HomeMy WebLinkAboutMay 22, 2001 :~ ,-" \.J o o ~ CLQJ ~ lR/ };)-/;;>C6/ CITY of ANDOVER PLANNING AND ZONING COMMISSION MEETING -MAY 22,2001 The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Jay Squires on May 22,2001,7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Jay Squires, Commissioners Larry Dalien, Douglas Falk, Tim Kirchoff, Mark Hedin, Dean Daninger, and Rex Greenwald. Commissioners absent: There were none. Also present: City Planner, Courtney Bednarz Planning Intern, Jason Angell Others APPROVAL OF MINUTES. May 8, 2001 The Commission mentioned that on page 3 of the minutes the motion should state that there were 6 ayes and 1 nay, which was by Commissioner Falk. Motion by Hedin, seconded by Dalien, the Minutes be approved as amended. Motion carried on a 7-ayes, O-nays, O-absent vote. SPECIAL USE PERMIT (01-04) - TO ALLOW A 12,000 GALLON ABOVE GROUND PROPANETANK AT THE ANOKA COUNTY HIGHWAY DEPARTMENT SITE LOCATED AT 1440 BUNKER LAKE BOULEVARD- ANOKA COUNTY HIGHWAY DEPARTMENT. City Planner Courtney Bednarz explained that the Planning and Zoning Commission is being requested to review the Special Use Permit request of Anoka County Highway Department. He stated that the request is to locate a 12,000 gallon above ground propane tank with a 160 gph Direct fIred vaporizer on the property located at 14440 Bunker Lake Boulevard. It was mentioned that the property is zoned R-l, Single Family Rural. It was o . also mentioned that if approved all applicable ordinances would be required to be met. U (J Regular Andover Planning and Zoning Commission Meeting Minutes - May 22, 2001 Page 2 \ , / Mr. Bednarz explained that during the building permit review process, the tank would undergo a rigorous review to ensure that the facility is safe. He stated that some of the items that will be required are a secondary containment, 2-hour fire rating, gauge to monitor tank level and prevent overfilling, automatic shut-off device, and emergency venting system to prevent over-pressurization. He stated that the tank would be located in the rear of the lot and bordered by an asphalt drive/parking lot and woods. He mentioned that the tank would not be visible from the surrounding properties. Mr. Bednarz explained that the tank and associated equipment would need to be protected by bollards and a chain link fence to prevent tampering and vehicle impact. He stated that the attached site plan in the packet shows the location of the proposed fence and bollards around the filling station but doesn't show bollards around the tank itself. Commissioner Hedin questioned the purpose of having bollards. Mr. Bednarz explained that they would help to prevent tampering and vehicle impact. Commissioner Falk questioned if a bollard is similar to a post. Mr. Bednarz stated that it's similar to a concrete post. Commissioner Falk questioned if 83 feet is a standard requirement. Mr. Bednarz , explained that 83 feet is the distance the tank would be from the structure. , ) Commissioner Falk questioned if there is an ordinance in place that states a tank that consists of a certain amount of gallons must be located a certain distance from a residential lot. Mr. Bednarz explained that the tank would be located 300 feet from Bunker Lake Blvd. and approximately 375 feet from the nearest residential structure. Commissioner Greenwald questioned if they currently have a building permit and if the tank is currently on site. Mr. Bednarz stated that there isn't a tank currently on site. Commissioner Greenwald stated that he feels the request should go under rigorous review before the Commission takes a vote on it. Mr. Bednarz explained that the request first needs to be approved to allow the site can be used in this manner, following that approval the request would receive additional and more rigorous review by the Fire and Building Departments. Commissioner Greenwald questioned if the secondary containment system would require an additional Special Use Permit. Mr. Bednarz explained the purpose of having a secondary containment system and how it would playa role in the request. The applicant Mike Palmer explained that they must meet every fire code and permit \ requirement in order to install the propane tank. He stated that he has additional , ) , \ () "--J . Chair Squires explained that in the past the Commission has looked at the general impact of the request to the surrounding areas. He stated that when it comes to safety the Commission typically relies on staff and other experts to address those issues. Commissioner Daninger questioned if any noise would be generated from the tank. Mr. Palmer stated that there could be a hissing sound, however he wasn't sure how much noise the tank would generate. Commissioner Daninger stated that the noise is a concern of his and he requested it be addressed somehow. He also questioned Mr. Palmer as to the amount of traffic that would be generated and how often the tank would be used. Mr. Bednarz explained that the tank wouldn't be used on a daily basis. Carol Schaffer, representing Anoka County, explained that she is unsure at this time as to how often the tank would be used. Commissioner Kirchoff questioned how many trucks come in and out of the site currently. Ms. Schaffer explained there are approximately 20 trucks that go in and out of the site. She stated that the traffic generated by the tank probably wouldn't make a huge ) difference compared to what already exists. Commissioner Daninger mentioned that another concern is to make sure the communications are available with the radio tower nearby in case there were any problems. Motion by Hedin, seconded by Falk, to open the public hearing at 7:20 p.m. Motion carried on a 7-ayes, O-nays, O-absent vote. Commissioner Dalien questioned if in the staff report when it talks about reduced electric rate if it should state gas rate. Mr. Palmer stated that it should state reduced gas rate. Commissioner Dalien questioned the size of the building. Ms. Schaffer stated that she isn't exactly sure of the size. Mr. Palmer stated that the tank should be able to carry the building for a day and possibly even two days. Commissioner Kirchoff questioned if the propane would substitute for natural gas. Mr. Palmer stated that that is correct. He questioned if delaying the request by two weeks would affect them much. Mr. Palmer stated that it wouldn't make a big difference since they aren't on a strict time schedule. I There was no other public input. Motion by Kirchoff, seconded by Hedin, to close the public hearing at 7:23 p.m. Motion carried on a 7-ayes, O-nays, O-absent vote. Commissioner Kirchoff stated that he works for Anoka County on this site, therefore he wouldn't be voting. Commissioner Dalien stated that he also works for Anoka County and wouldn't be voting. Chair Squires stated that he lives across the road from the site and wouldn't be voting. Commissioner Daninger stated that he would rather move slower and have all the right answers available then to push it through and have issues arise in the future. . I Mr. Bednarz stated that the item would be revisited at the next Planning Commission meeting on June 12,2001 with the following concerns addressed at that time: the noise level, the traffic levels, the filling schedule of the tank, the amount of propane needed to heat the building, and the affect on the radio tower. Commissioner Daninger stated that he isn't as concerned about the affect on the radio tower. Motion by Hedin, seconded by Daninger, to table the approval of Special Use Permit #01-04, Above Ground Fuel Storage Tank Anoka County Highway Department 1440 Bunker Lake Boulevard NW until the June 12,2001 Planning and Zoning Commission meeting. Motion carried on a 4-ayes, O-nays, 3-abstain (Kirchoff, Dalien, and Squires), O-absent vote. RESIDENTIAL SKETCH PLAN (01-01) - TO REVIEW SKETCH PLAN FOR SUBDIVISION OF PROPERTY LOCATEDAT 14440 CROSSTOWN BOULEVARD NW TO CREATE FIVE RESIDENTIAL LOTS - TAYLOR MADE HOMES. Mr. Bednarz explained that the Commission is being asked to review a residential sketch plan for the property located at 14440 Crosstown Boulevard NW. The sketch plan contains five residential lots. He stated that the proposed sketch plan is located in R-4, , Single Family Urban Zoning District. He mentioned that the minimum lot size in R-4 ) District is 11,400 square feet. \ ) (-) Regular Andover Plann;Yltf,' and Zoning Commission Meeting Minutes - May 22, 2001 Page 5 Mr. Bednarz explained that the property was created as Outlot B and Outlot C of the Creekside Estates Addition. He stated that this proposal would subdivide the outlots into four vacant residential lots and a fifth lot containing an existing house. He mentioned that municipal utilities are available to serve all of the properties. It was also mentioned that if approved all applicable ordinances would be required to be met. Mr. Bednarz explained that the proposed sketch plan is consistent with the Andover Comprehensive Land Use Plan as the property is designated RU, Residential Urban. He stated that the property is located in the Metropolitan Urban Service Area. Lot 5 Block 1, which contains the existing house, is currently served by a private well and septic system. The property is being reduced in size to an urban lot and will be required to connect to municipal utilities and abandon the on site septic system in accordance with state guidelines. Mr. Bednarz explained that the four vacant properties will be provided access from Osage Street NW. The lot containing the existing house will continue to be provided access from Crosstown Blvd. The sketch plan conforms with the design features of Ordinance No. 10 relating to easements, utilities, building setbacks, grading, drainage, and erosion control. He mentioned that a tree protection plan and a copy of the restrictive covenants would need to be submitted for review at the time of preliminary plat. Mr. Bednarz stated that the existing house located on Lot 5, Block 1 will meet all applicable setbacks when the new property lines are established. However, the small shed on the south side of the house is within the ten foot setback and encroaches slightly into the drainage and utility easement that will be established along the property line. He mentioned that the shed would have to be moved to comply with the ten-foot setback requirement from interior lot lines. The barn located on the portion of property that would become Lot 4, Block 1 of the development will be razed to allow the pond to be established. It was also mentioned that the applicant has indicated that a house will be located on Lot 4, Block 1 to preserve the potential for a future lot split to create a new residential lot on the east half of this property. In order for this to occur, 15 feet would need to be acquired from the property to the east to provide the minimum lot width of 80 feet for the future property. Utility connections for this future property haven't been constructed. Commissioner Greenwald questioned the location of the barn and shed. Mr. Bednarz pointed out the location of both the barn and the shed. \ Commissioner Hedin questioned the difference between a 1 DO-year flood plain and 3 feet above the seasonal flood mark. Mr. Bednarz explained the differences. Commissioner Hedin questioned what would be the normal level now. The developer stated that the normal level would be 868.1. Commissioner Falk questioned if Lot 4 were to split would the property owner buy 15 feet from Lot 5 in order to meet the 80 foot minimum lot width. Mr. Bednarz stated that indeed they would have to acquire and additional 15 feet from Lot 5 to meet the minimum lot width. Commissioner Kirchoff questioned if this would be done administratively. Mr. Bednarz explained that the lot split would require another public hearing. Motion by Daninger, seconded by Dalien, to open the public hearing at 7:41 p.m. Motion carried on a 7-ayes, a-nays, a-absent vote. There was no public input. Motion by Kirchoff, seconded by Falk, to close the public hearing at 7:42 p.m. Motion carried on a 7-ayes, a-nays, a-absent vote. . \ / Commissioner Hedin mentioned that it might be a lot to ask the developer to change the location of the driveway for the existing house from Crosstown Boulevard to Osage St NW. Commissioner Dalien questioned if there are currently two driveways off Crosstown Blvd. The developer stated that that is correct. Commissioner Dalien questioned if the one driveway comes out on the comer. The developer pointed out the location of the driveway. He explained that to his knowledge no one has lived there for at least 9 months. Commissioner Hedin questioned if there would be enough room between the south side of the house and the adjacent property if the driveway were to go out to Osage Street. Mr. Bednarz explained that the driveway setback is five feet so it may be possible, however staff is waiting for comments from Anoka County Highway Department before making a recommendation. Commissioner Kirchoff stated that it's nice to see access off the county road. He stated that the idea to move the access off onto Osage Street becomes a separate issue since there is one access already there. He mentioned that the traffic will likely change once the high school is up and running. He suggested the Commission think about changing the access onto Osage Street as a possibility. Commissioner Daninger questioned if the developer is looking into buying the comer lot. The developer explained that he is only interested in buying the additional footage from the comer lot. Commissioner Daninger questioned what the condition is of the structure on the lot. The developer stated that the home is fairly new and would have a value in the low $200,000's. Commissioner Hedin questioned the developer ifhe is aware if the property owner of the comer lot will be interested in selling him 15 feet. The developer stated that he hasn't been able to contact the property owner. Chair Squires suggested staff come up with the information on whether or not it's practical or not to eliminate the access on Crosstown and instead move it Osage Street. . '\ ) Mr. Bednarz stated that he personally doesn't feel it is a good idea because of the impact it would make on the overall design. Chair Squires questioned if it will be possible to get the county's perspective before the item would go before the City Council. Mr. Bednarz stated that it would be possible to get the county's comments prior to presenting it to the Council. Commissioner Kirchoff questioned if the county has any plans at this time to upgrade County Road 18. Mr. Bednarz explained that those comments would be available at the time of preliminary plat. RESIDENTIAL SKETCH PLAN (01-03) - TO REVIEW SKETCH PLAN FOR SUBDIVISION OF PROPERTY LOCATED EAST OF 752 140TH LANE NW TO CREATE TWO RESIDENTIAL LOTS - S. W. WOLD CONSTRUCTION. Mr. Bednarz explained that the Commission is asked to review the residential sketch plan for the property located west of Prairie Road on l40th Lane. The sketch plan contains two residential lots. He mentioned that if approved all applicable ordinances would be required to be met. , \, Mr. Bednarz stated that the property was created earlier this year when the property owner received approval of a Lot Split to create an .64 acre property for the existing house and a .86 acre residual parcel. He stated that the residual parcel was conveyed to , ) (J Regular Andover PlanniJ and Zoning Commission Meeting Minutes - May 22, 2001 Page 8 S.W. Wold who now seeks to divide this parcel into two residential lots. Due to the fact that the Lot Split Ordinance allows only one lot split per property per three year period, a plat will have to be processed to allow the property to be subdivided again at this time. Mr. Bednarz explained that the proposed sketch plan is consistent with the Andover Comprehensive Land Use Plan as the property is designated RU, Residential Urban. The property is located in the Metropolitan Urban Service Area. Municipal utilities are available to serve both proposed properties. He went on to review the additions that would need to be included as part of the preliminary plat submittal. Commissioner Greenwald questioned ifthere are any restrictive covenants that the Commission should be aware of. The developer stated that he is not proposing covenants for this small development. Mr. Bednarz gave a brief history explaining the reason for the first lot split was a cost and time savings for the former property owner. RESIDENTIAL SKETCH PLAN (OJ-02) - TO REVIEW SKETCH PLAN FOR SUBDIVISION OF TEN ACRES OF PROPERTY LOCATED AT 1374 161sT A VB. NW TO CREATE 27 RESIDENTIAL LOTS - DONALD PETERSON. Mr. Bednarz explained that the Commission is being requested to review a residential sketch plan for the property located east of the Chesterton Commons developments. The sketch plan consists of 27 residential lots. The proposed sketch plan is located in an R-l, Single Family Rural Residential Zoning District. A rezoning to R-4, Single Family Urban Residential would be necessary to process a formal plat. Mr. Bednarz explained that the applicant is seeking to subdivide approximately the south ten acres of the twenty-acre property he owns. He stated that an existing house and detached garage are located on the north ten acres. Municipal utilities will be extended from the south to serve this development. It was mentioned that if approved all applicable ordinances would be required to be met. \ I u ~) Regular Andover Planning and Zoning Commission Meeting Minutes - May 22, 2001 Page 9 Mr. Bednarz stated that the proposed sketch plan is consistent with the Andover Comprehensive Land Use Plan as the property is designated RU, Residential Urban. The property is also located in the Metropolitan Urban Service Area. He went on to explain that the sketch plan indicates an extension of l59th Avenue as well as a connection to Drake Street NW at the south end of the sketch plan. He stated that the north end of the new street would presumably end in a temporary cul-de-sac pending future development of the property to the north. Mr. Bednarz stated that the connection to Drake Street is not certain at this time. This connection would require obtaining access through Lot 10, Block 2 of the Cambridge Estates 2nd Addition. He stated that the applicant's representative has been seeking to acquire this property without success to date. It was mentioned that if access to Drake Street NW is not granted, an alternate design, likely involving a cul-de-sac and requiring a variance for the length of the cul-de-sac will be reviewed as part of the preliminary plat. Commissioner Greenwald questioned if there is a pretty good chance that the lots are buildable. Mr. Bednarz stated that yes there is a good chance the lots are buildable. I Commissioner Greenwald stated that the connection to Drake Street will be extremely important or there would be one long cul-de-sac. Donald Peterson, the applicant, explained that they have inquired about buying a lot on the south end so a road could be built through, however if that isn't possible the only other option is a long cul-de-sac. , Mr. Bednarz eXplained that the cul-de-sac would begin at 159th. He went on to explain that where the 500 feet would end, a variance would be needed for the remaining length of the cul-de-sac. Commissioner Hedin questioned if there are any houses on Lots 16 and 18. Mr. Bednarz stated that indeed there are houses on both of those lots. Motion by Falk, seconded by Hedin, to open the public hearing at 8: 10 p.m. Motion carried on a 7-ayes, a-nays, a-absent vote. Jeff Cook, 1389 1 56th Lane, stated that his property would be involved in the proposed connection to Drake Street. He mentioned that he has concerns on whether or not the wetlands would be wiped out if the connection were to exist. Mr. Bednarz stated that a survey is needed to delineate wetlands and determine which areas are buildable and which are not. He stated that it would definitely be addressed and any modifications to the wetland would have to go through a series of procedures. \ Commissioner Hedin stated that if the road were connected through to Drake Street Mr. ) Cook would have access to the trails. () ( ) Regular Andover Planning and Zoning Commission Meeting Minutes - May 22, 2001 Page 10 \ Commissioner Greenwald mentioned that if the connection to Drake existed Mr. Cook would also have access to the park. Mr. Cook stated that he doesn't have a problem with the road itself, but instead the impact it would make on the wetlands. Diana Hunter, 15885 Crane Street, explained that she lives on the comer of the proposed development. She stated that she is concerned about the speed and traffic it would generate since there are so many young children in the area, furthermore she mentioned concerns about the wetlands behind her property. Commissioner Greenwald questioned Ms. Hunter on when her house was built. Ms. Hunter stated that her house is one year old. She mentioned that having a park in the area th would be great, however suggested the park not be located off of 159 . Jim Lashinski, 1326 161 st Avenue, questioned if the park would be more for young children or a park with ball fields. Mr. Bednarz stated that the Park and Recreation Commission would determine that, however it was mentioned that the park may include both active and passive recreation facilities. J Mr. Lashinski questioned if 3 acres would be a large enough for a ball field. Mr. Bednarz stated that that is something that would be discussed at the June 7th Park and Recreation Commission meeting. , There was no other public input. Motion by Kirchoff, seconded by Falk, to close the public hearing at 8:21 p.m. Motion carried on a 7 -ayes, O-nays, O-absent vote. Commissioner Daninger stated that he feels the park would definitely be an asset to the area. He stated that he isn't in favor of a long cul-de-sac because of safety reasons. He agreed that the traffic somehow needs to be slowed down in the area. Commissioner Falk agreed with Commissioner Daninger. He stated that it would be nice if the adjacent property owner and Mr. Peterson would work together to come up with a joint sketch plan, which would help slow down the traffic and create a nicer park. Mr. Peterson stated that there is some wetland involved where the variance would be located if the cul-de-sac were constructed; however because there are some wetlands not all of the land would be buildable. Commissioner Daninger stated that his concern regarding the length of cul-de-sac isn't because of the number of homes necessarily but because of safety reasons for emergency vehicles. , '\ _ J / '\ ' " \ I \ J Regular Andover Planning and Zoning Commission Meeting Minutes - May 22, 2001 Page 11 Chair Squires questioned if there is general support from the Commission to pursue a connection to Drake Street. The Commission agreed. Commissioner Kirchoff suggested moving the park to the south end of the development as an alternative if the connection isn't possible. Chair Squires questioned the Commission ifthere is any support to coordinate the development with the adjacent property owner. The Commission agreed. Commissioner Hedin questioned why the road problem wasn't recognized when the development to the west was laid out. Mr. Bednarz stated that if one looks to see how Drake Street is laid out you'll notice that it curves to miss the property. He stated that this is the way the engineer laid it out. Commissioner Hedin mentioned that someone approved the development to the west knowing that there's this long piece of land and that the City typically doesn't like a long cul-de-sac. Chair Squires stated that the Commission's recommendation is to work strongly to make the connection to Drake Street, in addition to make a good community park and proceed on with the preliminary plat. I OTHER BUSINESS. Commissioner Dalien stated that he will not be able to attend the next Planning and Zoning Commission meeting on June 12,2001. ADJOURNMENT.
