Expenditure Reports for the Park Improvement Fund as of December 3l, 2005. This is a
preliminary report and 2005 will not be closed until the annual audit in complete.

SUBJECT: 5. Consider 2006 Softball/Baseball Tournament Applications

INTRODUCTION
This item is in regard to considering the attached softball/baseball tournament
application forms for the upcoming 2006 softball/baseball season as requested by the
Andover Baseball Association and the Andover Athletic Association.
DISCUSSION
The earliest the associations can submit is December 15th for the following summer. At
this time, no other tournaments have been scheduled for the upcoming season for the
ball fields. Listed below are the associations and dates of the tournaments that have
been requested.

As you can see, both associations have applied to have tournaments on May 20-21.
The associations are meeting sometime prior to the January 19th Park Commission
meeting to determine if one of the tournaments can be moved to another weekend.
Note: The Andover Family Fun Fest is scheduled for July 7 & 8.
ACTION REQUIRED
The Park & Recreation Commission is required to consider approving the attached
tournament application forms.

All requests for tournaments must be submitted by December 15, The application will be considered by the Park & Recreation
Commission at the first Thursday meeting in January. Any tournament application after that will be on a space available basis
and must be submitted at least eight weeks prior to the tournament date. A penalty of 50 percent of the field usage fee will be
assessed for applications made less than eight weeks prior to the tournament date. All fees must be submitted with the
application no later than eight weeks prior to the tournament date. For any late application, the late fees must also be submitted
with the application, including the penalty fee. Late applications must be approved by the Park and Recreation Commission at
least two weeks prior to the date of the tournament The sequencing of scheduling will be considered with City Youth
Associations having first priority.
A $500.00 damage deposit fee (or $250.00 deposit fee for non-profit organizations) is due eight weeks before the tournament
date. Any equipment damaged or lost or any damage to City property by renter will be deducted from deposit fee. The $500.00
(or the $250.00), less any money for damages, will be returned after inspection by the Public Works Parks Supervisor.
* If the tournament organization is requesting a Non-Intoxicating Liquor License, it will be necessary to request Attachment A.
The City Council has adopted the following refund policy:
"Fees for tournaments shall be paid no later than eight weeks prior to the tournament date. If the tournament is cancelled,
neither the Tournament Fee, Field Usage Fee nor the Non-Intoxicating Liquor License Fee will be returned. In the event that
another sponsor requests the use of the facilities after a tournament has been cancelled, the new sponsor must pay the full
amount and the original sponsor will be refunded the total minus any administrative costs incurred by the City."

If you need to use the Cushman, there will be a fee of $35.00 per day and $350 refundable damage deposit. It will be
necessary to pay the necessary fees 1 week prior to the tournament. Training for the Cushman by the Public Works

All requests for tournaments must be submitted by December 15. The application will be considered by the Park & Recreation

and must be submitted at least eight weeks prior to the tournament date. A penalty of 50 percent of the field usage fee will be
assessed for applications made less than eight weeks prior to the tournament date. All fees must be submitted with the
application no later than eight weeks prior to the tournament date. For any late application, the late fees must also be submitted
with the application, including the penalty fee. Late applications must be approved by the Park and Recreation Commission at
least two weeks prior to the date of the' tournament. The sequencing of scheduling will be considered with City Youth
Associations having first priority.

INTRODUCTION
This item is in regard to a request from Rita Burgeson at 4345 - 157th Avenue NW regarding
the frisbee golf course that was installed late last summer at Fox Meadows Park.
DISCUSSION
Attached is a letter from Ms. Burgeson regarding concerns that they are having since the
course was opened, which includes a request for a fence or netting along the south property
line of the park.
In response to the letter, City staff would like the Commission to know that we have made
significant efforts to work with the Burgeson's and have relocated two of the baskets and two
tee box areas along the south end of the parle Staff has encouraged the property owners that
if users are trespassing onto their property, it would be appropriate to call the Sheriffs
Department to investigate. This also pertains to the littering, drinking of alcohol, inappropriate
language, etc. With regard to frisbees flying onto the property, City staff has made several
attempts to throw a frisbee through the trees and found that in all cases the frisbee did not end
up on the private property.
As far as the request for fencing or netting that has been requested by the Burgesons, it is City
staffs position that we would not recommend fencing or netting. Generally, it has been past
practice not to fence along private property unless there is a safety issue with someone getting
hurt from baseballs or softballs.
Fox Meadows Park is one of the City's largest parks and sporting activities such as frisbee golf
are appropriate for a park of this size. In evaluating all of the parks within the City that would be
conducive to this particular activity, the Park Commission recommended Fox Meadows Park. In
addition to the size of the park, the terrain is ideal for this type of activity.
ACTION REQUIRED
The Park & Recreation Commission is requested to consider the request and recommend to
the City Council if a fence or netting should be installed along the south property line of Fox
Meadows Park.

Dear City of Andover Park Board,
We have lived at 4345 157th Ave NW in Andover (the Northeast corner of 7th Avenue and
County Road 20) since 1978. Our North property line is the most southerly property line
of the "Park" in the plat of Fox Meadows.
The Fox Meadows Park has been open for quite a few years. A large number of soccer
games are played in the park each year and people use the park for other recreation. We
have not previously had any problems with the park. We have no problem with the park,
so long as it doesn't infringe on our property and our property rights.
On about September 15th, 2005, a Frisbee course was opened in the park.
. No study or investigation was done on the sport or its potential impact on the park or
adjacent property before the course was put in, according to Todd Haas.
. The person who laid out the course (Mike) did not know where the property line
between our property and the park was, according to him. In fact, this fall, the city
manager and the Mike the designer of the course told us they did not know where the
property line was, so we showed them our property stakes.
The Frisbee course has resulted in a number of serious problems for us:
. Large numbers of Frisbee players have been throwing their Frisbees into the trees on
our property and retrieving them.
. Numerous Frisbee players coming on our property looking for their Frisbees and use
bad language, drink beer, smoke cigarettes. We wouldn't care if they smoked on park
land, but they are causing a potential fire hazard when they smoke on the dry pine
needles and dry weeds on our property.
. We have observed about one out of three players throwing their Frisbees onto our
property.
. They climb our trees, they break branches on our trees, they walk around on our
property interfering with our privacy.
. When people have their expensive Frisbees land on our property, they try to retrieve
them.
. The Frisbee course is generally creating a situation that causes people to go on our
property.
. We find empty beer bottles & cans both on our property and on park property along
the Frisbee course.
. Besides concern for invasion on our privacy and property rights, we have an eight year
old daughter and are extremely concerned for her safety - since large numbers of
strangers are entering our property, including people drinking alcohol.
After numerous discussions with us, the city has reluctantly taken some steps that have
not solved the problems.
. The city put in "No Trespassing" signs along the property line. We appreciate the
effort, but they did not seem to deter people wanting to retrieve their valuable
Frisbees. They still retrieved them.
. The city eventually changed the layout of the course. That does seem to have reduced
the amount of trespassers, because fewer Frisbees land on our property, but people
are still trespassing.
The Frisbee course draws various people.
.
We have been told that Frisbee courses become posted on Web sights and draw
people from far away, even all over the state. It is not just a local sport - it draws
people from outside of Andover.
People are still trespassing onto our property.
. We are afraid that if we confront them or call the police that they might retaliate.
. The older adults with younger children seem to act properly, other than the
trespassing.
. The teenagers and young adults seem to be the ones who do more of the drinking,
smoking, and loud swearing, besides the trespassing.
. Even when they stay on the park side of the property line, from time to time we can
hear loud swearing, even through closed windows in our house.
. They play the Frisbee course from morning until well after dark all days of the week.
.
Soccer and other team sports are generally supervised and the people are not drinking,
smoking, swearing loudly, trespassing, leaving beer bottles, and hanging out even well
after dark.
If a private business caused this to happen to a nearby homeowner and did not
immediately put a stop to the situation, they would be shut down.
We have not complained over the years as the park functioned with soccer and other park
usage.
The City of Andover is failing to protect our property rights. We have no problem with
the park when it was under control, but with this Frisbee course, the City of Andover has
lost control of its park. The situation is terrible and our worst fear is for the safety of our
little 8 year old daughter.
The course should be taken out of Fox Meadows Park or if it is to remain, the city should
erect a high fence or golf netting on the south property line.

The CSO was dispatched to a parking complaint at the park. On arrival there were
approximately lO vehicles parked on the grass between no parking signs. Several of the vehicles
were moved when the CSO arrived. She sat there for about lO minutes but no other vehicles
were moved. The vehicles that remained were issued warning tickets.

location. The deputy located the tent; the park ranger took down the "camp" and turned the
property that was recovered over to the sheriff's office.

A deputy was dispatched to a suspicious vehicle. Upon arrival the deputy located a person
sleeping in the vehicle. The belt on the car was broken and would not run. The person in the
vehicle stated the vehicle was his but that he had not yet transferred the title. He was issued a
citation for not transferring the title and the deputy ordered a tow to remove the vehicle from the
park.

A resident called to report by phone that sometime around midnight or so he'll see cars in the
parking lot. Once the occupants see the reporting party's vehicle they leave. The resident
wanted to request extra patrol.

This item is in regard to an update as to the status of the park dedication requirements for
Sophies South.
DISCUSSION
Just so that all the Commission members (including the new members) are aware, the
developer recently submitted a letter to the City challenging the park dedication requirements

cash is required. At this point, the developer has escrowed the cash with the City so that the
plat could be recorded at the County. The City Attorney and City Administrator are in the
process of reviewing the letter and will be responding back to the developer within the next few
weeks.

ON-GOING PROJECTS
o Develop Site Plans for all existing parks which indicates the facilities available. (On-Going).
o Update of Quarterlv Sheriff's Department Report on Park Patrol & Vandalism - Item is on the
agenda.
o Andover Station North Park (property south of the old landfill) - Now that the project has
received financing approval from the City Council, City staff will begin preparation of plans and
specs for the improvements (parking lots, street, fencing, etc.). Once a plan is nearly completed a
copy of the plan will be presented to the Park Commission for review.
o Country Oaks West Park - The playground equipment has been installed along with the sidewalks
and the basketball court has been paved. The irrigation will now be installed next spring. Some
trees have been planted by the developer and the City. The park is coming along nicely. To date,
the City has been invoiced about $56,000 by the developer for the playground equipment.

TASK FORCE UPDATES
Skateboard Task Force - Blackstad/Masloski. Item is on the agenda. A representative from the
Edina YMCA will be making a presentation at the meeting.
Advertisement Sian Task Force - The Task Force had their first meeting last Thursday, January
12111 to begin discussions on sign advertisements at City ball field facilities. The meeting went very
well and alot of progress was made. The Task Force is scheduled to meet again within the next two
weeks or so.
Concerts in the Park - Commissioner Albee is currently doing more research on this. This will be
discussed with the Commission at a later date.
