PLANNING AND ZONING COMMISSION MEETING -JUNE 26,2001
The Regular Bi-Monthly Meeting of the Andover Planiling and Zoning Commission was
called to order by Chairperson Jay Squires on June 26, 2001, 7:02 p.m., at the Andover
City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota.
Commissioners present:
Chairperson Jay Squires, Commissioners Douglas Falk,
Tim Kirchoff, Mark Hedin, Larry Dalien, Dean Daninger,
and Rex Greenwald.
Commissioners absent:
There were none.

APPROVAL OF MINUTES.
June 12,2001
Motion by Daninger, seconded by Hedin, the Minutes be approved as presented. Motion
carried on a 6-ayes, O-nays, I-present (Dalien), O-absent vote.
PUBLIC HEARING: AMENDED SPECIAL USE PERMIT - TO AMEND A
PLANNED UNIT DEVELOPMENT (PUD) FOR ALTERNATE TOWNHOUSE
DESINGS FOR NATURE'S RUN LOCATEDAT 1650 ANDOVER BOULEVARD
NW. - BILL TRAMM.

City Planner Courtney Bednarz explained that the Commission is being asked to review
. an Amended Special Use Permit request to change the townhouse style within the
Nature's Run Development. He stated that the Special Use Peimit for this Planned Unit
Development was originally approved with a specific townhouse style that was
incorporated into the rezoning contract. He mentioned that Avalon Homes is interested in
purchasing the development and providing a variety of styles to improve the look of the
project as well as the marketability of the units. The previously approved townhouse
style illustrated in Attachment A was very similar to the design oftownhomes within the
Sunridge project located to the south. It was mentioned that this change will allow future

homeowners the opportunity to choose a townhouse style and distinguish this
development from the Sunridge project.
Mr. Bednarz stated that the proposed townhomes have been designed to fit within the
building pads as previously approved on the grading plan for Natures Run. He stated that
this will prevent conflicts with setbacks, buildability and the wetland buffer area. He
mentioned that the various townhouse styles will be allocated throughout the
development based on the demand for each style. He also mentioned that it's anticipated
that individuals will choose different finishing materials based on their preferences and
that the larger units will be located in the interior of the development away from Hanson
Blvd.
Mr. Bednarz explained that the attachments included in the staff report illustrate the
exterior features of the proposed townhouse styles. He stated that the floor plans for the
various townhouse styles are also provided in the attachments for comparison. He
mentioned that floor plans generally reflect personal preferences.

Commissioner Falk questioned if the new developer is exempt from what the previous
developer had agreed to do. Mr. Bednarz stated that this proposal doesn't affect any of
the issues that were previously discussed or approved, therefore the only change would be
the look of the building.
Commissioner Falk questioned if the developer is able to step right in where the other
developer left off even if it is up for final plat review. Mr. Bednarz stated that the City
would have to approve the transfer from one developer to the other.
Chair Squires mentioned that this discussion is only for the Special Use Permit and not
for the Preliminary Plat. He questioned how many units they are proposing. Mr.
Bednarz stated that there would be a total of 54 units.
The Developer Bill Hupp mentioned that what is being proposed is just a different style,
therefore they would still fit within the guidelines that were previously approved.
Motion by Dalien, seconded by Daninger, to open the public hearing at 7:14 p.m. Motion
carried on a 7-ayes, O-nays, O-absent vote.

Mr. Hupp explained that because there will be a different builder working on the project
they had to select different plans. He stated that by having three different style
townhomes there will be more options available to the homeowner. He mentioned that
the three styles selected were designed specifically for this project, therefore they will be
unique to the area.

Gloria Freyholtz, 1806 Andover Blvd., questioned if it has already been decided that 54
homes will be going into that area. She felt that more consideration should be taken into
the project before deciding to put that many homes in that small of an area. She
questioned ifit's been approved to build on the site even though there are Indian Burial
Grounds there.
Chair Squires stated that what the Commission is discussing isn't the number of units, but
the physical appearance ofthe units. He questioned staff on whether or not it has been
approved to build there even though the site is the location ofIndian Burial Grounds.
Mr. Hupp stated that he wasn't prepared to answer a question on the Indian Burial
Grounds, therefore he agreed to check into it. He mentioned that to his knowledge the
DNR and the Historical Society have been contacted and the issue has been resolved,
however he didn't know how it was resolved.
Chair Squires stated that this is a concern of the residents and as a property owner it
should be something he is informed on. Mr. Hupp stated that he is aware that a letter was
sent to both the DNR and the Historical Society and to his understanding it was resolved,
however he wasn't sure how it was resolved.

Chair Squires stated that this is a legitimate question of a resident in the area. He
suggested to Mr. Hupp that an engineer be present at the City Council meeting to clarify
the concerns of the residents.
David Overbaugh, 1826 Andover Blvd., questioned where the water would go with that
many homes being developed.
Mike Hollister, 1860 Andover Blvd., questioned if the area is still an Indian Burial
Ground. He mentioned that they continue to lose their privacy due to all the traffic in the
area. He also mentioned that the water drains into their yards and floods them out now
not to mention when all the additional homes are built, he questioned if this could be
taken care of.
Mr. Bednarz questioned Mr. Hollister if the drainage problems he is experiencing on his
yard are a result of the grading activity being done as part of this project. Mr. Hollister
stated that the water has been draining into his yard for some time.

Commissioner Daninger questioned if it's correct to say that the square footage is
increasing, however the building pad hasn't changed. Mr. Bednarz stated that that is
correct. He mentioned that the building pad is actually larger than the original style
homes.
Commissioner Kirchoff stated that he feels it's an improvement from the original plan,
however agreed that an engineer should be present at the Council meeting to address the
concerns of the residents regarding the Indian Burial Grounds.
Commissioner Hedin agreed with Commissioner Kirchoff. He mentioned that the change
will offer more variety to the buyers.
Motion by Kirchoff, seconded by Hedin, to recommend approval to the City Council to
Amend Special Use Permit, SUP 00-17, Natures Run, 1650 Andover Boulevard, to
change the townhouse style within the development as proposed in the staff report.
Motion carried on a 7-ayes, a-nays, a-absent vote.
Mr. Bednarz stated that this item would be considered at the July 17,2001 City Council
meeting

'-. j PUBLIC HEARING: ORDINANCE AMENDMENT (01-01) - TO REVIEW
AMENDMENT TO ORDINANCE NO. 214 TREE PRESERVATION.
Mr. Bednarz explained that this is a continuation of the discussion held on May 22nd
with the City Council the Commission and on June 12th with the Commission. He stated
that at the June lih meeting the Commission recommended the ordinance require a
minimum of two front yard trees per new residential property or one tree per 50 feet oflot
width, whichever is greater. Trees preserved in this front yard during development could
satisfy a portion of or all of this requirement. He presented the Commission with a table
illustrating this proposal.
Mr. Bednarz stated that the Andover Review Committee reviewed the recommendation
from the Planning Commission and is concerned about the number of trees that would be
required for rural lots and the expense that would be added to landscaping costs. They
are suggesting the Commission consider a maximum number of three or four required
front yard trees for rural lots.

Commissioner Falk questioned if the Andover Review Committee would like a set
number of trees for rural lots. Mr. Bednarz eXplained that with the proposed change a
rural lot having a width 0000 feet would require 6 trees, therefore because of the costs in
landscaping they recommended there be a maximum number of trees for rural lots.
Commissioner Falk stated that typically rural lots already have trees on the property.

Commissioner Hedin stated that the Andover Review Committee has a good idea, He
stated that the rural area has plenty of trees, therefore three trees on a lot over 100 feet
should be sufficient.
Mr. Bednarz explained that they are referring to trees in the front yard only, not in the
backyard,
Commissioner Dalien stated that he isn't in favor of reducing the number of trees down to
what Commission Hedin suggested. He mentioned that if the City is going to require
trees in the front yards a 300-foot strip could certainly handle more trees.
Commissioner Greenwald agreed with Commissioner Dalien. He questioned if other
cities have maximum amounts for rural lots.
Chair Squires agreed with leaving the language as it is written, which would allow for
more trees on rural lots. He stated that it's important to have the same appearance if the
lot is larger, therefore it would require one tree every 50 feet of boulevard. He mentioned
that most rural lots have some trees, therefore the costs shouldn't be that substantial.

Commissioner Daninger agreed with Chair Squires and Commissioner Dalien.
Commissioner Greenwald questioned who is on the Andover Review Committee. Mr.
Bednarz explained who is on the committee.
Commissioner Kirchoff questioned how the performance bond would work. Mr. Bednarz
explained that the developer puts the performance bond into action. He stated that it's the
developer's money that the City is holding to guarantee the tree.
Motion by Daninger, seconded by Falk, to open the public hearing at 7:45 p.m. Motion
carried on a 7-ayes, O-nays, O-absent vote.

Commissioner Hedin commended Mr. Bednarz on a great job incorporating the
Commissioner's comments into his report. He questioned ifthe Commission agreed that
evergreens would not be included in the ordinance.

Chair Squires stated that at the last meeting there was a discussion on deciduous vs.
coniferous, however there was no consensus either way.

Mr. Bednarz stated that the word "deciduous" was added to the ordinance last time,
therefore it would eliminate evergreens as an option.
Commissioner Dalien questioned the reason evergreens wouldn't be included. Chair
Squires explained that the intent of the ordinance is to re-establish a canopy affect,
however evergreens can't do that. He mentioned that one could plant as many coniferous
trees as they choose as long as the ordinance requirements are met.
Commissioner DaIien questioned if they would have to plant 6 deciduous trees if a lot
were to contain many trees but they were all evergreens. Mr. Bednarz stated that as the
ordinance is written they would have to plant 6 deciduous trees.
Commissioner Kirchoff questioned if a variance couldn't be granted in a situation such as
this. Mr. Bednarz stated that indeed a variance could be granted under special
circumstances.

Motion by Greenwald, seconded by Hedin, to recommend approval to the City Council to
Amend Ordinance No. 214 as presented in the staff report, however adding the word
"deciduous" in Section 13, line 2 after the number "1".
Further Discussion
Commissioner Daninger questioned if the motion includes the recommendations from the
Andover Review Committee. Commissioner Greenwald stated that his motion does not
include the recommendation from the Andover Review Committee to have a maximum
number of trees for rural lots.
Motion carried on a 7-ayes, O-nayas, O-absent vote.
PUBLIC HEARING: ORDINANCE AMENDMENT (01-02) - TO REVIEW
AMENDMENT TO ORDINANCE NO. 10 PLATTING AND ORDINANCE NO. 114
WETLAND BUFFER.
Mr. Bednarz presented the Commission with the ordinance amendment for wetland
buffers to facilitate additional rear yard space between the structure, wetlands, and
retention ponds. This item was discussed at the last Planning and Zoning Commission
meeting, and a public hearing has been scheduled to hear the public's input.

Commissioner Dalien questioned ifthere would be anything preventing someone from
building in the 15-foot zone. Mr. Bednarz pointed out that one could build anywhere
within the 1 DO-foot buildable area as long as the setback requirements are met.

Chair Squires stated that most builders will put the house at the front yard setback,
however they wouldn't be prohibited from building in the IS-foot zone.
Commissioner Greenwald questioned ifthe change in the ordinance from using the
language "wetland resources" to "water features" came from the Andover Review
Committee. Mr. Bednarz explained that it's intended to include both retention ponds and
wetlands.
Commissioner Greenwald questioned if approving the amendment would set the City up
for a large number of variance requests. He also questioned if it would affect the
developer's plans that are already in process. Mr. Bednarz stated that the amendment
wouldn't affect anything that's already in process.
Commissioner Greenwald questioned if notification was sent out to active developers and
owners of developable property. Mr. Bednarz stated that notification wasn't sent out to
all owners of developable property.
Commissioner Kirchoff stated that in the past everyone who went into the buffer zone
needed a variance. Mr. Bednarz stated that even with the amendment anyone
encroaching into the buffer zone will require a variance.

Chair Squires stated that one option would be to move it forward to the City Council and
they can make the decision on whether or not they feel it's important to notify all
property owners of developable property.
Commissioner Greenwald mentioned that potentially the houses could be staggered if
some were to choose to move the house back from the 35-foot front yard setback.
Commissioner Dalien mentioned that some homes may want to be closer to the wetland.
Mr. Bednarz stated that the front yard setback hasn't changed, therefore people could've
done this before.
Commissioner Greenwald stated that making this change to the ordinance will give them
more options to build the house back further.
Chair Squires questioned if the engineer explained the difference between retention ponds
and detention ponds. Mr. Bednarz stated that it would be covered in the ordinance since
it mentions anything that holds water.

Chair Squires suggested changing the language to "storm water ponds" to make sure
everything is covered. He suggested staff discuss it with the engineering department.
Mr. Bednarz agreed to check into it.

clarification is necessary on retention vs. detention ponds in regards to storm water
ponds.
Further Discussion
Chair Squires mentioned that staff should raise the concerns of some Commissioner's in
regards to whether or not notification should be sent to all property owners with
developable property.

Mr. Bednarz stated that a committee has been formed to discuss the possibilities of a
recreational facility. He mentioned that the minutes from that meeting will be forwarded
to the Commissioners.

Zoning Commission meeting.
