HomeMy WebLinkAboutOrd. 073 - Groundwater Heat Pump CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA ORDINANCE NO. 73 AN ORDINANCE REGULATING THE INSTALLATION OF WATER-FED HEAT EXTRACTORS AND WATER-FED AIR CONDITIONING EQUIPMENT. THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS: SECTION I All residential and commercial water-fed heat extractors and water- fed air conditioning units shall be designed and installed to pro- vide that all of the water used is either returned to its original aquifer, except for recirculating ground loop systems, or discharged in a manner provided for in this ordinance. No water shall be discharged to sanitary or storm sewers. Natural waterways, reservoirs or other means of discharging water through surface disposal may only be used upon obtaining prior approval from the City Building Official. The Building Official may require soil borings or other data to determine if the surface disposal method being proposed will not endanger adjoining property and will provide for th.e safe disposal of the water. No surface disposal method shall be approved unless in the determination of the Building Official such disposal will be safe and cause no harm. There shall also be proof of sufficient well capacity. SECTION 2 In new construction, plans shall be submitted for approval to the Building Offici.al for all water-fed units prior to the issuance of a building permit. SECTION 3 Where groundwater recharge systems and closed vertical loop systems are utilized, standards established by the Minnesota Department of Health shall be met and a permit obtained from the agency prior to the issuing of a building permit. SECTION 4 Except for normal repairs and maintenance, no person shall erect, construct, alter or change any water-fed heating or w.ater-fed air conditioning system in the city wi.thout first securing a permit. Replacing other types and styles of heating or air conditioning equipment with water-fed units shall also require a permit from the Building Official. All criteria for new units set forth. in this ordinance shall be met by replacement uni'cs. SECTION 5 Units in use prior to the adoption of this ordinance need not comply with tIus ordinance provided they are not causing any flooding, threatening depletion of the aquifer from which it is drawing water, causing a nuisance to citizens or property, or is in violation of Department of Health standards. The City Council of the City of Andover hereby ordains: Ordinance No. 73 is hereby amended as follows: Ordinance No. 73 adopted November 15, 1985 is hereby repealed.
