PLANNING AND ZONING COMMISSION MEETING -APRIL 13, 1999
MINUTES
The Regular Bi-MontWy Meeting of the Andover Planning and Zoning Commission was called to
order by Chairperson Jay Squires on April 13, 1999, 7:03 p.m., at the Andover City Hall, 1685
Crosstown Boulevard NW, Andover, Minnesota.

Motion by Jovanovich, seconded by Falk, the Minutes be approved as written. Motion carried on a
4-ayes, O-nays, O-absent , 3-present (Apel, Dalien, Hedin) vote.
PUBLIC HEARING: PRELIMINARY PLAT - ANDOVER STATION - SECTION 34-
ANDOVER ECONOMIC DEVELOPMENT AUTHORITY
Mr. Hinzman explained that the Planning and Zoning Commission is requested to review and hold a
public hearing.on the preliminary plat of "Andover Station" located in Section 34, Township 32,
Range 24, Anoka County, Minnesota as requested by the Andover Economic Development
Authority (EDA).
Mr. Hinzman noted that the proposed preliminary plat is currently zoned GB, General Business and
currently within the Metropolitan Urban Service Area (MUSA). The municipal sanitary sewer and
water will serve the site. He stated that the proposed use of the property is consistent with the
Andover Comprehensive Plan Land Use Plan. The proposed subdivision consists of six commercial
lots, and explained that the developer and/or owner is responsible to obtain all necessary permits
(DNR,U.S. Army Corps of Engineers, Coon Creek Watershed District, LGU, MPCA and any other
agency which may be interested in the site.).

Mr. Hinzman explained that the ninety acre area being platted as "Andover Station" was formerly
the site of numerous auto recycling yards and similar related uses. The EDA has acquired the area
and is redeveloping the area consistent with the comprehensive plan. The development is planned to
be a multi-use business park and retail center.

Mr. Hinzman stated that the Commission should note the amount of clean-up and grading that has
been done on the "Andover Station" property. The clean-up grading will commence this spring.
The grading plan before the Commission was prepared by TKDA, Inc. and approved by the City
Council. Tree protection was installed in accordance with the Andover Tree Protection Policy and is
shown on the grading plan.
Mr. Hinzman stated that the Andover Review Committee (ARC) had the following comments
regarding the preliminary plat of "Andover Station."
1. Additional right-of-way is being dedicated on Bunker Lake Boulevard Northwest for the
proposed road reconstruction project.
2. There may be minor housekeeping items that need to be revised on the plat presented to the
Commission.
Mr. Hinzman noted that the preliminary plat has not been scheduled before the Park and Recreation
Commission to date. The EDA is exploring the provisions of Ordinance No. 10, Section 9.07 that
allows credit to be given where private open space for park and recreational purposes is provided in
the development. He stated that the development is proposed to incorporate bikeway/walkway trails
'. ) and common open space areas.
Mr. Hinzman explained that request for proposals are being accepted for the larger lots. He noted
that the Andover Cinema that is currently under construction will be opening May 1 st and that there
are plans for two restaurants and a veterinary hospital.
Mr. Hinzman reviewed the proposed outlay of the development which included an entertainment
area, office/warehouse, improved wetlands in the center of the development with trails, general
office and retail.
Commissioner Falk questioned if it is planned to install lights at the intersection of Jay Street and
Bunker Lake Boulevard. Mr. Hinzman stated that was correct
Motion by Apel, seconded by, Falk to open the public hearing. Motion carried on a 7-ayes, O-nays,
O-absent vote.
Pat ? .1308 Nightingale Street, questioned ifthere will be a full intersection at Quinn
Street. Mr. Hinzman stated that was correct.
Motion by Hedin, seconded by Daninger, to close the public hearing. Motion carried on a 7-ayes, 0-

Commissioner Apel stated that this development has been discussed at all different levels and he
does not feel it represents any problems.
Commissioner Daninger questioned if the trail system was still under review. Mr. Hinzman stated
that he had talked to City Council regarding the trail and questioned if the layout should be done
now, but they felt it would be better to wait until the proposals were received and then proceed with
the layout.
Motion by Apel, seconded by Jovanovich, to recommend to City Council approval of preliminary
plat for "Andover Station." Motion carried on a 7-ayes, O-nays, O-absent vote.
PUBLIC HEARING: SPECIAL USE PERMIT (SUP 99-04) - LAND RECLAMATION PERMIT
TO CONSTRUCT SLIDING HILL - SECTION 34 - CITY OF ANDOVER
Mr. Hinzman explained that the Planning and Zoning Commission is asked to approve a Special Use
Permit for land reclamation to construct a sliding hill as requested by the City of Andover. The site
is located on 80 acres south of the WDE Landfill in the North Half of Section 34. The reclaimed
land would consist of20,000 cubic yards of clean construction debris excavated from Andover
Station located on the south side of Bunker Lake Boulevard Northwest.

Mr. Hinzman stated that the applicable ordinances are:
Ordinance 8, Section 4.23 - Land Reclamation stating that Land Reclamation permits shall be
permitted by special use permit upon submittal of a finished grade plan which will not adversely
affect the adjacent lane. He stated that the following conditions shall be included upon approval:
I) Type offill shall be regulated
2) Rodent control plan
3) Fire control plan
4) Site be generally maintained
5) Vehicular ingress and egress control plan
6) Control of material disbursed from wind or hauling of material to or from the site
Ordinance No.8, Section 5.03, regulates the Special Use Permit process and outlines the following
criteria for review:
I) The effect of the proposed use upon the health, safety, morals and general welfare of the
occupants of the surrounding land.
2) The effect on existing and anticipated traffic conditions including parking facilities on adjacent
streets and land.
3) The effect on the values of property and scenic views in the surrounding area.
4) The effect of the proposed use on the Comprehensive Plan.

Mr. Hinzman stated that the proposed site would buffer future commercial development from the
WDE landfill and that the nearest resident is over 1300 feet away.
Mr. Hinzman reviewed the elevation of the proposed sliding hill stating that the hill will be 25 feet
high in the center and 150 feet from west to east with the actual width being 380 feet. He noted that
planting and fencing will be installed facing the WDE site to keep people from sliding into the area.
Mr. Hinzman showed pictures of the proposed location of the sliding hill stating that it also has been
suggested to install hockey rinks, and baseball fields at this site. He also reviewed sites of existing
sliding hills from other communities.
Mr. Hinzman explained that the City has hired The Leonard Parker Associates to develop a master
concept for the entire site. He noted that site may also include Anoka Auto Wrecking in the future.
Commissioner Hedin questioned if lights are being installed at the sliding hilL Mr. Hinzman stated
that has not been brought up as of yet. Commissioner Hedin stated that he feels night time sledding
is very popular.

Commissioner Falk questioned if any bathroom accommodations are being planned at the sliding
hilL Mr. Hinzman stated that a concession area is being proposed for the area.
Commissioner Falk questioned if a warming house was going to be included for winter use. Mr.
Hinzman stated that they are looking into it.
Commissioner Dalien questioned if there is any time line for the completion of the project. Mr.
Hinzman stated not at this time, but the fill does need to be moved soon.
Commissioner Daninger questioned if grass will grow on the hill over the summer. Mr. Hinzman
stated yes that the hill should be mowed over the summer.
Commissioner Daninger questioned if it was 1300 feet from the nearest resident. Mr. Hinzman
stated that was correct and there is a good tree line between the two.
Commissioner Hedin questioned how the amount parking spaces will be determined if all the
facilities are put in. Mr. Hinzman stated the number is determined by City ordinance. He also noted
that the City is looking into ajoint parking option in the office/warehouse area, but stated this is in
the real preliminary phase.
Commissioner Jovanovich questioned if any fee will be charged to slide. Mr. Hinzman responded
that it has not been brought up, but he doesn't think so.

Motion by Falk, seconded by Jovanovich, to open public hearing. Motion carried on a 7-yes, 0 nays,
a-absent vote.
Pamela Pratt. 13829 Nightingale Street, questioned where the road will be placed to connect to the
sliding hill. Mr. Hinzman stated that they are still working on that noting that no decision will be
made until plating phase.
Motion by Hedin, seconded by Daninger, to close the public hearing. Motion carried on a 7-ayes, 0-
nays, a-absent vote.
Commissioner Daninger stated that it should be considered to install a phone in case an accident
were to occur. Mr. Hinzman stated with a warming house and concession stand in the plans there
should be a phone installed.
Mr. Hinzman stated the reason the City is pushing the sliding hill right now is because the
construction debris needs to be moved.
Motion by Daninger, seconded by Jovanovich, to recommend to the City Council approval of the
Special Use Permit request of the City of Andover for a land reclamation permit in the North Half of
Section 34. The Commission finds the request meets the requirements of Ordinance No.8. Motion
\ carried on a 7-ayes, a-nays, a-absent vote.

VARIANCE (99-01) - SlDEYARD SETBACK FROM STREET FOR WELL HOUSE NO. 7-
2014 150TH LANE NORTHWEST - CITY OF ANDOVER
Mr. Johnson explained that the Planning and Zoning Commission is asked to review the variance
request for the City of Andover to construct a well house (Well House No.7) on the property located
at 2014 I 50th Lane Northwest, legally described as Lot 14, Block 10, Woodland Estates. He noted
that the property is zoned R-4, Single Family Urban.
Mr. Johnson stated that the applicable ordinances are:
Ordinance No.8, Section 6.02 establishes setback requirements for building in an R-4, Single
Family Zoning District. The minimum sideyard setback from a City street is thirty-five feet.
Ordinance No.8 Section 5.04 establishes the variance process. Variances may be granted where
there are practical difficulties or unnecessary hardships in any way of carrying out the strict letter of
the provisions of the Zoning Ordinance. The hardships or difficulties must have to do with the
characteristics of the land and not the property owner.

Mr. Johnson stated that the City is requesting a variance to construct a principal structure (well
house) which is 676 square feet in area and will encroach fifteen feet into the thirty-five foot

sideyard setback from the street. The proposed well house will be constructed of brick in order to be
compatible with adjacent residential structures. He stated that the hardship is based on the fact that
the well location was detennined by engineers and has been installed.
Commissioner Hedin questioned why the building wasn't rotated 45 degrees to stay out of the
easement. Mr. Johnson responded that this was taken to City Council and they looked at various
angles and chose this location. He stated that the way the building is proposed it will be 15 feet into
the 35 foot easement and would be 50 feet from the existing road.
Mr. Hinzman stated that there are two wells in the area and the engineers were very specific on the
well locations. Commissioner Hedin questioned if the building was rotated would there be a need
for a variance. Mr. Johnson stated yes that the proposed location requires the minimum variance.
He also noted that the City is looking into a trail system that will expand north of the building with a
water foul area adjacent to the building and some benches installed.
Mr. Johnson stated that a couple of other scenarios were brought to City Council and they chose the
option presented.
Motion by Apel, seconded by Daninger, to recommend approval to the City Council of said request
finding that the request meets the conditions established in Ordinance No.8, Section 5.04. Motion
carried on a 7-ayes, a-nays, a-absent vote.

DISCUSSION: ORDINANCE REVIEW ORDINANCE NUMBERS 254 THROUGH 258
Mr. Johnson explained that the Planning and Zoning Commission is asked to review and comment
on the revised Ordinances Numbers 254-258.
Mr. Johnson stated that Ordinance No. 254 regulates the operation of golf cars and motorized
wheelchairs by physically disabled persons on public roadways within the City of Andover.
Commissioner Jovanovich questioned how many pennits have been issued since the ordinance was
adopted. Mr. Johnson responded none in the last five years and only one since the ordinance was
adopted.
Commissioner Jovanovich questioned if the pennit was issued for a golf cart or wheelchair. Mr.
Johnson stated that the pennit was issued for a wheelchair. Commissioner Jovanovich questioned if
it is necessary to have a pennit for a wheelchair. Mr. Johnson stated yes for safety concerns. Mr.
Hinzman stated the ordinance was adopted because law enforcement was put into a situation to
which they did not know how to respond.

Commissioner Hedin questioned if a permit is issued are the neighbors notified. Mr. Johnson stated
that a permit application must be submitted and no notification to nearby residents is required, but
suggested maybe there should be.
Commissioner Falk questioned if a sign is placed in the area for a wheelchair. Mr. Johnson stated
that the engineering department would work with a resident if a sign was requested.
Commissioner Hedin questioned the purpose of an ordinance if only one permit is issued once every
five years.
Mr. Johnson stated that he will talk to the City Attorney and get his opinion on the ordinance.
Consensus was reached by the Commission to have the City Attorney review the ordinance and give
the Commission his input.
Mr. Johnson stated that Ordinance No. 255 establishes a boundary commission and setting out the
composition and duties thereof.
Commissioner Dalien stated that the ordinance was adopted due to an issue that came about which
required a whole new plat to be filed. He stated that the ordinance was only used once, but it is a
valuable tool to have.

Consensus was reached by the Commission to leave the ordinance as written.
Mr. Johnson stated that Ordinance No. 256 regulates the installation and operation of home and
business alann systems within the City of Andover.
Chairpersons Squires stated that the Commission had a lot of questions at the last meeting and
questioned if Staff had received answers to their questions.
Mr. Johnson stated that Andover charges a $75.00 false alann fee. He stated he talked to
neighboring cities and their false alann fees ranged from $100.00 to $150.00. He stated that the fee
is assessed after the third alann.
Consensus was reached by the Commission to leave the ordinance as written.
Mr. Johnson stated that Ordinance No. 257 establishes the Lower Rum River Watershed
Management tax district.

, Mr. Johnson stated that Ordinance No. 258 regulates lawful gambling within the City of Andover.

Commissioner Hedin asked how many gambling license have been issued. Mr. Hinzman stated just
one at Pov's.
Commissioner Hedin questioned if anyone else had applied. Mr. Johnson stated no, and noted that
Pov's is the only bar in the City but with more proposed restaurants coming into the area there will
probably be more requests in the future.
Consensus was reached by the Commission to leave the ordinance as written.
OTHER BUSINESS
Mr. Hinzman updated the Commission on action the City Council has taken.
