PLANNING AND ZONING COMMISSION MEETING - MARCH 10. 1992
MINUTES
The Regular Bi-Monthly Meeting of the Andover Planning and Zoning
Commission was called to order by Chairperson Bonnie Dehn on March 10.
1992. 7:32 p.m., at the Andover City Hall, 1685 Crosstown Boulevard
NW. Andover. Minnesota.

APPROVAL OF MINUTES
February 25, 1992: Correct as written.
MOTION by Pease, Seconded by Jovanovich, to accept the February 25,
1992, Minutes as presented. Motion carried on a 4-Yes (Dehn,
Jovanovich, Pease, Peek), 3-Present (Apel, Jonak, McMullen).
PUBLIC HEARING: PRELIMINARY PLAT - CEDAR HILLS 2ND ADDITION -
WOODLAND DEVELOPMENT
7:35 p.m. Mr. Haas reviewed the proposed preliminary plat of Cedar
Hills 2nd Addition located in the northwestern portion of the City.
The property is zoned R-2 Single Family Estate. Because It Is outside
the MUSA, 2.5-acre minimum lot sizes are required and rezoning will
not be necessary. The plat consists of 14 single family rural
residential lots. He also summarized the recommendations of the
Andover Review Committee on a variance for 178th Lane to vary from the
one-percent grade, The City will require bluetop elevation staking at
25-foot intervals to eliminate any pondlng on the street. The Park
and Recreation Commission is recommending cash in lieu of land for
park dedication.
The public hearing was opened for public testimony.
Mr. Haas also explained that the upgrading of CoRd 58 is under the
county Jurisdiction and will not affect the variance. He has received
a letter from the Anoka County Highway Department requesting no
accesses onto CoRd 58, which is also Tulip Street.
Commissioner Peek asked where the monument sign for the plat will be
located.

PUBLIC HEARING: AMENDMENT TO ORDINANCE NO.8. SECTION 8.08 - EXEMPT
PAVING OF CITY PARKS

7:44 p.m. M~. Carlberg explained the wording for the proposed change
to the o~dinance came out of the Joint meetIng of the Planning and
Zoning Commission and Pa~k and Rec~eatIon Commission on January 28,
1992.
The public hearing was opened. There was no pUblic testimony.
MOTION by Apel, Seconded by McMullen, to close the public hea~ing.
Motion ca~ried unanimously.
MOTION by McMullen, Seconded by Apel, that we accept the addItion of
Item (b) to Section 8.08 (E)(6) of O~dinance 8, CIty parks shall be
exempt from the paving ~equIrement unless deemed necessa~y by the City
Council. Fo~wa~d the recommendatIon to the CIty Council. A public
hea~ing was held on March 10, 1992, and there was no opposition.
Motion carried on a 6-Yes, I-No (Peek) vote. Commissioner Peek felt
the City should lead by example. 7:48 p.m.
PUBLIC HEARING: MINIMUM HOUSING STANDARDS CODE AND RENTAL HOUSING
ORDINANCE
7:48 p.m. Mr. Carlberg explaIned the notIces were publIshed for the
publIc hearIng prIor to the last PlannIng CommIssIon meeting, and that
is why it is on the agenda as a publIc hearing. After a brIef
discussion, the CommIssion generally felt that the public hearing
should be tabled to the next meeting and to review the p~oposed
ordInances In greater detail.

MOTION by Apel, Seconded by McMullen, to table the public hearing
until the next meeting and to keep the item on the table for
discussion this evening. Motion carried unanimoUSly. The Commission
suggested the item be advertised again in the hopes of obtaining
public input at the hearing.
Mr. Carlberg stated he contacted several other cities with similiar
ordinances and found they retained all the details in the ordinance
even though it makes for a lengthy document because it enabled them
to give one document to rental property owners which included all the
information needed. Plus there is the concern of it not being
retroactive. The Uniform Building Code is applicable to new
construction; whereas rental property is generally older buildings.
Commissioner Peek suggested general reference be made to Andover
Building Code, and define what that is in the definition section as
the current model code adopted by the City of Andover.

Proposed Ordinance 99:
Mr. Carlberg stated both Brooklyn Park and Brooklyn Center licenses
rental single family homes no matter what the time period is of the
rental. However, they do not enforce the posting of the license for
single family homes. They require a license to be on file with the
City and to be in the possession of the property owner.
Commissioner Jovanovich reviewed her research of the licensing and
regulating of rental housing in Brooklyn Park. One problem they have
is keeping track of the property owners when buildings are sold. They
also allow renting to two borders in single family houses without a
license. Mr. Carlberg stated Andover's ordinance is the same.
Commissioner Apel felt rental licenses should not be transferable, as
the City would want to deal with the new property owner.
Commissioner Jovanovich also found that the majority of the rental
property owners do comply with the ordinance. The ordinance also
helps them to deal with undesirable tenants.
Section 5, Subdivision 1. The Commission questioned whether the City
can legally require the responsible party to reside in Anoka County.
Mr. Carlberg stated he will check with the City Attorney on this item.
Section 9. The Commission felt the section should be changed since
the posting of the license will not be required in single family
" residences.

Section 13. Mr. Carlberg wondered if the enforcement of this section
should be with the Building Official, which he used because the
Building Official is used throughout the ordinance, or with the City
Administrator since this section may deal more directly with the Anoka
County Sheriff's Department. No decision was made.
Proposed Ordinance 100:
Page 6, Subdivisions 12, 13 and 14. The Commission discussed whether
the owner of the rental dwelling should be responsible for the Items
noted (removal of snow and ice, maintenance of driveway and parking
areas, exterior lightIng), some feeling that is not always possible
for someone renting a single family home. It was then agreed that the
property owner is ultimately responsible, even If those items are
assigned to the tenant. The SubdIvIsions are to remain unchanged.
No further changes were recommended. Mr. Carlberg stated those
changes will be made prior to the publIc hearing, whIch was tabled to
the March 24, 1992, PlannIng CommIssion meeting.

PUBLIC HEARING:. SPECIAL USE PERMIT - CITY OF ANDOVER - CONDUCT
RECYCLING RELATED ACTIVITIES - 1685 AND 1785 CROSSTOWN BOULEVARD NW
8:13 p.m. Mr. Carlberg reviewed the request by the City of Andover to
conduct sales and other related activities associated wIth the
Andover Recycling Day at the CIty Hall/Recycling BuildIng sites. The
City wIll be inviting local nurseries to conduct tree sales. The
nurseries will have to be certified by the DNR and Department of
Agriculture to make sure the species of trees sold are approprIate.
The SpecIal Use PermIt will be on-going, as they hope to contInue thIs
in the future. Ordinance No.8, Section 7.03 allows the sellIng of
ChrIstmas trees in resIdential areas by Special Use Permit, and Staff
has interpreted It to mean a permit is also requIred for the tree sale
and other related activities assocIated wIth Recycling Day.
The hearing was opened. There was no publIc testimony.
MOTION by Apel, Seconded by JovanovIch, to close the public hearing.
Motion carried unanimously.

MOTION by Jovanovich, Seconded by Apel, recommend approval of the
Special Use Permit requested by the City of Andover to conduct sales
and other related actIvities assocIated wIth the RecyclIng Day, the
legal description as listed on the notice of the public hearIng. It
meets the applicable OrdInance No.8, SectIon 5.03, whIch regulates
Special Use Permits, outlining conditions and procedures. A publIc
hearIng was held and there was no opposItIon. It meets all the
criteria for granting a Special Use Permit. Subject to an annual
revIew. MotIon carrIed unanimously. 8:24 p.m.

SKETCH PLAN - PHEASANT MEADOWS
Mr. Cariberg reviewed the proposed sketches of Pheasant Meadows
located east of Jay Street. The proposal was submitted by Hokanson
Development. Inc. Though the sketch plan Is an overall concept of
that entire area, which involves three or four owners. he thought the
immInent development Is for the Boeke property. He was not aware of
an agreement by the property owners ImmedIately to the north. The
Andover RevIew Committee is recommendIng sketch B with the "T"
intersection. or have 134th Avenue constructed as an east/west street
directly to Jay Street. There Is an existing house on the parcel
whIch makes it more dIfficult to connect with Jay Street from the
Boeke property.

There was a lengthy dIscussion on some of the concerns havIng to do
wIth the hIstory of this area of the City. One question was on the
alignment of 134th and Jay Street and how It affects the property to
the east. CommissIoner Peek didn't necessarIly agree with runnIng
134th straight through to Jay Street. In the past there was some
concern with the property north of Boeke's because of its proxImity to
the Junkyards. The CommissIon also asked that the hIstory of the area
be reviewed more closely before decIdIng on the most appropriate
development of the properties and that the intent of the developer be
clarified as to what is proposed for development at this time.
Mr. Carlberg stated he wIll bring the comments and concerns to the
City Council when they review the sketch plan.
OTHER BUSINESS
Mr. Carlberg invited the Commissioners to participate in the Recycling
Day on April 25, 1992.
There being no further business, Chairperson Dehn declared the meeting
adjourned. 8:50 p.m.
