(612) 755-5100 PLANNING AND ZONING COMMISSION MEETING - OCTOBER 8, 1996 MINUTES The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Jay Squires on October 8, 1996, 7:02 p.m. at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. PUBLIC HEARING CONTINUED: SPECIAL USE PERMIT - ANTENNA TOWER IN EXCESS OF 35 FEET - 3017 161ST AVENUE NW - SBA, INC. r- -, \ -...../ 7:03 p.m. Mr. Johnson reviewed the request of SBA, Inc., a consultin~ firm specializing in wireless telecommunications site development, on behalf of Sprint Spectrum L.P. to construct a Personal Communications Services (PCS) tower/antenna of 145 feet in height on a 5.5-acre parcel at 3017 161st Avenue NW. The property is zoned Industrial. He noted the applicable ordinances and criteria to be considered. The property owners, Walter and Bonita Johnson, have agreed to lease a 50' x 50' enclosed area in which the PCS wireless communications structure and ground equipment will be placed. All setback requirements will be met. A 20-foot wide paved bituminous road will lead from the bituminous parking lot to the lease area. The tower is a single pole made of steel and extends 140 feet above the existing grade. Up to 12 directional antennas will be mounted near the top in three sectors. These antennas will be spaced four feet apart and will extend an additional five feet above the tower. Ground equipment will consist of a base transceiver station and a control unit. Sprint Spectrum will be responsible for maintenance issues that arise for the equipment and the road leading to the leased area. The entire leased area will be fenced and landscaped. Fencing will consist of a six-foot high chain link fence secured with barbed wire to prevent unauthorized entry. This will be placed on the November 6 regular City Council meeting which will be held at the Oak View Middle School because of the construction at City Hall. 7:19 p.m. PUBLIC HEARING: SPECIAL USE PERMIT - SECURITY ARM FOR BARBED WIRE TO A MAXIMUM HEIGHT OF EIGHT FEET IN AN INDUSTRIAL DISTRICT - 3017 161ST AVENUE NW - SBA, INC. 7:19 p.m. Mr. Johnson reviewed the request of SBA, Inc., on behalf of Sprint Spectrum L. P. to allow for the placement of a barbed wire security arm on a chain link fence surrounding the 50' x 50' equipment on property being leased at 3017 161st Avenue NW. The chain link fence will be six feet high with an additional one-foot barbed wire security arm attached to the top of the fence to prevent unauthorized persons from accessing or climbing the equipment and tower structure. He noted the applicable ordinances and criteria to be reviewed. MOTION by Peek, Seconded by Barry, to open the public hearing. I U '\ U Regular Andover Planning and Zoning Commission Meeting Minutes - October 8, 1996 Page 3 . / PUBLIC HEARING: REZONING OF PROPERTY FROM R-l, SINGLE FAMILY RURAL, TO R-4, SINGLE FAMILY URBAN - TIMBER OAKS ESTATES - SECTION 36 - WOODLAND DEVELOPMENT COMPANY 7:21 p.m. Mr. Carlberg reviewed the request of Woodland Development Company to rezone approximately 16.64 acres located north and west of the intersection of Bunker Lake Boulevard NW and prairie Road from R-1 to R-4. The property is the location of the subdivision to be known as "Timber Oak Estates" and was recently incorporated in the City's MUSA area for the 1995-2000 time frame for development. The properties to the west and east are currently zoned R-4. He noted the applicable ordinances and criteria to be examined. This is consistent with the Comprehensive Plan and the MUSA map. He did not believe a traffic study has been done by the City, but the Anoka County Highway Department has reviewed the plat and studied the traffic patterns. MOTION by Wells, Seconded by Barry, to open the public hearing. Motion carried on a 4-Yes, 3-Absent (Apel, Luedtke, Putnam) vote. 7:28 p.m. Dave Szykulski. 752 140th Lane NW - lives directly north of this area, which is still zoned R-l. He asked if the six houses along 140th Lane are in the MUSA and are they able to hook up to utilities. Mr. Carlberg explained that area has been included in the MUSA. He stated there would have to be rezoning and the property owners would have to petition to hook up, but utilities are available. Mr. Szykulski - was concerned with the cutting of all the trees. He did not want to see this property leveled like they did to the east and to the north. He'd like to see the property regulated so that most of the trees are not cut down on the property behind him. Is there any way that few to no trees will be cut on that property? He also felt there would be some devaluation of his property because he has been looking at the back woods for 25 years, and now there will be a fully developed neighborhood. He'd like to see larger lots there, similar to those along 140th Lane. If the lot size goes down to 80 feet wide, he would be against the rezoning. Mr. Carlberg stated trees has been a concern to the City Council. The developer has submitted a tree preservation plan, which shows which trees are to be saved. An R-4 designation has City sewer and water, and the lot standards are much smaller. Dave Kochanek. 14035 Palm Street NW - asked about the value of homes in there. He didn't want to see his property values go down because smaller houses are built behind him as well as the cutting down of all of the trees. Mr. Carlberg stated the City does not regulate the value of homes. Byron Westlund. Woodland Development - stated they require covenants and restrictions in their developments which insures a certain type of value. Typically the value of homes in their developments exceeds those of the surrounding area. Motion carried on a 4-Yes, 3-Absent (Apel, Luedtke, Putnam) vote. 7:35 p.m. Commissioner Barry was concerned with the rezoning from the standpoint of increasing the density, thus generating more traffic. She understood the upgrading of roads generally follows the traffic, but she has a concern with safety with all the additional building in that area. With the increase in traffic, there may be a need for lighting. Also, with the increase in population, it is becoming more and more difficult to get from one place to another. It is frustrating that it takes so long before street improvements are made. In the mean time, it is a very serious safety concern. Mr. Haas explained Prairie Road is designated as an MSA road, designed to carry large volumes of traffic. A traffic study is done on MSA roads every two years. The proposal is to improve the intersection of Prairie Road and Bunker Lake Boulevard by adding a turn lane on Prairie Road. Sidewalks are also being suggested in th~ next agenda item dealing with the preliminary plat on this property. He also explained the process the county uses to determine warrants for traffic signals; however, the funding for those signals lags behind the need. I Chairperson Squires also felt it is a frustrating process. will not be with the 26 lots in this development, but when to the east is developed. The pI.oblem Shadowbrook Bvron Westlund. Woodland Development stated the county highway department has reviewed this and is taking additional right of way for the future construction of turn lanes and signals. Mr. Carlberg also explained copies of the proposed plat have been submitted to the school district. No comment has been received yet, but he does talk to district representatives frequently. Commissioner Peek stated that from a planning perspective, once the decision was made to rezone Shadowbrook to the east, it makes sense to bring this into similar zoning. Commissioner Barry agreed; she was expressing an overall concern of development. MOTION by Barry, Seconded by Peek, to forward to the City Council the rezoning for Timber Oaks Estates from R-1 to R-4 as written by Staff. This will be placed on the November 6 regular City Council meeting which will be held at the Oak View Middle School. 7:44 p.m. PUBLIC HEARING: PRELIMINARY PLAT - TIMBER OAKS ESTATES - SECTION 36 - WOODLAND DEVELOPMENT 7:44 p.m. Mr. Haas reviewed the preliminary plat presented by Woodland / Development Corporation for Timber Oaks located in Section 36, Township 32, Range 24, which consists of 26 single family residential lots. Variances are being requested from Ordinance 10, Section 9. 06F for " / \ \.J Regular Andover Planning and Zoning Commission Meeting Minutes - October 8, ~996 Page 5 (Public Hearing: Preliminary Plat - Timber Oaks Estates, Continued) double frontage lots along Block 1, Lots 12-18 and Block 2, Lots 1-5. Variances from Ordinance 10, Section 9.03G are also being requested for the cul-de-sacs north of 139th Lane NW that exceed the maximum length of 500 feet. The Andover Review Committee is recommending a sidewalk along the north side of 139th Lane NW from Palm Street, which is located in the Hills of Bunker Lake 5th Addition, to Prairie Road. It has not been determined who would pay for the sidewalk in that portion of the Hills of Bunker Lake 5th. The proposal was to place the sidewalk along the north side of 139th Lane because of the existing wetlands on the south side. Noting the concern for tree removal during the discussion of the last agenda item, Mr. Haas stated there will be significant grading on this property because of the elevation of the garages, storm sewer and storm drainage. The property will be just about clear cut except for those trees along the borders of the plat. One option the Planning Commission could consider is to request the lots be custom graded. That way the lots would be left alone until the builder comes in to construct the house on the lot pad. That option, however, may not work in this case because the lots need to be made to work for drainage. The Commission asked to see the Tree Preservation Plan. Mr. Carlberg did not have that available but noted that will be given to the I Commission and the Council with all preliminary plats in the future. He also reviewed how the current Tree Preservation Plan works and some of the proposed changes the City is considering to strengthen the plan. Mr. Westlund - stated they have to follow the ordinance, which their grading plan does. All of the documentation they have submitted is done according to the ordinances; however, their goal is to minimize the loss of trees. In all of their developments they have tried to save the trees, even coming to the Council for variances to do so. Mr. Haas stated sometimes it is not known until the streets are cut in whether the lots can be custom graded. The City will look at that as a possibility. (Commissioner Putnam arrived at this time; 8:00 p.m.) Mr. Westlund - stated there is a lot of red oaks and black cherry trees on the property. There is also some oak wilt. Once they can get access to the property and cut the centerlines of the road, they hope to contain the oak wilt. Commissioner Putnam was skeptical that many trees can be saved when there is a shifting of soils from two to four feet 0: the existing grades. Mr. Westlund - stated they have been known to use retaining walls in order to save a lot of trees. Commissioner Putnam stated he did not want to give anyone false hopes of being able to save all of the trees on this parcel. Commissioner Wells was concerned with the remaining sand hills once the area is graded. \. / \ 'J Regular Andover Planning and Zoning Commission Meeting Minutes - October 8, 1996 Page 6 (Public Hearing: Preliminary Plat - Timber Oaks Estates, Continued) Mr. Westlund - stated under MPCA regulations they are required t..:; restore that with black dirt, seed and mulch within 10 days after completion of the grading. They propose to break ground next spring, though there may be some tree removal this fall. Their goal is to get started and complete the project as soon as possible, though they lose some control because the utilities are turned over to the City to become a city project. MOTION by Wells, Seconded by Peek, to open the public hearing. Motion carried on a 4-Yes, 3-Absent (Apel, Luedtke, Putnam) vote. 8:05 p.m. Kevin Hondl. 13963 Palm Street NW - stated the sidewalk as proposed would go on his property. Since the south side is wetland or outlot, he wondered if it could be placed on the south side to avoid some of the problems created on one's property because of sidewalks. He was also wondering about the decrease in his property value if the trees right behind him are all cut down. His deck would then be looking into the driveway of someone else or the side of someone's house rather than the woods. He'd like to see the lot sizes bigger to keep the trees and keep a greater distance between his house and the new one going in. Mr. Haas stated there is wetland on the south side of 139th and approval would be needed from the Coon Creek Watershed to do so. It would depend on the type of wetland as to whether or not a sidewalk could be installe J without mitigation. That possibility can be researched further. The outlot in the Hills of Bunker Lake 5th immediately south of 139th is not buildable now; however, the wetland rules have changed since it was developed. It might be the type of wetland that can be filled without mitigation. If so, it potentially could become a homesite. Right now the City is responsible for plowing all sidewalks. Garv Fox. 13905 Palm Street - stated when he chose to move into Hills of Bunker Lake 5th, this property was zoned R-1 with the larger lot sizes. He would not make an issue of it if the development will make a significant effort to save trees. He is concerned with Block 2, Lot 8 because it has a higher elevation than the Hills of Bunker Lake 5th. More development will mean more drainage into their pond. It is a concern for those homes directly to the west. He also proposed that with the exits onto prairie Road, there is no need to link 139th Lane with the Hills of Bunker Lake 5th. He would propose that the neutral area between the two developments at 139th be for sidewalk only, but 139th would not go through to Palm Street. He foresaw a considerable increase in traffic onto Prairie Road from 139th and their development if that road is put through. Because those in Hills of Bunker Lake 5th have adequate accesses to major roads to the south, east and north, he did not feel the connection at 139th is needed. He asked about th~ City's ordinance for speed control and speed bumps. Mr. Haas stated the speed limit will be posted at 30 mph. Speed bumps have been tried in other locations, and the neighborhood didn't like them. Mr. Fox - stated if 139th must continue to Palm Street, he would recommend the Council consider speed bumps because it is a straight shot , , \ / u Regular Andover Planning and Zoning Commission Meeting Minutes - October 8, 1996 Page 7 (Public Hearing: Preliminary Plat - Timber Oaks Estates, Continued) for 400 homes all the way from Prairie Road to the west, plus there is future park land to be developed. Even now the traffic goes fast. Mr. Haas noted 139th Lane in Hills of Bunker Lake 5th was not constructed to the property line. It was anticipated that 139th would be extended to prairie Road in the future to provide another access out of tha':". development for public safety purposes. Also, the ponding in Hills of Bunker Lake 5th was designed to accommodate drainage from a portion of this property when developed to the R-4 density. Under the new rules, sedimentation ponds will be constructed, so there will be no more discharged into that pond that what is going there now. Mr. Westlund - stated the calculations determined that some of the houses that were constructed in the Hills of Bunker Lake 5th north of 139th were constructed below the 100-year elevation, so they are proposing to develop a swale to help those homes to the west. Mr. Hondl - stated there was some issue about drainage in their back yard and a few houses to the north a couple weeks before they closed on their property. He was concerned with adding additional water to the ponding and having someone's basement flooded. Also, he and his wife cleared a lot of trees on his property for construction and did not replace any. He hoped some trees would remain as a protection. Taking out all of the trees would be removing those he had counted on. j Another resident stated he agreed with Mr. Fox about restricting 139th Lane. There are a lot of smaller children in the neighborhood and there are a number of speeders going through there. There is a stop sign o~ Palm Street and Quince, but nine out of ten cars don't stop. If 139th is put through, it will increase the traffic in that area. It is a safety issue. Steve Olson. 13928 Palm Street - stated the traffic problem on Palm Street is very dangerous. It worries him to have 139th Lane access at Prairie Road and the increased traffic past their yard. The tree issue also worries him. He doesn't want this to be like Shadowbrook where all but a few trees were wiped out. Staff stated the Tree Protection Plan will be available at the City Hall for the residents to review, and it will be provided to the Council before they act on this plat. I Mr. Westlund - stated their plans have been submitted to the Coon Creek Watershed, the DNR and the Army Corps of Engineers as a part of the permitting processes. All permits have been approved, and the wetland replacement plans has been approved and put into effect. He reminded the Commission that this property was part of the controversy as the Hills of Bunker Lake 5th was being developed. Everyone is concerned with the traffic, but he believed most of it will travel east to prairie Road and not travel from Shadowbrook west through Hills 5th. He would be amenable to the construction of sidewalks on the property as a part of the subdivision, but he did not think it could be placed on the south side of 139th because it is within 1,000 feet of Bunker Lake. The DN~ has control over that wetland, and the primary concern is the avoidance of the wetland within that 1,000 feet. Motion carried on a 5-Yes, 2-Absent (Apel, Luedtke) vote. 8:30 p.m. The Commission discussed the proposal that would leave 139th Lane a cul- de-sac and not connect to Palm Street. The consensus of the Commission was that it is a safety issue, plus the need to provide another acces~ for both this development and Hills of Bunker Lake 5th, and that the street should connect to Palm Street as proposed. Commissioner Barry suggested the possibility of constructing more of an S curve through the area, moving 139th Lane further south so it doesn't align directly with 139th coming from Shadowbrook. Mr. Westlund stated it is a site triangle concern and the closeness of the intersection with Bunker Lake Boulevard if the entrance to the plat were to be moved further south. Also, the Anoka County Highway Department has asked that the intersection align because there is a potential for additional traffic control devices to help control traffic. That intersection with the Shadowbrook street was directed by the Council in the sketch plan stage. Discussion was also on the issue of sidewalks. Commissioner Barry questioned the significance of sidewalks, feeling they really do not make it safer. There is also the issue of maintenance. Also, sidewalks were not placed in the Hills of Bunker Lake 5th, and there should be some connection. There is also the issue of a crosswalk across Prairie Road and to get across Bunker Lake Boulevard. She agreed with the sidewalks along prairie Road, but not in the development itself. Mr. Haas explained the Andover Review Committee feels strongly that there is a need for a sidewalk to carry the pedestrian traffic from this development and the Hills of Bunker Lake 5th to the proposed paths along prairie Road and Bunker Lake Boulevard and down to Bunker Prairie Park. It is a safety issue as there will be a number of people who will want to use the trails to get to the parks. Commissioner Peek felt the sidewalk is a benefit because if focuses traffic. He understood the impact this will have to the people already there, but he felt this plat is the most logical and the best development relative to the parcel itself and the integrity with the neighborhood. He would recommend approval. Chairperson Squires supported the sidewalks in the area. There was no emphasis on sidewalks when the Hills of Bunker 5th was developed, but he doesn't think that is a reason not to have them in this plat. There will be a large concentration of the population along Bunker Lake Boulevard and to the north, and this sidewalk will be an opportunity to integrate the neighborhoods with the park to the south and keep pedestrian traffic off the road. It will be a good system if the City continues to develop the network. J / Commissioner Wells had a concern with pedestrian traffic Prairie Road to get to the trail on the other side. Commissioner Putnam was also concerned with crossing Prairie Road and would support having a trail on both sides of prairie Road from 139th Lane south to Bunker Lake Boulevard. He felt that should be looked at, though he didn't know if that would impact the wetland. Mr. Haas stated they will bring that to the Council. MOTION by Peek, Seconded by Putnam, to forward to the City Council the recommendation for approval of the Resolution drafted by Staff. In the second paragraph, "WHEREAS...comments were favorable", amend to state "there was some concerns from the public regarding tree preservation, the drainage impact on adjacent properties, sidewalks and traffic", Motion carried on as-Yes, 2-Absent (Apel, Luedtke) vote. This will be placed on the November 6 regular City Council meeting which will be held at the Oak View Middle School. 8:50 p.m. PUBLIC HEARING: SPECIAL USE PERMIT - AREA IDENTIFICATION SIGN - TIMBER OAKS ESTATES - SECTION 36 - WOODLAND DEVELOPMENT COMPANY 8:50 p.m. Mr. Hinzman reviewed the request of Woodland Development Company to install an area identification sign for the Timber Oaks Estates subdivision at 13948 prairie Road. The sign would measure 32 square feet and consist of a 3' x 8' stone sign supported by two brick / pillars measuring 2' x 2'. The sign would be placed approximately 10 feet from the right of way of both 139th Lane and Prairie Road and would be out of the 50-foot triangle of visibility in that area. Bvron Westlund. Woodland Development - staged the sign will be behind the car which pulls up to prairie Road on 139th Lane. The area will be landscaped with shrubs. Motion carried on a 5-Yes, 2-Absent (Apel, Luedtke) vote. 8:58 p.m. A concern of the Commission was that the sign be placed far enough back so that a car coming from the north on prairie Road would be able to see someone on the sidewalk approaching the intersection of 139th Lane. This will be placed on the November 6 regular City Council meeting which will be held at the Oak View Middle School. 9:00 p.m. \. / , 'J Regular Andover Planning and Zoning Commission Meeting Minutes - October 8, 1996 Page 10 / PUBLIC HEARING: AMENDED SPECIAL USE PERMIT - BULK STORAGE OF LIQUID FUELS (PROPANE) - 13727 HANSON BOULEVARD NW - SUPERAMERICA, INC. 9:00 p.m. Mr. Hinzman reviewed the request of SuperAmerica, Inc., for an Amended Special Use Permit to install a 1,000-gallon above-ground propane tank at 13727 Hanson Boulevard NW. The property is zoned GB, General Business. He noted the applicable ordinances and criteria to be considered. The tank would be located on the south side of the property along Bunker Lake Boulevard. Similar Permits for above-ground storage of propane have been granted to Total Mart and Bill's Superette. The tank would be located outside of the required setbacks. Michael Cronin. reoresentino SuoerAmerica - did not know which side the dispensing unit would be located, but stated it probably would be closest to the entrance of the store, which would be the east end of thA. tank. The refilling nozzle would probably be on the same side as the controls. Commissioner Peek raised a concern about the impact the refilling of the tank and those fueling would have on the traffic lane, especially access to the parking spaces on the south side of the building. He was concerned with pulling up to the tank, the backing out of a parked car, and a car coming into the station at the same time. Mr. Cronin - did not believe there would be a negative impact. The pay phone is there now, and that hasn't been a problem. A customer will I have to go in the store and have an attendant come out to fill from the propane tank. He felt there would be sufficient space for parked cars to back up. Mr. Carlberg also stated there is quite a bit of room there, but they will look at that more closely during the site plan stage. Commissioner Wells asked why it couldn't be on the north end of the lot. Mr. Cronin - stated they are proposing to add a car wash to the north end of the facility, and they do not want to create any congestion at that point. Mr. Carlberg again stated they can study this in greater detail, looking at the vehicular traffic patterns to be sure it doesn't conflict with parking, etc. Commissioner Putnam is familiar with the traffic patterns on that corner, and it seems there is a lot of activity there. He wondered if the tank couldn't be moved further south or even along the western border of the property. MOTION by Wells, Seconded by Barry, to open the public hearing. He asked that the Commission find the use a safe and compatible service for the site and adopt the first six contingencies on the proposed Resolution. He asked that for the seventh contingency, "That a parking space be designated by signage and pavement markings 'for propane tank use only'." the Commission consider allowing them to wait several months before doing so until they can study the traffic patterns. They would then talk with Mr. Carlberg and come back to the City with a proposal as to where the parking space should be designated, or whether such a designation is needed at all. They would like to see how the area is used before striping the parking space. \. Motion carried on a 5-Yes, 2-Absent (Apel, Luedtke) vote. 9:13 p.m. Commissioner Putnam again expressed concern with the location of the tank, though he acknowledged by moving it too far west along that border it would conflict with the corner of the canopy covering the gas pumps. He was concerned with the multiple tracks of traffic in that area. He also felt the controls need to be on the west end to alleviate congestion. Mr. Cronin - stated their preference is that every effort be made to stay with the site on the south side. They will move the phone as far west as possible, but their engineers have determined the south side is the best side for this tank. Chairperson Squires agreed with the concerns raised about congestion at that point and felt moving i ':". further west would eliminate the concern of parked traffic backing up and would get away from the congested area. He also liked the idea of moving the phone as far west as possible. MOTION by Peek, Seconded by Wells, to forward to the City Council the recommendation for approval the Staff prepared Resolution with the following adjustments: Alter Condition Number 7 to read "That a parking space be designated by signage and pavement markings 'for propane tank use only' within 90 days of installation, with the location and installation approved by City Staff." Add Number 8, "That the applicants work with City Staff to examine alternate locations along the south side of the property other than the proposed location prior to the Council meeting." This will be placed on the November 6 regular City Council meeting which will be held at the Oak View Middle School. 9:25 p.m. OTHER BUSINESS Mr. Carlberg reviewed the actions taken by the City Council at its October 1, 1996, meeting. He again noted the change in meeting site to the Oak View Middle School cafetorium of all Commission and Counci 1. meetings for the next few months because of the construction at City Hall. He believed it would be best to always meet in the same location to avoid confusion. He asked if the Commission was agreeable to recei ving the 11" x 17" preliminary plat maps and grading plans as opposed to the larger ones. The Commission generally agreed. Mr. Carlberg also reviewed the ordinance regulation of campaign signs and the problems and actions being taken to enforce those regulations. In addition, he proposed the December 24, 1996, Planning and Zoning Commission meeting be cancelled. The Commission agreed.
