PLANNING AND ZONING COMMISSION MEETING - APRIL 11, 1995
MINUTES
The Regular Bi-Monthly Meeting of the Andover Planning and Zoning
Commission was called to order by Chairperson Jay Squires on April 11,
1995, 7:00 p.m. at the Andover City Hall, 1685 Crosstown Boulevard NW,
Andover, Minnesota.

APPROVAL OF MINUTES
March 28, 1995: Page 5, Motion for Woodland Pond 2nd Addition
Preliminary Plat, change "real estate signs" to "area
identification signs".

MOTION by Peek, Seconded by Jovanovich, to approve the Minutes with the
amendment as noted. Motion carried unanimously.
PUBLIC HEARING: SPECIAL USE PERMIT - KENNEL LICENSE - 208 166TH AVENUE
NW - DEBBIE BRINK
7:01 p.m. Mr. Carlberg reviewed the Special Use Permit request of
Debbie Brink for a kennel license to have up to six adult dogs at 208
166th Avenue NW. The applicable ordinances and criteria to be examined
were noted. This would be a private kennel.
MOTION by Doucette, Seconded by Peek, to open the public hearing.
Motion carried unanimously. 7:08 p.m.

Debbie Brink, 208 166th Avenue NW - stated she has been training and
working with dogs for eight years. She currently has three dogs that
have won American and Canadian national obedience titles as well as
other competitions. She is very active with her dogs and has been paid
to fly to demos allover the united States. She is requesting the
license because the first dog was recently attacked by a neighbor's dog;
and after two surgeries, she didn't know if the dog will recover. The
other dogs are eight and six years old. She wants to try to breed one
and keep the puppy so she can keep the same line. Also, she wants to be
able to continue with competition, and she'll need to begin that process
before her present dogs die. They live on seven acres at the end of a
cul-de-sac. The dogs are house dogs and are well behaved. There have
been no complaints from the neighbors. When outside, the dogs are
controlled verbally and are always under supervision. She does a lot of
work with them in the cul-de-sac off leash. At this time, she has no
fenced-in enclosure. That would be a big expense.

Mr. Carlberg stated Staff did not receive any comments or concerns on
the request. Commissioner Doucette stated she talked to the neighbor
north of this residence, who had no problem with the request. There was
some discussion by the Commissioners on fencing. Mr. Carlberg didn't
know whether that could be made a requirement if it is an economic
hardship. There has not been a problem with Ms. Brink's dogs. It is
unlikely there will ever be any development behind them because of the
wetland, so there aren't many neighbors. Inspections are not made
annually unless complaints are received. If there are problems, the
Council can take steps to revoke the Special Use Permit. In another
instance when fencing was an issue, the operation boarded other dogs.
That is not the case here.
MOTION by Luedtke, Seconded by Jovanovich, to close the public hearing.
Motion carried unanimously. 7:16 p.m.
MOTION by Apel, Seconded by Peek, to forward the Resolution prepared by
Staff and recommend to the City Council to approve the Special Use
Permit request of Debbie Brink for a kennel license. The only change
would be to eliminate No. 4 on the Resolution. Motion carried
unanimously. This will be placed on the May 2, 1995, City Council
Agenda. 7:18 p.m.

OTHER BUSINESS
Mr. Carlberg explained the City Council would like to hold a joint
meeting with the Planning Commission on the issue of externalities.
Because the Planning Commission agenda is quite long for April 25, Staff
is recommending the meeting be scheduled for May 9 from 6 to 7 p.m.
Mr. Carlberg also reviewed the Council action taken on various items at
the April 4, 1995, regular meeting.
MOTION by Putnam, Seconded by Jovanovich, to adjourn. Motion carried
unanimously.
The meeting was adjourned at 7:25 p.m.
