()u& Vicki V olk City Clerk 0 0; 3 4 5 6 ANDOVER ECONOMIC DEVELOPMENT AUTHORITY MEETING 7 FEBRUARY 19,2008 - MINUTES 8 9 10 A Meeting of the Andover Economic Development Authority was called to order by President Mike 11 Gamache, February 19, 2008, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, 12 Andover, Minnesota. 13 14 Present: President Mike Gamache, Commissioners Don Jacobson, Mike 15 Knight, Ken Orttel, Julie Trude, Voting resident members Robert 16 Nowak and Joyce Twistol 17 Absent: None 18 Also present: Executive Director, Jim Dickinson 19 Community Development Director Will Neumeister 20 City Engineer Dave Berkowitz 21 Others 22 o;~ APPROVAL OF MINUTES 25 26 January 15, 2008 Regular Meeting: Correct as written. 27 28 Motion by Jacobson, Seconded by Knight, approval of the Minutes as written. Motion carried 29 unanimously. 30 31 32 ARCHITECTURAL DESIGN (MBG HOLDINGS) 33 34 Mr. Neumeister stated the architectural design for the Moose Knuckles Restaurant is presented 35 for review. Staff recommends more embellishments needed on the stone around the sides and 36 possibly the rear. 37 38 The roofline, screening around the dumpster and the patio plan was discussed. 39 40 Commissioner Trude would like to see the lighting carried around the building and some type of 41 panel to give the building depth. 42 43 Mr. Neumeister stated the architectural design would be brought back to the EDA with the 044 revisions along with the site plan. 45 46 47 0 Andover Economic Development Authority Meeting Minutes - February 19, 2008 Page 2 1 UPDATE ON ECONOMIC DEVELOPMENT ACTIVITIES 2 3 MVP Baseball (John Larkin) - Mr. Larkin is working on financing and is hoping to close by 4 February 29th. 5 6 PUBLIC HEARING: EDA LAND SALES IN ANDOVER STATION NORTH 7 8 Mr. Neumeister indicated there is a correction on the legal description Lot 26, Block 1; it should 9 be lot 24, Block 1. 10 11 Motion by Jacobson, Seconded by Knight, to open the public hearing on the two proposed land 12 sales. Motion carried unanimously. 13 14 Motion by Orttel, Seconded by Knight, to close the public hearing. Motion carried unanimously. 15 16 Motion by Jacobson, Seconded by Knight to approve the resolution with the correction of Lot 24. 17 Motion carried unanimously. 18 019 BUN/fER LAKE BOULEVARD MEDIANS 20 21 Mr. Neumeister stated staff is looking for further direction from the EDA regarding the cost of 22 the Bunker Lake Boulevard medians. Mr. Neumeister has been corresponding with the 23 associations regarding this issue. The associations are not very receptive to picking up the cost 24 of the medians and have other concerns such as the monthly and annual cost of the lighting is 25 getting to the point that could cause vacancies. 26 27 President Gamache asked for a break down of the two associates. Area A which is Andover 28 Station IT everything east of Martin Street. Area B, Andover Station everything west of Martin 29 Street. 30 31 Commission Knight suggested working with the associations about cutting the lighting cost. 32 33 Mr. Berkowitz stated he's been in contact with Connexus Energy about options to reduce the 34 lighting cost. A few of the options are shutting off every other light, a demand and energy rate 35 and energy only light rate. He would like a meeting with Connexus and the associations within 36 the next couple weeks. Bringing the results back to the EDA at a future meeting. 37 38 Jenny Lenhart representative for Andover Station stated the association would like to see the 39 median cost be reduced and the city to help with the cost. 040 41 Mike Mulroney representative for Andover Station IT reported other issues in Andover Station. 42 There is a traffic circulation and safety issue with the traffic coming east on Bunker Lake 43 Boulevard turning on to Jay Street and cutting through the parking lot. He suggested exploring 44 the option of a left turn access only through the median on to Martin Street. Another concern is 0 Andover Economic Development Authority Meeting Minutes - February 19, 2008 Page 3 1 the planting on Jay Street causing visibility issues. Trimming or removing the plantings would 2 help with the safety aspect. The last issue is the median on Bunker Lake Boulevard 3 responsibility should not fall on the associations. 4 5 President Gamache stated the best solution to the traffic issue would be a left turn lane coming 6 from the east on Bunker Lake Boulevard. 7 8 Mr. Berkowitz suggested preparing a drawing of a left turn lane and presenting it to Anoka 9 County. 10 11 President Gamache stated the issues to be looked at is the median cost on Bunker Lake 12 Boulevard, talking to Connexus regarding the light cost, talking to Anoka County regarding the 13 left turn lane from Bunker Lake Boulevard and looking at the plantings on Jay Street. 14 15 Mr. Neumeister stated EDA provided good direction for staff. The item will be brought back to 16 the EDA. 17 18 LETTER OF INTENT/OPTION AGREEMENT (DYNAMIC SEALING TECHNOLOGIES) 019 Mr. Neumeister stated a letter of intent and Option Agreement from Dynamic Sealing 20 21 Technologies, Inc. is being presented. They are offering $10,000 for an Option Agreement on 22 the property, securing the property until July 31, 2009 allowing them time to decide whether to 23 purchase the property. The Purchase Agreement proposes a price of$3.60 per square foot for the 24 land excluding the easements. 25 26 Commissioner Orttel asked what the price is for the lot? 27 28 Mr. Neumeister stated $4.00 - $4.50 per square foot. 29 30 Mr. Dickinson explained the cost incurred by the city regarding the lot. 31 32 Commissioner Trude suggested a closed session in the future regarding the price of the lot. 33 34 Mr. Dickinson stated the EDA is fine with securing the option agreement. A closed session to 35 discuss the fmer details of the price of the lot will be scheduled. Staff will also take the lot off 36 the market. 37 38 Motion by Jacobson, Seconded by Orttel, to adjourn. DATE: March 4, 2008 INTRODUCTION The EDA is asked to review and approve the attached architectural/site design of the proposed Moose Knuckles Restaurant (for MBG Holdings) that is to be built on the parcel ofland located north of First Regents Bank. Also attached is the site plan showing how they will position the building on the lot. Mr. Stoner will be present at the meeting to present materials samples and 0 color schemes he is proposing to use on the new restaurant. DISCUSSION The Andover Station Design Guidelines require the building to be reviewed by the Andover EDA to determine whether the design is in conformance to the qualities the EDA has established for this area. The materials that it will be built of insulated concrete with exterior finish materials that will be stone and EIFS (stucco). The drawings show that they have made modifications to add more stone as requested by the EDA at the last meeting. ACTION REOUESTED The EDA is asked to approve the architectural design and site plan of the Moose Knuckles Restaurant. See attachment. The owner of Blue Fin will be at the meeting to explain the proposal to build an extension onto the shopping center originally constructed by Louis Rudnicki. This 0 would be done to make it look like it finishes the center off and would still leave a portion of the lot for a free standing restaurant or a future shopping center expansion if a restaurant doesn't materialize. See attached plat and location maps. See concept plans showing alternatives that could remain. This seems to be an ideal extension of the shopping center and would still leave options for the future. They are offering a price of $6.50 per square foot with a request for a 3% "representation" fee to Merit Custom Homes. ACTION REOUESTED The EDA is asked to allow the buyers to make a short presentation at the meeting. The EDA is then asked to review/discuss the letter of intent and if there is debate about the offering price, move to closed session. Provide staff direction on whether there is interest in preparing a purchase agreement on the parcel they would like to buy to build a new Blue Fin Pool & Spa store. If there is, then a lot split will need to be prepared and processed as soon as possible. SUBJECT: Consider Allowing Temporary Greenhouse DATE: March 4, 2008 INTRODUCTION Linder's Greenhouse & Garden Center has come forward with a request to locate a "Flower Mart" temporary greenhouse in the parking lot of Festival Foods in Andover Station. The operation would run from April 15th through July 20th and would require a Conditional Use Permit. 0 DISCUSSION An attached letter from the applicant provides information about the operation and aesthetics of the "Flower Mart". Drawings and photographs are included as attachments with this report to provide additional information. The applicant will also be present to provide background information and to answer questions. , Andover Station Design Guidelines Specific design standards above and beyond the City Code were adopted by the Economic Development Authority (EDA) to regulate Andover Station. The EDA reviews all development proposals for conformance with these standards. The Andover Station Design Guidelines do not allow temporary structures. There is, however, an exception to the standards for special sales events. Please refer to the following excerpts from the Andover Station Design Standards: Section 2.07 Minimum Standards . Temporary Structures No temporary building or other temporary structure shall be permitted on any lot; provided, however, that trailers, temporary construction buildings, and the like shall be 0 permitted for construction purposes during the period of construction or alteration of a permanent building. Such structures shall be placed as inconspicuously as practicable, shall cause no inconvenience to owners or other occupants of other lots, and shall be removed not later than 30 days after the date of substantial completion for beneficial 0 occupancy of the building in connection with which the temporary structure was used. Section 5.02 Special Events The provisions of these Design Standards do not apply to and do not prohibit periodic, non-permanent business promotions and special event sales events conducted on a lot by the owner or occupant. In no event shall any sign be placed on any lot or parcel of land for a period to exceed thirty (30) days out of a twelve (12) month period. These provisions from the Design Guidelines effectively prohibit the proposed greenhouse. If the EDA decides to endorse the proposal, then it will need to decide if a variance should be granted to the above sections, or if the guidelines should be amended to allow the greenhouse proposal without a variance. Location The proposed location for the "Flower Mart" is roughly in the middle of Andover Station's shared parking area (see attachments). This location will allow for good traffic circulation around the operation without blocking any major sight lines. The central location does not dominate the parking area for any particular existing tenant and preserves the vast majority of parking stalls for shoppers. Festival Foods, United Properties, and Linder's Greenhouse are all amenable to this location. Staff Recommendation 0 The greenhouse operation can provide a benefit to the all the businesses in the Andover Station development, provided it is clean, well-managed, and organized. The Linders "Flower Mart" has a good reputation and staff feels it could draw more people that would otherwise be attracted to the commercial development. Staff recommends approval of the proposal. Additional Comments If the EDA determines that the proposed greenhouse operation is permissible, then the Planning Commission and City Council will review the Conditional Use Permit application and apply appropriate conditions, one of which may be to allow a one year trial period. ACTION REQUESTED The EDA is asked to determine if the proposed temporary greenhouse operation will be allowed to be considered by the Planning Commission for the Conditional Use Permit. If the EDA agrees to move it forward, it must also decide if a variance to the Design Guidelines is appropriate, or alternatively if the Design Guidelines should be amended to allow this use without a variance. ABOUT LINDER'S: Linder's is a family business and has been growing and selling high quality flower and vegetable plants for over 90 years. We grow most everything we sell other than nursery stock, some perennials, and specialty items, and have two large growing locations: St. Paul and Lake Elmo. During the last eighteen years we have developed our "Flower Marts" and have placed them throughout the Twin Cities. In 2007 we operated at forty eight different locations. During our season we sell all types of annuals, perennials, hanging baskets and other products for use in the home garden. Because we are well known as a quality grower, many gardeners seek us out to supply their planting needs. Locating in areas around the cities enables us to serve our customers better. This could be an opportunity to serve our customers in your community with a nearby convenient shopping location where they can buy quality plant materials from a local Twin Cities grower. We are experienced in this kind of operation and feel that we are doing an excellent service fot our customers and our surrounding communities. LOCATION: The area needed is typically 90 feet by 60 feet (about 5,400 sq. ft). This size includes the garden center itself and the patio areas connected to the Flower Mart. We will locate in a place that is some distance from the front of the other businesses and out of the main stream of traffic, both pedestrian and vehicular. We want to give the Flower Mart visibility to the public without obstructing the visibility of the other neighboring businesses, and at the same time have good visibility in order to attract customers into the lot. TRAFFIC: With regard for vehicle traffic, the "Flower Mart" is placed in the selected location in order to keep any traffic disruption to a niinimum. The patio areas at the front, side and back serve to protect the "Flower Mart" from vehicles and let the drivers see around the garden center. The patio fence is 0 about 4 ft high and surrounds the "Flower Mart" on three sides. This design has been used at our "Flower Marts" for several years and we have yet to have had a problem with vehicle movement. We feel that this is a safe way to deal with vehicles. Placed in this manner, vehicles cannot park adjacent to the "Flower Mart". The circulation of vehicles in the parking lot will not be adversely , affected by the "Flo.wer Mart" due to its location in the lot. PARKING: We have designed the "Flower Mart" as we did because we feel that this is the most professional design and uses the available space to its maximum potential. Linder's has operated "Flower Marts" successfully for ei!!hteen years in communities surrounding the Twin Cities. It has been our experience that the traffic and parking in the lots shared by the "Flower Mart" is not affected considerably due to the sharing of customers with our property owner. We bring in many customers but they are easily handled by the size of the lots we occupy. We do not want to create a congestive atmosphere for our customers or neighboring businesses. The "Flower Mart" generates business activity which varies during the business day with the most activity occurring in late afternoon and evening. There is also business activity occurring on the weekends with the most on Saturdays. Having done this type of operation for eighteen years, it would be safe to say that the average amount iIi the "Flower Mart" at anyone time is about five to six customers. The maximum amount of customers may be up to ten., There are certainly times when special sales occur that higher levels of activity may occur, but we have never seen so much that a problem has occurred in relation to the amount of cars or pedestrian traffic. 0 -i-- 0 THE "FLOWER MART": The typical "Flower Mart" itself is 72 feet long and 21 feet wide and 12 feet high. There are patio/display areas in the front, side and rear of the "Flower Mart". The entire size is 90 feet by 60 feet with total of 5,400 sq feet. See the attached drawing. The size and configuration can be adjusted somewhat in order to meet the available space. The "Flower Mart" itself is a high quality greenhouse structure which sitson the pavement and is held down with an internal system which uses water for ballast. It is a commercially made unit, which is manufactured by a Minnesota company (Poly- Tex, located in Castle Rock, MN).It is a very good looking structure which we have used for many years. ADVERTISING: Linder's has established an extensive advertising program, which includes a large presence on television, with commercials and other appearances by our staff. The Linder's name is synonymous with quality, selection, and service. Our two year warranty on most products has established us as a leader in this industry. We also use radio, both major newspapers, local papers, brochures, and other mailings to convey our message. We make extensive efforts to bring in customers so we can be successful as well as all other merchants. 0 SIGNAGE: The signage for a typical "Flower Mart" is shown on the drawing, This is what we believe tobe'an excellent signage plan. We have tried to design the appearance and signing of our stores ,to be not only eye catching but professional looking as well. We are very conscious of how we look and do business. We would comply with the current sign requirements of the City of Andover. UTILITIES: Our only utility requirements are reasonable access to water for the plants and 110 volt electricity (on 24 hours) which runs the cash register and ,other small items in the "Flower Mart". This power typically comes from a light pole in the lot nearest the "Flower Mart. We have no lighting permanently installed in the "Flower Mart". Linder's takes away all discarded material and unnecessary items. We strive to maintain a clean and professional appearance. Water is the other utility we need. This is needed to care for the plant material at the "Flower Mart". The source ofthe water is not specifically identified at this point. Hopefully a source can be located nearby or from the lll1derground watering system. We only need the equivalent of a standard gardening hose to water the plant material. THE SPRING SELLING SEASON: The selling season to be from April 15 thru July 20 (weather dependent). We typically begin preparations to set up all of the Linder's "Flower Marts" in the middle of March. We request the , , 0 necessary time to build the "Flower Mart" before the season begins. We first deliver the necessary equipment to the location and then begin setting-up the "Flower Mart" when the weather is -~- 0 permissible. The "Flower Mart" is taken down and totally removed on the closing day of the season. We totally clean and sweep the location in the parking lot so that once we are gone there is no evidence of our having been there. OUR HOURS: Our hours are 8:00 AM until 8:00 PM weekdays and 8:00 AM until 8:00 PM on most weekends. We typically have two to three employees during weekdays and three to four during weekends. We are open seven days a week during the season. The "Flower Mart" is closely supervised by myself and several District Managers who keep it stocked and operating cleanly and efficiently. Day Care Site (Griffen Business Holdings) - The signed purchase agreement,and $5,000 in earnest money are both in hand. They've started working with an architect on the site/construction drawings. There is some interest being shown in the north half of the lot by a dry cleaner and they are reviewing whether they can agree 0 to allow them to locate on the adjacent parcel. MVP Baseball (John Larkin) - Mr. Larkin is working to secure financing and did not close on the land on February 29th. He is asking for a short time extension at the March 4th EDA meeting. Restaurant (Moose Knuckles) - Mr. Stoner has made changes to the architectural drawings as directed by the EDA and provided a new set of drawings and would like EDA approval of the architectural design this evening. Light Industrial Building (Dynamic Sealing Technologies) - The Commercial Site Plan review is done and they will be applying for a building permit vel)' soon. They have a desire to have EDA approve an option agreement and agree to sell the lot to the south of the one that they bought last fall. The EDA will discuss that in closed session this evening. OffICe Development (Northstar Partners) - The listing agreement expired on February 29, 2008. They have 72 hours to produce a list of whom they have marketed the site to. EDA will need to discuss alternatives at the meeting as to what they would like to do with the site, staffhas some ideas that they will present. (DSTI) to buy the lot directly south of the parcel they bought last year. They would like to buy Lot 3, Block 3 and the east 35 feet of Lot 2, Block 3 to align with their parcel. See attached Plat Map of Andover Station North for the sites. They are also interested in obtaining an 18-month long option on the land for $10,000 (described above) to give them expansion potential. Their business is in a growth mode and they may need the additional space in a year or two. As explained by their Company President, "DSTI currently employs 23 well paid employees that 0 will help boost local business. The purchase of the second property is to support the forecasted growth to employ possibly double the current amount within the next 3-5 years." DISCUSSION They are offering $10,000 for an Option Agreement on the property for which they interested. The non- refundable option would be to secure the property until July 31, 2009 to allow them time to decide whether they want to purchase the additional land. The Purchase Agreement proposes a price of $3.60 per square foot for the land excluding the easements (including the park dedication and fee), with a price of $1.00 per square foot for the drainage and utility easement area of the lot. Staff has indicated to them that price is too low. The EDA will need to give direction on the offering price and the option price. Staffwill explain at the meeting what offering price is in line with the costs associated that are incurred in the terms that they are asking for. ACTION REQUESTED The EDA is asked to discuss the Option and proposed land purchase from DSTI. Once the EDA has determined a fair market price they feel is acceptable, direct the City Attorney to prepare the Option and Purchase Agreement with those terms and conditions.
