MINUTES
The Regular Bi-Monthly Meeting of the Andover Planning and Zoning
Commission was called to order by Chairperson Bonnie Dehn on January
28, 1992, 7:30 p.m., at the Andover CIty Hall, 1685 Crosstown
Boulevard NW, Andover, Minnesota.

MOTION by Apel, Seconded by Jovanovich, to accept the Minutes as
corrected. Motion carried on a 5-Yes, 1-Present (McMullen>, 1-Absent
(Pease) vote.
PUBLIC HEARING: PRELIMINARY PLAT. HOLMBERG ADDITION
7:32 p.m. Mr. Haas reviewed the preliminary plat of Holmberg Addition
being developed by Wayne Holmberg. The plat is located in the
vicinity of 170th and Ward Lake Drive, and will be developed to the
R-1 density of seven 2.5-acre single family rural residential lots.
The Andover Review Committee is recommending two variances. One for
lot width at the front building setback line of Lot 4, Block 1 because
of the City Council request to extend Magnolia Street south but not
north. The lot will still meet the building pad requirements and the
39,OOO-square-foot requirement for the septic system. The other
variance is for the two structures to remain on Lot 1, Block 2 along
with the home. The frontage of that lot will change from Ward Lake
Drive to 170th, creating the need for a variance on the setback of the
buildings.
Chairperson Dehn opened the hearing for public testimony.
Wayne Holmberq. owner and developer - stated he had not planned on
putting a monument sign at the entrance of the plat.
o Chairperson Peek questioned the difference in applying the denial of
bubbles in a 90-degree street proposed in a preliminary plat at the
last meeting to this plat on Lot 4, Block 1. Wouldn/t a variance on
lot frontage as proposed here apply to any 90-degree corner?

Mr. Haas explained in the other plat (Weybridge), the road could not
be extended along the lot lines because there would be too many roads
intersecting at one point. This particular lot would have met the
requirements, but a variance would then have been needed for lot size.
It is up to the Commission how it is handled. The City Council has
said one access to the adjacent parcel should be provided either north
or south and not create a permanent cul-de-sac at the end of 170th.
MOTION by Apel, Seconded by McMullen, to close the pUblic hearing.
Motion carried on a 6-Yes, l-Absent (Pease) vote.
MOTION by Apel, Seconded by McMullen, that the Planning and Zoning
Commission recommend to the City Council approval of the preliminary
plat submitted as the Holmberg Addition. A public hearing was held.
There was no opposition to it. It appears to adhere to the
Comprehensive Plan. It does not effect adversely the health, safety
and welfare of the citizens of the City. There are, however, a couple
recommendations of the Andover RevIew CommIttee to make note of:
)
1. The variance from Ordinance 8, Section 9.06(a)(3) on Lot 4, Block
1 for frontage.
2. Two structures will remain on Lot 1, Block 2. These two
structures will require a variance from from Ordinance 8, Section
4.05 f(l) and (2). The other two structures will be removed as a
part of the construction of the road.
Also add that the approval is subject to the review and approval of
the street plan profile by the City Engineer. The park dedication fee
is to be taken into consideration and met.
The developer and/or owner will be required to obtain all necessary
permits (DNR, U.S. Army Corps of Engineers, Lower Rum River WMO and
any other agencies which may be Interested in the site.)
Motion carried on a 6-Yes, l-Absent (Pease) vote. This item will be on
the February 18, 1992, CIty Council agenda. 7:47 p.m.
PUBLIC HEARING: AMENDED SPECIAL USE PERMIT - GRACE LUTHERAN CHURCH.
13655 ROUND LAKE BOULEVARD NW. ADDITION TO CHURCH

7:47 p.m. Mr. Carlberg reviewed the request by Grace Lutheran Church
to construct an addition to their church. The addItion is for
classrooms and office space. He noted the applicable ordInances and
criteria to be examined. The main concern is the anticipated traffic
conditions on adjacent streets and accesses to Round Lake and Bunker
Lake Boulevards because of the upgrading of those two roads.

The proposed addition will not increase patronage and therefore should
not increase the amount of traffIc onto those county roads. Staff
will be working with the county and the church when reviewing the site
plan to resolve the traffic situation. One proposal has been to
construct a road from 136th along the dental clinic building to Bunker
Lake Boulevard. The church has 138 parking spaces, which will be
sufficient since no pew space is being added.
Commissioner Apel stated in the past the residents of Chapman's
Addition were quIte concerned about the traffIc through their
development. Apparently they are not as concerned since they were
notified of this proposal. Commissioner Jovanovich felt there is a
need for a road from 136th to Bunker Lake Boulevard. The reason there
is a gate across the church access on 136th is because the neighbors
used to go out to Bunker Lake Boulevard through the parking lot.

The Commission had some concern about the number of parking spaces.
Mr. Carlberg stated based on the ordinance, there are sufficient
spaces already available, and this proposal will not increase the
patronage of the church.
ChaIrperson Dehn opened the hearIng for public testimony.
Charles Wold. recresentina Grace Lutheran Church - stated the
maxImum number of day care chIldren they can have is 30. They now
hold three services on Sundays, wIth the combined total of 370
parIshioners.
The CommissIon continued the discussion on the concerns of the traffic
patterns and the access problems of the church, though it was
acknowledged that those concerns are beyond the permit being
requested. Mr. Carlberg also noted that with the increased space, the
church wIll have to hook up to munIcIpal water and sprinkle the entIre
building.
There being no further public testimony, Chairperson Dehn asked for a
motion to close the public hearing.
MOTION by Apel, Seconded by Jovanovich, to so move. Motion carrIed
on a 6-Yes, 1-Absent (Pease) vote.

MOTION by Peek, Seconded by Jonak, The Andover Planning and Zoning
Commission recommends to the City Council approval of the Amended
Special Use Permit requested by Grace Lutheran Church to construct a
classroom addItion to the church located at 13655 Round Lake Boulevard
NW. PIN 32-32-24-42-0007 and 0009.

The Planning Commission finds the request meets the criteria
established in Ordinance No.8, Section 5.03, including: The use will
not be detrimental to the health, safety, morals or general welfare of
the community. The use will not significantly cause serious traffic
congestions or hazards. The use will not depreciate surroundIng
property. The use is in harmony with the Comprehensive Plan.
A public hearing was held. There was no opposition. The recommended
approval is based on the following conditions:
1. That the Amended Special Use Permit be subject to annual review
and site inspection by Staff.
2. The Amended Special Use Permit shall have a one-year sunset clause
as specified in Ordinance No.8, Section 5.03(D).
3. That the applicant obtain approval of the City for a site plan
review for the addition.

DISCUSSION - ORDINANCE NO. 44. JUNKYARD ORDINANCE
Mr. Carlberg explained the City Council has asked the Planning
Commission to review and discuss amending Ordinance No. 44, the
Junkyard Ordinance, as to the possibility of penalizing those
Junkyards who do not receive their Junkyard licenses in a timely
manner. He also gave the background regarding the problem of some
Junkyards not submitting applications in time to be licensed by
January 1, which is required by ordinance. In researching the matter
with other cities, he found most did not have the problem; however,
none have the large number of Junkyards that Andover has. He
recommended an amendment to Section 6.4 to charge a penalty for late
applications. No public hearing is required to amend the ordinance,
though the Commission may wish to hold one as a courtsey to the
residents.
The Commission discussed the problem and possible soiutions. It was
agreed that a penalty for late applications would be appropriate, and
suggestions for a penalty ranged from a flat amount to a daily penalty
up to a maximum amount. It was felt a penalty of $500 would not be
artibrary since that is the fine for a misdeamor when violating the
ordinance. Another suggestion was a $50 penalty per day for late
applications up to a maximum of $500.

Mr. Carlberg stated he will get a legal opinion on the proposals and
on how payment is to be collected. The item is to be brought back to
the Planning Commission for further consideration.

DISCUSSION - ORDINANCE NO.8. SECTION 8.07. SIGNS
Mr. Carlberg reported in researching the signs for the Hills of Bunker
Lake development, the identifIcatIon sign along 138th Lane has a real
estate sign permit issued In 1990. There Is no tIme limIt on the
permIt. There is no permit for the sign on the corner of Hanson and
Bunker Lake Boulevards. The sIgn on Crane and Bunker Lake Boulevard
and the one on WIntergreen have sign permits but no Special Use
PermIts. The Commission noted the sIgn on the corner is no longer
- there; however, there Is a sIgn on 139th. Mr. Carlberg stated he had
no documentatIon on that sIgn and wIll check on It further. The
developer has stated the Signs on 138th and 139th will be removed when
the commercIal area is developed.
The CommIssion dIscussed the number of signs that should be allowed
for any development. Mr. Carlberg was asked to look at the two-year
clause for real estate sIgns and at the possIbIlity of having those
signs removed that exceed that time period.

Commissioner Peek felt that the signage should be determined at the
time of the prelimInary plat, with one sign per plat allowed along
each major or arterial road. That signage would remain no matter how
many phases are developed or who the developments are sold to. He
felt the situations to be avoided are abusIng ordInances and turning
monument sIgns Into real estate signs.

The Commission discussed the placement of sIgns in various scenarios
of developments. It was generally agreed that some guidelInes need to
be established. Mr. Carlberg stated he wIll research other cItIes as
to how they handle signs in developments and in phasIng of
developments, whether a development is consIdered that whIch was
included in the preliminary plat or each phase of the development or
whether the size of a plat Is consIdered. He will fInd out how other
cities define "development".
OTHER BUSINESS
Mr. Carlberg reported the Metropolitan CouncIl Staff has asked the
City to spend $7,500 to run a model regarding transportatIon withIn
the CIty. He has said the City cannot afford to do so. The Met
CouncIl has also asked the CIty to address prIvate treatment
facilitIes; however, at the present tIme they are not permitted.
Staff is addressIng those concerns.
