HomeMy WebLinkAboutNovember 12, 1991 o o o o o (}\ CITY of ANDOVER PLANNING AND ZONING COMMISSION MEETING - NOVEMBER 12. 1991 MINUTES The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Randy Peek on November 12, 1991, 7:30 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Steve Jonak, Bev Jovanovich, Marc McMul len, Becky Pease Maynard Apel, Bonnie Dehn City Planner, David Carlberg Assistant City Engineer, Todd Haas Others Commissioners absent: Also present: APPROVAL OF MINUTES October 22, 1991 - Correct as written. MOTION by Pease, Seconded by Jovanovich, to approve the Minutes as written. Motion carried on a 5-Yes, 2-Absent (Apel, Dehn) vote. PUBLIC HEARING: LOT SPLIT/wAYNE HOLMBERG. 17011 WARD LAKE DRIVE NW 7:32 p.m. Mr. Carlberg reviewed the request of Wayne Holmberg to split a 2.5-acre parcel from a 20-acre parcel in an R-l, Single Family Rural DistrIct. The applicable ordinances are Ordinance 40, Lot Splits, Ordinance 8, Section 6.02, establishing minimum lot size, Ordinance 10, Section 9.06a(3), sanItary sewer outside the MUSA, and Ordinance 10, Section 9.07.10, park dedication. Staff is recommending approval subject to the payment of a $400 park dedication fee upon City Council approval and subject to a sunset clause per Ordinance 40, Section IIICE). Discussion was on the proposal of only 231.62 feet of frontage along Ward Lake Drive. Wavne HolmberQ. 17011 Ward Lake Drive NW - stated this is splitting off his home from the remainder of the area. He has already submitted a sketch plan for platting the remaining acreage. His house faces Ward Lake Drive, but it could also face the street that will be buIlt along the northern border of this proposed lot. He stated this lot should have been split several years ago when he had some financing done, but it was overlooked. The credit union prefers to have the homestead on 2.5 acres rather than on a 20-acre parcel. Mr. Holmberg stated that making the lot 300 feet along Ward Lake Drive would not work in his proposed plat. There will be 300 feet along the proposed 170th Lane once that road is built. They also dId not see a hardship for grantIng the variance on frontage. ChaIrperson Peek asked for a legal opinIon. Mr. Carlberg recommended the Item be tabled for further study. ChaIrperson Peek opened the public hearIng. There was no publIc comment. He then asked for a motion to continue the pUblic hearing. MOTION by Pease, Seconded by Jonak, to so move. MotIon carried on a 5-Yes, 2-Absent (Apel, Dehn) vote. The item was carried to the November 26, 1991, Commission meeting. 7:48 p.m. PUBLIC HEARING: SPECIAL USE PERMIT/FIRE STATION NO.2. 16603 VALLEY DRIVE NW 7:49 p.m. Mr. Carlberg provided the background information for a ~ SpecIal Use Permit requested by the Andover Fire Department to '/ construct Fire Station No.2 at 16603 Valley Drive NW. The statIon is already constructed. Staff is recommending approval of the permit. He thought that when the plans for the Fire Stations were being reviewed by Staff. the need for this permit was missed. Concerns raised by the Commission were the recourse when others do not get needed permits, the fact that the residents did not have a chance to express their opinions before construction, and possible conditIons to be placed on the permit. A suggestion was to add an annual review to the permit, though some felt it was not necessary. Mr. Carlberg stated a building permit was applied for and granted to construct the Station. The Planning Department is at some fault for not realizing a permit was needed. Chairperson Peek opened the hearing for public testimony. There was none, though the Commission acknowledged a letter from Tom Redmann, 16541 Valley DrIve NW, which asked several questions. Mr. Carlberg stated he will forward the letter to Bob Peach, Fire Bond Coordinator, to contact Mr. Redmann. Chairperson Peek asked for a motion to close the public hearing. MOTION by Pease, Seconded by Jovanovich, to so move. Motion carried on a 5-Yes, 2-Absent (Apel, Dehn) vote. '\ ,) Chairperson Peek did not object to a Special Use Permit, but took exception that it is interpreted as a public utility use. He stated this is not a public utility; this is a public safety function. Mr. Carlberg stated there is no other section of the ordInance that would apply. It was thought there were no permIts Issued for the PublIc Works BuIlding/FIre StatIon or the other storage buIldIng. ChaIrperson Peek pointed out the problem Is the ordInances do not address publIc buildings and functions. The CommIssIon recessed for fIve mInutes to allow Mr. Carlberg to research whether or not the Andover Elementary School has a SpecIal Use Permit. 8:11 p.m. Mr. Carlberg stated the Andover Elementary School dId not need a permIt because schools are a permItted use In resIdential areas. He dIdn't know if the Interpretation of an allowable use being "Publ iCly owned and operated property," as It is worded in the ordinance, includes the buIldIng on that land. MOTION by McMullen that we accept fire statIons as a permitted use In the residentIal area. There was no second, and the motion was I ater wI thdrawn. '\ ,) The CommissIon asked for a legal opInIon on whether permItted uses on publIcly owned and operated property In the resIdentIal areas Include such buildIngs as fire statIons, polIce statIons, park buIldings, etc. The Item was tabled to the next CommIssIon meetIng, November 26, 1991, pendIng a legal interpretatIon from the CIty Attorney as to whether a permit is needed. 8:19 p.m. PUBLIC HEARING: ORDINANCE NO.8. SECTION 7.01. DISALLOW TRANSPORTATION TERMINALS AS A PERMITTED USE IN GB. GENERAL BUSINESS DISTRICTS 8:19 p.m. Mr. Carlberg presented the background InformatIon regardIng the request to dIsallow transportatIon terminals as a permitted use In the General Business Districts. The CouncIl brIefly revIewed the matter whIle examIning another requested use In the GB DIstrict and was concerned about the lack of suitable roads in the City for heavy truck traffic associated with transportation terminals. Staff Is recommendIng approval of the proposed amendment. Chairperson Peek opened the publIc hearing. There was no publIc testImony. He then asked for a motIon to close the hearIng. '_/ , \.. / \ ) Planning and Zoning Commission Minutes - November 12, 1991 Page 4 (Public Hearing: Ordinance No.8, SectIon 7.01, Disallow Transportation Terminals as a PermItted Use In GB, Continued) MOTION by McMullen, Seconded by JovanovIch, that we recommend amending OrdInance No.8 known as the ZonIng OrdInance for the CIty of Andover, SectIon 7.01, PermItted Uses, under subtItle "GB General BusIness", eliminate Transportation Terminal; and under "Industrial Districts", I., eliminate TransportatIon terminal or motor freIght termInal. A publIc hearing was held on November 12 and there was no opposition. Motion carried on a 5-Yes, 2-Absent (Apel, Dehn) vote. The item wil I be on the December 3, 1991, Council Agenda. 8: 28 p.m. SKETCH PLAN - KOB'S KNOLL ADDITION \ '- / Mr. Haas revIewed the proposed sketch plan of Kob's Knoll AdditIon off Valley Drive for five 2.5-acre resIdential lots, inClUding the comments from the Andover RevIew Committee. The maIn concern Is the length of the cul-de-sac. It Is proposed to be 1390 feet; maximum allowed by ordInance Is 500 feet. The ARC felt an alternatIve would be to brIng the road back to Valley DrIve from the end of the proposed cul-de-sac. The Commission poInted out that would mean Lot 2 would have roads on three sIdes. Mr. Haas agreed, realizIng then that that option Is not feasIble since dOUble-frontage lots are not allowed. He didn't know of any other option to gettIng the road back to CoRd 58. ChaIrperson Peek asked If the lot on the end of the cul-de-sac whIch is outside of the proposed plat would be consIdered as haVing double frontage since it fronts on CoRd 58 but would also back onto the cul-de-sac. Mr. Haas stated no, since that lot could be split. Mr. Kob will have to acquire property to complete the cul-de-sac. The Commission had no further comments or recommendations. The item will be forwarded to the City Council for theIr revIew at their November 19, 1991, meeting. OTHER BUSINESS Mr. Carlberg informed the Commission that the Council is holding a special meeting this Thursday, November 14, 1991, on the Comprehensive Plan Draft. He urged the members to attend.
