(612) 755-5100 PLANNING AND ZONING COMMISSION MEETING - MAY 28, 1996 MINUTES The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Jay Squires on May 28, 1996, 7:03 p.m. at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Maynard Apel, Lynnette Barry, Jeffrey Luedtke, Randy Peek, Jerry Putnam, Lorna Wells None City Planning Director, David Carlberg Others Commissioners absent: Also present: APPROVAL OF MINUTES May 14, 1996: Pg 3, Variance on Deck at 3220 138th Avenue NW, last sentence, clarify the zoning district is R-4, but the PUD allows commercial as the overlying district in that area. (j MOTION by Apel, Seconded by Wells, to approve the Minutes as amended by Staff. Motion carried on a 4-Yes, 3-present (Luedtke, Peek, Putnam) vote. PUBLIC HEARING: LOT SPLIT - 2735 134TH LANE NW - MICHAEL E. ZIERTMAN 7:05 p.m. Mr. Carlberg reviewed the request of Michael E. Ziertman to split a 1.68t-acre parcel into parcels of .88 and .8 acres that do not meet the minimum district requirements. He noted the applicable ordinances. Park dedication will not be required in this case because buildable parcels are not being created. A condition of the lot split would be to combine the parcels with parcels to the south for tax purposes so they could not be sold separately or built upon. Tract B is proposed to be combined with Tract A and Tract D with Tract C for tax purposes. The parcels would basically be an extension of the back yards and no structures would be allowed them, not even accessory buildings. The lots will remain separate lots of record but combined with the others for tax purposes. The only way to legally combine them would be to replat. ( \, \J Michael E. Ziertman. 2735 134th Lane NW - stated Lot 5 is undeveloped. Orville Tempel lives on Lot 3 and owns half of the parcel being split. He bought the other half from Frank Stone several years ago. He does the upkeep for the area. The intent now is to separate the lots to get the names separate for each parcel so there is no problem when one of them dies. He wants it for an extension of his yard. There was no public testimony, MOTION by Wells, Seconded by Luedtke, Motion carried unanimously. 7:14 p.m. to close the public hearing. MOTION by Apel, Seconded by Wells, forward to the City Council the Resolution granting the lot split/variance request of Michael Ziertman to create two parcels using the Resolution as presented to us by Staff. Motion carried unanimously. 7:16 p.m. This will be placed on the June 18, 1996, City Council agenda. OTHER BUSINESS Mr. Carlberg reviewed the actions taken by the City Council at its May 21, 1996, regular meeting. MOTION by Luedtke, Seconded by Barry, to adj ourn. unanimously.
