SUBJECT: 4:. Consider Park Dedication Requirements/Round Lake Crossing
(Previously known as Fox Cove) Sketch Plan

INTRODUCTION
This item is in regard to reviewing and determining the park dedication requirements for
the proposed sketch plan.
DISCUSSION
A copy of the sketch plan is in your side pocket of your packet. The location of the
proposed development is on the east side of "the intersection of Round Lake Blvd and
143rd Avenue. The development is proposed to be a Planned Unit Development (PUD),
which will have some smaller sized lots that are below the R-4 single family zoning
district requirement. For the developer to have smaller sized lots, they will need to
demonstrate the benefits that the city will r~ceive to allow.the PUD to happen. One of
the ways they could do this is by offering a new playground equipment to be installed at
Creekridge Estates Park which is located just the east of this proposed development
(see attached location map). It is still recommended that the required park dedication
fee for each lot be paid and the new playground equipment for the park would be
required as part of the PUD.
Note: Most of the Commissioners were not around but there was some playground
equipment in the park at one time but it was removed as the equipment was old and
outdated and the city has not considered replacing the equipment since it was removed.
ACTION REOUIRED
The Park and Recreation Commission is requested to review the proposed sketch plan
and give direction as to the park dedication requirements to the City Council.

INTRODUCTION
As you know, this item was tabled from the last meeting to allow city staff to
contact Connexus Energy about redesigning the proposed locations of the 2
security lights based on direction from the Park Commission for the existing
south parking lot.
DISCUSSION
Attached is the revised outdoor lighting proposal/fee statement to install the 2
lights. One of the lights would be proposed to be located in the northwest comer
of the parking lot near the trail and the other light would be proposed to be
located the center between the entrances to the parking lot.
BUDGET IMPACT
The only funding source available is the 2008 miscellaneous funds as identified
in the CIP. The estimated cost to install 2 security lights is $6050.00 (see
attached fee statement from Connexus Energy).
ACTION REQUESTED
The Park Commission is requested to consider request to install security lighting
for the existing south parking at Prairie Knoll Park.

This proposal includes the cost of all material and labor to install the outdoor lighting system at PRAIRIE KNOLL
PARK, and is valid for 120 days. The system will be connected before your electric meter, and will qualify for
Connexus Energy's Outdoor Lighting Energy & Maintenance rate. This rate adheres to Connexus Energy's published
rate schedule, and is subject to change. Connexus Energy will provide full maintenance on the luminaire(s) and
pole(s) for a period of 25 years (subject to the terms and conditions of Connexus Energy's outdoor lighting policies).

INTRODUCTION
As you know, this item was tabled from the last meeting to allow city staff to
contact Connexus Energy about other options for the lighting of the boat landing.
DISCUSSION
Attached is the revised outdoor lighting proposaVfee statement to install a
security light at the boat landing. City staff did meet the day after the last
Commission meeting to talk about Crooked Lake Boat Landing security lighting
and the electric service that the city will be providing to the shelter. Since a single
phase electrical transformer was needed to provide electric service near the new
shelter, the footage of 473 feet that was needed originally to install a light has
been shorten to 180 feet. In addition, Connexus Energy is also willing to allow the
city to relocate an existing security light that is no longer needed at Terrace Park
that was once used for a free skating rink in the low area at no cost to the city. As
you may recall, the free skating rink was relocated to the ball field area, as this
new location was much easier to maintain by Public Works Parks Department.
BUDGET IMPACT
As mentioned the only funding source available is the 2008 miscellaneous funds
as identified in the CIP. The estimated cost to install the 1 security light is
$1170.00 (see attached fee statement from Connexus Energy).
ACTION REQUESTED
The Park Commission is requested to consider request to install security lighting
at Crooked Lake Boat Access.

INTRODUCTION
This item is a continuation of the agenda from the last meeting in regard to
considering a location for the existing skate park. equipment that the city still
owns.
DISCUSSION
As you may recall, the Park Commission made a recommendation to either
install the city owned equipment at City Hall in the south end of the east parking
lot next to Crosstown Blvd or install the equipment over in the existing parking lot
on the west side of the community center. So with that, staff did forward the
Commission's recommendation to Erick Sutherland, Facilities Manager at the
Andover Community Center and to Jim Dickinson, City Administrator, for their
review and comments. Attached are the comments from both Mr. Sutherland
and Dickinson for your review.
ACTION REQUESTED
The Park and Recreation Commission is requested to consider the preferred
location for the existing skate park equipment that the city still owns.

I'm still have some concerns, but I would like to give it a go in the NW corner of the parking lot if Jim feels we are
ok on any liability issues.
I would like the park commission to cover any potential costs that may arise from damage to the parking lot
or Community Center including any vandalism or other related issues. I'm hoping we can get the sheriffs office to
drive by as much as possible.
There may be some issues during Fun Fest. I've heard the carnival isn't coming this year but there will be other
events in the parking lot that may lead to some conflicts.
I would ask that the skate park be taken down no later then September 5th. The week after Labor Day we start to
get very busy with fall/winter sports.
Lastly, if we do run into problems with vandalism, fighting, or other disruptive behavior I would ask that the skate
park be removed immediately. I will be happy to talk with the core group of kids that may use the park and let
them know that it's in their hands and that they need to be respectful of the equipment, nearby facilities and the
general public that uses the Community Center and nearby children's park.

I agree with Erick, we should give it a try in the NW corner of the Community Center parking lot. Placement of the
equipment in the lot in front of City Hall would create parking problems for the Senior Center, especially on the
days where larger functions are scheduled.
Relative to the Community Center lot, I would like to see a sketch as to how the equipment will be placed. I would
not want to see any equipment in what is currently a drive lane, I would like to see how the area will be sectioned
off, the trash pick up schedule, and the placement of a porta-potty.
As far as other liability issues I am not overly worried as long as we do appropriate due diligence in making the
sectioned off area safe. Vandalism will not be tolerate and if problems occur that disrupt the City's ability to be a
good landlord to the YMCA, the equipment will need to be removed.
I also agree with Erick, that a strong message needs to be delivered to the core group of individuals about our
expectations.

INTRODUCTION
This item is an update of concessions equipment in regards to Andover Station
North ball field facility.
DISCUSSION
Well at this point, the Finance Department is looking at other possible funding
sources to purchase the equipment. But as it stands right now, it appears that
there is not enough funding available to complete the lower level of the building
for this year until either the city finds some funds available in the existing budget
or the Andover Baseball Association dedicates additional funds to complete the
items that need to be completed before the building can open to the public for
use. It appears that about $50,000 and $75,000 is needed to complete the lower
level of the building before it can be opened.
ACTION REQUESTED
No action is necessary as this item was for information only.

. DeveloD Site Plans for all existing parks which indicates the facilities available. (On-Going).
. Andover Station North Ball Field Facility (DrODertv south of the old landfill) - There are some
items that still need to be done including getting the building sprinkled and the bathrooms which is a
must before the publiC can use the building. The city staff/building department did meet and it
sounds as if it will very difficult to finish the lower level unless some funds are made available to the
Andover Baseball Association. The playground equipment has been installed including the fencing.
The wood chips that will be placed around the equipment is scheduled to go in yet this week. If you
get a chance, stop by the site to see for yourself how things are looking.
. UDClate of Park Dedication ImDrovement Fund Quarterlv ReDort - Next quarterly report is due in
July.
. UDClate of Quarterlv Sheriff's DeDartment ReDort on Park Patrol & Vandalism - Next quarterly

. Woodland Crossina Park - The playground equipment has been delivered. The grade work is
pretty much done. It appears that some of the equipment may start going in later on this week. As
you may recall, the structure is designed for 2-12 year olds.
. ComDrehensive Plan (Park & ODen SDace ChaDter) - Nothing new to report. The City Council
reviewed the final draft this past February 61n for all the various chapters of the plan including the
parks chapter. The Planning Department has sent out the draft plan to the surrounding
communities and other governmental agencies for their review and comments. These various
agencies will have up to 6 months to review the plan.
. Sunshine Park Irriaation Well-If you have not been by the park recently, the well driller has been
to the park developing the well which is located on the west side of the ball fields just to the north of
the existing west parking lot. They will test pumping the well this week to see what effects the well
will have on other existing wells in the area. If all goes well, the irrigation system will be connected to
the new well in the very near future. Any questions regarding this, feel free to contact Dave
Berkowitz, City Engineer, at 763-767-5133.

INTRODUCTION
This item was tabled from the last meeting to allow city staff to revise the 2009-2013
Parks Capital Improvement Plan (CIP) to have a positive fund balance for each year.
DISCUSSION
Attached is the revised projected fund balance sheet for your review that was prepared
by the Finance department. As you can see, no projects are proposed for the year
2009 and the skate park has been moved to 2010 due to the possible negative fund
balance in 2008 that needs to be addressed in 2009 so that there is a positive fund
balance.
Note: As always, $25,000 has been budgeted in every year for miscellaneous items.
Just as a reminder, the playground equipment that the Public Works Parks Department
would like to replace as they are either outdated or do not meet the ADA requirement
for 2009 are located in the following parks:
. Meadowoods North
. 138th Avenue Tot Lot
. Timber Trails
Some of the parks that still need access to meet ADA requirements are as follows:
. Timber Trails, Pleasant Oaks, Hawkridge & Rose
Also there are a number of parks that need security lights. Public Works has also
expressed concern that some of the parks need to be updated to provide decent
parking by paving them.
BUDGET IMPACT
Based on the recommendation from the Finance Department, the fund balance for each
of the years 2009-2013 reflects a positive fund balance.

INTRODUCTION
This item is in regards to considering a non-resident fee for the use of the City of
Andover park facilities.
DISCUSSION
As you may recall, this item is being brought forward to the Park Commission at
the request of the Park Commission to determine if a recommendation should be
made to the City Council to charge a fee to non-residents for use the City of
Andover's park facilities. City staff has done some research of various
communities including a couple of the surrounding communities adjacent to the
City of Andover. Some of the responses that we did receive included additional
information about the use of their park facilities, which may be helpful in your
making your decision to move forward with user fees, or not. Attached is a
summary to this item. We have also attached the City of Andover's current 2008
fee schedule for your review.
ACTION REQUESTED
The Park and Recreation Commission is requested to consider a non-resident
fee for the use of the City of Andover park facilities.

RULES FOR USE
1. The approved applicant shall submit a key/damage deposit* or payments, if applicable, to the City Hall prior to
the event. Key and damage deposit fee may be in the form of a personal or cashier's check. A deposit receipt will
be issued. The amount of the deposit returned will be based on an inspection of the facilities. Full deposits
will be
returned as the un-cashed check as soon an inspection of the area occurs and the key is returned to City Hall.
Keys
must be signed out at the City Hall, during normal work hours (Monday-Friday 8 to 4), located at 2241 221st Ave.
NE, and is to be returned the next working day immediately following the activity.
2, The individual requesting the permit must be at least 21 years of age and will be responsible for activities for
park
and other facilities provided for in the permit.
3. The approved permit form must be presented, if requested, by city staff or other responsible authority.
. 4. Alcoholic beverages are prohibited in City Parks.
5. The City of East Bethel is not responsible for any lost, stolen, or damaged property belonging to the permit holder
or any group named therein.
6. Cars are to be parked in designated parking areas or on roadways where Dermitted.
7. Facilities are to be left in good condition. Excessive refuse may subject the permit holder to additional cleanup
or
" maintenance charges as determined by the City. The permit holder waives his/her rights to appeal any additional
charges by accepting the permit for facility usage.
8, All games end at 9:30 p.m.
9. All parks close at 10:00 p.m.
10. Any organization granted use of any City park or other City facility as evidenced by the issuance of a permit shall
provide the. City of East Bethel a Certificate of Insurance in an amount not less than $1,000,000 in aggregate
naming the City as an additional insured. This certificate of insurance must be provided prior to the permit being
issued.

1. The hourly rate is $20 per hour with a minimum time of rental for various fields/sports:

POLICY
PURPOSE
The purpose of this policy is to establish guidelines for the priority use of outdoor athletic facilities in
the City of Woodbury or under control of the City of Woodbury, to provide for the health, safety and
welfare of the public.
It is the intent of this policy to grant priority use for organizations and groups that may desire the use of
specific facilities for a specific period of time. The priority system is a listing from highest to lowest in
terms of reserving specific times and facilities by organizations or groups. ,Each priority lists tIie
following:
. Requirements that the organization or group must meet to fall within that priority;
" . Amount of use each priority will be eligible for; and
. The uses that will require fees.

It is also the purpose of this policy to ensure priority spheduling and use of athletic facilities is for
Woodbury residents. Woodbury residents are defmed as living"or attending school full-time in
Woodbury. However, if an organization or group desires to host a tournament that will b~g in teams
from outside the community, then the residency requirements will not need to be followed.
The City of Woodbury reserves the right to determine if an outdoor athletic facility shall be considered
"a scheduled facility" or not. In other words, the City may decide that it is in the public's best interest to
periodically not schedule specific outdoor athletic fields. Examples would include the need to rest a
field for maintenance or safety purposes, or make specific outdoor athletic facilities available to the
public at large due to demand.

Requirements - Activities that are directly organized as part of the City's Parks and Recreation
Department programs or directly sponsored by the City as a cooperative program. (Examples: City
offered adult programs, summer playground programs, special events open to the entire community.)
Use - Use will be based on the needs of the program. Needs will be established annually and
communicated to the Field coordinators at the field-scheduling meeting respective to the scheduling
season.
Fees - Fees will not be charged.
PriDrity II: Public and Private Schools
Requirements - Schools must be located within the City of Woodbury and there must be an agreement
in place that provides the City with the recipro'cal use of the school's athletic facilities."
Use - Use will be limited to weekday activities and concluding prior to or at 5:30 p.m. The types of uses
allowed will be for organized school programs and physical education classes, provided there is no
disruption to the City's normal maintenance of the facilities. Limited use (Fees will be assessed) will be
allowed for later weekday hours and tournaments provided there are no scheduling conflicts with
Priority I or Priority III groups.
Fees - Fees will be charged if the City is providing the field maintenance. including lining or field
preparation. Fees will also be charged field fees for practices. scrimmages or. games outside Mon. - Fri.
activity time from 2:45 -5:30 p.m. at the resident rate per hour or day. .
Priority ITI: Non-Profit Youth & Adult Or2'anizations and GrouDs
Requirements - Must be a Woodbury, non-profit, public service organization or group. "Woodbury" is
defmed as located or based in Woodbury. "Non-profit" means a not for profit organization as defined
by State Statues. "Public service" is defined as a group organized to provide a public service to the
entire City of Woodbury or all individuals in the City of Woodbury with the age group being served.
ORGANIZATIONS WHICHREOUEST PERMITS TO OFFER ONGOING PROGRAMS ON
SCHEDULED OUTDOOR ATHLETIC F A CIL TIES ARE REOUIRED TO COMPLY WITH THE
FOLLOWING GUIDELINES.
1. Participation shall be for those 18 years and under and shall be ninety percent (90%) Woodbury
residents. This residency requirement is organization wide. Each year before the scheduling
meeting, a listing of organizational members must be submitted to the City of Woodbury with
names, addresses and sport to prove residency requirements.
2. Each year before the scheduling meeting, proof of non-profit status as defined by State statute,
must be submitted to the City of Woodbury.

3. Each year, a financial statement shall be submittecl to the City of Woodbury and made available
to the public upon request. This statement must indicate revenues, expenditures and fund
balances.
4. A COpy of current bylaws, policies and procedures, which govern the operations, shall be on file
with the City of Woodbury and submitted to any resident of the community upon request.
5. A copy of the current board of directors, contacts shall be submitted to the City of Woodbury.
6. The association is open to all City of Woodbury residents and may not discriminate based on
race, ethnic background, or religion, or ability, however, may make team assignments based on
ability. There will be a policy in place describing the formation of teams, which will be
submitted to the Parks and Recreation Department by January 1, and made available to any
resident of the community upon request.
7. The organization shall have a coach's certifi,cation training program in place for head coaches of
all sports and it shall address sportsmanship values, safety and liabil~ty. A copy of this coaches
training program shall be submitted to the City of Woodbury.
8. All board meetings are open to the public. The election of the governing body shall be a process,
which is open to all members as defmed by the bylaws of the organization.
9. The organization shall have a policy in place for dealing with members that have special
economic, physical and/or social needs. This policy shall be in writing, approved by the board, ,
submitted to the City of Woodbury, distributed to its members and made available to residents
upon request.
10. Organizations wishing to utilize fields/facilitiesfor clinics or camps for the benefit of the
organization only will be required to work with Recreation Supervisor in determining fees for
that facility. Depending upon the requests, the Recreation Supervisor may limit the number of
camps/clinics per sport.
11. The organization shall have liability insurance in place in an amount equal to the statutory
maximum liability of a government unit with the State of Minnesota as set forth in state law
naming the City of Woodbury as an additional insured. A copy of this insurance must be
submitted to the City of Woodbury Parks & Recreation Department at the time of field
reservation. The current statutory limits are $1,000,000 for each occurrence.
12. The organization and the City hereby mutually agree to indemnify and defend each other from
any claims brought or actions filed against either of the parties hereto, for injury or death to any
third person or persons, or damage to property of third person, arising out of the negligent acts of
the agents, employees, and representatives of either party as they relate to the shared use of the
City of Woodbury fields and facilities. The intent of the indemnification requirement of this
Article is to impose upon the party against whom a claim is being made a limited duty to defend

and indemnify the other party against whom a claim is being made a limited duty to defend and
indemnify the other party for claims arising out of the actions of the employees, agents, or
representatives of the party against whom the claim is being brought, subject to the City's limits
of liability under Minnesota Statutes Chapter 466. The purpose of creating these reciprocal
duties to defend and indemnify is to simplify the defense of liability claims by eliminating
conflicts among defendants, and to permit liability claims against multiple defendants from a
single occurrence to be defended by a single attorney. Under no circumstances, however, shall
the City be required to pay on behalf of itself or other parties any amounts in excess of the limits .
of liability established in Minnesota Statutes Chapter 466.
As an act of good faith and for the Health & Well b~ing of all participants the City of Woodbury
recommends that the associations do background checks on coaches, volunteers and board members.
Use - Use shall be based on the needs of the program and shall not interfere with Priority I and II use.
The City will establish dates each year by which the organization must submit requests for field
reservation use in order to utilize their priority status. After that date. fields or facilities will be reserved
on a fIrst come. fIrst served basis.
Fees - Fees will only be charged for tournaments for fIeld maintenance & concession use as long as the
organization is providing for fIeld improvements/changes through their organization and addressed
within bylaws or policies and procedures. If that is not being met; per person fees will be assessed for
use of the fIelds. The "pet person" fee for 2007 will be $10i'person per season. Fees will also be
charged if special layouts & maintenance that is outside the scope of daily or weekly/maintenance and
time and material basis.
Priority IV: All other Woodburv Ore:aniZations and GrouDs
Requirements - Reservations must be made by a. Woodbury resident and organizations or groups must
have more than 75% Woodbury residents participating in the use to receive the resident rates as
established within City of Woodbury fee ordinance.
1. A listing of the team with names and addresses must be submitted prior to reservation to prove
residency status for on-going reservations.
2. The organization shall have liability insurance in place in an amount equal to the statutory
maximum liability of a government unit with the State of Minnesota as set forth in state iaw
naming the City of Woodbury as an additional insured. A copy of this certificate of insurance
must be submitted to the City of Woodbury Parks & Recreation Department at time of field
reservation.
Use- Use shall be based upon requests and will be filled after completion offield allocation of Priority
I-III requests.

Fees - Resident fees will be charged for use and determined annually by the City of Woodbury Parks &
Recreation Department and outlined within the City of Woodbury fee ordinance.
Priority V: Non-Resident GrouDs and For Profit CamDs/Clinics
Requirements - The reservation may be made by a resident or non-resident of the organization or group
which has less than seventy-five percent (75%) Woodbury residents participating in the use. For profit
means revenues in excess of expenses will be generated as the result of the use and the excess revenues
will not be used for the benefit of the organization as a whole.
1. The organization shall have liability insurance in place in an amount equal to the statutory
maximum liability of a government unit with the State of Minnesota as set forth in state law
naming the City of Woodbury as an additional insured. A copy of this certificate of insurance
must be submitted to the City of Woodbury Parks & Recreation Department at time of field
reservation.
Use - Use shall be limited to availability of athletic facilities and shall not interfere with Priorities I - IV
use. Requests will be filled after completion of field 'allocation of Priority I-IV requests.
Fees':" Non-Resident Fees will be charged for use and determined annually by the City of Woodbury
Parks & Recreation Department and outlined within the City of Woodbury fee ordinance.
Individual Field Rental
Requirements - The reservation may be made by an individual or team, not associated with an
organized group for a one time or limited use 'basis.
Use - Use shall be limited to the availability of athletic facilities and shall not interfere with Priorities I
- V use.
Fees - Fees will be based upon the place of residence. Resident rates will apply if renter (person
assuming responsibility) lives within the City of Woodbury. Fees will be assessed in two hour
increments or on a daily rate basis as outlined within the City of Woodbury fee ordinance.
PROCEDURES:
. The Parks and Recreation Department will on a yearly basis evaluate organizations to determine if
the requirements are met and will issue a statement regarding the organizations priority standing.
Organizations wishing to be evaluated for priority standing must submit required documents by the
, due date established by the City of Woodbury Parks & Recreation Department. No field/facility
permits will be issued to individual teams within an organization. Field/Facility permits will be
issued to the organization only.

. The Parks and Recreation Department will coordinate athletic facility reservations and will provide a
timeline each year by which organizations and groups must submit requests in order to utilize their
priority status. After that date, facilities will be reserved on first come, first serve basis.
. The City will only authorize reseryations and changes throughout the reservation period with one
field coordinator per organization or sport. The reservation must be made by an individual 18
years or older.
. If organizations or groups are at the same priority level, then the organization or group that serves
the highest number of Woodbury residents will receive the higher priority status in terms of
reserving athletic facilities. The City of Woodbury will not require those organizations to work
together in meeting the needs of the organization with lower priority.
. Any organization or group, which fails to provide for and follow the guidelines, set forth above, or
provides false information is subject to revocation of its athletic facility use reservation at the
discretion of the Parks and Recreation Department.
. No organization or group will be allowed to sublease athletic facilities without City approval. The
City will not authorize subleasing for profit, or for programs that compete with City programs.
RAIN OUT PROCEDURES:
In the event of inclement weather or saturated ground*, fields will be closed to ensure the safety of
participants andto prevent turf damage. Inclement weather includes:
a. Thunderstorms (thunder, lightening and/or hail)
b. Heavy rain storms and/or saturated ground*
c. Heavy frost or snow cover
d. Extreme Temperatures .
e. Any weather condition that may be dangerous to participants or damage fields.
*Saturated ground refers to standing water on a field or conditions when the ground is so wet that use of
the field will damage the turf.
The decision to close fields will be made by City of Woodbury Parks and Recreation Department staff.
. The decision to close fields will be made as follows:
a. . When fields are closed the Parks & Recreation Department will send an e-mail to the Field
Scheduling Coordinators identified at the beginning of the season by the sport directors. It is
the sport's Field Scheduling Coordinators responsibility to contact all coaches involved with
cancellation information.
b. Weekdays: When possible, the decision to close fields will be made by 2:00 p.m. If
inclement weather conditions develop after the office closes, the umpire/referee or the park
maintenance staff on duty will make the decision to close fields.

c. Information in regards to field closings will be recorded on the Parks & Recreation
Department information line.
d. Information in regards to field closings will also be sent out to sport directors and field
scheduling coordinators through the City of Woodbury's "In Touch" system. Please
encourage those wishing to receive these updates, to sign up through the City of Woodbury
web site at www.cLwoodbury.mn.us.
e. City of Woodbury and District 833 personnel reserve the right to close fields under special
circumstances.
Field Scheduling Coordinators and their athletic associations will be held financially responsible for any
turf damage caused by the use of fields during inclement weather, by the use of fields with saturated
ground or py the use of fields in a negligent or inappropriate manner at any time. (i.e. hitting balls into
fences (soft toss), batting practice when not using mound or home plate). Damaged fields may be closed
for extended periods to allow for turf repair and restoration. '
