall size was adequate and if this Ordinance needs
to be in balance with the City's Ordinance governing kennels.
Staff will get the City Attorney's opinion on kennels versus
equine Ordinances. Also discussed as a concern is the boarding
of horses if it becomes a business, and that this should be
cross-referenced in this ordinance.
This item will be scheduled for a Public Hearing on August 28,
1990.
ORDINANCE NO. 44:
DISCUSSION CONTINUED ON FENCING OF JUNKYARDS
MOTION by Vistad and seconded by Jovanovich to postpone this
item until the next meeting of the Planning and Zoning Commission.
Motion carried unanimously.
ORDINANCE NO. 29: DISCUSSION CONTINUED ON DISEASED TREE ORDINANCE
AMENDMENT
Sowada discussed with the Commission some of the concerns and
difficulties of regulating the removal of diseased trees and
the transporting of diseased branches and wood through the
City.

It was the general concensus that the general public is not
informed of the need for a permit or how to properly dispose
of a diseased tree. It was recommended that the permit application

process be as simple as possible, including being able to
apply in person or over the phone and that there be no charge
for the permit.
This amended Ordinance 1S scheduled for a Public Hearing on
August 14, 1990.
Staff will check on getting some articles into the newsletter
and local paper on public education of this topic.
There being nothing further on the approved agenda, Chairperson
Pease declared the meeting adjourned at 11:44 p.m.
