35 Fire Chief Dan Winkel introduced the newest members of the Fire Department that have successfully
36 completed their probationary period. Mayor Gamache helped present them with their badges.

27 RECEIVE ANOKA COUNTY SHERIFF DEPARTMENT MONTHLY REPORT

29 Captain Tom Wells, Anoka County Sheriff's Department, provided an update on law enforcement
30 activities occurring within Andover.
31
32 Councilmember Jacobson stated he has been noticing lately about reports regarding break-in's of
33 vehicles parked in the city and he wondered if there was something going on. Captain Wells
34 indicated they have noticed there have been thefts from open garages and thefts of opportunity in the
35 city in the last few months. He noted to reduce theft from vehicles to lock the car doors and not
36 leave valuables in site.

38 Councilmember Jacobson wondered if most of it is juveniles out doing this for fun. Captain Wells
39 stated some of it is that but there are other people that are in the neighborhoods just to look for
d~ opportunities to burglarize homes.

2 The applicant is requesting an amendment to the conditional use permit to extend the timeframe for
3 the removal of the temporary classrooms on their property by five years.

5 Mr. Neumeister reviewed the information with the Council.
6
7 Councilmember Orttel asked City Attorney Baumgartner to explain the Attorney's Office opinion
8 that was made previously on these structures. City Attorney Baumgartner stated he has not reviewed
9 the memo that was prepared by Mr. Hawkins. There was also a question before the meeting
10 regarding schools being exempt from the process and he would look into this.

12 Councilmember Orttel stated when it comes to temporary structures he thought there was a
13 difference between the physical structure and the type of use. The buildings are temporary type of
14 buildings but not time specific. Mr. Neumeister stated it is confusing because the code does state
15 that temporary structures shall require a CUP. He read from the City Code.

17 Mr. Neumeister stated that the code is indicates that even though it is a permitted use it is saying it
18 still needs a conditional use permit. Councilmember Orttel did not think this was for expanding a
Q19 use and needing a CUP, it is to continue the use of a temporary structure which is a very specific part
20 of the ordinance and a lot more strict than some of the other issues. He wondered why the public
21 versus private issue would make any difference. If they have considered it and figured that it is
22 acceptable for a public school it should be the same for a private school as well.

24 Councilmember Orttel wondered if the temporary buildings are inspected every year. Fire Chief
25 Winkel stated they have not had an opportunity to get in to inspect every year but they were able to
26 get in this spring to inspect them.

28 Councilmember Jacobson suggested they have the City Attorney look at the City Code for
29 differences to clarify the issues brought forward.

31 Councilmember Jacobson thought five years was a little long and suggested allowing the structures
32 for three years. They have others coming up and if they are going to change their definitions in
33 allowing what they are allowing; if they can shorten rather than stretching these time frames it is best
34 for everyone around. Councilmember Knight thought if the building was being used for public or
35 private schools there is little difference in how they apply it.

37 Motion by Jacobson, Seconded by Gamache, to approve the proposed Conditional Use Permit
38 amendment changing the date to August 31, 2011. (Trude absent) (Res.063-08)

d~ Councilmember Orttel stated he did not see a problem with allowing five years because it is apparent
that the church is trying to find an alternative solution.

43 Councilmember Jacobson stated this is for approval of a temporary structure, not a school or
44 anything else. Councilmember Knight preferred they clean up the code before they put a yearly

1 deadline on it. He does not think the code is very clear. Councilmember Orttel agreed and asked if
2 Mr. Jensen would be willing to wait a month or two before this is approved.

4 Mr. Jim Jensen, Chairman of Trustees for Andover Christian Church, 3423 165th Lane NW, stated
5 they have hail damage on the roof and want to get it repaired but want to wait on fixing it based on
6 what the decision is. He stated that his position for a three year extension is it basically gets them
7 two years to find funding which puts them at a hardship.

9 Mayor Gamache asked if they would make some changes that give them different criteria upon the
10 organization, would they still have the five years to live up to the old ordinance. City Attorney
11 Baumgartner stated if this is approved at five years and then the Council makes changes, the
12 applicant will be locked into five years based on the current situation.

14 Mr. Jensen stated they would prefer the five year approval based on the fact it gives them time to
15 plan and raise the money for a permanent structure.

17 Mayor Gamache stated based on what was discussed he would not vote in favor of this.

019 Motion failed 1 aye (Jacobson), 3 nays (Knight, Gamache, Orttel).

23 Councilmember Knight wondered if they could move this item to staff for revisions. Mayor
24 Gamache indicated this will be brought to a Council Work Session.

1 Councilmember Orttel removed himself from this discussion because of a conflict of interest.

3 This item was tabled to allow up to 60 days for a Conditional Use Permit to be processed allowing
4 the highest bidder the opportunity to see if the house would be able to be moved. The first bid
5 opened was from Ken Orttel and his bid was to pay the City $5,060 to move the house and complete
6 the work listed in the bid form. However, the bid contained a condition that indicated it was subject
7 to the City of Andover approval of placing the home at 14355 Crosstown Boulevard. The second bid
8 was from Prodger House Movers, Inc and their bid was to charge the City $3,710 to move the house
9 and complete the work in the bid form.

11 Councilmember Jacobson stated because they delayed action on this previously he did not believe
12 September 8, 2008 was a reasonable amount of time and he wondered if the date should be thirty or
13 sixty days further out in order to accomplish this. Mr. Orttel thought this should be extended an
14 appropriate amount of time. Sixty days from today would be great but hoped it will be done in two
15 weeks.

17 Motion by Jacobson, Seconded by Knight, to accept the bid of Mr. Ken Orttel and extend the project
18 date to be completed by November 1, 2008. Motion carried 3 ayes, 1 abstain (Orttel). (Trude

24 City Administrator Dickinson updated the Council on the administration and city department
25 activities, meeting reminders and miscellaneous projects.

27 City Engineer Berkowitz updated the Council on road improvements projects in the city.

29 Community Development Director Neumeister updated the Council on development activity in
30 the city.

32 Fire Chief Winkel updated the Council on fire department activities in the city.

37 (Open Space Public Meeting) - Councilmember Jacobson stated he wanted to encourage input
38 from the public rather than a drawn out presentation from the speakers. Mr. Neumeister stated
39 that Mr. Bednarz noted in the update that there will be a short presentation and then resident

42 (Round Lake Boulevard Preliminary Plat) - Councilmember Jacobson asked if there were any
43 changes on the preliminary plan from what they saw on the sketch plan on the proposed
44 development on Round Lake Boulevard by Coon Creek and is it still going to be coming in for

1 review. Mr. Neumeister stated everything looks to be the same.

3 (Traffic Backup by Andover High School) - Mayor Gamache stated by the high school, residents
4 have been complaining about traffic backing up by the stoplight. He wondered if they could
5 work out something with the county regarding this. Mr. Berkowitz stated they are currently
6 working with the high school and county to do a traffic study. They have discussed having the
7 stop light back up a little more on Andover Boulevard to allow traffic to flow on Crosstown
8 Boulevard.

BUDGET IMPACT
The edit lists consist of routine payments with expenses being charged to various department budgets and
projects.

INTRODUCTION
0 The City Council is requested to authorize the approval of a hold harmless and easement
encroachment agreement with Daniel and Shirley Fairbanks, property owners at 15575 Bluebird
Street NW.
DISCUSSION
The property owners (Daniel and Shirley Fairbanks) have installed a pool along with a retaining
wall and concrete pad in their backyard. A portion of the rear yard drainage and utility easement
was recently vacated to accommodate the pool. However, the retaining wall and a small portion
of the concrete pad still encroach into the easement (see Exhibit A). Typically retaining walls and
concrete pads are not allowed in such easements due to access requirements and maintenance
needs by the City. Staff has reviewed the proposal closely, and has determined that general
maintenance can still be achieved.
By entering into this hold harmless and easement encroachment agreement the property owners
agree to cover all expenses due to damage and/or removal of improvements (wall and concrete
pad) that are within the easement.
ACTION REQUIRED
The City Council is requested to approve the hold harmless and easement encroachment
agreement with Daniel and Shirley Fairbanks, property owners at 15575 Bluebird Street NW.

HOLD HARMLESS AGREEMENT
0 AND EASEMENT ENCROACHMENT AGREEMENT
THIS AGREEMENT, made this 2nd day of September, 2008, by and between
Daniel and Shirley Fairbanks, owners of said property noted below and the City of
Andover, a Minnesota Municipal Corporation (hereinafter "City").
WHEREAS, Daniel and Shirley Fairbanks are the fee owners of 15575 Bluebird
Street NW (PIN 23 32 24 21 0027; Lot 4 Block 5, Chesterton Commons 2nd Addition),
Andover, Anoka County, Minnesota; and
WHEREAS, drainage and utility easements exist throughout the property; and
WHEREAS, Daniel and Shirley Fairbanks understand that a retaining wall and
concrete pad (hereinafter "improvements") encroach into said drainage and utility
easements (see Exhibit A);
WHEREAS, the City is willing to acknowledge and agree to an encroachment of
the drainage and utility easements for said improvements assuming certain conditions
are met;
WHEREAS, Daniel and Shirley Fairbanks are aware the area is for drainage and
0 utility purposes and acknowledges that access, maintenance, repair and/or replacement
may be required in said easements resulting in removal of the improvements;
NOW, THEREFORE, in consideration of the foregoing and the City's consent
and approval to the encroachment onto the drainage and utility easements, Daniel and
Shirley Fairbanks hereby agree to hold the City harmless and indemnify the City from
any and all liabilities, and defend against lawsuits, expenses, damages, acts or failures
to act, attorney's fees and court costs, which may arise as a result of Daniel and Shirley
Fairbanks or their successors in interest constructing and maintaining said
improvements upon the utility easements of the City. Furthermore, the City not be held
responsible for any damage to said improvements constructed on the City's easements
if they are damaged or destroyed as a result of the City exercising its rights to access,
excavate, repair, construct or maintain any public improvements within said easements.
The City may require evidence of insurance from property owner to cover the
indemnification required herein.

INTRODUCTION
This item is in regards to approving Compensating Change Order #2 for the above referenced
0 projects.
DISCUSSION
Compensating Change Order #2 depicts the actual project quantities at the unit price bid amounts
(see attached itemization).
The total costs associated with 08-02a, Northglen Area; 08-02b, Grow Oak View Estates; and 08-
11, 2008 Curb Replacement, Sidewalk Repairs, and Pedestrian Ramps; are under the contract bid
amounts.
BUDGET IMPACT
The total project cost ($724,857.23) is less than the contract bid amount of$753,926.39.

INTRODUCTION
The proposed addition to the existing house is shown on the attached survey.
DISCUSSION
The city approved a variance to reduce the front and side yard setback requirements from
40 feet to 35 feet for a previous owner of the subject property in 2004. The northwest
comer of the proposed addition will encroach slightly into the 35 foot setback.
0 The existing house sits at an angle to the property lines. An addition that extends the
west wall flush with the existing structure causes the comer of the addition to encroach
less than one foot into the setback area. Staff discussed this situation with the applicant.
The applicant has elected to pursue this variance request.
The applicant has provided the attached letter as justification for the variance. The letter
references a variance that was recently approved in Woodland Estates 4th Addition. The
Council will recall that variance reduced a comer lot side yard setback from 35 feet to 25
feet to allow a new home to be constructed on the lot.
It should be noted that the subject property contains areas of both wetland and floodplain.
These areas will not interfere with construction of the addition.
An additional finding that can be made in this case. According to the survey prepared by
the applicant's surveyor, 66 feet of right-of-way exists along the west side of the
property. The city typically requires only 60 feet for a local street. The additional width
is a contributing factor to the need for the variance.
Planning Commission Recommendation
The Planning Commission recommended approval of the proposed variance with a 6-0
vote. There was no public input at the public hearing. The Planning Commission did not
0 take issue with the findings that were presented.

My wife and I would like to request a variance to the 40 foot side yard setback as stated in the .

The following items were taken from the City Council Meeting minutes dated May 6th 2008.
0 1) Councilmember Trude stated they may want to change their ordinance for comer lots
where no other homes can be located immediately around the comer.
2) Councilmember Knight stated another thing is that the setback is a line of sight item and
in this case the line of sight is moot because the adjoining piece has nothing to do with
sight.
Item # 1 will apply to our situation because the property owner's home behind us is nowhere
close to the line of sight with our home. Please see the attached aerial photograph.
Item #2 will apply because there is currently no home located in the line of sight and if a home
would be built there it would be because of a development and if that happens we will sell.
We have also included a petition signed by four of our neighbors supporting our addition. Three
out of the four are located directly west of us and would be impacted the most.

INTRODUCTION
The City Council is requested to open the public hearing for assessment of the costs of removal and
replacement of a failed septic system at 2279 154th Lane NW, Project 08-25.
DISCUSSION
0 On April 15, 2008 the City Council ordered the removal and replacement of the failed septic system
and the work was completed by Casper's Excavating within a few weeks after the work was ordered
by the Council. The property owners of the failed septic system at 2279 154th Lane NW did sign a
right of entry consenting to allow the City to complete the need repairs.
Based on the invoiced work, the assessment to be levied against the property is $7,015. The
assessment will be spread over 5 years with a 5.50% interest rate (see attached Special Assessment
Roll).
ACTION REQUESTED
The City Council is requested to hold a public hearing on the assessment for the abatement of a
failed septic system, PrqjFc!,,08-25; and approve the resolution that will direct the property to be
assessed over 5 years at 5.50% for the costs ofperfonning the work.

MOTION by Councilmember to adopt the following:
A RESOLUTION ACCEPTING COMPLETION REPORT AND CALLING PUBLIC HEARING
ON ASSESSING COSTS OF ABATEMENT OF FAILED SEPTIC SYSTEM AT 2279154TH
LANE NW, PROJECT NO. 08-25.
WHEREAS, pursuant to orders from the City Council, the abatement of a failed septic
system has been completed at 2279 154th Lane NW (PIN 22-32-24-23-0004), Lot 2, Block 1,
Nightingale Estates Third Addition; and
WHEREAS, documentation regarding completion of the work is on file at the office of the
City Building Official; and
WHEREAS, the proposed assessments have been found to be in compliance with the City
Council's order to abate the ,immanent health hazard at the described property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Andover that:
1. The City Council hereby accepts the Report for Assessment of the Abatement Costs for
0 the failed septic system at 2279 154th Lane NW.
2. The Council will consider the assessments in accordance with the report and the
assessment of the subject property for all of the costs of abatement pursuant to
Minnesota Statutes Chapter 463.22 and Chapter 429. The abatement project cost for
the property at 2279 154th Lane NW is $7,015.
3. A Public Hearing shall be held on the proposed assessments on the 2nd day of
September, 2008 in the Council Chambers of the City Hall at 7:00 PM and the Clerk
shall give mailed and published notice of such hearing and improvement as required by
law.
MOTION seconded by Councilmember and adopted by the
City Council at a reQular meeting this 2nd day of September , 2008 , with
Councilmembers voting in favor of the resolution, and
Councilmembers voting against, whereupon said resolution
was declared passed.

The City Council of the City of Andover will hold a public hearing at 7:00 p.m., or as
soon thereafter as can be heard, on Tuesday, September 2, 2008 at Andover City Hall,
1685 Crosstown Blvd NW, Andover, Minnesota The purpose of the public hearing is to
review costs associated with the completion of the ordered abatement (of a failed septic
system) and assess those costs against the property located at 2279 154th Lane NW, -

A RESOLUTION ORDERING ABATEMENT OF FAILED SEPTIC SYSTEM AT 2279 154TH
Lane NW
WHEREAS, pursuant to a City Code, the abatement of a failed septic system at 2270 154th
Lane NW (PIN #22-32-24-23-0004)) needs to begin as the property owner has not taken
action to correct an imminent health hazard; and
WHEREAS, documentation regarding notifications from the Building Official and City
Attorney indicates the property owner has had ample opportunity and notifications to correct
the situation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Andover that:
the City Council orders the Building Official to move forward with obtaining three quotes to
repair the septic system at 2279 154th Lane NW; and order the property assessed for the
work to be completed by the contractor with the lowest responsible quote.
o MOTION seconded by Councilmember ORTTEL and adopted by the
City Council at a reoular meeting this 15th day of Aoril ,2008, with
Councilmembers GAMACHE. TRUDE. ORTTEL. KNIGHT. JACOBSON voting in favor of the
resolution, and Councilmembers NONE voting against, whereupon said
resolution was declared passed.

INTRODUCTION
Each year the City Council is required by state law to approve a preliminary budget and submit a
preliminary levy certification to Anoka County Property Records and Taxation Division by
September 15th. .

DISCUSSION
0 The 2009 Preliminary Levy certification is the outcome of the numerous budget workshops held
with the Council over the summer. The Preliminary 2009 Budget proposes a total property tax
levy of $10,593,520: $6,879,236 (64.94%) operational levy, $2,241,965 (21.16%) debt service
levy, and $1,472,319 (13.90%) capital levy. The Council has the right to reduce or keep constant
this levy until the final certification date of December 29, 2008. The proposed levy will result in
a approximately 4.04% increase in the tax capacity rate.
Please note that the proposed levy includes the second year of the Open Space Referendum levy.
BUDGET IMP ACT
This is 'the first step in establishing an operating budget for 2009.
ACTION REQUIRED
The Andover City Council is requested to receive a brief presentation, discuss and approve the
attached resolution that indicates a total preliminary levy of $10,593,520 to be submitted to the
Anoka County Property Records and Taxation Division by September 15th.

WHEREAS, the City of Andover receives significant financial support from its residents through the payment
of property taxes; and

INTRODUCTION
Anoka County Property Records and Taxation Division requires a City Council resolution
changing bonded indebtedness levies for 2009 that would have been certified to Anoka County as
part of prior years bond sales.
DISCUSSION
When the City issues bonds, a certification of the bonded indebtedness levy is sent to Anoka
0 County. The County is charged with assuring on an annual basis that local government bonded
indebtedness payments are made. To assist in monitoring, the County is requesting a resolution
that would update all or a portion of previously certified bonded indebtedness levies.
Attached is a resolution to update bonded indebtedness levies along with a brief description as to
why there was a change. .
BUDGET IMP ACT
The 2009 City of Andover Debt Service Budget is current and up-to-date. This resolution is to
inform the County of any changes that have taken place in the past year as well as any new
issuances proposed to be levied for 2009.
ACTION REQUIRED
The Andover City Council is requested to approve the attached resolution that would update

This year the Andover City Council is required to hold Truth in Taxation meetings. These meetings give the
public the opportunity to comment on the proposed 2009 budget and tax levy.

The first hearing date selected by the City will be for the initial hearing to present the proposed levy and
budget to the public. If the initial hearing is not sufficient for all public comment and further discussion is
required, a continuation hearing will be necessary. The date and time of continuation hearing must be
announced before the close of the initial hearing and the continuation hearing must occur at least 5 but no
more than 14 business days after the initial hearing. If a continuation hearing is not necessary, the City must
announce the date and time of a subsequent hearing for the official adoption of the final levy and budget.

INTRODUCTION
The proposed addition to the existing house is shown on the attached survey.
DISCUSSION
The city approved a variance to reduce the front and side yard setback requirements from
40 feet to 35 feet for a previous owner of the subject property in 2004. The northwest
comer ofthe proposed addition will encroach slightly into the 35 foot setback.
The existing house sits at an angle to the property lines. An addition that extends the
west wall flush with the existing structure causes the comer of the addition to encroach
less than one foot into the setback area. Staff discussed this situation with the applicant.
The applicant has elected to pursue this variance request.
The applicant has provided the attached letter as justification for the variance. The letter
references a variance that was recently approved in Woodland Estates 4th Addition. The
Council will recall that variance reduced a comer lot side yard setback from 35 feet to 25
feet to allow a new home to be constructed on the lot.
It should be noted that the subject property contains areas of both wetland and floodplain.
These areas will not interfere with construction of the addition.
An additional finding that can be made in this case. According to the survey prepared by
the applicant's surveyor, 66 feet of right-of-way exists along the west side of the
property. The city typically requires only 60 feet for a local street. The additional width
is a contributing factor to the need for the variance.
Planning Commission Recommendation
The Planning Commission recommended approval of the proposed variance with a 6-0
vote. There was no public input at the public hearing. The Planning Commission did not
take issue with the findings that were presented.
