Administrator's Report - Administration Mayor/Council Input Adjournment 0 0 REGULAR ANDOVER CITY COUNCIL MEETING - SEPTEMBER 2,2008 MINUTES The Regular Bi-Montbly Meeting of the Andover City Council was called to order by Mayor Mike Gamache, September 2, 2008, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Councilmembers present: Don Jacobson, Mike Knight, Ken Ortte1, Julie Trude Councilmember absent: None Also present: Director ofPub1ic Works/City Engineer, Dave Berkowitz City Administrator, Jim Dickinson Community Development Director, Will Neumeister Others PLEDGE OF ALLEGIANCE 0 RESIDENT FORUM No one wished to address the Council AGENDA APPROVAL Add Special Proclamation - Constitution Week. Motion by Jacobson, Seconded by Knight, to approve the Agenda as amended above. Motion carried Ilmmlmously. SPECIAL PROCLAMATION - CONSTITUTION WEEK Mayor Gamache read the Constitution Week Proclamation. APPROVAL OF MINUTES 0 August 19, 2008, Regular Meeting: Correct as amended. Councilmember Jacobson stated on page three, line 17, the word "is" should be removed. Motion by Knight, Seconded by Gamache, approval of Minutes as indicated above. Motion carried unanimously. 0 ACCEPT COMPLETION REPORT/HOLD PUBLIC HEARING TO ASSESS COSTSlPROJECT 08-25/F AILED SEPTIC SYSTEM AT 2279 -154m LANE NW Mr. Neumeister stated the City Council is requested to open the public hearing for assessment of the costs of removal and replacement of a failed septic system at 2279 154th Lane NW, Project 08-25. Mr. Neumeister reviewed the information with the CounciL Motion by Knight, Seconded by Jacobso~ to open the public hearing. Motion carried unanimously. No one wished to address the CounciL Motion by Trude, Seconded by Jacobso~ to close the public hearing. Motion carried unanimously. Motion by Jacobso~ Seconded by Knight, to approve the Resolution as prepared by staff. Motion carried unanimously. (Res. R067-08) ADOPT 2009 PRELIMINARY BUDGET & TAX LEVY Mr. Dickinson stated each year the City Council is required by state law to approve a preliminary 0 budget and submit a preliminary levy certification to Anoka County Property Records and Taxation Division by September 15th. Mr. Dickinson reviewed the preliminary budget and tax levy information with the CounciL 0 Regular Andover City Council Meeting Minutes - September 2, 2008 Page 3 Councilmember Orttel asked what is included inthe Road and Bridge Fund. Mr. Dickinson stated it covers the annual crack fill and seal coat program, it also covers the contribution towards the annual mill and overlay project. They are one of the few communities that does modified approach towards infrastructure, which means they do not depreciate their streets, they try to maintain a particular level of standard on their streets, often called an OCI Index, which is the Overall Condition Index Rating and they want to maintain a level of good in the City. Councilmember Jacobson asked for clarification on the 4.04 percent tax capacity rate. Mr. Dickinson stated the tax rate is what is used to multiply against a tax capacity value, which is a computation from the market value. He gave an example, of the factor. He stated if the value of a home went up there is the potential for the City portion to go up more than four percent but if the value went down, the taxes could go down. Councilmember Trude asked for clarification on the Open Space Referendum Levy. Mr. Dickinson stated what was authorized was for the city to issue bonds up to two million dollars and if they maxed out that levy they would look for two hundred thousand dollars on that voter approved amount. What they are proposing in the budget is one hundred sixty-two thousand nine hundred. 0 Based on the fact they have not purchased a parcel yet they have adjusted the levy. The dollars they have previously levied will offset the total bond issuance. Motion by Orttel, Seconded by Trude, to approve the resolution prepared for the tax levy for 2009. Motion carried unanimously. (Res. R068-08) 2009 DEBT SERVICE LEVY CHANGES Mr. Dickinson stated Anoka County Property Records and Taxation Division requires a City Council resolution changing bonded indebtedness levies for 2009 that would have been certified to Anoka County as part of prior years bond sales. Motion by Jacobson, Seconded by Knight, to approve the attached resolution that would update certified bonded indebtedness levies for 2009. Motion carried unanimously. (Res. R069-08) SET TRUTH IN TAXATION HEARING DATE Mr. Dickinson stated the Andover City Council is required to hold Truth in Taxation meetings. These meetings give the public the opportunity to comment on the proposed 2009 budget and tax levy. 0 Motion by Jacobson, Seconded by Knight, to set a Truth in Taxation Hearing for Wednesday, December 10, 2008 at 7 :00 p.m. with a continuation date of Tuesday, December 16, 2009. Motion carried unanimously. 0 Regular Andover City Council Meeting Minutes - September 2, 2008 Page 4 ADMINISTRATOR REPORT City Administrator Dickinson updated the Council on the administration and city department activities, meeting reminders, and CIP Projects. City Engineer Berkowitz updated the Council on road improvements projects in the City. Community Development Director Neumeister updated the Council on development activity in the City. .MAYOR/COUNCIL INPUT (I'urn Lane on Bunker Lake Boulevard by Target) - Councilmember Trude stated at one time they had discussed with the County Bunker Lake Boulevard and getting a cut through the 0 boulevard of Bunker to allow people to make a left turn into Target so there is not a lot of cutting through the neighboring parking lots and the County indicated they would not allow it. She wondered if there was something they could do as Councilmembers to make this happen. Mr. Berkowitz stated they went to the County and were told they would not allow this turn. Mr. Dickinson stated since they have not gotten the desired response back from the County, staffhas talked to some of the business owners and discussed alternatives to that access which they could do on their own if interested. This would include be shutting off some of the access points off of Jay Street or Martin Street from their parking lots, which could possibly alleviate the cut through traffic. Motion by Jacobson, Seconded by Orttel, to adjourn. Motion carried unanimously.
