PLANNING AND ZONING COMMISSION MEETING - JUNE 25, 1991
MINUTES
The Regular Bi-Monthly Meeting of the Andover Planning and Zoning
Commission was cal led to order by Acting Chairperson Becky Pease on
June 25, 1991, 7:30 p.m., at the Andover City Hall, 1685 Crosstown
Boulevard NW, Andover, Minnesota.
Commissioners present:
Maynard Apel, Bonnie Dehn, Steve Jonak, Marc
McMullen (arrived at 7:36 p.m.)

APPROVAL OF MINUTES

MOTION by Apel, Seconded by Jonak, approval of the Minutes as
presented. Motion carried on a 3-Yes (Apel, Dehn, Jonak), i-Present
(Pease), 3-Absent (Jovanovich, McMullen, Peek) vote.
VARIANCE REQUEST - SEPTIC SYSTEM SETBACK ENCROACHMENT. STEVEN BURY.
17230 AZTEC STREET NW
Mr. Carlberg reviewed the variance request of Steven Bury to al low for
the construction and placement of a septic system encroaching into the
required 100-foot setback from the Ordinary High Water mark of the Rum
River. The applicable ordinance is Ordinance No. 52, Sections 5.02
and 10.03. The septic system would be located entirely within that
encroachment; however, there is no other location to place it without
cutting down numerous trees, which is also an ordinance violation.
The variance is needed because of the topography of the land and the
shape of the lot. It is a 1 1/4-acre lot.
Mr. Carlberg also reported the DNR has been contacted and wil I have
final approval, but they suggested the City begin its process while
they review it. The variance should be contingent upon DNR approval.
(Commissioner McMullen arrived at this time.)
Mr. Carlberg also stated that Staff feels thIs proposed location is
the best site. The BuildIng Official looked at the proposal and did
not see a problem wIth it. This needs to be done as soon as possIble
because Mr. Bury's present system is fallIng.

MOTION by Apel, Seconded by Jonak, that the Andover Planning and
Zoning Commission recommend approval of the variance requested by
Steven Bury to allow for the construction and placement of a septic
system encroaching into the required 100-foot setback from the
Ordinary High Water mark on the property located at 17230 Aztec Street
NW, legally described as Lot 7, Block 2, Valley View Estates, PIN 8 32
24 22 0007.
The PlannIng Commission fInds that the proposal meets the conditions
established in Ordinance No. 52, Section 10.03.01. The variance would
be contingent upon the approval of the Minnesota Department of Natural
Resources.
Motion carried on a 5-Yes, 2-Absent (Jovanovich, Peek) vote. This
Item will go to the CouncIl on July 16, 1991.

OTHER BUSINESS
Mr. Carlberg brIefly discussed the Comprehensive Plan Task Force
meeting to be held on Thursday, June 27, 1991.
There being no further business, Acting Chairperson Pease declared the
meeting adjourned at 7:43 p.m.
