HomeMy WebLinkAboutFebruary 27, 2001 /'- '\ ,....j :J /'~ \.J o o ~~ lu~ 3J /3/6/ CITY of ANDOVER PLANNING AND ZONING COMMISSION MEETING - FEBRUARY 27,2001 The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Jay Squires on February 27,2001, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Jay ~quires, Commissioners Larry Dalien, Douglas Falk, Tim Kirchoff, Mark Hedin, Dean Daninger, and Rex Greenwald. Commissioners absent: There were none. Also present: Zoning Administrator, Jeff Johnson City Planner, Courtney Bednarz Others APPROVAL OF MINUTES. February 13,2001 Motion by Dalien, seconded by Hedin, the Minutes be approved as submitted. Motion carried on a 6-ayes, O-nays, I-present (Kirchoff), O-absent vote. Zoning Administrator Jeff Johnson introduced and welcomed Courtney Bednarz as the new City Planner. PUBLIC HEARING: LOT SPLIT (01-01) - SPLIT THE SOUTHERN 2.5 ACRES FROM A 10.0ACRE PARCEL - 3245161ST AVENUE NW - JAMIE AND BERNICE HUMNICK. Mr. Johnson explained that the Commission is being asked to review the lot split request of Jamie and Bernice Humnick to split the southern two and one-half acres of a ten-acre parcel located at 3425 161 st Avenue NW. He stated thatthe property is zoned R-l, Single Family Rural. He stated that if approved all applicable ordinances will be required to be met. He mentioned the proposed lot split would meet or exceed the minimum lot size requirements as stated in Ordinance No.8, Section 6.02. '\ , / ! '\ I...J Regular Andover Planning and Zoning Commission Meeting Minutes - February 27, 2001 Page 2 u Mr. Johnson explained that the applicant is planning to combine the 7.5 acre parcel to a portion of land located to the north of this parcel and construct a single family home adjacent to the l63rd Lane temporary cul-de-sac. He stated that the process would be done administratively to assure that buildability and all setbacks are met from the future extension of l63rd Lane NW. Commissioner Kirchoff questioned if staff isn't talking about 162nd instead of 1 63rd Lane NW. Mr. Johnson explained the exact location of where the applicants will be acquiring some property and constructing a home, which is north of I 63rd Lane. Commissioner Dalien questioned if 1 63rd goes through. Mr. Johnson explained that currently 163rd Lane is a temporary cul-de-sac. Commissioner Hedin questioned if it's safe to assume that the road will eventually go through. Mr. Johnson stated that that is a correct assumption. Commissioner Falk questioned the lot width as the front setback. Chair Squires stated that the lot width as a front setback is at least 300 feet. / Commissioner Daninger questioned where they are planning to get access. Mr. Johnson explained that they are planning to get access off 163rd Lane NW. Commissioner Dalien questioned if the house would be located north of l62nd or l63rd. Mr. Johnson eXplained that the house would be located north of 163'd Lane. Commissioner Kirchoff questioned if there are any plans at this time to make l62nd Lane a through street. Mr. Johnson stated that at this time it's a temporary cul-de-sac, however it'spossible it could loop around at some point in the future. Commissioner Hedin questioned if the lot would be unbuildable. Mr. Johnson stated that it's possible the lot would be considered unbuildable, therefore they may have to put the home on the south side of l63rd Lane. Motion by Daninger, seconded by Hedin, to open the public hearing at 7:10 p.m. Motion carried on a 7-ayes, O-nays, O-absent vote. Mike Abbott, 16041 Quay Street, questioned what the future plans are for the lot divide. He questioned if the lot would remain single family residential, or if it would be rezoned to allow multiple dwellings. Mr. Johnson explained that currently the property is zoned R-l, Single Family Rural, which doesn't allow multiple dwellings. Motion by Falk, seconded by Kirchoff, to close the public hearing at 7:13 p.m. Motion carried on a 7-ayes, a-nays, a-absent vote. Commissioner Daninger questioned if the applicant is aware that it's possible a street could go through there at some point in the future. The applicant stated that they are aware the street could be extended. Chair Squires questioned if the 7.5-acre parcel would meet the front setback requirement. Mr. Johnson stated that the front setback requirements would be met. Commissioner Dalien questioned which property would connect up to the cul-de-sac. Mr. Johnson eXplained which properties would be connected to the cul-de-sac. Commissioner Dalien questioned if the cul-de-sac for the frontage is for the one to the north of 163 rd Lane. Mr. Johnson stated that that is correct. Commissioner Hedin questioned if it would be possible for the applicants to build a house on each of the lots, because of the location of the cul-de-sacs. Mr. Johnson stated that that is correct, however they would only be able to have one single family home on ' / each lot. Commissioner Greenwald questioned where the applicants would be building the house on the lot. Mr. Johnson pointed out the location and explained that the applicants would be meeting the 40-foot setback requirement from the street. Motion by Kirchoff, seconded by Hedin, to recommend to the City Council approval of Resolution No. _, granting the lot split of Jamie and Bernice Humnick to split the southern 2.5 acres of ala acre parcel located at 3425 161 51 Avenue NW, subject to the following conditions: 1. A property survey be completed and submitted to the City showing that both lots meet or exceed the minimum lot requirements as stated in the Ordinance No.8, Section 6.02. 2. The applicant pay the park dedication and trail fees for the newly created lot as stated in the fee schedule as adopted by the Council resolution. 3. The lot split be subject to a sunset clause as defined in Ordinance No. 40, Section III (E). PUBLIC HEARING: REZONING (01-01) REZONE PROPERTY FROM R-l, SINGLE FAMILY RURAL TO R-4, SINGLE FAMILY URBAN - /.42 ACRES _ 752 I40TH LANE NW - DA VID AND SHARON SZYKULSKl. PUBLIC HEARING: LOT SPLIT (01-02) SPLIT THE WESTERN .81 ACRES FROM A /.42 ACRE PARCEL - 752 MOTH LANE NW - DA VID AND SHARON SZYKULSKl. Mr. Johnson explained that the Commission is being asked to review the request of David and Sharon Szykulski to rezone land from R-l, Single Family Rural to R-4, Single Family Urban. He stated that the proposed 1.42-acre site to be rezoned is located at 752 140lh Lane NW. He mentioned that the rezoning is submitted in conjunction with the proposed lot split to the property. He also mentioned that a comprehensive land use amendment to RU, Residential Urban Single Family was completed a few years ago. Mr. Johnson explained that if approved all applicable ordinances will be required to be met. He stated that the site is within the planned Metropolitan Urban Service Area ': (MUSA) expansion as depicted in the 2020 Draft Comprehensive Plan, and is designated \. / for urban development in the 2000-2005 time frame. He mentioned that the site is adjacent to the existing MUSA and existing R-4 zoned development. Mr. Johnson stated that Commission is also being asked to review the lot split request by Mr. and Mrs. Szykulski to split the western .81 acres from a 1.42-acre parcel. He stated that the proposed lot split would meet or exceed the minimum lot size requirements as stated in Ordinance No.8, Section 6.02. He mentioned that the applicant plans to sell the newly created lot. He also mentioned that buildability would need to be confirmed by the Building Department for the newly created lot. Chair Squires questioned what the requirements would be for setbacks. Mr. Johnson stated that the setbacks would be 10 feet for structure and 5 feet for concrete and 6 feet for garage. Commissioner Dalien questioned if the current house is hooked up to water and sewer. Mr. Johnson explained that the house is hooked up to sewer, however isn't hooked up to water even though it's in the house. Mr. Szykulski stated that they are selling to two different people. Commissioner Greenwald questioned if the builder is planning on splitting the lot. Mr. Szykulski explained that yes the builder is planning on splitting the lot. He mentioned that when they put water and sewer in they installed it in three different spots. There was no further public input. Motion by Falk, seconded by Kirchoff, to close the public hearing on item #4 at 7:29 p.m. Motion carried on a 7-ayes, a-nays, a-absent vote. Motion by Hedin, seconded by Daninger, to close the public hearing on item #5 at 7:29 p.m. Motion carried on a 7-ayes, a-nays, a-absent vote. Motion by Hedin, seconded by Daninger, to recommend to the City Council approval of Ordinance No.8, Section 6.03, Zoning District Map of the City of Andover, to rezone land from R-l, Single Family Rural to R-4, Single Family Urban as requested by property owners David and Sharon Szykulski. Motion carried on a 7-ayes, a-nays, a-absent vote. , ) Motion by Daninger, seconded by Falk, to recommend to the City Council approval of Resolution No. _, granting the lot split of David and Sharon Szykulski to split the western .81 acres from a 1.42 acre parcel located at 752 140th Lane NW, subject to the following conditions: 1. I "' , Mr. Johnson asked for three volunteers from the Planning Commission to attend focus group meetings to discuss the possibilities of a Community Center. He stated that there will be representation on the committee from the Council, Planning Commission, and Park Board, among others. Commissioner Hedin, Commissioner Daninger and Commissioner Greenwald volunteered to attend the meetings. ADJOURNMENT. Motion by Greenwald, seconded by Hedin, to adjourn.
