PLANNING AND ZONING COMMISSION MEETING - APRIL 28, 1998
MINUTES
The Regular Bi-MontWy Meeting of the Andover Planning and Zoning Commission was called to
order by Chairperson Jay Squires on April 28, 1998, 7:30 p.m. at the Andover City Hall, 1685
Crosstown Boulevard NW, Andover, Minnesota.

Motion by Peek, Seconded by Wells, approval as presented. Motion carried on a 4-Yes, I-Present
(Squires), 2-Absent (Barry, Luedtke) vote.
PUBLIC HEARING: SPECIAL USE PERMIT - AREA IDENTIFICATION SIGNS - SECTION
36 - SHADOWBROOK THIRD ADDITION - SHADOW BROOK COVE TOWNHOMES- GOR-
EM, LLC
Mr. Johnson reviewed the request of Bunker LLC, Inc. to erect two area identification signs located
on both sides of 139th Avenue at the entrance to Shadow Brook Cove, a townhome development in
Shadowbrook Third Addition. The signs will be located on Lot 29, Block 3 and Lot 33A, Block 2.
Each sign will be a 18.33 square-foot pennanent monuments at the entrance of Shadow Brook Cove.
The applicable ordinances were reviewed. These sign locations were not identified on the preliminary
plat and were not a part of the Special Use Permit request in 1996 when the preliminary plat of
Shadowbrook was approved. That permit was for the area identification sign on Bunker Lake
Boulevard and Goldenrod Street. Staff is recommending approval with conditions.

Commissioner Wells questioned the size of the sign. Mr. Johnson explained by ordinance the sign
is calculated by measuring six inches around the letters. The proposed signs do meet the ordinance
provision, and the Andover Review Committee has no objections to the proposal. These signs will
not be visible from Bunker Lake Boulevard. When questioned why the developer did not apply for
this sign at the time of the preliminary plat, Mr. Johnson didn't specifically know but thought the
developer did not have specific plans for that area at the time. The applicant will be required t6 enter
into a maintenance agreement with the City. The lots are interior lots and all setback requirements
will be met.

Motion by Gamache, Seconded by Wells, to open the public hearing. Motion carried on a 5- Yes, 2-
Absent (Barry, Luedtke) vote. 7:40 p.m. There was no public testimony.
Motion by Apel, Seconded by Wells, to close the public hearing. Motion carried on a 5-Yes, 2-
Absent (Barry, Luedtke) vote.
Commissioner Peek understood the ordinance was amended to make sure area identification signs
were a part of the preliminary plat process. The concern was the number of such signs along major
thoroughfares, and that is why a limit of one or two signs per development was put in place. He felt
that is still good planning. However, because these signs are in the interior of the plat and will not
be visible along Bunker Lake Boulevard, he would be in favor of the proposal.
Motion by Peek, Seconded by Wells, to forward the Staff prepared Resolution to the City Council
for approval. Motion carried on a 5-Yes, 2-Absent (Barry, Luedtke) vote This will be on the May
\ 19, 1998, City Council agenda. 7:42 p.m.

Mr. Johnson reported the item has been withdrawn at the request of the applicant. The applicant is
continuing to negotiate a purchase agreement with the current property owner.
OTHER BUSINESS
Propane tanks at Bill's - Commissioner Wells asked ifthere is going to be landscaping around the
propane tanks at Bill's Superette or have they completed the project. Mr. Johnson stated he would
check into it.
Status of Bill's Superette on Hanson Boulevard - Mr. Johnson understood the matter is still before
the court and a decision has not yet been made by the court.
Sale of private vehicles - Commissioner Wells asked if there is an ordinance regulating the sale of
private vehicles on City streets or the number of vehicles that can be sold by any individual in a
calendar year. It is getting to be unsightly along Round Lake Boulevard with the many used cars for
\ sale along the side of the road, plus it is a traffic hazard pulling out from intersections. Mr. Johnson
stated there is a number of cars that can be sold beyond which a dealer's license from the state must
be received. The Zoning Task Force will also address the parking of vehicles for sale in residential
districts.

Noise tests at Pov's - The Commission asked when the noise tests will be taken at Pov's. Mr.
Johnson did not have a specific date, though he has talked to the MPCA who is willing to let the City
use their equipment. The Commission suggested it be done as soon as possible and that readings be
taken in other places around the City as well for comparables. Also, it should be done without
advance warning to anyone. Possibly the Community Service Officer should take those readings.
Mr. Johnson stated he will discuss the matter with the City Administrator.
Motion by Apel, Seconded by Wells, to adjourn. Motion carried on as-Yes, 2-Absent (Barry,
Luedtke) vote..
The meeting adjourned at 7:48 p.m.
