(Gamache absent) 27 28 29 APPROVAL OF MINUTES 30 31 December 2, 2008 Regular Meeting: Correct as amended 32 33 Commissioner Trude stated on Page 1 line 41 revise to" Commissioner Trude stated she did not want 34 to impair the businesses ability to attract customers. (Gamache absent) Andover Economic Development Authority Meeting Minutes - December 16, 2008 Page 2 1 2 Commissioner Trude asked why the Voting Resident Members were called that, instead of 3 Commissioners and would like it changed. 4 5 Motion by Trude, Seconded by Orttel, Change "Voting Resident" to "Commissioner". Motion 6 carried unanimously. (Gamache absent) 7 8 PURCHASE AGREEMENT/LETTER OF INTENT/PROGRESS REVIEW 9 10 Mr. Dickinson discussed the status of economic development activities related to Andover 11 Station North. He said that Laura Heppner of Mr. T's Dry Cleaners may have an investor partner 12 and more information will be forthcoming in the future. Blue Fin Pool & Spa construction is 13 going good walls are up and they are working on the roof. 14 15 Mr. Dickinson stated that nothing has happened recently with Moose & Co. Grill House. Fees 16 will go up in 2009, staff needs to meet with them and find out the status. There maybe some 17 legal action against one of the partners. Construction loans were approved, but the long-term 18 financing may be an issue. 19 20 Mr. Dickinson discussed the monument signs and provided an example to the EDA of how staff 21 would like to market the area by promoting the blank space on the signs with "Space Available" 22 signage. Commissioner Trude stated that she thought this was a good idea and that some of the 23 other businesses, close to Bunker, may be willing to pay to advertise on the sign. 24 25 Mr. Dickinson discussed the Kwik Trip Convenience store/car wash letter of intent to purchase 26 Eddy's Auto Body has expired and Kwik trip is currently renegotiating the purchase ofthe 27 property, at a lower cost. Eddy's has been talking with Kottke's on a possible relocation site. 28 29 Commissioner Orttel asked if Kwik Trip has thought of another site. Mr. Dickinson is not aware 30 of any other K wik Trip options. 31 32 Motion by Trude, Seconded by Knight recognizing Commissioner Orttel for his years of service 33 on the Economic Development Authority and for his efforts in cleaning the area along Bunker 34 Lake Boulevard. WWW.CI.ANDOVER.MN.US TO: EDA President and Board ~ CC: Jim Dickinson, Executive Directo FROM: Will Neumeister, Director of Community Development IAIl SUBJECT: Discuss Andover Station Design Guidelines - Outdoor Displays DATE: February 17,2009 INTRODUCTION / DISCUSSION The last time this was discussed by the EDA on December 2, 2008, staff was directed to prepare the needed changes to the guidelines to enable outdoor displays to be allowed on a limited basis. To define what the issue is, a portion of the previous report is reprinted below: The design guidelines for Andover Station do not allow outside sales or storage. A change of policy happened when the guidelines were revised on March 18, 2008 to allow a seasonal greenhouse for Linders to locate in front of Festival Foods. For the last couple of years Festival Foods has had flowers, pumpkins, Christmas wreaths, etc. at the front door on the sidewalk nearly all year long. No enforcement action has ever been taken, as staff felt this was needed to help this shopping center become more accepted by the customer base, and also there were no complaints on this type of merchandizing. Questions arose because of the "Redbox" video rental and propane tank exchange cage located on the sidewalk infront ofWalgreens. Similar to the situation infront of Festival, these types of outdoor vending machines provide a service to the residents of the community and draw patrons into the vicinity. The discussion at that EDA meeting resulted in a consensus to.direct staff to bring forward suggestions for changes that could be made to allow this in the Andover Station area including: . Focus on making sure they are temporary (i.e. vending machines, seasonal, promotional). . Distinguish them as being different from outdoor sales or storage. ACTION REQUESTED The EDA is asked to review and discuss the issue and proposed language in the Design Guidelines for both Andover Station and Andover Station North. Design Guidelines (with changes) 1.06 "Property" shall mean all of the real Property submitted to the provisions of these Design Standards, including all improvements located on the real Property now or in the future. The Property as of the date of the adoption of the Design Standards is legally described on Exhibit A. 1.07 "Permitted Uses" shall mean the permitted uses of the Property be limited to community commercial, office, entertainment, builder's showcase, office warehouse and residential as defined below. The uses shall be limited to those as defined herein. If there is a question as to whether or not a use meets the definition, the Economic Development Authority shall make that interpretation. 1.08 "Community Commercial" shall mean the establishments engaged in commercial operations including retail trade and services and hospitality industries. The Andover Station North Design Standards are intended to encourage creative application of specific design principles to the Property. The goal of the design review process is to provide a framework for performance based communication, collaboration, negotiation and accommodation. The following are the primary categories of the Andover Station North Design Standards: 2.01 Site Plan 2.02 Landscaping 2.03 Architecture 2.04 Parking 2.05 Lighting 2.06 Signage 2.07 Minimum Standards 2.08 Maintenance, Alterations, Construction, Noxious Activities, Temporary Structures 2.09 Residential Design Standards 2.01 Site Plan - Each site plan submitted within the Property shall be reviewed to be in substantial compliance with the following: Andover Station North Design Standards Feb. 17,2009 -4- - . ANDOVER ECONOMIC DEVELOPMENT AUTHORITY MEETING DECEMBER 2,2008 - MINUTES REVIEW ANDOVER STATION DESIGN GUIDELINES (FOR OUTDOOR DISPLAYS) Mr. Neumeister stated the EDA needs to decide how strict they want to be with allowing outdoor display areas for qusinesses in Andover Station and Andover Station North. Ifthe EDA is going to allow the outdoor displays then the guidelines will need to be changed. Commissioner Trude stated she did not want to impair the businesses ability to attract customers. She also did not think that any of the activities described violate the prohibition of permanent outside storage. Commissioner Jacobson stated he doesn't have an issue with the outdoor displays; however the guidelines don't allow this so the guidelines should be changed. r , Commissioner Orttel stated the guidelines address outdoor storage and sales. WhIch this issue is neither .since you have to go into the store to pay for the item and the items are brought in to the business at closing. Commissioner Trude asked if any of the items are permanent. She doesn't believe they are, so do not violate the guidelines. Commissioner Jacobson stated he would like staffto change the wording on the guidelines to allow for outdoor displays for both Andover Station and Andover Station North. Commissioner Trude would like staff to talk to the association at Andover Station to see if they have any suggestions or ideas' to any change in the guidelines. WWW.CI.ANDOVER.MN.US TO: EDA President and Board CC: Jim Dickinson, Executive Director FROM: Will Neumeister, Director of Community Development (<.4- SUBJECT: Discuss Annual Business Development Day DATE: February 17,2009 INTRODUCTION For six years the staff has worked to market the City and Andover Station at the Annual Business Development Day (golf tournament). We are about to begin advertizing and getting mailings ready for the next event and it occurred to us that before we start that work, we should check with the EDA and discuss whether this is something the EDA wants to continue with. DISCUSSION The only real cost to the City and EDA is the staff time to put on the event. It has been financially supported by the hole sponsors and the fees collected from the golfers. Ea~h year we have balanced the income to meet the expenses. No tax dollars or TIF dollars have been expended other than to pay the staff for their work time to put it together and run the event. We use it as our once a year event to promote business and development and it has worked quite well at virtually no cost. The last few years attendance at the banquet has been between 112 and 166 people. We feel that we have become successful at promoting and running the event and get enough attendance that it has been worth the efforts. The first year we held the event, we struggled to get 60 people to attend. The question for the EDA is what would you like to do to promote business and development networking if you didn't continue with this event? ACTION REQUESTED The EDA is asked to discuss whether they would like to continue running this annual event. SUBJECT: Andover Station Banner Discussion DATE: February 17, 2009 INTRODUCTION Last fall there was some discussion related to putting up banners on the light fixtures at Andover Station. Staff has obtained two quotes for banners in the Andover Station area (see attached). DISCUSSION There are a total of 97 decorative street lights in the area and 32 of them are on privately owned and maintained streets (16 fixtures on Quinn, and 16 on the service road between Quinn and the front of Target). Staff recommends that if banners are to be put up, they should be put on every other light fixture in the whole area. We would need to approach the Andover Station Property Owners Association to see if they would agree to have the banners installed on their light fixtures also. The quote would cover all the banners needed to do every other light fixture and still have 10 spare ones held in reserve as replacements. ACTION REQUESTED The EDA is requested to review and discuss the issue and determine whether there is interest and funding available to pursue this any further. Here are a few things we spoke about that should help make Main Street Design the clear choice. As I mentioned Main Street Designs now has a process that applies a micro thin layer of UV Protectent to the entire diqital banner after it has been printed. This is adding valuable life to our product. The best way so see is compare samples. On a head to head comparison, both of our banner products are a higher quality of construction. We warranty both type of banner for three full years. If there should be any fading of inks or construction defects we will replace and repair for that warranted period. The canvas is a product called Sunbrella. It is essentially recycled pop bottles. Ground up into fiber and ,died as a fibrous material. It is then spun into yarn, from there woven to make this 100% fade proof and waterproof material. If you need anything else. Please ask. Thank you. We do not print to canvas for this The inks we use are rated for 2-3 years outdoors under normal conditions. That is with minimal fading. After a couple years you may notice some fading - we us a UV curable ink. ~venue banners (outdoor banners in general) are a difficult one to place a warranty or guarantee on. I have yet to see our product fail under normal conditions. Over a couple years~ they will start to show wear and tear even under normal conditions. All of the product guarantees, even from the material manufacturer will state the same thing. The product will also perform differently depending on the bracket system you are using. If the bracket is solid and does not flex with high wind~ there is a higher likelihood of damage with higher winds. If you - have a "70-mile and hour" wind come through, this would not be considered a normal condition... Are you leaving these up all year or for seasons? I will send you a sample of our Laos. Spanish Language Preschool - Doris Griep has begun to show interest in buying land and building in the area. Staff has indicated that she may find it advantageous to work with one of the owners of the vacant office buildings located south of the Andover Cinema. She is evaluating her options. Blue Fin Pool & Spa - They are nearly all done with construction and ready to occupy the building. Moose & Co. Grill House - The project is at a stand still, waiting for financing. Office Development - Staff has been marketing the site through both the MSP and CoStar websites. New bright red colored "Need New Space?" sign faces have been installed at the bottom ofthe large monument signs. The other marketing/for sale signs were installed on the remaining vacant lots in the fall. One call has been received this winter and that was from an agent looking for a place to build a car wash. Monument Signs - Both Louis Rudnicki and Scott Brenner would both like to install panels on the large monument sign advertizing Dancin' Feet, the Parlor, and Blue Fin Pool & Spa. If the EDA agrees to this on a temporary basis, staff would write up an agreement that this will be allowed (temporarily) until other properties in Andover Station North are sold. Ifthis is ~omething the EDA agrees to, we will bring it back for approval on March 17th. Kwik Trip Convenience Store/Car Wash - Kwik Trip has been waiting for Eddy's Auto Body to firid a place to move. Eddy has been negotiating on a property in Ramsey. The K wik Trip representative indicates that the deal is alive and will need to come to the March 17th meeting to get EDA agreement on the deal points that he needs to make the redevelopment happen. WWW.CI.ANDOVER.MN.US TO: President and Commissioners FROM: Jim Dickinson, Executive Director SUBJECT: Discuss Proposed Communication Site - Andover Station North DATE: February 17,2009 INTRODUCTION The EDA discussed a proposal by a site acquisition consultant for Verizon Wireless to have the EDA consider the potential of a communication site lease at the Andover Station North Ball Field Complex on December 2, 2008 (minutes attached). Since that meeting, Verizon Wireless has applied for a Conditional Use Permit to locate a cellular phone antenna in Andover Station North between the easterly and central ball fields. That proposal is attached, and is schedule for a public hearing in front of the Planning and Zoning Commission on February 24,2009. DISCUSSION History: The proposal was brought before the Andover Review Committee (ARC) for review in November, the conclusion of the ARC group was that the communication site was a reasonable request, although there was some debate as to whether Verizon would really need the structure at the base of the tower to be that large. Also it was determined that the bottom line was that the MPCA would need to be consulted since they regulate the structures that could be placed in the proposed area adjacent to the WDE Landfill Site. City Planner, Courtney Bednarz, since the ARC meeting, has made contact with the MPCA and the MPCA has provided the following comment: "The building needs to be greater than 200 feet from the waste footprint. We need more detail from the city regarding the location of the building relative to the waste footprint. Or, the building could be set on supports so that air can pass underneath the floor." Based on the MPCA comment being favorable, and subsequent direction provided by the EDA on the merits of the proposal, Staff coordinated a site visit with Verizon to firm up the proposal, started the City Conditional Use Permit process, and I continue to negotiate the license/lease arrangement. The Proposal: The proposal is to remove and replace an existing light pole with one that will support the ball field light, a cellular antenna array for Verizon Wireless and potentially one additional antenna for a different user in the future. The new antenna will require equipment to be placed on the ground. The enclosed site drawing and letter from the applicant provide additional information about the proposed installation. The structure will be located outside the 200 foot setback from the closed landfill as required by MNPCA for this type of building installation. City Code 9-12 provides the specific requirements for antennas and towers. The proposal meets the height, location, design, setback and collocation requirements of City Code 9-12 Antennas and Towers. A building permit will be required for the foundation ofthe new pole and structure. The Location: At the December EDA meeting, the selection of the location was questioned, and in response Verizon has identified that the selection of the proposed location was driven by several factors. These factors included the following: . The coverage area desired by Verizon Wireless. . Locating the antenna as far as possible from surrounding residential properties. . A voiding conflicts with the use of the ball field complex. . Providing an area that would be accessible to Verizon Wireless' vehicles. . A voiding the 200 foot setback from the closed landfill. Miscellaneous: Other points that will be discussed as part of the CUP review process will be the license/lease agreement, access issues, grading requirements, irrigation modifications, screening, and the reattachment of the ball field lights. They don't have a problem with the antenna but they would like to see some of the revenue assist in maintaining the area. Mr. Dickinson stated one issue ARC has is the size of the building. Mr. Dickson has talked to Mr. Nelson the consultant of the project and stated they will not be allowed a building that size. Commissioner Trude suggested adding a light pole on the east field instead of replacing an existing pole. Mr. Dickinson stated part of the rationale the middle field was selected was having a buffer to the developable lot to the east. Commissioner Trude also asked staff to look at the alternative locations and discuss the matter with member of the ABA, Commissioners concurred. Commissioner Knight stated foul balls would be going into the fenced areas and then kids would be climbing the fence. Mr. Dickinson stated they would require a top to be on the fence. Commissioner Jacobson stated he's ok with the antenna but not the size of the building. Current zoning for the property, as shown on the city of Andover Zoning Map, is General Business This letter, the enclosed application, application fee and scaled drawings will serve as a request for approval of a Conditional Use Permit to allow construction of a wireless antenna site replacing the current ball field lighting standard located in Andover Station North whose owner of record is the Andover Economic Development Authority. Proposal: Verizon Wireless proposes to replace the current light pole with a 100 foot pole that will structurally accommodate both the ball park light array, Verizon's antenna array located at the top and a future carrier's antennas to meet the city collocation requirements. The radio equipment will be contained in a 11.6 ft by 20 ft (approx. 10 ft in height) pre-cast concrete, modular building placed on a poured concrete slab adjacent to the base of the new light pole. The exterior of the equipment building is finished in a washed aggregate brown tone. The lease area requested measures 19' x 40' (760 sq ft.). A back up power generator will be placed at the site and located as shown on the site plan. I have enclosed a general site location using an aerial photo. In a 11 x 17 size I have a scaled site plan and survey, elevation diagram of both the shelter and the proposed tower, and an enlarged site elevation to provide clearer detail. As shown in the site plan the site is placed so as not to restrict any day to day operation of the activities at the ball fields. Further, the proposed location meets all code required setbacks including those required by the MPCA regarding structure distance from the WDE Landfill Site. Verizon Wireless will bring utilities underground to the site from the nearest location. Upon approval of the plans, Verizon would improve the access drive to the site using standards required by the city and capable of accommodating the equipment used to construct the site. The portion of the driveway extending past the site itself is shown so as to allow for proper removal of snow without tearing up the grass around the site. If the driveway were to terminate at the south end of the lease area, any snow pushed out into the open would likely have a negative effect on the grass from a plow or other mechanical snow removal equipment. That portion of the driveway passing to the east of the site would encroach on an existing drainage and utility easement and would be so placed and maintained, by Verizon Wireless at Verizon' s own risk. Any reasonable and appropriate screening required will be accommodated and incorporated into the site design. Verizon Wireless' communications services and operations comply with FCC Standards. Further, Verizon Wireless agrees to comply with the conditions as stated in the city zoning code as well as those that C0 may be included in the approved Conditional Use Permit. Verizon Wireless. agrees that failure to do so may constitute a breach of the requirements as approved in the CUP. Verizon Wireless is currently negotiating a License Agreement with the city. I understand that this request has been brought before the Andover EDA as well as the MPCA. The MPCA has provided some guidelines to be followed in the construction of the site and the AEDA has indicated that this light standard replacement is a reasonable request for this area. As proposed, your city will benefit both financially as well as with improved service for residents once this site is operational. This site will provide improved in building coverage for the area as well as improved service for mobile users, Your facility has some ideal traits which when viewed through the application of your zoning code meet all reasonable requirements for a cell site. Facilitates the provision of wireless services to the residents and businesses of the city. Located so as to minimize any adverse effects of towers and their aesthetic impact on surrounding properties. The location avoids any potential damageto adjacent properties from tower failure.
