HomeMy WebLinkAboutFebruary 24, 1998 ~J o o o u CITY of ANDOVER PLANNING AND ZONING COMMISSION MEETING - FEBRUARY 24, 1998 MINUTES The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Jay Squires on February 24, 1998, 7:38 p.m. at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Commissioners absent: Also present: Maynard Apel, Jeff Luedtke, Randy Peek, Lorna Wells Lynette Barry, Mike Gamache City Planning, Jeff Johnson Others APPROVAL OF MINUTES January 27, 1998: Correct as written. Motion by Peek, Seconded by Luedtke, approval as written. Motion carried on a 5- Yes, 2-Absent (Barry, Gamache) vote. DISCUSSION: VARIANCE TO ALLOW THE EXISTING PRINCIPAL STRUCTURE TO REMAIN DURING THE CONSTRUCTION OF A NEW PRINCIPAL STRUCTURE - 12 177TH A VENUE NW - KENT ALLEN Mr. Johnsonreviewed the variance request of Kent and Kelli Allen to allow more than one principal single family home on a lot and to allow the new principal structure to encroach into the required front-yard setback at 12 177th Avenue NW. The property is about 20 acres and is zoned R-l, Single Family Rural. The applicable ordinances were reviewed. The request is to allow the existing structure to remain until one year after the building permit is issued for the new principal structure, after which it will be removed. The new structure will be constructed directly behind the existing one but will encroach 9 feet into the required SO-foot front yard setback because of the location of the wetland on the property and the water table elevations. In talking with the Building Department, they didn't have a problem with the request. The City is planning on a 120-foot right of way for 177th Avenue. The center line from the property now is 31 feet. Kent Allen - stated he plans to construct a new house behind the existing one. He already has a 40x60-foot pole barn which serves as their garage, so there is still an issue on whether or not they can build without an attached garage. He would prefer not to. The setback for the new structure is 110 feet from the center of the road. They can get between 101 and 102 feet back. Any further back and they have a problem with the wetland, the water table and trees that were planted years ago. Perk tests were not taken, but soil borings were done a couple years ago to find the mottled soils. , J \ '-.J Regular Andover Planning and Zoning Commission Meeting Minutes - February 24, 1998 Page 2 (Variances, 12 177th Avenue NW - Kent Allen, Continued) Mr. Allen also stated the existing structure would not remain until the house is done. They would like to live in that house until the new house is sheet rocked, not until completion. They want to be able to live on the property during that time period to maintain the automatic watering for their livestock. They are also concerned with it being so close to the main road, which increases the opportunities for vandalism if someone is not around. The two structures would be seven to eight feet apart, which is not a problem, as both will be structurally sound. The existing house would be removed after the new one is sheet rocked, and they will move to his in-laws until the new one is completed. The Commission questioned Mr. Allen about the setback for the new structure. Mr. Allen stated he talked with the Building Official. To move the new structure back to meet the setback requirements would mean taking out many trees in the back of the lot which were planted as a shelter around the old homestead about 100 years ago. Also, there is a real problem with the water table by moving the house back eight feet. They had originally intended to remodel the existing house but found it would be more expensive to do that than to build a new one and tear down the old one. He can't build the house he wants to build ifit has to be moved back another eight feet because of the water table. Commissioner Apel favored the variance requests to avoid the water table and to retain the trees. The original homestead was constructed prior to any setback regulations, and the only other building site is about 460 feet across the pond. That would also mean that the barn and garage would be in front of the house. Chairperson Squires wondered when or if a major road would go through there at a width of 120 wide. In the past the Commission has discussed the legality of having the setback based on an assumed right of way. Me Allen - stated they inquired about widening the road to four lanes. There are no such plans indicated by any governmental body. Motion by Peek, Seconded by Luedtke, to forward the Staff prepared Resolution on to the City Council with the recommendation for approval, add encroaching 9 feet into the required 100-foot front yard setback from the center line of the road. DISCUSSION: Mr. Allen stated it has not yet been finalized whether or not an attached garage will be constructed. He does not want one; his wife does. He wants to maintain the tum-of-the-centUl)' look on the new building. The Commission stated the ordinance requires an attached garage. If he wishes to vary from that provision, he would need to make application and appear before this Board again. Motion carried on a 5-Yes, 2-Absent (Barry, Gamache) vote. Survey of MTC use - Commissioner Wells had understood the Council asked that a survey be done regarding the desire for public transportation. Mr. Johnson stated he was not aware of that matter. Motion by Luedtke, Seconded by Wells, to adjourn. Motion carried on a 5-Yes, 2-Absent (Barry, Gamache) vote.
