CITY of ANDOVER
PLANNING AND ZONING COMMISSION MEETING - SEPTEMBER 12,2000
The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was
called to order by Chairperson Jay Squires on September 12, 2000, 8:04 p.m., at the
Andover City HaIl, 1685 Crosstown Boulevard NW, Andover, Minnesota.
Commissioners present:

Mark Hedin, Maynard Apel, Dean Daninger, and Tim
Kirchoff

APPROVAL OF MINUTES.
o Commissioner Daninger stated that on page 5 ofthe minutes it reads that Chair Squires
stated the item would be discussed at the September 5 Council meetipg, however Chair
Squires was absent.

Commissioner Hedin stated that on the motion to approve the minutes his vote should
have been considered present since he was absent at the previous meeting.
Chair Squires mentioned that the opening paragraph should also be changed to state that
the Acting Chair called the meeting to order, since he was absent.
Motion by Hedin, seconded by Daninger, the Minutes be approved as amended. Motion
carried on a 3-ayes, O-nays, 3-present, I..absent vote.
PUBLIC HEARING: AMEND ORDINANCE 8 -ADMINISTRATIVE PERMITS
FOR SPECIAL EVENTS.
City Planner, John Hinzman explained that the Planning and Zoning Commission is
asked to hold a public hearing and review Ordinance No.8, Section 8.07 Administrative
Permits for Special Events. He stated that the said amendment would require an
administrative permit process for the issuance of signs or similar devices related to, and a
part of, temporary outdoor promotional events in non-residential zoning districts provided
the event does not exceed ten calendar days per year.

Motion by Daninger, seconded by Kirchoff, to open the public hearing at 8:07 p.m.
Motion carried on a 6-ayes, O-nays, I-absent vote.
There was no public input.
Motion by Hedin, seconded by Daninger, to close the public hearing at 8:08 p.m. Motion
carried on a 6-ayes, O-nays, I-absent vote.
Motion by Daninger, seconded by Apel, to recommend to the City Council the changes
made to Ordinance No.8 as recommended by staff. Motion carried on a 6-ayes, O-nays,
I-absent vote.
Chair Squires stated that this item would be considered at the October 3, 2000 City
Council meeting.
DISCUSSION: ORDINANCE NO. 112, PLANNED UNIT DEVELOPMENT.

City Planner John Hinzman explained that the Planning and Zoning Commission has
been asked to review the proposed amendments to the current PUD ordinance. He stated
that the commission has asked staff to bring forward a revised PUD ordinance for
discussion. He mentioned that any changes the commission recommends will be
incorporated into the draft PUD ordinance and forwarded to the City Council.
Commissioner Kirchoff questioned if a developer would still get credit for donating
wetlands. Mr. Hinzman explained that open space dedication would need to be of high
quality as determined by the Council.
Commissioner Dalien questioned a section in the ordinance where it states that access
would be provided by the general public to trails, parks, or other recreational facilities of
the development. He questioned how they would be opened up to the public and how the
association would be responsible.
Commissioner Apel stated that the City wouldn't be able to dictate who would be
allowed to use the facilities.
Commissioner Kirchoff suggested having a gate across that would state members or
residents only.
Commissioner Apel stated that it is an option, however he felt that it wouldn't be
acceptable.

Chair Squires mentioned that there wouldn't be an argument for a density increase if they
choose to keep a pool private.

Chair Squires suggested the ordinance state that if there is an increase in density then
there has to be the amenities.
Commissioner Apel suggested there be incentives for the developer to take a section of
land and donate it to the City.
Mr. Hinzman suggested changing the language to read that a section of land would be
dedicated to the City.
Chair Squires summarized that on page four, Section 8A, should read, "Provide access by
the general public to trails, parks, or other recreational facilities within the development
above and beyond park dedication requirements that are accessible to the general public."
Commissioner Dalien suggested the ordinance state that the developer is dedicating the
land to the City.
Chair Squires stated that it would be possible for them to retain ownership of the
elements, since homeowners typically have insurance. He stated that if the language is
general then anytime a PUD comes before the commission it would be in the contract.

'~-j Chair Squires stated that the language would even be broad enough to possibly include a
nature walk, and other types of uses where a homeowners association would do a better
job.
Commissioner Dalien mentioned that it needs to be broad enough so there could be
negotiation between the developer and the City Council if necessary.
Commissioner Apel stated that he agreed it would be broad enough if stated as Chair
Squires has read.
Commissioner Kirchoff questioned how page 6, Section 15, Part 2D should read in the
ordinance. Mr. Hinzman explained that actually part 2D should be deleted since it is
covered under the minimum setback requirements.
Chair Squires suggested page 5, part c, read "Incorporate a higher quality design....",
since we are trying to set a theme that things need to above and beyond the norm.
Chair Squires commented that he likes the ordinance written as staff has prepared it much
better than the original.

Commissioner Hedin stated that the City of Andover is a leader. He commended Mr.
Hinzman for a job well done.

Chair Squires stated that he feels more comfortable applying this ordinance than the
original.
Commissioner Apel questioned Section 14, number 18 on page 8. Mr. Hinzman
explained that it was added to the ordinance.
Commissioner Daninger questioned if staff added to the ordinance that the developer
would be required to create a list to present before the commission and the Council.
Mr. Hinzman explained that he did have it included in the ordinance and then ended up
removing it. He explained that it would be difficult to include it in the ordinance since all
PUD's are different. He stated that the important thing is that they realize that in order to
go through the process they would need to show a higher quality design.
Commissioner Apel mentioned that part of the process is that they need to state what their
plans are going to be.
Commissioner Daninger questioned if it would be necessary to state in the ordinance that
they need to cover all areas in order to be considered for approval.

Commissioner Apel stated that it would be difficult to put it into words.
Commissioner Daninger stated that he didn't disagree, however, he felt it would help if it
was stated.
Mr. Hinzman stated that he would give some examples to the developer ofPUD's that
were approved by the commission and Council.
Commissioner Daninger stated that sometimes developers have wonderful presentations,
however, they forget to include the facts.
Chair Squires suggested adding a paragraph 8 on page 5 that would state, "It is the
applicant's burden to demonstrate entitlement to the density increase." He questioned the
commission as to whether anyone was opposed.
Commissioner Kirchoff questioned the statement regarding density increases of up to 5%,
on page 4, paragraph 8 of the ordinance. Mr. Hinzman clarified the purpose of the
statement.

Commissioner Hedin stated that it would be more clear if it read, "Density increases of up
to five percent may be allowed for each category listed below (20% maximum total) at
the discretion of the City Council..."

Chair Squires asked the commission if they would be comfortable forwarding the
amended ordinance along with the changes to the City Council. The commission agreed.
Mr. Hinzman stated that he would bring the amended ordinance including the changes
made tonight before the City Council. He explained that the Council will decide ifthere
should be a public hearing scheduled.
OTHER BUSINESS.
Mr. Hinzman mentioned that the Bunker Hills Activity Center is having a GIS Fair from
3-7 p.m. on September 13, 2000.
ADJOURNMENT.
Motion by Apel, seconded by Hedin, to adjourn. Motion carried on 6-ayes, a-nays, 1-
absent vote. The meeting was adjourned at 8:45 p.m.
