HomeMy WebLinkAboutJune 23, 1992 o o o C}\ CITY of ANDOVER PLANNING AND ZONING COMMISSION MEETING - JUNE 23. 1992 MINUTES The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Bonnie Dehn on June 23. 1992, 7:30 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover. Minnesota. Commissioners present: Bev Jovanovich, Marc McMullen (arrived at 7:34 p.m.), Randy Peek Maynard Apel, Steve Jonak, Becky Pease Assistant City Engineer, Todd Haas Others Commissioners absent: Also present: APPROVAL OF MINUTES June 9, 1992: Correct as written. MOTION by Jovanovich, Seconded by Peek, approval of the Minutes. Motion carried on a 3-Yes (Dehn, Jovanovich, Peek), 4-Absent (Apel, o Jonak, McMullen, Pease) vote. PUBLIC HEARING: PRELIMINARY PLAT - LEEMAN LAKE ESTATES. DAN CHRISTENSEN 7:31 p.m. Mr. Haas reviewed the proposed preliminary plat of Leeman Lake Estates located in the vicinity of Crosstown Boulevard and 170th Avenue. It consists of six single-family rural residential lots. Both Ordinances 50 and 71 effect the plat, plus the developer will be required to obtain all necessary permits from the various agencies who have an interest in the site. The Andover Review Committee is also recommending a variance for Lot 1, Block 2 for lot size. The lot is an existing lot which is 1.84 acres, but meets the 60-percent requirement in Ordinance 8, Section 4.04. The Park and Recreation Commission is recommending cash in lieu of land for park dedication. (Commissioner McMullen arrived at this time; 7:34 p.m.) The hearing was opened for public testimony. o Ralph James. 16906 Crosstown Boulevard NW - stated Leeman Lake is designated a recreational development lake. What does that mean? Mr. Haas expiained the DNR has determined it to be a recreational lake, which means that certain requirements must be met regarding frontages along the shoreline and setbacks from the ordinary high water mark. Continued) Mr. James - noticed a large area of fill, asking if the DNR has looked at this and whether a wildlife sanctuary will be disturbed. Mr. Haas explained the Coon Creek Watershed has determined that no wildlife area is being proposed to be filled. Mr. James - stated there is going to be a dispute on the property line between Mr. Christensen and himself. It involves a small piece of property on which he has a playground which he has maintained for over 15 years. He plans to file a torrens action for adverse possession of that piece of land that he has a structure on and which he considers his property. It would affect a portion of the road in the proposed plat. The playground equipment Is in the area of the cul-de-sac. Mr. Haas stated that will be a dispute between the two parties and does not affect the City. What is being piatted is a lot of record. Robert Steele. 16680 Crosstown Boulevard - is adjacent to the triangle on the east side of the road. He understood the minimum lot size in that area is 2.5 acres and didn't understand how this lot . \ could be developed when it is only 1.84 acres. What is the reason for ,_J the variance. Mr. Haas explained it is an existing lot of record on which a building permit could be received as it is. The City has asked that this be Included in the preliminary plat. He also went into some detail as to lots of record meeting the 60-percent requirement of the ordinance. Mr. Steele - asked if the house will be built in the location shown on the plan on the lots. Mr. Haas stated not necessarily. The purpose for showing the building pads is so the City knows the garage floor elevation and the lowest floor level of the lot. The house can be moved anywhere along the setback line as long as all setbacks are met and no wetlands are filled in. Mr. Steele - asked if the driveway for the triangular lot will go directly onto Crosstown Boulevard. Mr. Haas stated yes, and the City is recommending the driveway be located as far away from 170th Avenue as possible. It will not affect Mr. Steele's land in any way. Mr. James - asked if there is going to be a swale along his property line and a drainage ditch in that area. Mr. Haas explained there is a shaliow grade so the water from the low area north of Mr. James' house drains away from his lot. Everything will drain within the project through a storm sewer and into the low area. ) ~) \ ~ .) Continued) Commissioner McMullen asked Staff whether Leeman lake was designated as Open Space in the proposed Comprehensive Plan. He was told that it was not due to an oversight. Chairperson Dehn felt the purpose of designated the low areas as Open Space was to allow the City the choice of obtaining those areas if it was in a position to do so. At this point, the Plan has not yet been adopted: and she didn't think the City was in a position to do anything with it. Mr. Steele - questioned why land wasn't taken for park. With the increased development of the area, he thought it wouid be nice to have a park in that area. The Commission explained that decision is made by the Park and Recreation Commission, who looks at the overall needs of the City: however, they urged the residents to contact the Park Commission with their request. MOTION by McMullen, Seconded by Jovanovich, to close the public hearing. Motion carried on a 4-Yes, 3-Absent <Apel, Jonak, Pease) vote. \ MOTION by Peek, Seconded by McMullen, that the Andover Planning and ,) Zoning Commission recommends approval to the City Council of the preliminary plat of Leeman Lake Estates. the application of Dan and Dixie Christensen, located in Section 12, Township 32, Range 24, Anoka County. with the following conditions: That the plat comply with Ordinances 50 and 71. That the developer and/or owner will obtain all necessary permits <DNR. U.S. Army Corps of Engineers, Coon Creek Watershed District, LGU and any other agency which may be interested in the site). And that the following conditions are part of the approval: 1) A variance for lot size be granted for Lot 1, Block 2 that Is in compliance with Ordinance 8, Section 4.04. The variance would be for lot size of 1.84 acres. 2) The street plan and profile be submitted to the City Engineering Department for review prior to any construction along with the storm sewer. Park dedication be made in cash in lieu of land as recommended by the Park and Recreation Commission. A pUblic hearing was held. Regular City Council meeting. 7:58 p.m. \ .J \ \. ) / Regular Andover Planning and Zoning CommissIon MeetIng Minutes - June 23, 1992 Page 4 OTHER BUSINESS ChaIrperson Dehn stated she attended a meetIng of the Tree CommIssion where developers and land owners met to dIscuss the proposed Tree OrdInance and Tree PreservatIon Plan. The intent Is that those Items wIll go dIrectly back to the City CouncIl for consIderatIon. The RecordIng Secretary hIghlIghted the major changes to the documents whIch are beIng recommended by the Tree CommIssIon. There beIng no further busIness, ChaIrperson Dehn declared the meetIng adjourned at 8:00 p.m. The next meetIng Is on Tuesday, July 14, 1992.
