HomeMy WebLinkAboutNovember 10, 1998 o u /~ \,J CITY of ANDOVER Andover Planning and Zoning Commission Meeting November 10, 1998 - Minutes The Regular Bi-Monthly meeting of the Andover Planning and Zoning Commission was called to order by Chairman Jay Squires at 7:33 pm, Tuesday, November 10, 1998 at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners Present: Maynard Apel, Mike Gamache, Don Jacobson, Lorna Wells Jeff Luedtke, Randy Peek City Planner, John Hinzman City Zoning Administrator, Jeff Johnson Commissioners Absent: Also Present: Approval of Minutes October 27. 1998 Commissioner Jacobson asked that the motion made by Commissioner Apel on Page 2 be amended to read that Commissioner Wells seconded the ~ motion rather then staff. Motion by Jacobson, seconded by Wells to approve the minutes of October 27, 1998 as corrected. Motion carried ori a 4-yes (Apel, Gamache, Jacobson, Wells), 1-present (Squires), 2-absent (Luedtke, Peek) vote. Public Hearing: Andover Comprehensive Plan City Planner John Hinzman requested that the public hearing for the Comprehensive Plan be tabled to the next meeting as there was no one in the audience for the item. Motion by Wells, seconded by Apel to open the public hearing. Motion carried on a 5-yes (Apel, Gamache, Jacobson, Squires, Wells, 2-absent (Luedtke, Peek) vote. .~~ Motion by Apel, seconded by Gamache to continue the public hearing for the Comprehensive Plan to the November 24, 1998 meeting. Motion carried on a 5-yes (Apel, Gamache, Jacobson, Squires, Wells), 2-absent (Peek, Luedtke) vote. (J u " ,) Andover Planning and Zoning Commission Meeting November 10, 1998 - Minutes Page 2 Mr. Hinzman noted that the open house will also be scheduled for 7:00 pm and that notices will be sent to those residents who were present at the town meeting. Mr. Hinzman asked that item #6, Reviewing the Results of Planned Unit Developments, be tabled to the next meeting. Discussion - Ordinance No. 245, Abandoned Vehicles - Related to the Exterior Storage of Collector/Classic Cars Mr. Johnson explained that the City Council requested the Planning Commission review Section 3 of this ordinance and the language pertaining to collector or classic automobiles. As stated in the ordinance, these types of vehicles are not considered as an abandoned vehicle, which makes them exempt. " ) Commissioner Jacobson noted that State Statute 168.10, Subdivision 1.e, Outdoor Storage, provides tha~ pioneer, classic, collector vehicles, collector military vehicles, or street rods, licensed or unlicensed, operable or inoperable, may be stored in compliance with local government zoning and ordinances on their owners' property, provided that the vehicles and any outdoor storage areas they may require are maintained in such a manner that they do not constitute a health or environmental hazard and are screened from ordinary public view by means of a fence, shrubbery, rapidly growing trees or other appropriate means. He didn't feel that this was inconsistent with our ordinance and suggested that Section 3 of Ordinance 245 be left as is. The Commission agreed. No further action was taken. Discussion - Ordinance Review Ordinance No. 246, Abatement of Nuisances Mr. Johnson explained that staff wants to development an abatement process similar to the abandoned vehicle procedure. Commissioner Jacobson suggested that in Section 6, the first sentence should read "Any tanqible personal property......". Section 9 - it was suggested that the first sentence read "Any personal property taken into custody and not reclaimed within thirty days by the owner may be sold to the highest bidder at a public auction, sale or disposed of following..." Regarding the city reimbursing itself for the costs of the sale, it was suggested that it say "...the City shall reimburse itself for all costs incurred by the city..." Commissioner Wells felt that disposal costs should be addressed in the ordinance. Chairman Squires requested that Mr. Johnson check with the city attorney to see if the city can assess back to the owner the disposal costs. \ , ) Ordinance 247, Installation of Water Fed Heat Extractors and Water Fed Air Conditioning Equipment Mr. Jolmson noted that the Building Official asked that this ordinance be kept as there is a need for it. Commissioner Jacobson explained that water fed heat extractors are no longer allowed in the state and this ordinance therefore is obsolete. Chairman Squires asked Mr. Johnson to check with the Building Official again and if this is illegal there may not be a need for this ordinance. Ordinance 245 - Curfew for Minors Mr. Johnson noted that this ordinance is consistent with the Anoka County ordinance. No action was taken. \ ) ~.J Andover Planning and Zoning November 10, 1998 - Minutes Page 4 Commission Meeting Ordinance 249, Commercial Building Standards Mr. Johnson explained that the current ordinance, Number 78, talks about requirements for outdoor storage. That was removed from the rewrite because it is addressed in the zoning ordinance. Commissioner Jacobson questioned Section 2 which requires all buildings in commercial areas to be of masonry construction. He asked if this applies to buildings in agricultural preserve areas and our city parks. It was noted that agricultural preserves and city parks are zoned residential. It was requested that Mr. Johnson check on requiring a letter of credit in the amount of 150% of the cost of the building. It was also suggested that Section 4, Site Plan Agreement, be rewritten. Motion by Jacobson, seconded by Wells to adjourn. r-1otion carried on a 5-yes (Apel, Gamache, Jacobson, Squires, Wells), 2-absent (Luedtke, Peek) vote. Meeting adjourned at 8:15 pm.
