PLANNING AND ZONING COMMISSION MEETING - JULY 12, 1994 MINUTES The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Jay Squires on July 12, 1994, 7:00 p.m. at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Maynard Apel, Bonnie Dehn, Bev Jovanovich, Becky Pease, Jerry Putnam Randy Peek . City Planning Director, David Carlberg Others Commissioner absent: Also present: APPROVAL OF MINUTES June 28, 1994: Page 9, third paragraph, add "Mr. Carlberg clarified when using the definition in the ordinance for repajr garages, there are four repair garages along Bunker Lake Boulevard." o MOTION by Jovanovich, Seconded by Apel, approval of the corrected. Minutes as Jovanovich, PUBLIC HEARING: SPECIAL USE PERMIT - REPAIR GARAGE IN A GB, GENERAL BUSINESS DISTRICT - 13624 THRUSH STREET NW - JIM HUGHES 7:02 p.m. Mr. Carlberg reviewed the Special Use Permit request by Jim Hughes to operate a repair garage Lot 4, Block 1, Andover Commercial Park. He noted the applicable ordinances and criteria to be examined when granting Permits. The Andover Economic Development Committee reviewed this item at their meeting last week and is recommending that the lot be sold to Mr. Hughes. They felt this is an appropriate use in the Commercial Park, but they were concerned that all exterior storage be screened. Mr. Carlberg noted the ordinances and restrictive covenants on the lot will deal with the exterior storage issue. Commissioner Dehn understood the need to restrict exterior storage, but at the same time she did not want to hinder the operation such that they cannot function. Mr. Carlberg stated the control will be to make it aesthetically pleasing and not depreciate surrounding properties. He also reviewed the activities on the other lots within the Park. o Commissioner Dehn asked if there was concern by the AEDC with the day care center to be located immediately north of this lot. Mr. Carlberg stated they were sent a notice of this hearing. They were also aware of the uses that could potentially be allowed on this lot, and they chose Lot 3, Block 1 for visibility and accessibility rather than choosing a lot abutting the residential area. Staff will contact the day care center to inform them of the proposal, and they will work with Mr. Hughes to have a minimal impact on the proposed day care facilities. o o o Regular Andover Planning and Zoning Commission Minutes - July 12, 1994 Page 2 (Public Hearing: Special Use Permit/Repair Garage/Hughes, Continued) MOTION by Apel, Seconded by Dehn, to open the public hearing. Motion carried on a 6-Yes, 1-Absent (Peek) vote. 7:15 p.m. Jim Huohes - explained they are planning to construct a 5,000-square- foot building, with two exists from the lot to Thrush and to 136th. The north side of the building facing the day care center will just be building with no parking or storage. Inside the building there will be approximately 2,000 square feet of shop acre with three bays, 1,800 square feet of office space, and 1,200 square feet of cold storage. They do not plan to have any outside storage. The most vehicles they have on hand is about four, as most customers do not want their vehicles tied up for very long. MOTION by Dehn, Seconded by Jovanovich, to close the public hearing. Motion carried on a 6-Yes, 1-Absent (Peek) vote. 7:17 p.m. o There was some discussion on the hours of operation. Mr. Hughes stated they generally work from 8 a.m. to 5:30 p.m., Monday through Friday, occasionally on Saturdays from 8 to 12. But they also have the county service contract; and, for example, when there is a snow storm, they must work whatever it takes to get the equipment repaired. The Commission felt that because this is in a General Business area away from residential, there would be no need to set hours of operation. If noise becomes a factor, it can be handled with the Noise Ordinance. The Commission also raised the issue of the day care center to the north but felt the two uses could be compatible. Mr. Carlberg stated Staff will work with both parties to make sure the uses are conducive for both lots. Mr. Hughes then noted the day care center will probably have ten times more traffic than he will. MOTION by Apel, Seconded by Dehn, to recommend to the City Council that the Council approve a Special Use Permit request by Jim Hughes. The Commission finds the request meets the criteria established in Ordinance No.8, Section 5.03, including: the use will not be detrimental to the health, safety, morals or general welfare of the community; the use will not cause serious traffic congestions or hazards; the use will not depreciate surrounding property; and the use is in harmony with the Comprehensive Plan. And the following conditions be included in the Special Use Permit: 1. The Special Use Permit will be subject to a sunset clause as defined in Ordinance No.8, Section 5.03(D). The Special Use Permit will be subject to annual review and site inspection. The applicant must secure a Hazardous Waste Generator's License from Anoka County and provide proof to the City. The site shall be subject to meeting the requirements of Ordinance No.8, Section 8.08, Parking. 2. 3. o 4. Motion carried on a 6-Yes, 1-Absent (Peek) vote. This will be placed on the August 2, 1994, City Council Agenda. 7:23 p.m. o o o Regular Andover Planning and Zoning Commission Minutes - July 12, 1994 Page 3 PUBLIC HEARING: DAILEY LOT SPLIT/VARIANCE - 17004 VALLEY DRIVE NW - FRED 7:23 p.m. Mr. Carlberg reviewed the lot split/variance request of Fred Daily to split an a-acre parcel into two separate lots of 2.5 acres and 5.5 acres. A variance is also requested from the 300-foot lot frontage requirement on Parcel B. Parcel B has 253 feet of frontage; therefore, a 47-foot variance is being requested. The property is zoned R-2, Single Family Estates; however, because the R-2 zone is no longer allowed for development, the provisions of the R-l district must apply. Park dedication is also required on lot splits for each dwelling unit that could be constructed upon. Parcel A will have structures on it, so park dedication would be collected for Parcel B only. The driveway for Parcel B would come onto Valley Drive. There are some wetlands in that parcel, and soil borings and perk tests will be required before a building permit is issued for that parcel. The cul-de-sac for 171st Avenue shown on the map has never been constructed, possibly because of the wetlands. Chairperson Squires asked if the lot lines of Parcel A could be reconfigured so the variance would not be necessary. o Fred Dailey - explained the driveway for Parcel B would run along the line of Parcel A to the back of the parcel where the house will be built. That is the only place the driveway can go because of the wetlands. Commissioner Dehn noted the section of high land through there is not very wide. Much of the area is swampy, but there is high ground in the back. She felt what Chairperson Squires is suggesting would produce a very odd-shaped lot; and looking to the future with the possibility of subdividing parcels, she felt it is important that the lots be geometric. Mr. Carlberg also noted the buildable area and driveway location will be determined through the building permit procedure. MOTION by Apel, Seconded by Jovanovich, to open the public hearing. Motion carried on a 6-Yes, I-Absent (Peek) vote. 7:37 p.m. Adam Kaplan, 3741 171st Circle NW - explained they were drawn to that entire area because of the wetland conservation, but five years later houses are being built there and the conservation of wetland is being ignored. He felt the proposed location of the driveway for Parcel B will create a dangerous situation because of the dangerous curve to the north. o Mr. Dailey - stated he's lived there for 22 years and has seen only one car in the ditch. He disagreed that it was that dangerous. Sharon Kuhn, 17017 Valley View Drive NW - talked with Mr. and Mrs. Dailey at one time about their thoughts to put a road through to the back. She's glad he isn't doing that because that would take out between 30 to 40 trees. She likes the seclusion and does not want to see the trees removed. The house on Lot 19 was built right on the property line. She asked how many homes can be built on the property. There is a lot of wetland, and she wondered if the City would consider that property as park land. Mr. Carlberg stated the Wetlands Conservation Act will apply, and any filling of wetland must be mitigated two for one. Only one house is being proposed for Parcel B. This area is not proposed for park land in the Comprehensive Plan. This area is not being considered for sewer and water within the City's plan until 2010, if at all. Ms. Kuhn - couldn't see how a home could be built back there. Mr. Carlberg stated there appears to be a buildable area on Parcel B. The house can be built up to 10 feet from the side property line. There were some comments from the audience about the proposed driveway for Parcel B being five feet from the property line and a notation on the easement for the power line. The Commission noted these items would be reviewed by the Building Department when application is made for a building permit. Another resident stated they have seen perk tests done in the middle of the winter, which causes some concern for them. Mr. Carlberg thought the driveway would be as far south on the parcel as possible. A resident noted Valley Drive has just been resurfaced by the county. Mr. Witman - again asked about the wetland issue to make sure it is not filled in. That is a main drainage area for the whole neighborhood; it is a natural spring. Mr. Carlberg explained there are a number of agencies that get involved with the wetlandsr including the watershedr the DNR and the Army Corps of Engineers. He again stated Parcel B in all a likelihood is a buildable lot. But the buildability issue will be determined by the Building Department. Also, he did not think the issue of taking it as park property is valid. The applicant is looking to subdivide his property, and this does meet ordinance requirements. Mr. Dailev - knew of someone who is buying the land to the north and plans to subdivide it into three lots without constructing 171st Avenue. o Mr. Witman - asked how they will be kept informed of what is going on with this property. Mr. Carlberg stated they can contact the Building Department for the construction of a home. They would receive written notification from the City if there is any future subdivision of the property. The Commission also noted that this is the public hearing, but the residents can also go before the Council when they hear this item. ..., "-.-.1 o C.) Motion carried on a 6-Yes, 1-Absent (Peek) vote. 7:50 p.m. MOTION by Apel, Seconded by Jovanovich, recommending that the Planning and Zoning Commission forward to the Council and recommend approval of the Resolution granting the lot split as prepared by Staff with the following changes: Where it says "WHEREAS, a public hearing was held and there was no opposition", change "no opposition" to "there was opposition to said request based largely on the wetland consideration and traffic, particularly the driveway corning out on Valley Drive". Motion carried on a 6-Yes, 1-Absent (Peek) vote. This will be placed on the August 2, 1994, City Council Agenda. 7:52 p.m. OTHER BUSINESS Mr. Carlberg updated the Commission on the Council action at their July 5, 1994, meeting regarding Planning Commission items. He is also still receiving information on massage therapy as a home occupation.
