Consider Application for Schedule Use of Recreational Facilities/Oak View Community School Date: April 16, 2009 INTRODUCTION This item is in regard to considering an application for scheduled use of recreational facilities from the Oak View Community School. DISCUSSION Attached is the application from Oak View Middle School. They have requested to use Field #7 at City Hall in April (Monday - Friday) and in May (Monday - Thursday) from 3:10 pm to 5:10 pm. City staff did contact Andover Baseball Association and did not see this as a problem as they do not start until 5:45 pm. The goal of the Park and Recreation Commission in scheduling is to allot the limited number of recreational facilities in a fair and equitable manner, using compromise when necessary to accommodate the maximum number of requests possible. Facility requests submitted by the due date with this completed form will be given the highest priority. Subsequent requests will be filled on a first-come, first-served basis if facilities are available. The sequencing of scheduling will be considered with City youth associations having first priority. Consider Park Dedication Requirements/Woodland Crossing 2nd Addition DATE: April 16, 2009 INTRODUCTION This item is to consider the park dedication requirements for the proposed preliminary plat for Woodland Crossing 2nd Addition. DISCUSSION A copy of the preliminary plat is in your side pocket of your packet. The location of the proposed development is located on the west side of Jay Street NW. The developer (Woodland Development) has made a preliminary plat submittal to replat 5 existing single family lots and relocating lots lines create 1 additional lot for a total of 6 lots and which will be done as a Planned Unit Development (PUD) similar to what has been done on the east side of Jay Street NW. Since only one new additional lot is being- created, it is recommended to accept cash in lieu of land for just the 1 new lot. ACTION REQUIRED The Park and Recreation Commission is to consider the Woodland Crossing 2nd Addition preliminary plat and recommend direction as to the park dedication requirements to the City Council. Consider Request to Relocate Security LightlNorthwoods East Park DATE: April 16, 2009 INTRODUCTION The Park and Recreation Commission is requested to consider a request from Steve. Johnson to install a security light near the existing parking lot. DISCUSSION Attached is an e-mail from Steve Johnson with the request. Apparently the neighbors are having issues with vehicles parking after hours in the parking lot. As you can from e-mail to Mr. Johnson, I have suggested that if they are having issues parking after 11 pm, they are requested to contact 911 immediately so that they can send out a deputy or CSO. Just as a reminder, the parks are officially close at 11 pm. Note: There is an existing security light located in the northwest corner of the park but is not in a very location. The light has been there for quite some time. Currently it does not shine a lot of light on the playground and certainly does not provide any light on the parking area. Attached is a proposal from Connexus Energy as for the cost of a new light which is about $3311. The existing light in the northwest corner of the park will not be able to be used as the light is mounted on an existing telephone pole. Budaet Impact As mentioned in the e-mail to Mr. Johnson, currently no funds are available. As mentioned to the Commission over the past couple months, all park dedication expenditures are on hold. Could the light be moved? Answer-Sure it could be moved but the cost of relocating the light would be a cost that the city would have to pay for. Would the gain anything by moving the light closer to the parking lot? Sure some additional light would spill on a portion of the parking lot but some areas could still end up being dark. Does the city have the funds set aside to relocate the light? Answer-No funds have not been set aside for this but you certainly can request the Park Commission to see if they are interested in spending park dedication funds to move the light. If they are interested in relocating the light, I certainly can request Connexus Energy to price this out and bring it back to the Commission for their consideration. Please let me know if you want me to pursue this with the Commission. If your having problems with individuals parking in the park after 11 pm, please call 911 immediately so that they can send a sheriff's deputy or CSO out to see what is going on. Minnesota Statutes, chapter 448. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [448.581 PARKS. TRAILS. AND RECREATIONAL FACILmES; 1.7 FINANCING OPTION. 1.8 -, Subdivision 1. Definitions. (a) The te11DS in this subdivision apply to this section. 1.9 (b) "Facilities" means parks. playgrounds, walkinl2: or biking trails. and recreational 1.10 complexes. including sportinl2: fields. including hut not limited to. softball. baseball. 1.11 socc.er, football. ice hockey. and tennis courts. 1.12 ( c) "Fund" means a dedicated account in which revenues raised under this section 1.13 are kept separate from all other governmental unit funds. 1.14 (d). This authority is in addition to all other powers with reference to facilities 1.22 otherwise granted by law or by charter of the governmental unit. Financin2. To pay the cost of building, constructing, reconstructing, 2.4 !Wairing, enlarging, improving. or in any manner obtaining the facility or any portion of it 2.5 and of obtaining and complying with any permits required by law, the governmental unit 2.6 may levy a sPecial assessment to pay the cost of the facility. The proceeds of the special 2.7 assessment must be kept in a dedicated account and used only to pay for such facilities 2.8 allowed in the adopted plan. The assessment may be assessed equally on all property or 2.9 assessed proportionally against the value of the property. 2.10 Subd. 4. Collection of assessment. On or before October 15 of each year, the 2.11 .l1;oyernmental unit shall certify to the county auditor anv and all anticipated expenditures 2.12 under the adopted plan for the next vear, minus anv unspent funds from the previous 2.13 TI;.ar. The amount certified must be collected and enforced in the manner provided for the 2.14 collection and enforcement of a special assessment against the property within the area 2.15 governed by the governmental unit 2.16 Subd. 5. LocaloDtions. To establish the fund, the goyernmental unit must either 2.17 adopt the plan by ordinance after a public hearing on the plan or submit the plan to a vote 2.18 by the registered voters within the governmental unit, with the plan being made available 2.19 to the public. If the plan is submitted to the voters, a maioritv of those voting must vote in 2.20 the affinnative to adoPt the plan. The vote may be for a continuous assessment for the 2.21 tenn of the plan or for a specific time frame shorter than the full term of the plan. 2.22 Subd. 6. Excess net revenues. If at the end of a fiscal year there are excess 2.23 revenues. the excess revenues must be deducted from the next year's special assessment. 2.24 If there are no other assessments reQuired for the plan, excess revenues may be kept 2.25 within the fund for maintenance of facilities already developed or pledged to any future 2.26 plan that may be developed and adopted. 2.27 Subd. 7. Other revenue sources. This section does not preclude the e:overninSl unit 2.28 from using other financing instead of Or in addition to the powers authorized in this section. 2.29 EFFECTIVE DATE. WWW.CI.ANDOVER.MN.US TO: Todd Haas, Assistant Public Works Director FROM: Jim Dickinson, City Administrator ~ SUBJECT: Administrator's Report DATE: March 9,2009 As requested, I have reviewed the attached proposed language for Parks, Trails and Recreational Facilities Financing legislation and offer the following comments: - The definitions are in line with other Minnesota State Statutes. - The "Authorization" section reference to "both inside and outside the corporate limits" should be clarified as to intent. A City would be hard pressed to substantiate why they would be using a "special assessment" to fund a project outside the City corporate limits, but if it is a regional center and the city is guarantee proportionate usage of the facility, there maybe be merit. -The "Authorization" section refers to using special assessment funds to "operate" a facility. The nature of a special assessment is to improve or enhance property not for operations, that's generally what taxes or fees for service are for. -A special assessment is intended to enhance or preserve market value and as such is not viewed as a property tax and not eligible to for a deduction on an individual's income tax return. Overall: Implementation of the proposed legislation does not appear to over onerous and the ongoing accounting of the funds is pretty straightforward. The proposed legislation appears. to be an attempt to provide another tool in the tool box for developing Parks, Trails and Recreational Facilities, but one should keep in mind if this proposed legislation is in the spirit of what a "special assessment" should be used for and if there may be any unintended consequences. ---------- C I T Y o F NDOVE 1685 CROSSTOWN BOULEVARD N.W. . Consider Improvements to Hawkridge Parkl09-18, cant. Date: April 16, 2009 INTRODUCTION This item is in regards to considering the improvements that should be made in the redevelopment of Hawkridge Park. DISCUSSION The City Council will be discussing if the hockey rink and free skating is to stay at Hawkridge Park on Tuesday, April 21st. Once the staff receives direction from the City Council if the rink stays or goes away, staff will begin preparing a couple layouts of the park. It sounds from the Park Commission and the neighborhood that the existing ball field is not a big loss and that preparing a layout with soccer fields is the way to go at this point. Just so you know it probably take a month or two to prepare the layouts, as we will need to meet with North Metro Soccer Association to see what their needs are. Update of Hidden Creek East Park Meeting with Area Residents. DATE: April 16, 2009 INTRODUCTION This item is just an update in regards to the Hidden Creek East Park meeting with area residents. DISCUSSION As previously mentioned to the Park Commission at the last meeting, city staff will be meeting with the property owners to discuss possibilities of creating more natural areas around the edges of the park. (On-Going). . Andover Station North Ball Field Facilitv (DroDertv south of the old landfill) - Things are moving along. The floor tiling is now completed. The bathroom partitions should be done sometime this week. It appears that everything is near completion and an occupancy permit could be issued by the end of this week. Just as a reminder, the grand opening of the ASN ball field facility is scheduled for Thursday, April 30th at 6pm. Please plan on attending. Chairman Butler will be speaking at the opening ceremony. . UDdate of Park Dedication ImDrovement Fund QuarterlY ReDort- Item is on the agenda. . ComDrehensive Plan (Park & ODen SDace ChaDter) -The city staff has been down to Metro Council staff and the planning department looking at the possibility the comprehensive plan would be approved most likely in May sometime. . Citv Hall CamDus Hockev Outdoor Hockey Rink -The trees have been cut and stumps are being removed from the site this week and next week. !he engineering staff is currently working on a grading and drainage plan as we speak. The plan stills needs approval by the Coon Creek Watershed District which will most likely occur at the end of April. We are still looking at grading the site in early May and site to be graded by the middle to the end of May. Note: We have met with Tony Howard, AHYHA President, to see where they are at as far the purchase of the rinks. To date the rinks have not been purchased. . Hawkridae Park -Item is also on the regular agenda. . Rose Park - The Park Commission has agreed to meet with neighborhood informally to discuss the future redevelopment the park that could potentially include a couple hockey rinks and a free skating rink. The staff is looking at scheduling this May to meet with the neighborhood. . Hidden Creek East Park - The Public Works staff has been approached by a few property owners about the possibility of providing natural areas and/or tree and shrub plantings within the park. The staff will be meeting with the property owners adjacent to the park on Thursday, April 16th to discuss this possibility. Item is also on the agenda. Eveland Fields Scoreboards - As directed by the Finance Department, the city cannot make the commitment at this time until sufficient funds are available to help in purchasing the scoreboards.
