Consider 2008 Softball/Baseball Tournament Application DATE: July 17, 2008 INTRODUCTION This item is pending in regard to considering a softbalVbaseball tournament application form for the 2008 softbalVbaseball season as requested by the Andover Baseball Association. DISCUSSION The city staff was anticipating that baseball tournament application would be received from the Andover Baseball Association for August 1st -3rd. Below are currently all the tournaments left to be played that have been scheduled along with this tournament. - July 18-20/ ABA/End of the Season/ Fields 1-6 at Sunshine Park and Field 7 at City Hall - July 18-20/MYAS State Tournament 14A/Andover Station North Facility (west, middle & east fields) - July 25-27/AAA/Senior High Co-Ed End of Season Tournament! Fields 1-4 at Sunshine Park & Field 7 at City Hall - August 1-3/ABAI---1Andover Station North - August 2-3/AAA/Field of Dreams Tournament/ Fields 1-6 at Sunshine Park, Eveland Fields (north, middle & south fields) - September 20-~1/AAA/Field of Screams Halloween Tournament/Fields 1-6 at Sunshine Park ACTION REQUIRED If the application is received prior to the meeting, the Park & Recreation Commission is requested to consider approving the tournament application form from the Andover Baseball Association. FOR SPRING AND SUMMER USE - FIRST THURSDAY IN MARCH FOR SOCCER, SOFTBALL AND BASEBALL. NOTE: Scheduling decisions will be made at the PRC meeting on the third Thursday in March. FOR FALL USE - THIRD THURSDAY IN JULY FOR SOCCER, SOFTBALL, FOOTBALL AND BASEBALL. NOTE: Scheduling decisions will be made at the PRC meeting on the third Thursday in July. It is the policy of the City of Andover to try to meet the recreational needs of its citizens. The goal of the Park and Recreation Commission in scheduling is to allot the limited number of recreational facilities in a fair and equitable manner, using compromise when necessary to accommodate the maximum number of requests possible. Facility requests submitted by the due date with this completed form will be given the highest priority. Subsequent requests will be filled on a first-come, first-served basis if facilities are available. The sequencing of scheduling will be considered with City youth associations having first priority. In regards to sections 2.1.2, 2.1.3, 2.1,.4 and 2.1.5 of the Andover Field Use Guidelines, all required items have been provided to the City of Andover with prior applications and all items are currently in place and in good standing. If you have any questions or require any additional information, please let me know. Concerning the scoreboard controllers, how does Friday around 11 :30am sound? Please confirm that the guys have checked the electrical at Prairie Knoll prior to then. If not, I'm open most days next week. DISCUSSION Attached are applications received from the Andover Football Association (AFA) and the Andover Athletic Association (AAA). No application from the Andover Baseball Association (ABA) has been received to date. AFA has requested use of Sunshine Park Fields 1-6 and all fields at Andover Station North Ball Fields from August 1 st - November 1 st. The Andover Athletic Association (AAA) based on the application submitted has requested to use fields 1-4 at Sunshine Park from July 22nd - August 26th on Tuesday nights. Starting September 2nd, AFA will be using the Sunshine Park fields 1-4 on Tuesday nights. The proposed 2008 fall softball/baseball/football schedule is attached for your review. When the deputy arrived, the juveniles were gone. He checked the surrounding area and nothing appeared unusual. 04.03 1528 1530 Prairie Knoll . 08073263 A resident reported a vehicle doing "brake stands" in the parking lot. The deputy arrived and spoke to the driver. She admitted she was driving recklessly and the deputy observed deep tire marks in the gravel. The woman was issued a citation for unreasonable acceleration. 04.04 1557 1606 Fox Meadow 08074243 A resident reported a vehicle tearing up the parking lot. When the deputy arrived, the vehicle was gone. 04.17 1705 1707 Bunker Lake Park 08084941 A deputy received a call of a reckless driver - going in and out of ditches. The caller was following the vehicle; the suspect vehicle fled when they noticed the caller following. The deputy got the license plate from the witness and followed up with the registered owner. .The RO said his granddaughter drives the vehicle and he will have a "stern" talk with her about the privileges of having a vehicle. 04.22 0906 0908 Fox Meadow 08088915 An Andover City Park employee reported that unknown individuals stole four frisbee golf course baskets and posts from the park. 04.21 1528 1533 Sunshine Park 08088414 Deputies received a report of juveniles drinking alcohol at the park. The deputies made contact with the juveniles who stated it was "senior skip day" and denied drinking alcohol. The deputies smelled alcohol and cited three of the juveniles for drinking. 04.25 1738 1742 Prairie Knoll 08091874 A resident called for extra patrol concerning parking issues at the park. The deputy drove through the area and all cars were parked legally and there was plenty of parking room. Information for extra patrol was passed along to other Andover deputies. 04.25 2205 2214 Terrace Park 08092072 A resident called about two juveniles starting a fire on the playground. The deputy arrived and extinguished the fire and the juveniles were gone upon arrival. 04.28 1707 1719 Prairie Knoll 08095002 A resident reported several cars parking illegally at the park. The resident requested extra patrol and the information was given to the Andover Park CSO and other deputies. 04.29 1629 1637 Wild Iris 08094964 A caller reported a pounding and screaming noise coming from the woods. The deputies checked the area and found nothing. They also spoke with several basketball players who stated that they did not hear anything. 05.05 2017 2020 Red Oaks 08099956 A resident advised there were juveniles riding a dirt bike in the park. The juveniles were gone when the deputy arrived. 05.08 2029 2033 Terrace Park 08102510 A caller reported juveniles vandalizing the swings in the park. The deputy arrived and the juveniles were gone. 05.09 2210 2210 Hidden Creek East 08103506 A CSO contacted a deputy to respond to the location due to kids who had fled when they saw the squad. The CSO caught and detained the juveniles and a resident stated they were causing trouble in the park. The deputy arrived and found marijuana on one of the juveniles and he was issued a citation and returned to his guardians. 05.15 1444 1450 Sunshine Park 08108583 Deputies received a call of two males fighting at the park. When the arrived they found one person who looked like he was in a fight. Through investigation they discovered the other participant and both were issued Disorderly Conduct citations and returned to their parents. 05.16 2131 2134 Fox Meadows 08109815 A resident was going to make a report about activity in the park but she changed her mind and canceled the deputy. 05.21 2303 2305 Prairie Knoll 08114799 A deputy was asked to check a vehicle that was in the park. The vehicle was unoccupied and no one was around. There was nothing odd or criminal about the vehicle. 06.26 1716 1717 Hidden Creek East 08119295 A resident reported a soccer net damaged at the park. She believed juveniles had damaged it. However there was a severe thunderstorm that day and it is possible it was damaged by the wind; nothing suspicious. 06.18 1453 1505 Strootman 08141481 A resident reported ATV's in the park. Through investigation the deputy located two juveniles who denied riding the ATV's in the park but witnesses identified them. Both were issued a citation. 06.29 2311 2315 Cedar Crest 08151381 A resident reported a suspicious vehicle parked across the street from the park. The deputy made contact with the vehicle occupants and they were talking. They were warned about being in the park after hours and curfew violations. One mother was called to the scene to pick up two female juveniles. 07.06 1932 1932 Bunker Hills 08158806 A resident requested a "no tag/tow" because her vehicle broke down and she needed to park there overnight. 07.08 0254 0326 138 Ave 08160010 A deputy responded to a call of a vehicle parked on the street where two males got out and were walking. The deputy made contact with the individuals. They were under 18 and verbally warned for curfew violation and advised about the ordinance about city park closing times. The were asked to leave and they complied. 07.08 2309 2311 Sunshine 08160798 A deputy responded to a report of loud juveniles in the parking lot. He arrived and found three occupants that were in a car. They were advised the park was closed and that they needed to leave; they complied. 07.08 1813 1813 Hiills of Bunker Lake West Park 08160564 A resident reported her wooden privacy fence was damaged; the damage is consistent with a vehicle backing into the fence. She also stated that the problem is ongoing because people are parking on a grassy area at the park where there is "no parking". We currently do not charge the clubs or associations for regular league play (that includes in house and travel) we also allow each association that has in house tournaments - one free one per year, per association. It is the intent of this policy to grant priority use for organizations and groups that may desire the use of specific facilities for a specific period of time. The priority system is a listing from highest to lowest in terms of reserving specific times and facilities by organizations or groups. . Each priority lists the following: . Requirements that the organization or group must meet to fall within that priority; . Amount of use each priority will be eligible for; and . The uses that will require fees. It is also the purpose of this policy to ensure priority scheduling and use of athletic facilities is for Woodbury residents. Woodbury residents are defmed as living, or attending school full-time in Woodbury. However, if an organization or group desires to host a tournament that will bring in teams from outside the community, then the residency requirements will not need to be followed. The City of Woodbury reserves the right to determine if an outdoor athletic facility shall be considered "a scheduled facility". or not. In other words, the City may decide that it is in the public's best interest to periodically not schedule specific outdoor athletic fields. Examples would include the need to rest a field for maintenance or safety purposes, or make specific outdoor athletic facilities available to the public at large due to demand. POLICY PRIORITIES: Priority I: City ofWoodburv Administrative Directive AD-Parks and Recreation - Outdoor Athletic Facility Use Policy Page 2 of7 Requirements - Activities that are directly organized as part of the City's Parks and Recreation Department programs or directly sponsored by the City as a cooperative program. (Examples: City offered adult programs, summer playground programs, special events open to the entire community.) , Use - Use will be based on the needs of the program. Needs will be established annually and communicated to the Field coordinators at the field-scheduling meeting respective to the scheduling season. Fees - Fees will not be charged. Priority II: Public and Private Schools Requirements - Schools must be located within the City of Woodbury and there must be an agreement in place that provides the City with the reciprocal use of the school's athletic facilities. Use - Use will be limited to weekday activities and concluding prior to or at 5:30 p.m. The types of uses allowed will be for organized school programs and physical education classes, provided there is no disruption to the City's normal maintenance of the facilities. Limited use (Fees will be assessed) will be allowed for later weekday hours and tournaments provided there are no scheduling conflicts with Priority I or Priority III groups. Fees - Fees will be charged if the City is providing the field maintenance. including lining or field preparation. Fees will also be charged field fees for practices. scrimmages or. games outside Mon. - Fri. activity time from 2:45 -5:30 p.m. at the resident rate per hour or day. Priority ill: Non-Profit.Youth & Adult Or2anizations and GrouDs Requirements - Must be a Woodbury, non-profit, public service organization or group. "Woodbury" is defined as located or based in Woodbury. "Non-profit" means a not for profit organization as defined by State Statues. "Public service" is defined as a group organized to provide a public service to the entire City of Woodbury or all individuals in the City of Woodbury with the age group being served. ORGANIZATIONS WHICH REOUEST PERMITS TO OFFER ONGOING PROGRAMS ON , SCHEDULED OUTDOOR ATHLETIC F A CIL TIES ARE REOUIRED TO COMPLY WITH THE FOLLOWING GUIDELINES. 1. Participation shall be for those 18 years and under and shall be ninety percent (90%) .Woodbury residents. This residency requirement is organization wide. Each year before the scheduling meeting, a listing of organizational members must be submitted to the City of Woodbury with names, addresses and sport to prove residency requirements. 2. Each year before the scheduling meeting, proof of non-profit status as defmed by State statute, must be submitted to the City of Woodbury. Each year, a financial statement shall be submitted to the City of Woodbury and made available to the public upon request. This statement must indicate revenues, expenditures and fund balances. 4. A copy of current bylaws, policies and procedures, which govern the operations, shall be on file with the City of Woodbury and submitted to any resident of the community upon request. 5. A copy of the current board of directors, contacts shall be submitted to the City of Woodbury. 6. The association is open to all City Of Woodbury residents and may not discriminate based on race, ethnic background, or religion, or ability, however, may make team assignments based on ability. There will be a policy in place describing the formation ofteams, which will be submitted to the Parks and Recreation Department by January 1, and made available to any resident of the community upon request. 7. The organization shall have a coach's certification training program in place for head coaches of all sports and it shall address sportsmanship values, safety and liability. A copy of this coaches training program shall be submitted to the City of Woodbury. 8. All board meetings are open to the public. The election of the governing body shall be a process, which is open to all members as defmed by the bylaws of the organization. 9. The organization shall have a policy in place for dealing with members that have special economic, physical and/or social needs. This policy shall be in writing, approved by the board, submitted to the City of Woodbury, distributed to its members and made available to residents upon request. 10. Organizations wishing to utilize fields/facilities for clinics or camps for the benefit of the organization only will be required to work with Recreation Supervisor in determining fees for that facility. Depending upon the requests, the Recreation Supervisor may limit the number of camps/clinics per sport. 11. The organization shall have liability insurance in place in an amount equal to the statutory maximum liability of a government unit with the State of Minnesota as set forth in state law naming the City of Woodbury as an additional insured. A copy of this insurance must be submitted to the City of Woodbury Parks & Recreation Department at the time of field reservation. The current statutory limits are $1,000,000 for each occurrence. 12. The organization and the City hereby mutually agree to indemnify and defend each other from any claims brought or actions filed against either of the parties hereto, for injury or death to any third person or persons, or damage to property of third person, arising out of the negligent acts of the agents, employees, and representatives of either party as they relate to the shared use of the City of Woodbury fields and facilities. The intent of the indemnification requirement of this Article is to impose upon the party against whom a claim is being made a limited duty to defend Administrative Directive AD-Parks and Recreation- Outdoor Athletic Facility Use Policy Page 4 of7 and indemnify the other party against whom a claim is being made a limited duty to defend and indemnify the other party for claims arising out of the actions of the employees, agents, or representatives of the party against whom the claim is being brought, subject to the City's limits of liability under Minnesota Statutes Chapter 466. The purpose of creating these reciprocal duties to defend and indemnify is to simplify the defense of liability claims by eliminating conflicts among defendants, and to permit liability claims against multiple defendants from a single occurrence to be defended by a single attorney. Under no circumstances, however, shall the City be required to pay on behalf of itself or other parties any amounts. in excess of the limits of liability established in Minnesota Statutes Chapter 466. As an act of good faith and for the Health & Well being of all participants the City of Woodbury recommends that the associations do background checks on coaches, volunteers and board members. Use - Use shall be based on the needs of the program and shall not interfere with Priority I and II use. The City will establish dates each year by which the organization must submit requests for field reservation use in order to utilize their priority status. After that date. fields or facilities will be reserved on a first come. first served basis. Fees - Fees will only be charged for tournaments for field maintenance & concession use as long as the organization is providing for field improvements/changes through their organization and addressed within bylaws or policies and procedures. If that is not being met; per person fees will be assessed for use of the fields. The "per person" fee for 2007 will be $lO/person per season. Fees will also be charged if special layouts & maintenance that is outside the scope of daily or weekly/maintenance and time and material basis. Priority IV: All other Woodburv Ore-anizations and GrouDs Requirements - Reservations must be made by a Woodbury resident and organizations or groups must have more than 75% Woodbury residents participating in the use to receive the resident rates as established within City of Woodbury fee ordinance. 1. A listing of the team with names and addresses must be submitted prior to reservation to prove residency status for on-going reservations. 2. The organization shall have liability insurance in place in an amount equal to the statutory maximum liability of a government unit with the State of Minnesota as set forth in state law naming the City of Woodbury as an additional insUred. A copy of this certificate of insurance . must be submitted to the City of Woodbury Parks & Recreation Department at time of field reservation. Use - Use shall be based upon requests and will be filled after completion offield allocation of Priority I-III requests. --------------------- Administrative Directive AD-Parks and Recreation- - Outdoor Athletic Facility Use Policy Page 50f7 Fees - Resident fees will be charged for use and determined annually by the City of Woodbury Parks & Recreation Department and outlined within the City of Woodbury fee ordinance. Priority V: Non-Resident GrouDs and For Profit CamDs/Clinics Requirements - The reservation may be made by a resident or non-resident of the organization or group which has less than seventy-five percent (75%) Woodbury residents participating in the use. For profit means revenues in excess of expenses will be generated as the result of the use and the excess revenues will not be used for the benefit of the organization as a whole. 1. The organization shall have liability insurance in place in an amount equal to the statutory maximum liability of a government unit with the State of Minnesota as se~ forth in state law naming the City.ofWoodbury as an additional insured. A copy of this certificate of insurance must be submitted to the City of Woodbury Parks & Recreation Department at time of field reservation. Use - Use shall be limited to availability of athletic facilities and shall not interfere with Priorities I - IV use. Requests will be filled after completion offield allocation of Priority I-IV requests. Fees - Non-Resident Fees will be charged for use and determined annually by the City of Woodbury Parks & Recreation Department and outlined within the City of Woodbury fee ordinance. Individual Field Rental Requirements - The reservation may be made by an individual or. team, not associated with an organized group for a one time or limited use basis. Use - Use shall be limited to the availability of athletic facilities and shall not interfere with Priorities I - V use. Fees - Fees will be based upon the place of residence. Resident rates will apply if renter (person asstuning responsibility) lives within the City of Woodbury. Fees will be assessed in two hour increments or on a daily rate basis as outlined within the City of Woodbury fee ordinance. PROCEDURES: . The Parks and Recreation Department will on a yearly basis evaluate organizations to determine if the requirements are met and will issue a statement regarding the organizations priority standing. Organizations wishing to be evaluated for priority standing must submit required documents by the due date established by the City of Woodbury Parks & Recreation Department. No field/facility permits will be issued to individual teams within an organization. The Parks and Recreation Department will coordinate athletic facility reservations and will provide a timeline each year by which organizations and groups must submit requests in order to utilize their priority status. After that date, facilities will be reserved on first come, first serve basis. . The City will only authorize reservations and changes throughout the reservation period with one field coordinator per organization or sport. The reservation must be made by an individual 18 years or older. . If organizations or groups are at the same priority level, then.the organization or group that serves the highest number of Woodbury residents will receive the higher priority status in terms of reserving athletic facilities. The City of Woodbury will not require those organizations to work together in meeting the needs of the organization with lower priority. . Any organization or group, which fails to provide for and follow the guidelines, set forth above, or provides false information is subject to revocation of its athletic facility use reservation at the discretion of the Parks and Recreation Department. . No organization or group will be allowed to sublease athletic facilities without City approval. The City will not authorize subleasing for profit, or for programs that compete with City programs. RAIN OUT PROCEDURES: In the event of inclement weather or saturated ground*, fields will be closed to ensure the safety of participants and to prevent turf damage. Inclement weather includes: a. Thunderstorms (thunder, lightening and/or hail) b. Heavy rain storms and/or saturated ground* c. Heavy frost or snow cover d. Extreme Temperatures e. Any weather condition that may be dangerous to participants or damage fields. *Saturated ground refers to standing water on a field or conditions when the ground is so wet that use of the field will damage the turf. The decision to close fields will be made by City of Woodbury Parks and Recreation Department staff. The decision to close fields will be made as follows: a. When fields are closed the Parks & Recreation Department will send an e-mail to the Field Scheduling Coordinators identified at the beginning of the season by the sport directors. It is the sport's Field Scheduling Coordinators responsibility to contact all coaches involved with cancellation information. b. Weekdays: When possible, the decision to close fields will be made by 2:00 p.m. If inclement weather conditions develop after the office closes, the umpire/referee or the park maintenance staff on duty will make the decision to close fields. - ------ --------------- --- Administrative Directive AD-Parks and Recreation- Outdoor Athletic Facility Use Policy Page 70f7 c. Information in regards to field closings will be recorded on the Parks & Recreation Department information line. d. Information in regards to field closings will also be sent out to sport directors and field scheduling coordinators through the City of Woodbury's "In Touch" system. City of Woodbury and District 833 personnel reserve the right to close fields under special circumstances. Field Scheduling Coordinators and their athletic associations will be held financially responsible for any turf damage caused by the use of fields during inclement weather, by the use of fields with saturated ground or by the use of fields in a negligent or inappropriate manner at any time. (Le. hitting balls into fences (soft toss), batting practice when not using mound or home plate). Damaged fields may be closed for extended periods to allow for turf repair arid restoration. These various agencies will have up to 6 months to review the plan. . Sunshine Park Irriaation Well - The pump that is necessary to pump water from the well has been sized. The City is waiting for delivery of this. Also electrical service still needs to be installed from the building to the well. This project is a proactive approach in achieving these goals. -the site will be seeded with blue grama grass, which is a warm season, short-growing, native grass, which can tolerate dry, sandy conditions (once established). -the intent is to experiment with an alternative form of landscaping; it is hoped that this grass will be aesthetically pleasing, yet be more sustainable and be much less maintenance than conventional turf grass; it can be mowed, but will only need to be mowed a couple times a year; once established, it shouldn't need watering. --some of the seed was donated by Prairie Restorations, Inc. out of Princeton, MN. -a sign will be erected, which will describe the project and inform the public.
