()'Lt Vicki V olk City Clerk Attach: Minutes 1 2 ANDOVER CITY COUNCIL CLOSED SESSION MEETING - MARCH 18, 2008 3 MINUTES 4 5 6 The Closed Session Meeting of the Andover City Council was called to order by Mayor Mike 7 Gamache, March 18, 2008, 8:46 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, 8 Andover, Minnesota. 9 10 Councilmembers present: Don Jacobson, Mike Knight, Ken Orttel, Julie Trude 11 Councilmember absent: None 12 Also present: City Attorney, Scott Baumgartner 13 Director of Public Works/City Engineer, Dave Berkowitz 14 City Administrator, Jim Dickinson 15 16 17 PUTNAM LITIGATION 18 19 City Attorney BaUmgartner explained the Putnam's have filed a process of appeal and it is 20 currently in litigation. Mr. Baumgartner and City Administrator Jim Dickinson met recently 21 with Mr. Putnam and his attorney. They offered a proposal to try to resolve this. They currently 22 have twelve developable lots and their proposal was if they could get fourteen lots out of the 23 parcel and reduce the amount of the assessments to $250,000. They would also like to remove 24 that street connecting the two neighboring developments. 25 26 Councilmember Orttel stated they had talked about that connection and thought it was not 27 needed. Mr. Dickinson stated he concurred with that, but the Fire Chief would still be requesting 28 the street connection. 29 30 Mr. Berkowitz explained how the land would look with a development built on it. 31 32 Councilmember Jacobson asked what the appraisal said. City Attorney Baumgartner stated the 33 appraisal was for $850,000 based on the twelve lots. He agreed that the maximum would be to 34 allow fourteen parcels but no discount on the amount. 35 36 Councilmember Jacobson asked how much it would cost to go to litigation. Mr. Dickinson 37 stated part of his concern about litigation is not knowing how this will go especially with the 38 current status of the economy. 39 40 Mayor Gamache asked if it would be worthwhile to make a financial counter offer. 41 42 City Attorney Baumgartner recommended that they not do anything with lowering the 43 assessment but allow the two additional lots. 44 45 Councilmember Jacobson stated he would agree with Councilmember Orttel to give them the 46 additional two lots and not offer them a lower assessment. Andover City Council Closed Session Meeting Minutes - March 18, 2008 Page 2 1 2 Council Consensus was to allow two additional lots on the property but no reduction in the 3 assessment fees. 4 5 Councilmember Trude wondered if Mr. Putnam would need to pay fees for the new lots. 6 Berkowitz stated that would be a minimal amount because the area charge was covered for the 7 entire parcel. The only thing extra they would need to cover through an assessment would be 8 connection fees. 9 10 The closed session adjourned at 9:00 pm to return to the City Council meeting for adjournment. DISCUSSION Claims totaling $597,224.75 on disbursement edit lists #1 - 4 from 03/20/08 to 03/27/08 have been issued and released. Claims totaling $814,629.23 on disbursement edit list #5 dated 04/01/08 will be issued and released upon approval. BUDGET IMPACT The edit lists consist of routine payments with expenses being charged to various department budgets and projects. ACTION REQUIRED The Andover City Council is requested to approve total claims in the amount of $1,411,853.98. Please note that Council Meeting minutes will be used as documented approval. DISCUSSION The well proposed at Sunshine Park will be considered a test well. This test well will determine if there are adverse impacts to surrounding wells in the area including Andover Elementary's Irrigation Well, City Municipal Wells and Private Wells. If the test pumping rates do not impact the surrounding wells, the test well will be used to irrigate the entire Sunshine Park complex. BUDGET IMPACT The well at Sunshine Park would be funded from a combination of the Parks Operation Budget for 2008 and Capital Equipment Reserves. The cost estimate for this well is $ 40,000. This cost also includes monitoring of the surrounding municipal and private wells. Berkowitz, Director of Public Works/City Engineer SUBJECT: Approve Sanitary Sewer Lateral Charge Refund for the Sophie's South Development - AdministrationlEngineering DATE: April I, 2008 INTRODUCTION As directed by the City Council at the March 25,2008 City Council Workshop staffhas presented a solution to facilitate the refund of a sanitary sewer lateral extra depth charge that was collected from Mr. Winslow Holasek as part of the Sophie's South development project. DISCUSSION Mr. Holasek has requested that the extra depth lateral charge that he paid back in August of 2005 to lower a lateral sanitary sewer main to serve his property south of the Sophie's South development be refunded. This was discussed in detail at the March 25th City Council Workshop. The City Council suggested a compromise to allow the refund to be made with interest as long as the original fee of $15,000 plus the Index from the Engineers News Record is collected at the time of development of Mr. Holasek's property, if the north sanitary sewer line is utilized as part of the new plat. If the area is served by a pipe from the south, the fee would no longer be required. If this option is acceptable to the City Council staff recommends that the fee be identified on the City's Fee Schedule so that it can be collected in the future. BUDGET IMP ACT The $15,000 plus interest would be refunded from the City's Sanitary Sewer Trunk Fund. Subject: Riverside pipeline construction update Good morning Jim, With construction season just around the corner, I want to give you a brief update on communication, easement acquisition and construction activities taking place with the Riverside Pipeline project. Communication: . Preconstruction meeting: On 03-04~08, contactors, other utility providers, and city staff interested in the project (city engineers / public works directors, etc) participated in a preconstruction meeting to review the final pipeline route, discuss concerns that may not have been raised to this point, and learn about the construction schedule. In addition to that general pre-con meeting, we will be happy to meet individually with city staff to discuss in even greater detail the construction timeline and other issues of particular interest to your community. . PUC notification: On 03-06-08, a complete set of engineering drawing (outlining the pipeline route) was sent to the Public Utility Commission, per the notification requirements outlined in the Pipeline Routing Permit approved by the PUC in 2006. CenterPoint Energy was required to send the PUC the plan drawings 14 days prior to the start of 2008 construction - which has now been done. . . Customer notification: On 03-15-08, a packet of information containing information about the project, a copy of the Pipeline Routing Permit, and letter reminding people about the project, will be sent to property owners along the route. A copy of that letter is attached FYI. The city of Andover will also be receiving that packet of information in the mail, since the city is a property owner along the route. . Other: All property owners along the route were contacted by phone and/or in person as part of the easement acquisition process. Given this, everyone should be aware that the final phase of construction will be starting this spring. In addition, a Riverside Pipeline telephone number (612-321-5329) has been set up and is being monitored daily, in the event property owners have questions or concerns throughout the project. Eas ment acquisition: . Easements have been obtained from most of the property owners along the route. In a small number of cases, the terms of an agreement have not been reached, prompting the need to included those particular properties in a condemnation proceeding. In Hennepin County, there are three such properties that will be reviewed in a hearing on 03-10-08. In Anoka. County, seven properties will be discussed at a hearing on 03;..12-08. In all cases, CenterPoint Energy is interested in reaching a mutually acceptable settlement that hopefully works for all concerned. Construction: . Clearing of trees, vegetation, and obstructions along the route will begin 03-24-08 3/26/2008 Page 2 of2 . Construction will begin the week of 04-01-08, with a target completion date of 08-31-08 . Restoration of areas disturbed during the construction process will be restored throughout the project. Jim, I hope you find this information helpful. Administration will provide a brief presentation to the Council relative to the current City revenue and expense forecasts at the meeting. DISCUSSION The following are some suggested 2009 Budget Development guidelines for your consideration (consistent with discussion at the March 25, 2008 Council workshop): 1) A commitment to a City Tax Capacity Rate to meet the needs ofthe City and positioning the City for long-term competitiveness through the use of sustainable revenue sources and operational efficiencies. 2) Continued development of a financial plan to appropriately structure the expenditure of bond proceeds generated from the successful 2006 Open Space Referendum. 3) A fiscal goal that works toward establishing the General Fund balance for working capital at no less than 35% of planned 2009 General Fund expenditures. 4) A commitment to limit the 2009 debt levy to no more than 25% ofthe gross tax levy and a commitment to a detailed city debt analysis to take advantage of alternative financing consistent with the City's adopted Debt Policy. 5) A comprehensive review of the condition of capital equipment to ensure that the most cost- effective replacement schedule is followed. Equipment will be replaced on the basis of a cost benefit analysis rather than a year based replacement schedule. 6) A team approach that encourages strategic planning to meet immediate and long-term operational, staffing, infrastructure and facility needs. 7) A management philosophy that actively supports the implementation of Council policies and goals, and recognizes the need to be responsive to changing community conditions, concerns and demands in a cost effective manner.
