PLANNING AND ZONING COMMISSION MEETING - JUNE 22,1999
MINUTES
The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to
order by Vice Chairperson Maynard Apel on June 22, 1999, 7:02 p.m., at the Andover City Hall,
1685 Crosstown Boulevard NW, Andover, Minnesota.
Commissioners present:
Maynard Apel, Larry Dalien, Dean Daninger, Douglas Falk, Mark
Hedin, and Bev Jovanovich.

o Motion by Daninger, seconded by Hedin, the Minutes be approved as submitted. Motion carried on
a 6-ayes, O-nays, I-absent (Squires) vote.
PUBLIC HEARING: PRELIMINARY PLAT - WOODLAND MEADOWS THIRD ADDITION _
SECTION 10 - WOODLAND DEVELOPMENT CORPORATION.
Mr. Hinzman stated the Planning and Zoning Commission is requested to review and recommend to
the City Council the approval of the preliminary plat of Woodland Meadows Third Addition located
in Section 10, Township 32, Range 24, Anoka County, Minnesota as requested by Woodland
Development Corporation.
Mr. Hinzman noted the general comments contained in the staff report, indicating the proposed plat
is currently zoned R-I, Single Family Rural. The project is proposed to be developed with private
individual wells and septic systems since it is outside the Metropolitan Urban Service Area (MUSA).
The proposed subdivision consists of five single family residential lots. The developer and/or
owner is responsible to obtain all necessary permits. Mr. Hinzman explained there may be minor
housekeeping changes needed on the plat.
Mr. Hinzman pointed out that a variance from Ordinance No. 10, Section 9.03G is being requested
with the preliminary plat as the length of the cul-de-sac(s) exceeds the maximum 500 foot
requirement on I 69th Lane NW. A variance of 126.5 feet is being requested. Mr. Hinzman noted the
existing driveway access of the existing home onto Verdin Street NW is proposed to be eliminated

and relocated to 169th Avenue. He noted the Park and Recreation Commission will review the
preliminary plat at the July 1, 1999 meeting and will likely be recommending the acceptance of cash
in lieu of land.

Motion by Falk, seconded by Jovanovich, to close the public hearing. Motion carried on a 6-ayes, 0-
nays, I-absent (Squires) vote.
Vice Chairperson Apel noted the variance being requested and that in the past several similar
variances had been granted. He commented that this is a very easy plat.
Mr. Hinzman explained the property drops off into a wetland area which results in the need for a cul-
de-sac length varia.'lce request.
Commissioner Daninger asked how long of a cul-de-sac variance had been granted in the past. Vice
Chairperson Apel stated he remembers a cul-de-sac approval for a length of 800 feet.

ORDINANCE REVIEW - ORDINANCE NO. 102, GARBAGE HAULERSIRECYCLINGI
COMPOST/NG.
Mr. Hinzman presented Ordinances No. 102, 104 and 106 and asked the Planning Commission for
their comments.
Acting Chairperson Apel stated that the ordinance has worked well and he would not suggest any
changes.
Mr. Hinzman reviewed the previous amendments to incOIporate composting and agreed that the
ordinance has worked well.
The Commission had no comment on this ordinance.

Mr. Hinzman explained that a pawn broker is only allowed in the General Business District and
second-hand dealers are regulated elsewhere. He stated there are none in the City at present and the
number of licenses is restricted to three.
Commissioner Daninger asked if there have been any challenges to this ordinance. Mr. Hinzman
stated there has not been.
The Commission had no comment on this ordinance.
ORDINANCE REVIEW - ORDINANCE NO. 106, BOULEVARD ENCROACHMENTS.
Acting Chairperson Apel asked when this ordinance had previously been reviewed. Mr. Hinzman
stated it was reviewed in 1994. He reviewed the types of encroachment that are regulated.
The Commission had no comment on this ordinance.
DISCUSS ORDINANCE NO. 229B AMENDMENT, REGULATING PARKS.

Mr. Hinzman stated that the Planning and Zoning Commission is asked to discuss and review an
amendment to Ordinance No. 229 - an Ordinance Establishing a Park and Recreation Commission
and Regulating Conduct in Public Parks; Providing for Enforcement; and Prescribing Penalties for
Violations. The Park and Recreation Commission, at their May 19, 1999 meeting, reviewed Section
2 (City Park and Recreation Area Regulations) and Section 4 (Penalty) of this ordinance and has
made a recommendation to the Planning and Zoning Commission and City Council regarding which
park activities when violated shall be guilty of a petty misdemeanor or misdemeanor. He explained
the difference between a petty misdemeanor and misdemeanor is the amount of the fine.
Acting Chairperson Ape! stated he would not support considering adding any act that is not already
classified as a misdemeanor.
Mr. Hinzman asked if the Planning Commission had any changes to recommend.
Commissioner Jovanovich stated she has seen vehicles operating on the park property. Mr. Hinzman
advised that activity is already identified as a misdemeanor and would remain as such.
Commissioner Daninger stated any acts already identified as a misdemeanor would already be
regulated.
Commissioner Dalien asked how this amendment started. Mr. Hinzman explained someone was
golfing in the City park, was asked to stop, and refused so that person was brought into court and
charged with a misdemeanor which the Council felt was a little strong. Commissioner Dalien
/" questioned the need to change the ordinance based on only one incident.

Acting Chairperson Apel concurred and stated that he has seen some parks with "no golfing" signs.
Commissioner Daninger stated it may be worth it to amend the ordinance to restrict golfing and
define it as a petty misdemeanor.
Acting Chairperson Apel commented on the responsibility involved with judging someone arid need
to consider first offenders. He suggested that most of these incidents are a '1udgment call" by the
responding officer.
Commissioner Daninger stated if they continue the offense, the City can take the appropriate legal
action.
Commissioner Dalien stated it is a different situation if the person is asked to stop golfing and
refuses.
Mr. Hinzman asked if the Planning Commission has any recommended changes.
The Commission had no comment on this ordinance.
) OTHER BUSLVESS.
Mr. Hinzman updated the Planning Commission regarding recent Council action. He noted the
upcoming joint work session meeting to review the Comprehensive Plan and advised of the planning
cases that will be considered at the next meeting.
With regard to the recent consideration of a shed for storage of pool supplies, Commissioner
Daninger noted the Council minutes indicated the building would be used for additional storage. He
stated the hardship finding could have been based on the need to lock up these chemicals, but now it
appears the building will be used for other purposes as well.
Commissioner Dalien stated the minutes also mentioned this was one of the smallest comer lots in
the City so, perhaps, the consideration should have occurred during plat approval. Mr. Hinzman
advised that the square footage for comer lots has been increased since that particular lot was platted.
Commissioner Dalien noted the hardship could then be found in that the rules changed after this
comer lot was platted.
There was no other business to come before the Andover Planning and Zoning Commission.
