HomeMy WebLinkAboutAugust 22, 2000 () (', '0 o o o CITY of ANDOVER PLANNING AND ZONING COMMISSION MEETING -AUGUST 22,2000 MINUTES The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Jay Squires on August 22, 2000, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Acting Chair Mark Hedin, Commissioners Dean Daninger, Tini Kirchoff, and Douglas Falk. Commissioners absent: Chairperson Jay Squires, Commissioners Larry Dalien and Maynard ApeL Also present: . City Planner, John Hinzman Others APPROVAL OF MINUTES. August 8, 2000 Commissioner Daninger clarified that on page 7 of the minutes it states that he said the Brooke Crossing PUD was wonderful, however what he really meant was that it was a wonderful presentation. MotiOIl by Falk, seconded by Kirchoff, the Minutes be approved as amended. Motion carried on a 4-ayes,0-nay, 3-absent vote. PUBLIC HEARING: SPECIAL USE PERMIT (SUP 00-09) - RELOCATION OF A PRIMARY STRUCTURE (HOME) -142XX ROUND LAKE BLVD NW- CHRISTINA - MICHELLE KRAMER. City Planner John Hinzman stated that the Planning and Zoning Commission has been asked to review the Special Use Permit request of Christina-Michelle Kramer to move a single family home onto a parcel ofland iocated at 14278 Round Lake Boulevard NW. He explained that all applicable ordinances will be required to be met if the application is approved. o Regular Andover Planning and Zoning Commission Meeting Minutes-August 22,2000 Page 2 o \ ,--J Mr. Hinzman stated that the applicant is requesting to move an approximately 1347 square foot rambler style single-family home from Coon Rapids, MN onto the property located at 14278 Round Lake Boulevard NW. It was mentioned that. the property is 94.49 feet x 162.00 feet (.35 acres in size) and has a 493 square foot detached garage located in the rear of the lot, which will remain on the property. The attached garage will not be moved with the home. He mentioned that the applicant will not be required to construct an attached garage due to the fact that the minimum garage size requirement of 440 square feet is met per ordinance. Mr. Hinzman stated that the Building Official has conducted an inspection of the home and found that it is in structurally sound condition. Commissioner Kirchoff questioned what the height would be from the road. The applicant, Christina-Michelle Kramer, stated that the requirement has been met. Commissioner Kirchoff questioned if the home is one of those being moved as a result of the Hwy. 10 project. Ms. Kramer stated that it is being moved as a result of the Hwy. 10 project. . , - ) '- " Commissioner Daninger questioned if there would be a time limit as to when the conditions are completed. Mr. Hinzman reviewed the conditions listed in the proposed resolution. Ms. Kramer explained that the house will not actually be moved onto the foundation until August of 200 I. She stated that realistically they could have all the modifications completed six months after that point. Mr. Hinzman suggested the completion date be set for January 1,2002. The Planning and Zoning Commission agreed. Motion by Daninger, seconded by Kirchoff, to open the public hearing at 7: 13 p.m. Motion carried on a 4-ayes, a-nays, 3-absent vote. Ms. Kramer questioned if the commission was referring to the stucco portion of the house in terms of painting. Mr. Hinzman pointed out the location of the home that would not be moved, he questioned what modifications would take place. Ms. Kramer explained that she is thinking of putting a storm door in that area. Mr. Hinzman questioned if the siding would remain the same in that .location. :') ,_/ Ms. Kramer stated that the siding would remain the same. He pointed out that there would be a 5-6 ft. section on the front and back that would need to be sided. Ms. Kramer stated that it would be sided to match the siding currently on the house. There was no other public input. Motion by Kirchoff, seconded by Falk, to close the public hearing at 7:18 p.m. Motion carried on a 4-ayes, a-nay, 3-absent vote. Commissioner Falk stated that if staff is recommending approval of the application that he believes it should be acceptable. Commissioner Daninger mentioned concerns since nothing would take place until 2001. He explained that there is a lot of time until then where a lot can happen with construction, etc. He also stated concerns about having stucco and aluminum on the same side of the house. He stated that he is uncomfortable voting in favor of the request at this time. Commissioner Kirchoff questioned when the foundation would be built. " '\ U Mr. Hinzman stated that the house would need to be on the foundation within 30 days of the foundation being built. Ms. Kramer explained that if they wait until next year it would affect the contingency of the other property. A member from the audience explained that she would have the choice to buy the property and approach the City next year. Commissioner Daninger stated that he is uncomfortable making a decision now due to uncontrollable circumstances that may arise. Ms. Kramer questioned if the commission is concerned since they would be approving the house not knowing for sure what will be its condition. Commissioner Daninger stated that he has concerns since there is a long period of time between the City's approval and the placement of the home on the new foundation. He mentioned that since there is only one picture available of the home it is very difficult to get a good idea of what the home will look like once the garage is removed. Ms. Kramer questioned if there is something that could be done to meet Commissioner Daninger's satisfaction. , '\ '-_ .J U 0 Regular Andover Planning and Zoning Commission Meeting Minutes-August 22,2000 Page 4 ~ Commissioner Daninger expiained that the commission is not present to negotiate what is on the table, but instead to vote on the resolution prepared by staff. . Commissioner Hedin questioned what the one side of the house would look like once the garage has been removed. A member from the audience explained that it would consist of siding and stucco combined, however they are willing to reconsider if desired by the City. Commissioner Hedin suggested that only stucco be used on the garage side of the house. Commissioner Daninger stated that it would help to ease some of his concerns, however it wouldn't change his vote on the resolution at this time. Commissioner Falk agreed that it is hard to know the end result in terms of appearance, however he stated that -it is possible to get it up to the expectations of another neighborhood. Mr. Hinzman showed homes that were moved in the past from one neighborhood to another. He mentioned that it has been done in the past, and therefore could be done in this situation if the commission agrees. .' \ \~j Commissioner Hedin questioned if there has been any other feedback from the surrounding properties. Commissioner Hedin questioned if the building inspection would need to take place prior to the moving of the home. Mr. Hinzman stated that the building inspection would indeed need to be done prior, however they did feel it would meet the structural requirements. Commissioner Daninger explained that it is an option to list everything that would need to be done, however that becomes difficult when we don't know what needs to be done. Commissioner Falk stated that he is pleased with what staff has presented, and sees no problem with the proposal other than the time frame. Commissioner Kirchoff also questioned the time frame, however stated that he sees no major concerns with what is being presented. Commissioner Hedin questioned the applicant if it is realistic to see tp.ings happen by next August. A member from the audience stated that there should be no reason why the house couldn't be on the new foundation by next August. A member from the audience stated that he is not sure on how the renovation would take place, and therefore requested to have until January 1,2002 for a completion date. Motion by Falk, seconded by Kirchoff, to forward to the City Council a recommendation to approve the Special Use Permit request of Christina-Michelle Kramer to move a single family home onto a parcel of land located at 14278 Round Lake Blvd. NW, subject to the following conditions: u 1. That if the City Council determines that no significant progress has been made in the first twelve months after the approval of the Special Use Permit, the permit will be null and void. 2. That the home be brought onto the foundation within 30 days of completion of the foundation. 3. That all applicable ordinances and existing building codes are met. 4. That the roof and soffits are replaced prior to completion. In addition the exterior of the home be either repainted or restuccoed and the porch area to be altered to match the existing exterior. 5. That the work be completed by January 1,2002. Motion carried on a 3-ayes, I-nays, 3-absent vote. Chair Squires stated that this item would be considered at the September 5, 2000 City Council meeting. DISCUSSION: ACCESORY STRUCTURE PROVISIONS IN URBAN AREAS. Mr. Hinzman explained that the Planning and Zoning Commission is being asked to examine decreasing size for accessory buildings on properties less than one acre. He stated that the review of the ordinance is made at the request of the City Council, since recently there was a comment made by a resident regarding a neighbor building an accessory building that didn't seem to fit the_character of the neighborhood. He mentioned that staff examined the property and found it to meet the existing ordinance requirements. Mr. Hinzman explained that staff examined accessory building provisions of other metropolitan communities. He presented the results to the commission, stating that most of the communities establish a maximum accessory building coverage of 1000 square feet. Mr. Hinzman stated that there is no limit on the number of buildings. Commissioner Kirchoff stated that he has heard of some areas having a very strict ordinance that doesn't allow any accessory buildings at all. Commissioner Kirchoff commented that he doesn't see much difference in the ordinance when comparing to other cities. Mr. Hinzman agreed that there isn't much difference other than some cities setting a limit at 1,000 square feet. Commissioner Daninger questioned the size of the building Mr. Hinzman displayed during the staff presentation. Mr. Hinzman stated that the size of the building was 38 X 24, which put them right at the 75%. Commissioner Falk questioned the size of the lot. Mr. Hinzman stated that the lot is approximately 30,000 square feet. Commissioner Hedin stated that he drove by the site being discussed, however in his mind sees no problem with the size of the building. '. -'-.j Commissioner Falk stated that he likes the way the ordinance is written and sees no reason to make a change at this time. Commissioner Kirchoff stated that after seeing the picture he doesn't feel the building is out of place, and therefore can't see that a change is necessary at this time. Commissioner Hedin questioned if staff receives very many calls concerning the current ordinance. Mr. Hinzman stated that to his mowledge there have been few phone complaints since 1983. Commissioner Daninger commented since few complaints have been logged the commission should make no changes to the ordinance. Commissioner Hedin agreed with the rest of the commission in that no real changes are necessary at this time. CHANGE MEETING TIME: SEPTEMBER 12, 2000 PLANNING AND ZONING COMMISSION MEETING. Mr. Hinzman explained the Planning and Zoning Commission is being asked to change the meeting time for the regularly scheduled meeting on September 12, 2000 to avoid conflict with primary elections. He mentioned that the commission could begin the meeting at 8:01 p.m. on the 12th or pick another date. Commissioners Daninger and Hedin suggested the meeting take place on September 12, 2000 at 8:01 p.m. OTHER BUSINESS. Mr. Hinzman briefed the Planning and Zoning Commission on the outcome of the issues that were pending with the City Council. He also gave a brief overview of items that wiil be up for discussion at the next Planning Commission meeting. ADJOURNMENT. \. I Motion by Kirchoff, seconded by Daninger, to adjourn.
