Adjournment (\ \J o o o o C}\ CITY of ANDOVER PARK AND RECREATION COMMISSION MEETING MINUTES JANUARY 02, 1992 The regularly scheduled meeting of the Andover Park and Recreation Commission was called to order at 7:32 p.m. by Chairperson Jeff Kieffer on Thursday, January 02, 1992 at the Andover City Hall Offices, 1685 Crosstown Blvd., Andover, MN. Commissioners Present: Tom Anderson, David Woods, Jeff Kieffer, Jim Lindahl, Darrell DeLarco, Commissioners Absent: Roger Paulson, Mike Auger Others Present: Todd Haas, Jerry Windschitl of Ashford Development Corporation, Inc. RESIDENTS FORUM None. APPROVAL OF MINUTES MOTION by Woods, seconded by Lindahl, to approve the minutes of the December 19, 1991 Regular Park and Recreation Commission meeting. Motion passed on a 5-yes, 2-absent vote. WEYBRIDGE PRELIMINARY PLAT PARK DEDICATION At their December 19, 1991 regular meeting, the Park and Recreation Commission reviewed park dedication for the proposed sketch plan of C) u Andover Park and Recreation Commission 01/02/92 Meeting Minutes, page 2 '\ ) Weybridge. As requested, the Commission is again reviewing park dedication for the preliminary plat of Weybridge. Mr. Todd Haas, City Engineer, reported that he and the Public Works Superintendent have reviewed the preliminary plat and are recommending to accept the 4.89 acres of park as indicated on the plat and the remainder to be cash in lieu of land. The remaining dedication is approximately 0.77 acres. According to Mr. Haas, staff has discussed the issue regarding the low ground versus high ground with the City Attorney. It is the City Attorney's opinion that if the Commission recommends accepting the park that whatever the City accepts, even if it is high ground, low ground or both, the City cannot require the developer to dedicate the difference between high ground versus low ground. Furthermore, the City Engineer and the Public Works Superintendent are recommending the park to be dedicated for the following reasons: , 1. The proposed Andover Comprehensive Plan, Chapter 8, titled Parks, Recreation and Open Space, Section E subsection (d) "Trail Development" Figure VIII E titled Trails Plan proposes bicycle and pedestrian uses along the north side of Coon Creek between Burlington Northern Railroad and Hanson Boulevard. ) 2. The City should continue to propose to keep the sanitary sewer trunk furthest away from Coon Creek and closest to the ridge of the hill due to better soils. 3. The City should accept the Park which will eliminate the extension of lot lines to Coon Creek, which would have allowed property owners to build fences, plant trees, store junk, etc. After examining the facts and engaging in discussion with Mr. Windschitl and Mr. Haas, the Commission will accept the dedication of the preliminary plat of Weybridge even though the park land does not relate to their policy. The Commission is dissatisfied with the dedication for the following reasons: '- /' c) u Andover Park and Recreation Commission 01/02/92 Meeting Minutes, page 3 '\ / 1. The land is unusable and does not follow the definition of park land. 2. Park Board money is being used to acquire land for Public Works benefits. 3. The original plat agreement contained a negotiated park dedication. Cash was never paid into the park dedication fund. The Park Board feels that this area should be explored before a final decision is made. 4. Cash is preferred in lieu of land. 5. The value of the land is questionable to the Park Board. 6. The amount of dedicated land may be in excess of what is needed for a trail system. Mr. Windschitl feels he is satisfying the City's ordinance one hundred per cent and is not concerned with the original plat agreement for park dedication. He wants a decision from the Park Board as soon as possible, so that he can advance his development. Mr. Windschitl said that the bulk of this land is above the one hundred year flood and considers itthe "best property" in the \ development. In his opinion, it would "improve those lots that are for sale". '. ) Mr. Haas reports that a feasibility study on the possible expansion of the trunk line will be ready in approximately two to four weeks. Commissioner Anderson formulated the Park Board recommendations to City Council in accepting the over-all dedication of the plat in regard to the preliminary plat of Weybridge: Take the acreage west of property along the creek up to where the sewer line cuts south, then seventy-five feet (75') from the creek to the east end of the property in order to facilitate further trail systems; the dedication required in excess should be in the form of cash and dependent upon the feasibility study; and original dedication with Old Colony Estates of May 19, 1988 should be explored. The City Attorney is to determine which party is liable for cash dedication (the original developer or all three current developers). MOTION by Lindquist, seconded by Woods to accept the City's recommendation concerning Weybridge Park Dedication; however, any Park Board money designated to acquire land for the sewer trunk line should come from Public Works or the General Fund and not the Park o (j (~ Andover Park and Recreation Commission 01/02/92 Meeting Minutes, page 4 '-/ Board. The Park Board also recommends a consistency with the Comprehensive Plan. Motion passed with 5-Yes, 2-Absent vote. APPROVE LETTER TO DEMSKY'S The Commission reviewed the proposed letter to Barbara Demsky, 2421-177th Lane N.w. and edited the first paragraph. In effect, the commission is not purchasing a plaque or tree to plant in memory of Matthew Demsky, but welcomes the family purchase of a tree for Hawkridge Park. Mr. Haas will handle the corrections and send out the letter. CHAIRMAN'S REPORT . \, ,j Commissioner Lindahl recommends that City Council considers an amendment to the city's policy on property access for Public Works through the Park Board. Mr. Haas agreed that this would be an item on a future agenda. Commissioner Anderson suggests that a statement should be added to park dedication so that the commission does not have to accept lesser valued land without any recourse.
