HomeMy WebLinkAboutMay 14, 1991 o o o o o ~ CITY of ANDOVER PLANNING AND ZONING COMMISSION MEETING - MAY 14, 1991 MINUTES The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Randy Peek on May 14, 1991, 7:30 p.m., at the Andover City Hal I, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Maynard Apel; Bonnie Dehn, Steve Jonak, Bev Jovanovich, Becky Pease (Arrived at 7:35) Marc McMu II en City Planner, David Carlberg; Assistant City Engineer, Todd Haas; and others Commissioner absent: Also present: APPROVAL OF MINUTES April 23, 1991: Correct as written. MOTION by Jovanovich, Seconded by Apel, to approve the Minutes. Motion carried on a 5-Yes, 2-Absent (McMullen, Pease) vote. CONTINUED PUBLIC HEARING: PRELIMINARY PLAT - KOB'S FIRST ADDITION Chairperson Peek noted the public hearing portion of the meeting was closed at the last meeting. Mr. Haas reported the Andover Review Committee has discussed the lot configurations and variances, as the Planning Commission had asked to have the number of variances reduced. It was their determination that because of the configuration of the land and the amount of wetland, that those variances listed are needed and acceptable. In comparing the density of this plat with Nightingale Estates 3rd Addition, a rural plat that was recently developed, it equates to the density and meets the 2 1/2-acre minimum average lot size. (Commissioner Pease arrived at this time. 7:35 p.m.) Mr. Haas also pointed out the variance for the length of 168th Lane cui de sac, which Is approximately 800 feet. Lot 5, Block 1 will still be required to meet the 39,000-square-foot requirement, though the building pad will not be required to be 150x150 feet. The ARC Committee is recommending approval of the plat with the variances indicated, contingent upon an approved grading plan. He did receive a grading plan this evening; however, he has not had a chance to review it. He also recommended this go to the Council on May 21, 1991. The Commission briefly reviewed the proposed variances and generally agreed that some variances wil I be needed because of the configuration of the parcel and the ditch and wetlands on the property. ~) . \ ~) ~-) Planning and Zoning Commission Meeting Minutes - May 14, 1991 Page 2 (Preliminary Plat - Kob/s First Addition, Continued) MOTION by Apel, Seconded by Dehn, that the Planning and Zoning CommissIon recommend to the City Council the approval of the Kob/s FIrst AddItion prelimInary plat, recognIzIng the fact that some of the parcels, particularly this one, that we have left that wIll be comIng through us for approval wII I have dIffIculties. ThIs plat does. It requIres several varIances. The Andover RevIew Committee has recommended that they be granted. Also, it would appear that the plat does conform to our Comprehensive Plan and will not adversely affect the surrounding area when it Is developed. The approval of the preliminary plat is to contain the fol lowing variances: Block I, Lots 5 and 6: Variances for lot width at the front setback line from Ordinance 10, Section 9.06 a(3), which requires 160 feet for cul-de-sac lots. Lot 5 shows 150 feet; Lot 6 shows 130 feet. Block 1, Lot 7: Variance for lot width at the front setback line from Ordinance 10, Section 9.06 a(3) which requires 300 feet of frontage for standard 2.5 acre-lots. Lot 7 shows 238 feet. \ , ) Block 1, Lot 5: Variance for 150x150-foot area as required by Ordinance 10, Section 9.06 a(3). Block 1, Lots 2 and 3: Variances from Ordinance 10, Section 9.02 Cb) to al low frontage onto Tulip Street NW, which is currently designated as a Municipal State Aid Street. 168th Lane NW cuI de sac: Variance from Ordinance 10, Section 9.03 g for length of cui de sac which exceeds the maximum of 500 feet. The proposed length is approximately 800 feet. This is contingent upon receiving a revised grading plan to meet the ordinance requirement prior to City Council revIew, which will be next Tuesday, May 21. A publIc hearIng was held as there was no opposition. Motion carried on a 6-Yes, I-Absent (McMullen) vote. 7:47 p.m. PUBLIC HEARING: LOT SPLIT/VARIANCE - DENNIS AND JEANETTE NORSTEN. 17525 TULIP STREET NW , Mr. Carlberg reviewed the lot split request to split a 4.775-acre lot into two separate lots of 2.497 and 2.278 acres. The parcel was a 5-acre metes and bounds parcel, but it was reduced in size because of the street right of way. He outlined the applicable ordinances, recommending the owner pay a park dedication fee of $400 upon City Council approval. The purpose Is so the applIcant can sell off the larger parcel on which a single-family home can be constructed. The variances are for lot areas on both lots and for lot width on Parcel B. / \ I - / , \ ~J \ J Planning and Zoning Commission Meeting Minutes - May 14, 1991 Page 3 (Hearing: Lot Split/Variance - Norsten, 17525 Tulip Street, Cont.) Chairperson Peek opened the hearing for public testimony. Mr. Dennis Norsten - stated he cannot take care of the entire parcel, so he would rather sell it and have someone build a house on it. Mr. Carlberg stated the house pad Is not desIgnated; however, the property in Parcel B is hIgh and dry. The reason it Is split in this manner is to have more of a rear yard for Parcel B so they can set the house back farther. The proposed alIgnment tended to gIve the best arrangement to get as close to 2 1/2 acres as possible for both lots. Chairperson Peek asked for a motion to close the publIc hearing. MOTION by Apel, Seconded by Pease, to so move. Motion carrIed on a 6-Yes, i-Absent (McMullen) vote. MOTION by Apel, Seconded by Jovanovich, that the Andover PlannIng and Zoning Commission recommend to the CIty Council the approval of the lot split request of Dennis and Jeanette Norsten. The reason for recommending approval is basically the same as any other lot spIlt. This makes a good decision by the City Staff as to the use of the \ land. It conforms with the Comprehensive Plan. The approval, / however, is sUbject to a varIance for lot frontage on Lot B and also for a variance on the lot size on Lot B according to Ordinance 40. Lot A needs a variance for lot size, also contained in Ordinance No. 40. This is contingent upon the applIcant paying a park dedIcatIon fee of $400 upon CIty Council approval of the proposed lot spIlt. A publIc hearIng was held and there was no opposItion. Include a sunset clause that this would be surveyed and park dedication fee paId within one-year/s time. Motion carried on a 6-Yes, i-Absent (McMullen) vote. If a publIc hearing was held and closed, a report wil I be made to the CouncIl. Mr. Carlberg stated he wIll also contact Ms. Sonsteby. No further actIon was taken. \. J -" \ o " , / Planning and Zoning Commission Meeting Minutes - May 14, 1991 Page 4 DISCUSSION-BURGLAR ALARM ORDINANCE The Planning Commission reviewed the proposed Alarm Ordinance and agreed to the following changes: Page 2, Section 3, Determination of the Occurrence of a False Alarm: The words In parentheses (Building OfficIal) are to be deleted wherever they occur. It was felt the responsibilIty would be that of the City Clerk, who can delegate If necessary. The wording Is to be changed to: The alarm user, wIthIn 30 days of receipt of notice, may submit a wrItten report to the CIty Clerk to explain the cause of the alarm activation. If the City Clerk determines the alarm was caused by conditions beyond the control of the alarm user, the alarm will not be counted as a false alarm at that address. The decision of the CIty Clerk may be appealed in writing to the City Council. Section 5, Effective Date: Correct the year to 1991. Mr. Carlberg stated those changes wil I be made and notices published for a public hearing on the proposed ordInance to be held by the Planning CommIssIon on May 28, 1991. \ ) OTHER BUSINESS CommIssioner JovanovIch noted an Invitation she receIved on ConstitutIonal Issues In Land Use and Zoning, Due Process, Equal Protection, and the Taking Issue to be held on May 29, 1991, at the Marriott City Center in Minneapolis.
