Present: Commissioners Don Jacobson, Mike Knight, Ken Orttel (arrived 6:03 p.m.), Julie Trude and Voting Resident Member Joyce Twistol Absent: Voting Resident Member Robert Nowak: Also present: Executive Director, Jim Dickinson Community Development Director, Will Neumeister City Engineer, Dave Berkowitz Others APPROVAL OF MINUTES June 17, 2008 Regular Meeting: Correct as amended Commissioner Trude stated on page 2, line 11 to add "The EDA concurred". Motion by Knight, Seconded by Trude, approval of the Minutes as amended. Motion carried unanimously. (Nowak: absent) UPDATE ON MVP SPORTS ACADEMIES Mr. Neumeister received an email from John Larkin stating that he has exhausted all his opportunities to attract investors and will be withdrawing his request for a time extension. Motion by Trude, Seconded by Orttel, to acknowledge MVP Sports Academies withdrawal of the purchase agreement for land in Andover Station North. Motion carried unanimously. (Nowak: absent) ADD ITEM TO AGENDA Motion by Jacobson, Seconded by Trude to add on item number 6, Discuss Bruggeman Properties Request to the agenda. Motion carried unanimously. (Nowak: absent) Andover Economic Development Authority Meeting Minutes - July 15,2008 Page 2 UPDATE ON EDDYS/KWIK TRIP ,Mr. Neumeister updated the EDA on what Eddy Prater is proposing. Mr. Prater is interested in Lot 1, Block 1, Andover Station North. Mr. Neumeister stated the building would be built in two . phases. Phase one being the auto body'repair business and phase two being an auto retail mall. Mr. Prater's goal being, the EDA would be willing to change the guidelines to allow this type of business in Andover Station North. Mr. Neumeister stated allowing this business under a Conditional Use Permit would give the EDA considerable control. Voting Resident Member Twistol stated her concern with the look of the large garage doors that will be seen from the intersection of 139th Lane and Hanson Boulevard. Commissioner Jacobson asked what would happen to the property if Mr. Prater decided not to build phase two. Mr. Neumeister responded the property would be marketed with the same game plan. Commissioner Knight asked how long the option would be. Mr. Neumeister stated that has not been discussed. Commissioner Orttel asked if Mr. Prater has talked to any potential tenants. Mr. Prater stated he has talked to Budget Car Rental. Commissioner Jacobson asked what purchase price has been discussed. Mr. Neumeister stated $4.50 to $5.00 per square foot. Mr. Dickinson recommended that staff sit down with Mr. Prater to talk price and for Mr. Prater to submit a letter of intent. Hanson Boulevard elevations were discussed. Commissioner Orttel stated he would like to see refined drawings. Mr. Dickinson summarized on the direction the EDA is going: 1. Mr. Prater coming back with a basic elevation drawing. 2. Staff to work with Mr. Prater on price. 3. Discuss options of phase one and two. President Gamache requested staff to take pictures of the site from the intersection at Hanson Boulevard. Andover Economic Development Authority Meeting Minutes - July 15,2008 Page 2 UPDATE ECONOMIC DEVELOPMENT ACTIVITIES Mr. Neumeister updated on the following: Dry Cleaners Site (Golden Eagle IT) - They are working with city staff to put in the driveway. Moose & Co. Grill House - Small changes are needed on the site plan. DISCUSS BRUGGEMAN PROPERTIES REQUEST Mr. Neumeister stated Bruggeman Properties is requesting the EDA reduce their land purchase price on their existing units. Mr. Dickinson stated $105,000 note is due at the end oftbis year. 24 units have been released. By contract 1.2 million is due for the entire site with the final payment being in 2010. EDA is the developer and the lien holder. Commissioner Orttel asked about lessening the term of the payment. Mr. Dickinson would prefer to restructure the note rather than lower the price of the lot. Commissioner Orttel mentioned a different layout on the units for them to sell better. Mr. Neumeister stated he has mentioned that to Bruggeman. The EDA directed Mr. Dickinson to negotiate the note with Bruggeman. Motion by Jacobson, Seconded by Knight, to adjourn. Motion carried unanimously. WWW.CI.ANDOVER.MN.US TO: EDA President and Board ~ CC: Jim Dickinson, Executive Director ~ FROM: Will Neumeister, Director of Community Development U/a4- SUBJECT: Discuss Changes in Allowable Uses / Potential Land Sale to Eddy Prater (continued) DATE: September 2, 2008 INTRODUCTION As a follow up to what was indicated by the EDA at the July 15th meeting, the Praters have hired an architect to prepare an elevation drawing showing the style of building they would like to build. They are willing to work with the EDA on the architectural design details. They understand that all vehicles in need of service would need to be kept inside at all times. They also know that if they would like to pursue any auto sales, they also would need to be kept inside; and all of this would be controlled by the Conditional Use Permit process. The Andover Station North Design Guidelines would need to be amended to take auto related industries off the list of excluded uses (see attached list of uses). DISCUSSION EDA is requested to review the attached drawings and provide comment on whether they are willing to change the allowable uses in the Design Guidelines for Andover Station North to allow auto repair services. Some neighboring property owners have sent letters of objection (see attached). Based on comments from EDA members at previous meetings, the lot development sketch was modified to show how to position Eddy's auto repair facility on the lot. The Praters are thinking of purchasing the eastern Y2 of the parcel for their initial building needs and also writing an option on the west Y2. The second phase of the land purchase would be to create an auto-services related mall (including such uses as a retail parts store, car wash, sound system installer, car rental, claim processing center). They have indicated that they would be interested in developing the entire auto mall but it would be done as they generate interest from other auto-service related business owners, thus the need for phased land acquisition. ACTION REQUESTED The EDA is asked to review the Prater's drawings and make a fmal determination whether the EDA is willing to modify the uses (conditional) in Andover Station North to allow auto-repair services. If the EDA makes an affirmative decision on that issue, please direct staff to begin working with the Praters on a "Letter of Intent" on the east Y2 of the lot located east of the ballfields. Andover Station North Uses List. 1.06 "Property" shall mean all of the real Property submitted to the provisions of these Design Standards, including all improvements located on the real Property now or in the future. The Property as of the date of the adoption of the Design Standards is legally described on Exhibit A. 1.07 "Permitted Uses" shall mean the permitted uses of the Property be limited to community commercial, office, entertainment, builder' sshowcase, office warehouse and residential as defined below. The uses shall be limited to those as defined herein. If there is a question as.to whether or not a use meets the definition, the Economic Development Authority shall make that interpretation. 1.08 "Community Commercial" shall mean the establishments engaged in commercial operations including retail trade and services and hospitality industries. PROJECT DESIGN STANDAlIDS The purpose of the Andover Station North development is to provide for the orderly and integrated development of a high quality Commercial Center that includes a mix of shops, offices, office/showroom, entertainment, housing, recreation, community facilities, and open space. The Andover Station North Design Standards are intended to encourage creative application of specific design principles to the Property. The goal of the design review process is to provide a framework for performance based communication, collaboration, negotiation and accommodation. The following are the primary categories of the Andover Station North Design Standards: 2.01 Site Plan 2.02 Landscaping 2.03 Architecture 2.04 Parking 2.05 Lighting 2.06 Signage 2.07 Minimum Standards 2.08 Maintenance, Alterations, Construction, Noxious Activities, Temporary Structures 2.09 Residential Design Standards 2.01 Site Plan - Each site plan submitted within the Property shall be reviewed to be in substantial compliance with the following: A. Site Planning to Preserve Natural Assets-While the network of required streets is fixed, many site decisions remain for other streets and for buildings. B. Views and Vistas-Site planning shall recognize the role that street alignment and topography contribute to visual prominence. Andover Station North Design Standards March 20, 2007 . Andover, MN 55304 Subject: Further development of Andover Station North While Mayor Gamache is 'just taking one and moving it to another section of town", the homeowners of forty town homes in Bunker Lake Village have a decidedly different view point on the Prater application. Comments quoted in the July 25th edition of the Union newspaper suggest all that is needed by your office and the Council are professional drawings so as to have a "better idea of what the building would look like". I have great concern that the Prater request is being given special consideration . The request by Eddy Prater involves a simple "yes" or "no" vote" by the your office and the City Council., based on the original plans that described what types of business would be permitted in this development. It is difficult to concede that the Prater request fulfills the basic intent of the North Station development nor the over-all objectives of your department.. Allocating seven acres of auto repair business within Andover Station North is inconsistent with the information the Mayor Gamache provided us at the 2005 Andover summer outdoor event. Standing beside a detailed layout, he assured my wife and I that no strip mall, nuisance type business, etc. would be permitted. One need only observe the existing auto repair facility to conclude that moving it to Andover Station North is not a viable choice. Approval of the Prater request simply sets a tragic precedent, a situation that can become more contentious with each subsequent application for similar consideration. Simply moving a business to "the eastern part of the city" fails to meet any logical test of what constitutes economic development in Andover. The jobs at Prater's already exist, ..how can they be "bringing jobs" ? In conclusion my question is, "How could the Andover City Council revoke a CUP without incurring legal expense?" Is revocation of a CUP a remedy for an original poor decision. Andover, MN 55304 ~ Letter from Neighbors RECEIVED To: Will Neumeister, Community Development Director AUG 4 2008 From: Ron Mitchell, President of Bunker Lake Village Home Owners Association CITY OF ANDOVER RE: Request of Eddy's Auto Body Repair to Relocate in Andover Station North Date: July 30, 2008 The Board of Directors of the Bunker Lake Village Home Owners Association would like to go on record as to their opposition to the relocation of Eddy's Auto Body Repair. It is our understanding that the request is for it to be located in the northeast corner of the Andover Station North development. This would put it right along Hanson Blvd. directly across from our Town House development. We feel that it makes more sense to leave the business where it is at. It is now located where other commercial businesses are located instead of relocated directly across from one of the newest residential developments in the city of Andover. It now shares an area where there is a gas station business, and a bus company both of which deal with the automotive business. We understand there are some businesses now in Andover Station but they are on the west and south side and also are completely different businesses then an Auto Body Repair business that would have numerous cars parked at the facility at any given time. One only has to look at the existing business now on Bunker Lake Blvd to understand further the point we are making. We would like to commend the City of Andover for the excellent job that was done in cleaning up Bunker Lake Blvd. Years ago it was very unsightly and now has been developed into a beautiful Blvd. Please do not undo any of this fine work by changing Hanson Blvd. We hope you will seriously consider the concerns of many homeowners with this request for relocation. We cannot see any advantage for the City of Andover to grant the request. The business has been in existence for some time so there would be no additional jobs created in the city or any additional tax base created. We would be more then glad to meet with the council as they debate this request. Thank you! Mr. T's Dry Cleaners - The EDA approved the site and architectural plans. The CUP was approved for dry cleaner processing and drive-thru on July 1 st. They're working on pre-selling some of the space in their proposed building to get SBA approval to build the entire building. If they don't get enough committed to buying, then they may only build half of the building initially. Blue Fin Pool & Spa - The purchase agreement has been signed and they have paid the $5,000 down payment. They obtained architectural and site plan approval at the EDA meeting on June 17th. They are getting their financing for an SBA loan, but they will need to reduce how much space they are finishing off. They may delay the construction of the mezzanine level until later. The water main and sanitary sewer are being installed now, so that the site is ready for fall construction. Moose & Co. Grill House - Thel purchased the property on April 1 st. The CUP for the on-sale liquor was approved by the City Council on April 15 . They have completed the Commercial Site Plan review and a building permit is sitting here ready to go. They only need come in and pay the fees. They indicate they are very close to pulling the building permit. Light Industrial Building (Dynamic Sealing Technologies) - They are ready to move into the building. They have indicated they will probably exercise the option to buy the lot south of their building. OffICe Development - Staff has been marketing the site through both the MSP and CoStar web sites. Staff will continue to market the site and if any potential buyers surface we will bring forward any and all offers. Once the street at 139th is open and the new monument sign is completed, that should help to make things easier to sell. Monument Sign - LeRoy Sign Company has begun building the next new sign along Hanson Blvd. (at 139th Avenue) and it will be done by the third week of September. It will look exactly like the new one on Bunker Lake Blvd., just east of First Regions Bank. Kwik Trip Convenience Store/Car Wash - Kwik Trip has a signed letter of intent to buy Eddy's Auto Body. At the EDA meeting this evening, more discussion will occur with the EDA on the Eddy's move to a site in Andover Station North and whether the uses list will be modifIed or not. Laura Heppner has indicated that she will need another extension to allow her time to put the proper tenants in the building and obtain her SBA financing and will need another extension to allow her to take down the property and begin construction in the Spring of2009.
