Present: Commissioners Don Jacobson, Mike Knight, Ken Orttel, Julie Trude; and Voting resident members Joyce Twistol Voting resident member Robert Nowak Executive Director, Jim Dickinson Community Development Director, Will Neumeister Others Absent: Also present: APPROVAL OF MINUTES February 6, 2007: Correct as amended. Commissioner Trude stated on page two, fourth paragraph, the sentence should read "Commissioner T rude stated that her concern is there are quite a few vacant retail spaces builamgs in the City now." On page three, second line from the bottom should read "Commissioner Trude stated that on the markiBg marketing end,..." MOTION by Trude, Seconded by Knight, approval of the Minutes as amended. Motion carried unanimously. LETTER OF INTENT (JOHN LARKIN) The EDA is asked to review the newest "Letter of Intent" from John Larkin. Mr. Neumeister indicated Mr. Larkin called and said he was unable to attend the meeting and his sub could not make it either. He would like to be back on the 20th of March if the EDA would agree. Mr. Neumeister reviewed some of the changes made to the plans with the EDA. Commissioner Knight stated this was an exciting proposal. Commissioner Trude stated the parents are really excited what their kids do so she thought Mr. Larkin was looking to capitalize not only on what the kids do but also on the coaches. Mr. Newneister stated it is geared towards motivational team support. President Gamache wondered how large the lot was across the street to accommodate a restaurant. Mr. Newneister stated the corner lot that is remaining is about ninety by two hundred feet, which would support a fast food restaurant. Commissioner Trude stated she would like to see this come into the City. Motion by Commissioner Gamache, Seconded by Commissioner Trude, to schedule an EDA meeting for March 20, 2007 at 6:00 p.m. Motion carried unanimously, Commissioner Trude wondered if Park Dedication will be backed out of the proposal. Mr. Newneister indicated that was correct. REVISED PROPOSAL AND PURCHASE AGREEMENT (NASSAU BUILDERS) Andy Stoner (Nassau Builders) has verbally indicated that he would like to enter into a purchase agreement for all of Lot 24, Block 1, Parkside at Andover Station. He feels that the entire site would support multiple office buildings. Mr. Newneister reviewed the proposal with the EDA. Commissioner Jacobson stated on page three at the bottom, Exhibit A is blank. Mr. Newneister stated that is a lot division diagram and they are getting rid of it because it is no longer needed so Exhibit A will be the drawing they saw before. They can note the drawing is Exhibit A. Mr. NeU).lleister stated another change is Mr. Devon Walton is still representing the buyer and they talked to the City Attorney and Mr. Walton was working with ReMax and Associates Plus at the time this was originally written and unless they get a release from ReMax, they are not going to change that. Motion by Commissioner Jacobson, Seconded by Commissioner Knight, to accept the revised proposal and purchase agreement for Nassau Builders. Motion carried unanimously. Purchase Agreement with Dynamic Sealing Technologies Mr. Neumeister reviewed the purchase agreement with the EDA. Mr. Dickinson stated this group has a light manufacturing facility. The jobs will be very livable wage jobs and they came forth to staff after they were doing their due diligence and indicating the costs were too much in comparison with other cities. They compared Andover with Blaine, Ramsey, Coon Rapids, Anoka. The group told Mr. Dickinson that the water hook up charges were higher than other cities and Mr. Dickinson stated those were utility costs and they were not going to negotiate those. The group indicated they may have to look elsewhere. Mr. Dickinson told them the only place they would be willing to negotiate is on the cost of the property. They were able to negotiate with them on the property and the amount he is recommending to the EDA after that negotiation is .15 cents a square foot reduction. Commissioner Trude wondered what the amount would be per square foot. Mr. Dickinson stated it went from $3.75 to $3.60 a square foot. He stated this included the area charges. The connection charges are going to be significant on the water, probably around $40,000 and is not a number they will negotiate. Mr. Dickinson stated at this point, he understood the group was in agreement with the reduction of .15 cents and is in review with their attorney. Their broker has agreed to most of the items and thought the buyer would agree also. Commissioner Trude stated she would rather have the price go down another nickel and have them write a separate check. Mr. Dickinson stated they do have a precedent on doing the area charge and that was a fairly small dollar amount so he did not really have a problem with that. Motion by Commissioner Jacobson, Seconded by Commissioner Trude, to approve the purchase agreement. Motion carried unanimously. Mr. Neumeister reviewed the cross access agreement with the EDA. Commissioner Knight stated if it is just panel trucks he did not see a problem. He did not want to do anything that is detrimental to the restaurant site. Mr. Neumeister stated that is what they wanted in the agreement and how it is worded. Anoka County Partners Mr. Dickinson stated with their participation in Anoka County Partners, they do have a board seat and they have a board meeting coming up shortly. He wondered who they want to have on the board. He stated he did not mind attending the meeting on behalf of the EDA. Motion by Commissioner Knight, Seconded by Commissioner Jacobson, to appoint Jim Dickinson as representative of the EDA to the Anoka County Partners Board. Motion carried unanimously. . Commissioner Knight stated there is a conflicting sign on Hanson and Round Lake Boulevard. One sign says for sale and another sign says for lease. Mr. Neumeister stated he talked to Mr. Courtney Bednarz and the plans have not changed. Mr. Dickinson stated his understanding was the property is still for sale and the group has a purchase agreement if they can get their approvals through the City Council. . Commissioner Knight wondered what was going on at Hanson Boulevard. Mr. Berkowitz indicated the closure has been postponed until March 16th and the road and bridge will be closed to take the bridge down and Highway 10 will reopen on Monday, March 19, 2007. Motion by Knight, Seconded by Jacobson, to adjourn. Motion carried unanimously. He indicates that he would like to purchase the lot directly east of the ball fields and build a tip up panel structure to be home to his MVP baseball training academy as well as a gymnastics training facility. The site plan shows that he would build at least 26,400 square foot of building in the first phase. They would like to have an outdoor practice hitting area. The site plan may need to be slightly adjusted and that can be dealt with during the site plan review process. This will be needed to avoid the 200 foot setback from the WDE landfill (should he ever want to expand the building to 52,000 square feet). Please review the attached document to understand what Mr Larkin is proposing to construct at Andover Station North. Mr. Larkin will be at the EDA meeting to make a presentation to the commissioners on his proposal. The staff is supportive of his proposal as the land price is comparable to what the land appraisal indicates the site is worth. Please recall that the building will need to be constructed to have special monitoring and venting systems to meet the MnPCA's requirements as it is within 500 feet ofthe WDE landfill. This enters into the price Mr. Larkin is willing to offer on the land purchase. ACTION REOUESTED Please allow Mr. Larkin to make a short presentation at the meeting and consider his proposal to buy one of the lots at Andover Station North to build a ball training facility (Lot 1, Block 1, Andover Station North). Propertv use and Buildin!!: reauirements. o Our current plan for the 4.31 acre usable area would include a large open structure to be used as a practice and training space for sports teams, (baseball, football, soccer, lacrosse, etc). This would be adjacent to a series of indoor batting cages for walk-in batting practice and 2 to 4 individual instruction cages for specialized hitting and pitching instruction. These individual cages would include 4-point video analysis and a room or viewing area attached to each space. We would also like to include outdoor monitored batting cages for the wanner months, .., -~- o probably on the north side of the property. We are currently Working on a layout of approximately 26,400 S.F. with an addition of 26,400 S.F. more. We hope to raise the funds to build the entire facility in one shot, Please refer to the drawing attached. It is our hope to fInalize any and all approvals very soon so we can secure financing ASAP. We would like to break ground in the spring. We have a lot of support from many different athletic organizations in the area. We hope to fInd ways to support and help all of them. About us Joe and I each have a long history in baseball and with coaching. John Larkin I had played division 1 College baseball in southern California and Colorado. And I have played ball and coached in the Mens Senior Baseball League for 10 plus years, and one year of Town ball on a traveling team here in Minnesota. I currently own and operate a Security Systems business for nearly 11 years, so I understand the commitment it takes to tackle such a project as this. My backround includes a degree in architectural design and engineering, general contracting, and many years in the security business. I have been a volunteer frrefIghter here in Andover for 4 plus years. o Joe Ruhland Joe previously was recruited by Medtronic to work with Cardiologist and Sales Leadership to increase revenues and improve their overall effectiveness in the medical industry, hence his return to Minnesota in 1998. His previous background included -3- c working with New York Rangers organization in P.R. & Media Relations and he consulted with Team USA Hockey as performance improvement expert. In 2005, Joe started his own consulting company, implementing his motivational sports background with his rich experience in the medical device industry. Over the past year, Joe has partnered with Bill George, former Medtronic CEO, Anne Bancroft and Lance Armstrong to deliver impactful and successful workshops around the country. His clients include, Medtronic, St. Jude Medical and AMS just to name a few. He sets a tempo for success in everything his is involved with and creates a level of excitement that can best be compared to as "momentum" in the sports world. . Joe's approach includes practice and scheduling balance, positive response, and realistic goal setting. The programs Mr. Ruhland has developed will be an integral part of our format, and teaching principals. The positive attitude is the only attitude. However the Exhibit B attachment should be updated to reflect that they are allowed, as that is the primary handout that staff uses to show prospective clients what is allowed in Andover Station North DISCUSSION Staff recommends that the design guidelines (Exhibit B) be amended to show concrete tip-up panels are an allowed building material. Remember the EDA still has full approval of the type and quality of the panel so that they can determine if it is architecturally compatible with the other buildings in Andover Station North. There are some rather attractive looking tip-up panels that with additional embellishments in the form of brick stone and glass can look as nice or nicer than block construction. ACTION REOUESTED The EDA is asked to review the proposed change to the Andover Station North design guidelines to modify Exhibit B of the guidelines to show the use of pre-stressed tip-up panels on buildings in Andover Station North are allowed. All enclosures must be 7, cc~ssible to waste and recycling collection vehicles. G. Uti . . es and Antennas - All permanent, local service, utility lines on any lot shall be place underground. All utility apparatus and appurtenances including but not limited to trans rmer or terminal equipment shall be visually screened from view from streets an ~acent lots. Antennas that present a cluttered view, or that interfere with the operatio of other owners in the Property are not permitted. 2.02 Landscaping A. All areas on any lot or p el not used for buildings, storage, parking, walkways, access roads, or loading areas s be suitably graded, drained and sodded, maintained and landscaped with trees and sbni so as to provide a park-like setting and to screen parking areas. o B. Landscaping plans are required for all evelopments and are subject to the approval of the EDA, as part of the site plan approval ocess. All lots and parcels shall be landscaped within 90 days of substantial completion f construction and issuance of Certificate of Occupancy in accordance with approved lans. All landscaping associated with substantial completion during the Winter must e escrowed in accordance with Building Department requirements. C. The landscape design should be complementary t common areas and previously developed areas. Plantings should provide for season interest and should include a selection of coniferous and deciduous plants. Natural andscaping and indigenous vegetation shall be permitted and are encouraged in those as not associated with the formal entries and common areas or buffers between propertie that may be negatively impacted by said landscaping. Annual flowers are recommended t accent or supplement the landscape plan. All landscaped areas shall be irrigated. D. The approved plan for landscaping a building site may not be alter substantially without submitting a revised plan to the EDA for approval. E. For parking lots, a minimum number of shade trees are required, equivalent to ne tree per ten parking stalls. Trees in parking lots shall be spread uniformly through t the parking area Trees planted along connecting walkways and adjacent landsc ed frontages may also contribute to the one-per-ten requirement for parking lots. Trees mu be set into a landscaped island or placed around the perimeter of the parking lot. 2.03 Architectural Standards (Commercial, Industrial, Office Showroom Buildings) o A. Building Entries and Windows - Building massing shall be designed to highlight the location of building entries. Primary pedestrian entries shall be clearly expressed and Andover Station North Design Standards February 7, 2006 - 6- o be recessed or framed by a sheltering element such as an awning, arcade, porch or portico. Greater height may be used to accentuate entries in the form of tower elements, tall openings, or a central mass at an entry plaza. B. Reveals - Windows and doors must be recessed at least two inches from walls or exterior trim to create shadow for visual interest. C. Building Scale and Definition - The guidelines in this section are intended to create buildings with a human scale, making Andover Station North a more pedestrian- friendly and a pleasant place to walk. o 1. Structural Legibility and Articulation-Facade articulation is required. Building fenestration (windows and doors) and changes in mass shall relate to structural system(s) and the organization of interior space. Vertical architectural features such as columns and piers help articulate building mass. 2. Roof Form/Rooftop Equipment-A variety of roof forms are permitted. Architectural drawings shall show rooftop mechanical equipment details. Changes in roof form must correspond with a building's structural bays and massing. Mechanical. equipment must be integrated into overall mass of a building and screened and/or hidden behind parapets or recessed into hips, gables. Equipment boxes must be adequately screened. 3. Fences and W alls- Walls and fences within view of streets, parks or plazas must be constructed out of attractive, long-lasting materials, such as wood, wrought iron. masonry or stone. Chain link and wire fencing must not be used. Walls and fences must not exceed 42 inches in height within 20 feet of streets, parks, and plazas. D. Buildings 1. Quality and Materials - Each bUilOm:g located Williiri the Property shall be built in an industry acceptable and city approved workman-like manner with high quality, first-class building materials. The design and location of buildings constructed on a lot shall be attractive and shall compliment existing structures and the surrounding natural features and topography with respect to height, design, finish, color, size and location. The following standards shall be adhered to: I A. fvt:asonry material shall be used. Color shall be introduced through colored block or panels and not painted block. B. Brick may be used upon approval of the ARC to assure uniformity. o C. Block shall have a weathered, polished, fluted or broken face. D. Concrete may be poured in place, tilt-up, pre-cast, and shall be finished in] .It. stone or textured finish, and coated. r Andover Station North Design Standards February 7, 2006 -7- o E. Metal siding is prohibited, except as an accent material upon approval of the ARC. F. All accessory structures shall be designed and constructed with materials compatible with the primary structure. G. All roof-mounted equipment shall be screened by walls of compatible appearing material or camouflaged to blend into the building or background. Wood screen fences are prohibited. All exterior machinery, tanks, etc., are to be fully screened by compatible materials. o H. Acceptable materials will incorporate textured surfaces, exposed aggregate and/or other patterning. All walls shall be given added architectural interest through building design and/or appropriate landscaping. The buildings shall have varied and interesting detailing. The use of large unadorned concrete panels and concrete block:, or a solid wall unrelieved by architectural detailing, such as change in materials, change in color, fenestrations, or other significant visual relief provided in a manner or intervals in keeping with the size mass, and scale of the wall and its views from public ways shall be prohibited. See recommended materials palette, Exhibit B. (Samples available at Andover < Community Development Office). Other materials may be approved by the ARC and EDA if determined to be in conformance with existing design and character of the Property . 1. Each building shall contain one or more architectural treatments such as towers, arches, vaults, entryway projections, canopies and detailing to add additional interest and articulation to structures. J. There shall be no underdeveloped sides of buildings visible from public right- of-ways. All elevations visible from the street shall receive nearly equal treatment and visual qualities. Windows shall be incorporated into areas that front streets, sidewalks or trails, when appropriate. K. Review and approval of building materials by EDA. < L. Minimum Height - Street facing buildings must be at least 20 feet high. Minimum building height is measured relative to the finished grade. Minimum height is measured to the highest point of the roof, excluding minor lengths of parapets, cupolas, or other discontinuous projecting features. Continuous parapets or false fronts and peaked or sloped roofs do qualify towards meeting the minimum height. o M. Maximum Height - In all locations, the maximum allowable building height is 45 feet, measured at the tallest part of the building. Minor Projections - Minor projections and special architectural features such as clock towers, bell towers, cupolas and ornamental portions of parapet walls may extend up to 10 feet above the maximum height, provided they make up no more than one third of the length of a building's facade. 2.0 arking, Loading and Unloading Areas A. parking shall be permitted on any street or any place other than parking areas located on a ot. All parking provided on a lot must meet the requirements of City codes and ordin es of the City. From and after the date a building is constructed the owners of such bill . g and building site shall maintain adequate on-site parking spaces and loading fac .ties to serve the needs of each building site, taking into account the building or buildings 10 ated or to be located thereon, and the use made or to be made thereof. B. Separate areas sh be designated for automobile parking, loading, commercial, and storage uses. Loadiri areas shall not encroach into yard setbacks or required off street parking areas of any lot. All parking and drive aisle surface areas shall be either asphalt or concrete and all parking eas including parking islands must be poured concrete curb. Any deviation is subject to ap oval of the ARC. C. Landscaping shall be incorpora . to all parking lots to decrease the visual monotony. The following is the update on activities: Rudnick's Retail Building - The dry cleaner that wants to locate in the building has applied to the City for a Conditional Use Permit. That CUP comes before the City Council on March 20, 2007 for consideration. o Bruggeman Homes - The townhomes have been getting "walk through" traffic each weekend by about twenty individuals during the "Parade of Homes". The sales agent indicates that sales are going very well. They have started construction on more of the attached townhomes as the ones that are up are almost all spoken for. Funeral Home Proposal - They have signed the fmal form of the purchase agreement and are preparing a commercial site plan. The closing on the land sale will be on or before March 27, 2007. NBI Office Development - The EDA amended the purchase agreement as was discussed at the last EDA meeting. The agreement was modified to show Devon Walton is now working for Prudential Metrowide. The City Attorney recommended that REMAX provide a letter indicating that they no longer have any connection to the sale of the property before we could change the real estate firm in the agreement (see attached letter). REMAX has provided us the letter that was needed. MVP Baseball (John Larkin) - The newest letter of intent is before the EDA. The EDA will need to decide if they are willing to sell the lot at the comer of 139th and Hanson to them for a ball training facility. Light Industrial Building (Dynamic Sealing Technologies) - The final form of the purchase agreement is before them for signature. They indicate that they will sign it after attorney has reviewed it. OffICe Development (Northstar Partners) - They have been pursuing office developers/banks and have provided an update of what marketing activities that they have been engaged in (See attached). The most exciting is a prospect that would like to build a 110,000 to 130,000 square foot office building. We will keep the EDA informed of any potential buyers as they materialize. o Restaurant Propects - Staff prepared and mailed out a packet of information to Maynard's Restaurants.
