The Regular Bi-Monthly Meeting of the Andover Planning and Zoning
Commission was called to order by Chairperson Bonnie Dehn on May 26,
1992,7:30 p.m., at the Andover City Hall, 1685 Crosstown Boulevard
NW, Andover, Minnesota.

MOTION by Apel, Seconded by Jovanovich, approval of the Minutes as
presented. Motion carried on a 4-Yes, 2-Present (Pease, Peek),
1-Absent (McMullen) vote.
PUBLIC HEARING: PRELIMINARY PLAT - PHEASANT MEADOWS. HOKANSON
DEVELOPMENT CORPORATION. INC.
7:35 p.m. Mr. Haas reviewed the proposed preliminary plat of Pheasant
Meadows located west of Jay Street, which consists of 28 single family
urban residential lots. The developer is considering leaving the
existing house on Lot 7, Block 1, which would need a variance for side
yard setback from the south property line. If It remains, the
Building Department will require the house to be brought up to code.
The other two existing buildings will be removed. The drainage is
being reviewed by the consulting engineer, which wil I be done
according to the plan agreed to by Andover and Coon Rapids. Mr. Haas
stated the construction of Commercial Boulevard by the City may affect
the parcel immediately north of this one. Mr. Carlberg stated the City
Council will be discussing the location of Commercial Boulevard at the
June 2, 1992, meeting.
Mr. Haas stated the intersections to Jay Street will depend on the
future development to the east and the location of Commercial
Boulevard. The recommendation has been to close off Jay Street such
that the commercial and residential traffic do not mix. According to
the ordinance, KIldeer south would be a temporary cul-de-sac, but
134th and Martin would not be.
The hearing was opened for public testimony.

Kurt Carson. Hokanson Development - stated they will develop this
property in conjunction with the Hurst property. They have signed the
purchase agreement on the Hurst property and wil I grade the two
properties at the same time, but it will be developed as two plats
because of the liability.
Jerrv Windschitl. 3640 152nd Lane - owns the property immediately
south of the proposed plat. With this plat as proposed, the street
alignment from his property to match Kildeer is about 20 feet off.
The alignment was off more than that; however, Mr. Carson made some
adjustment on this plat; and he went into detail as to why the two
streets do not match. Mr. Windschitl stated he would prefer to see
Kildeer as a cul-de-sac in the Pheasant Meadows plat, which could be
done without losing any lots and which would completely separate this
plat from his own. He and the owner of the parcel Just south of him
plan to come in with a Joint plat for that area. One other concern was
that of being able to obtain FHA financing on his plat if it is
connected to those Just above him and those plats are denied FHA
financing.

One other point made by Mr. Windschitl was that if the Hurst property
is not developed for some reason, the Pheasant Meadows plat has only
one access to the west, or through his property to the south if
Kildeer is required to extend to the south. He felt it would be
better to get some assurance that the Hurst property will be platted
simultaneously. Another thing that could hold up the development of
the Hurst property is the alignment of Commercial Boulevard, as it may
impact the development proposal as it is now laid out.
Don Boeke. 13414 Jav Street - didn/t want the purchase and
development of his property to be held up with having to wait for a
decision by the Council on Commercial Boulevard. Mr. Haas hoped that
all property owners in that vicinity would be able to meet and agree
on the future development of that area. Commissioner Apel pointed out
that the City will work with everyone for the development of the
entire area. However, if Kildeer is extended to connect with Mr.
Windschitl/s future plat, the traffic flow through Pheasant Meadows
would not be as dependent on what happens to the Hurst property. The
Commission discussed the effects of Commercial Boulevard upon the
Hurst property.
Mr. Carson - stated the plat is exactly what was shown on the master
plan for this area. He did shift Kildeer, but he didn/t realize it
would still be 20 feet off from what Mr. Windschitl is proposing to
, the south. Mr. Haas felt it would be preferable to have Kildeer extend
,/ to the southern plat, as it is desirable to be able to move about and
blend the neighborhoods rather than have them exist as separate
entities.

addItIonal schools, etc. The CommIssIon felt most of the concerns
related to the plat Itself, suggestIng he raIse them agaIn when the
next Item Is beIng consIdered.
Darrel Stern. 1653 Andover Boulevard NW - dIdn't know the dIfference
between R-4 and R-3. Mr. Carlberg revIewed the lot sIze dIfferences.
Carol Christopherson. 1703 Andover Boulevard - asked if the sewer
and water wIll affect her property, as the prelImInary plat shows the
street going rIght next to her garage. She Is concerned about
assessments and cost to her. The CommIssion explaIned the rezoning
does not affect on her property. Questions relating to sewer and
water are more appropriately addressed with the prelimInary plat.
Chairperson Dehn asked for a motion to close the public hearIng.
MOTION by Apel, Seconded by Jovanovich, to so move. Motion carried
on a 6-Yes, i-Absent (McMullen) vote.
Commissioner Janak felt that some of the concerns raised by the
~_/ resIdents may be relevant to the rezonIng and should be addressed at
this tIme such as the traffic. Once it Is rezoned to R-4, the traffic
conditions wIll be created that are greater than the current 2.5-acre
lot sIze requIrement. Mr. Carlberg stated the proposed plat has only
one access to the west to Lund's Evergreen Estates. All other
accesses are onto county roads. ChaIrperson Dehn stated due to the
proximity of the property to the exIstIng urban area, the fact that
sewer and water wIll be available, and because this is consistent with
the City's Comprehensive Plan for growth, the rezonIng is approprIate.
Commissioner Pease also noted that this is the request of the owner
and It meets all of the CIty's crIterIa for a rezonIng.
The CommIssion also explaIned to those present how the R-4 zoning
differs from the existing zone. Mr. Carlberg explaIned where the sewer
and water lInes wIll be enterIng the plat, indIcatIng there would not
be a dIrect benefit to Ms. ChrIstopherson's property at this time.
MOTION by Peek, Seconded by Apel, that the Andover Planning and
ZonIng CommissIon recommend approval of the rezoning of ContInental
Development Corporation, Inc., to rezone property to be known as
Plnewood Estates from R-l, single famIly rural, and R-3, single famIly
suburban, to R-4, single family urban per the legal description In the
Staff report and generally located north of Andover Boulevard NW and
west of Hanson Boulevard NW and presently known as Santa's Tree Farm.

The Planning Commission finds the proposed rezoning meets the crIterIa
establIshed In OrdInance 8, SectIon 5.03(B). A public hearIng was
held and there was one comment In opposItion. Motion carrIed on a

PUBLIC HEARING: PRELIMINARY PLAT - PINEWOOD ESTATES. CONTINENTAL
DEVELOPMENT CORPORATION. INC.
8:48 p.m. Mr. Haas reviewed the proposed preliminary plat of Pinewood
Estates which consists of 174 single family urban residential lots.
The plat has been modified slightly from the sketch plan, in that one
of the cul-de-sacs has been removed. Variances are required for Block
8, Lots 23 and 27 for lot depth. The developer is working with TKDA
regarding the drainage, which will be handled on site without
additional runoff to other properties. The City has received a letter
from School District No. 11 agreeing with the access being provided to
Andover School. Anoka County sent a letter regarding accesses to the
county roads and berming. The Park and Recreation Commission has
recommended cash in lieu of land for park dedication because of the
close proximity of the school and potential park area to the west,
Lund's Evergreen Estates park and the City Hall park.
Chuck Cook. Continental Development Corporation - has had this
property under contract for over six years. He addressed some of the
questions raised by the residents earlier relating to traffic
requirements and accesses from the plat.
/ Dave Leindecker. 14570 Martin Court - stated the bal I field in the
Lund's Evergreen Estates park is used, but the parking is not
adequate. He was concerned with the additional traffic coming through
when cars are parked on both sides of the street for bal I games. He
wondered if this ball field would be eliminated if others are built
west of the school. What is the plan for a park there? Mr. Haas
didn't know what would happen to that bal I field. He recommended
those concerns be directed to the Park and Recreation Commission.
Mr. Cook - continued that sewer will come in from Andover Boulevard
between two lots at a depth of about 25 feet. Laterals will be used to
service the interior lots. There will be no assessments to the
abutting properties for those utilities. All drainage will be
contained within the plat with internal ponding to regulate the
outflow. There wil I be no assessments to abutting properties for
storm drainage improvements.

Several residents expressed many concerns about the storm drainage and
its effect on their properties and the wetlands, questioning the
claims that the water to the ponding to the southeast will not affect
the abutting properties. Mr. Cook went into detail on how the
drainage will be regulated with catch basins and piping so the water
level will not be raised in the abutting properties and wetlands. He
is working with TKDA and the Coon Creek Watershed within the
parameters of the regulations for wetlands. About two feet will be
excavated from the pond in the southeast corner to get the ponding
capacity needed in a 100-year event. He assured the residents and the
Commission that according to the engineers, the water will leave his
property at a rate not any faster than it does today.

Dave Hefner. 14719 Linnet NW - stated when he moved there, the
development had a park, which has been very nIce. With 174 new homes
being put in, he felt It Is strange that they do not have their own
park. Plus they wIll be driving out to Crosstown on 148th, past cars
parked on both sides of the street during ball games. It can be dealt
with now, but he wondered what it wIll be like with 300 more kIds. He
asked about sidewalks along Hanson Boulevard.
Mr. Cook - stated he has no plans for them. The children will walk
to the elementary school through the middle of the plat and access by
the entrance provided from within the plat. He also stated that the
Park and Recreation Commission and City has been of the opinion to
take cash in lieu of land in this development, typIcally to be used to
improve nearby parks. He also referenced the land the CIty already
owns in the vicinity. The CommIssion suggested the residents may wish
to address the Park and RecreatIon CommIssion about their concerns
with the Lund's Evergreen park.
Carol Christopherson. 1703 Andover Boulevard NW - asked about the
placement of the sewer and the road going into the plat.

Mr. Cook - reviewed the routing of the sewer line. He explained they
gave a lot of thought to her garage when proposing the placement of
Ibis Street. It appears the garage is 10 to 15 feet from the property
line; and with the rIght of way, the actual road wII I be about 30 or
more feet from the garage. With the stable solIs there, he did not
antIcIpate any problems. In response to a question from a resident,
Mr. Cook stated the trees from the right of ways wIll be removed by
the CIty and put In the parks. Others wIll be avaIlable to anybody
who wants to remove them; however, there Is only a two- to three-week
period in whIch they can be removed. He will also have varIous
covenants on the lots. He expected the prIce range of the homes to be
from $90,000 and hIgher in the heavier wooded and cul-de-sac areas.
Mr. Hefner - asked if he would be able to replace his electric
fence, which is on his property line abutting this plat, with a
permanent fence. The Commission recommended he communicate with his
neighbors as to what he plans to do. Fences can be placed on the
property lines, though he may wish to move it back one or two feet.
Ms. Christopherson - noted the increasing problems they are having
along Andover Boulevard of "mail box bashing" and was concerned about
an increase in vandalism with the more homes and people behind her.
Will there be an increase in polIce patrols? The Commission pointed
out some of the problems the CIty faces as it grows so rapidly and
noted the CIty CouncIl is aware of when additional patrols are needed.
However, over the last several years, those types of crimes have
lessened in the City. They discussed the City's future growth and
development with the residents, explaining the City's five-year plan
of development.

Mr. Leindecker - stated he moved out here to a more rural setting,
but this development changes that. Now he found out there are plans
to widen Hanson Boulevard to four lanes. He asked about signals along
Hanson Boulevard. Mr. Haas stated that will depend on when warrants
are met. The streets are full intersections. The traffic volumes
will determine when and where signals are needed. The development
wil I also be signed according to Minnesota Traffic Control
regulations. The speed limit within the plat will be 30 mph.
Commissioner Peek suggested that a pathway be provided from the
cul-de-sac for pedestrian traffic to the north so the children do not
cut across the yards as the shortest route to the school and parks.
It would make the north/south flow considerabiy better. The worst
thing that could happen is to have the children walk on Hanson
Boulevard to get to school. Mr. Cook stated he has not given that
any consideration, but he didn't feel the children would have any
reason to go out to Hanson Boulevard.

MOTION by Jovanovich, Seconded by Apel, that the Andover Planning
and Zoning Commission recommend to the City Council approval of the
preliminary plat of Pinewood Estates being developed by Continental
Development Corporation located in the southwest quarter of Section
27, Township 32, Range 24, Anoka County, per the Resolution presented
by Staff. There was a public hearing and there were concerns on the
park, park parking lot, traffic, the wetlands, and pedestrian trails.
Motion carried on a 6-Yes, i-Absent (McMullen) vote. 9:50 p.m.
The Commission recessed at this time; reconvened at 10:00 p.m.
PUBLIC HEARING: AMENDMENT TO ORDINANCE NO.8. SECTION 8.08. SIGNS
10:00 p.m. Mr. Carlberg reviewed the phone survey of other cities
regarding area identification signs. As a result, the Staff felt it
is reasonable to have an area identification sign located on each
vehicular access to a subdivision not to exceed 32 square feet in
size. If the Commission agrees, Section 8.07 of Ordinance 8 should be
amended.

The CommissIon dIscussed the results of the phone survey and possible
changes to the CIty's sIgn ordInance. Mr. Carlberg suggested the
possibIlity of amendIng OrdInance 10 to include the area
identIfIcatIon sIgnage as a part of the prelimInary plat process.
ChaIrperson Dehn felt that the IdentIfIcatIon sIgns make the
neIghborhood more sophistIcated and gIves a sense of IdentIfIcation.
Chuck Cook. Continental Development - stated what motivates him on
sIgnage Is partly for marketing, but also to establish a sense of
community in the subdIvision. He believes it does have a
psychological value of creating communIty.
CommIssioner Peek dIdn't wIsh to see an area IdentIfIcatIon sIgn on
every lIttle subdIvIsIon, suggestIng the mInImum acreage be Increased
from fIve acres to In excess of ten acres. He does not support
anythIng more than one sIgn per frontage, which he feels Is
approprIate for the establishment of the neighborhood feeling. He
also felt the maxImum 32-square-foot sIze Is suffIcIent, and he has no
problem wIth the gate-type entrance sIgns. PhasIng should not be
considered development; signs should be based on the total plat.
CommissIoner Jonak agreed.

There was some debate as to whether "frontage" should be on major
roads or can be on cIty streets as well, poIntIng out dIfferent
scenarIos for each posItIon. Another questIon Is how would It be
handled for those plats that do not have frontage on any street such
as the Meadows of Round Lake. CommIssIoner Peek felt frontage relates
to any street. There Is no frontage for the Meadows of Round Lake.
Mr. Cook - believed it would be appropriate to have a monument In
that case. It Is difficult to put In rules that apply to every
situatIon.
Chairperson Dehn asked for a motIon to close the public hearIng.
MOTION by Peek, Seconded by Jovanovich, to so move. MotIon carried
on a 6-Yes, 1-Absent (McMullen) vote.
MOTION by Peek, Seconded by JovanovIch, to dIrect Staff to prepare
an amendment to the ordInance and brIng it back to the Commission
putting the minImum acreage of more than ten acres, one sign per
frontage on a street for the whole plat, same square footage --
whether It is one sign or two as in a gate sign, as long as the total
does not exceed 32 square feet. And amend Ordinance 10, that Special
Use Permit be required at the time of platting to IndIcate the
location of the sign.

DISCUSSION: CommissIoner Peek stated the intent is this will affect
the plattIng of developments only, not area identIfIcatIon for
churches, schools, etc. Motion carried on a 5-Yes, 1-No (Apel),

DISCUSSION - REVOCATION OF SPECIAL USE PERMIT (MINING). MARVIN
BENSON. 14817 NW ROUND LAKE BOULEVARD

M.. Ca.lberg explained M.. Benson has requested the Special Use Permit
to conduct mining activities on his p.operty be revoked. Staff as
determined the property is classified as a Type 3 wetland and found
that the fil ling of the p.operty and the wetland would .equire
mitigation and .eplacement. In addition, the.e is no .eco.d of eve.
.eceiving the escrow secu.ity which was a condition of the Permit.
The land would be left as is.
MOTION by Apel, Seconded by Jovanovich, that we recommend to the
City Council that the Special Use Permit granted to M.. and M.s.
Benson be revoked at the .equest of the holde. of the pe.mit. Motion
carried on a 6-Yes, 1-Absent (McMullen) vote.

116. She believed it is the Council's intent to continue to pu.sue
that exit.
