AN ORDINANCE ESTABLISHING AND SETTING CURFEWS FOR MINORS. The City Council of the City of Andover does hereby ordain as follows: SECTION 1. DEFINITIONS: Curfew a regulation enjoining the withdrawal of specified persons from the street, avenues, parks and public property within the City of Andover at a stated hour. Minor for the purposes ofthis ordinance, a person who is sixteen (16) years of age or under. SECTION 2. REGULATIONS: It shall be unlawful for any person eleven (11) years of age and under to be present on any public street, avenue, park or other public place in the City of Andover between the hours of: Sunday Monday Tuesday Wednesday Thursday Friday Saturday 9:00 p.m. through Monday 9:00 p.m. through Tuesday 9:00 p.m. through Wednesday 9:00 p.m. through Thursday 9:00 p.m. through Friday 11 :00 p.m. through Saturday 11 :00 p.m. through Sunday 5:00 a.m. 5:00 a.m. 5:00 a.m. 5:00 a.m. 5:00 a.m. 5:00 a.m. 5:00 a.m. unless accompanied by a parent, guardian or person having lawful custody and control thereof, or unless there exists a reasonable necessity therefor. It shall be unlawful for any person twelve (12) to fourteen (14) years of age to be present on any public street, avenue, park or other public place in the City of Andover between the hours of: Sunday Monday Tuesday Wednesday Thursday Friday Saturday 10:00 p.m. through Monday 5:00 a.m. 10:00 p.m. through Tuesday 5:00 a.m. 10:00 p.m. through Wednesday 5:00 a.m. 10:00 p.m. through Thursday 5:00 a.m. 10:00 p.m. through Friday 5:00 a.m. 11 :00 p.m. through Saturday 5:00 a.m. 11:00 p.m. through Sunday 5:00 a.m. 1 It shall be unlawful for any person fifteen (15) to seventeen (17) years of age to be present on any public street, avenue, park or other public place in the City of Andover between the hours of: Sunday Monday Tuesday Wednesday Thursday Friday Saturday I I :00 p.m. through Monday 5:00 a.m. I I :00 p.m. through Tuesday 5:00 a.m. 11:00 p.m. through Wednesday 5:00 a.m. I 1 :00 p.m. through Thursday 5 :00 a.m. 11:00 p.m. through Friday 5:00 a.m. 12:01 a.m. through Saturday 5:00 a.m. 12:01 a.m. through Sunday 5:00'a.m. SECTION 3. PRIMA FACIE EVIDENCE: It shall be unlawful for any parent, guardian, or other person having the lawful care, custody, or control of any minor to allow or permit such minor to violate the provisions of this Ordinance. The finding of any minor in violation of the curfew shall be prima facie evidence that a parent, guardian, or other person having lawful care, custody, or control allowed or permitted the violation. SECTION 4. CURFEW PROCEDURES: Any Police Officer or Sheriff's Deputy upon finding a minor in violation ofthis Ordinance shall notify the parents, guardian, or person having custody or control of such minor and the juvenile authorities. SECTION 5. VALIDITY: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining provisions of this Ordinance. SECTION 6. PENALTY: Any person violating any provisions of this Ordinance shall be guilty of a misdemeanor as defined by State Law and subject to the penalties thereof.
