Enclosed is the staterrent of the 1988 Sewer Service Charges for your cannunity
in accordance with the 1988 Program Budget approved and adopted by the
Metropolitan Waste Control Comnission at the August 19, 1987 neeting.
The total annual estimated charges to your cannunity are to be remitted to the
Comnission in 12 equal rronth1y insta1l.rrents due on the first day of each rronth.
The Comnission will bill each cannunity by mailing a rronthly invoice approxima-
. tely 30 days prior to due date. The first such installment is due on or before
January 1, 1988.
The 1987 Legislature passed an aroondrrent to Minnesota Statutes, Chapter 473c,
which allows for the phasing out of the six (6) service areas over a five-year
period beginning in 1988. Thus, the 1988 area rates reflect the first phase
towards accanplishing the uniform rate for the rretropolitan area by 1992.
Listed below are examples of sewer rates (per 100,000 gallons) fOJi the calendar

Please note that 1987 rates vary from $72.39 for carnnmities with treatment
works only, to $109.08 for those cannunities in Service Area #3. The effect of
the first step of the phase-in can be seen in 1988 where the rates vary fran
$77.95 to $108.14, a difference of $30.19 compared to the difference of $36.69
in 1987. There will be one uniform rate in the rretropolitan area by the year
1992.
The SAC Charge will increase fran $525.00 to $550.00 except for those can-
muni ties who do not have interceptor service where the increase will be fran
$310.00 to $350.00.

As a neans of keeping camunities' well informed, we have enclosed the
Cannission's 1988 Budget. This document will provide you with information on
Cannission programs and projects. Each program budget indicates a description
of the program and total resources required.
The 1988 adopted Operating Budget of $108,349,615 is an increase of $8,800,000
or 8.84% over the 1987 budget. The increase is attributed to the following:

In other \\'Ords, cost for all items, except those seven listed above, show an
aggregate decrease of O\1er $500,000.
The Capital Budget contains requests for additional appropriations for pre-
viously approved projects of $66,765,194. The largest projects in this budget
are $26,000,000 for the Second Phase of the Minneapolis Fast Interceptor,
$15,000,000 for the addition to the Empire Plant, and $8,380,000 for construc-
tion of the Plymouth Interceptor.
The Capital Budget also contains a request for $2,500,000 for various miscella-
neous projects for 1988 as described in the enclosed 1988 Program Budget.
Also enclosed is the Calprehensive Annual Financial Report for Fiscal Year 1986.
The data contained in the Calprehensive Financial Report canplies with GAAP
reporting requirements as attested by our receiving GFOA Certificates of
Achievement for Fiscal Years 1983 through 1985.
We encourage you to contact the Metropolitan Waste Control Cannission if you
have any questions regarding the Cost Allocation for your carmuni ty, the

Brandon's Lakeview
Estates Sketch Plan

The City Council is requested to review the sketch plan. Enclosed
is a copy of the proposed layout from the developers. The 2nd
copy is the proposed and recommended layout from the Andover Review
Committee (ARC).
The ARC has reviewed the sketch plan and their comments and/or
concerns are as follows:
**The proposed sketch plan is within 1000 feet of Round Lake and
therefore the developmenf will be required to satisfy ordinance
number 71 (Shoreland Management)
**Lot 1 Block 1 does not .meet the setback width of 35 feet at 35
feet from front property line.
**Lot 4 Block 1 driveway access shall be located on the west side
of lot to eliminate traffic congestion at the intersection of
Round Lake Boulevard and l44th Avenue.
**Outlot B, C, and D is recommended to be combined as one large
outlot-B. If left alone as out lots A, B, C, and D, C and D
would be landlocked (no access to property)
**There may be a possibility of extending the watermain along east
property of lot 4 for the looping of the system to Creekridge
and other surrounding properties. A feasibility report of this
project will tell us if the looping is needed.
**Soil borings of site will be necessary.
**Berming is recommended along Round Lake Boulevard to height of 5
feet above centerline of Round Lake Boulevard and side slopes of
no more than 4:1.
**Watermain will need to be extended along l44th to service lots 1-4.

435.193 SENIOR CITIZENS OR RETIRED & DISABLED PERSONS HARDSHIP
SPECIAL ASSESSMENT DEFERRAL.
Notwithstanding the provisions of any law to the contrary, any
county, statutory or home rule charter city, or town, making a
speCial assessment may, at its discretion, defer the payment of
that assessment for any homestead property owned by a person 65
years of age or older or retired by virtue of a permanent and
total disability for whom it would be a hardship to make the
payments. Any county, statutory or hom~ rule charter city, or
town electing to defer special assessments shall adopt an
ordinance or resolution establishing standards and guidelines for
determining the existence of a hardship and for determining the
existence of a disability, but nothing herein shall be construed
to prohibit the determination of hardship on the basis of
exceptional and unusual circumstances not covered by the
standards and guidelines where the determination is made in a
nondiscriminatory manner and does not give the applicant an
unreasonable preference or advantage over other applicants.
435.194 PROCEDURE TO OBTAIN DEFERRED ASSESSMENT.
The homeowner shall make application for deferred payment on
special assesments on forms prescribed by the county auditor of
the county in which the homestead is located. Where the deferred
assessment is granted, the auditor shall record a notice thereof
with the county recorder of said county which shall set forth the
amount of the assessment. The taxing authority may determine by
ordinance or resolution the amount of interest, if any, on the
deferred assessment and this rate shall be recorded by the
auditor along with and in the same manner as the amount of the
assessment.
435.195 TERMINATION OF RIGHT TO DEFERRED PAYMENT.
The option to defer the payment of special assessments shall
terminate and all amounts accumulated plus applicable interest,
shall become due upon the occurrence of any of the following
events:
(a) the death of the owner, provided that the spouse is
otherwise not eligible for the benefits hereunder;
(b) the sale, transfer or subdivision of the property or any
part thereof;
(c) if the property should for any reason lose its homestead
status; or
o
(d) if for any reason the taxing authority deferring the
payments shall determine that there would be no hardship to
require immediate or partial payment.

A RESOLUTION PROVIDING FOR THE DEFERMENT OF SPECIAL
ASSESSMENTS FOR PERSONS 65 YEARS OF AGE OR OLDER FOR WHOM
IT WOULD BE A HARDSHIP TO MAKE PAYMENTS.
WHEREAS, Minnesota Statutes authorize the City of Andover
upon proper application, to defer the payment of special assessments against
any homestead property owned by a person 65 years of age or older on
January 1 of the payment year and for whom it would be a hardship to
make the payments, and
WHEREAS, the City Council has determined that the deferral of
assessments should be granted to any person otherwise qualified who shall
make proper application claiming that the annual principal and interest
due on an assessment is in excess of 2J /2% of his current annual income
and, therefore, a hardship for hiIn. The proper application form shall be
provided by the City. Any homestead parcel with an Assessor's Market
Value in excess of $65,000 shall not qualify.

NOW, THEREFORE, BE IT RESOLVED, by the Andover City Council
that special assessments against any homestead property owned by a person
65 years of age or older for whom it would be a hardship to make the payment
be deferred subject to the aforementioned income and property value conditions
upon submission of the appropriate application signed by the qualified person.
FURTHER BE IT RESOLVED that an interest rate of 6% be applied
to the principal and interest of the assessment to be deferred and shall be
payable in accordance with the terms and provisions of Minnesota Statutes.
FURTHER BE IT RESOLVED that the right of deferment is
automatically terminated as provided under Minnesota Statutes.
FUR THER BE IT RESOLVED that applications for deferments for
a particular year must be submitted by October 15 of the preceeding year.
FURTHER BE IT RESOLVED that a copy of the current Minnesota
Statutes relative to deferred assessments for senior citizens is made a part
of this resolution by reference.

Dear Vicki:
I am writing in response to the letter that you received from
the County regarding the erroneous deeds that had been filed in
1962 and 1969. In 1962 the Township of Grow received a deed
from Stephen J. and Laura Nemeth to the property shown on the
attached map in green. In 1969 the Township conveyed to Cletus
N. and Irene H. Kroll property shown in cross-hatched red.
Apparently the County has discovered that there is a 20 foot gap
between the Kroll property which lies south of the south right-
of-way line of 133rd Lane Northwester extended easterly and the
City's property. Mr. Kroll is indicating that it was always the
intent that he was to have this adjacent property and that it
was an error in the deeds at the time of conveyance. Similarly
it would appear that the green property that was conveyed to the
City overlapped on the parcel shown on the half section map to
be owned by Curtis and Hazel Wingness.
Would you please check the old town minutes in 1962 and 1969 to
see whether or not there was any discussion in regard to this
matter.
Also we should determine whether or not the City has any use for
drainage or utility easements, parkland or other purposes over
the property that was originally conveyed to the City. The best
way to resolve this matter would be to obtain a deed from Mr.
Nemeth to Mr. Kroll as to the 20 feet adjacent to Mr. Kroll1s
property. The City could convey any interest that it has in the
Wingness parcel by quit claim deed to Mr. Wingness. This would
still leave a small strip of land that would have to be disposed
of either by conveyance to Mr. Kroll or Mr. Wingness. All of
these transactions would have to be authorized by the City
Council. Would you please put this on the agenda for discus-
sion.

Purchase Conroy Tax
Forfeit Property

The City Council is requested to approve the purchase of the
Conroy property for the sum of $10,188.95. This includes the
property as shown on the attached map.
East parcel is the east 230 feet (see map)
West parcel is the remainder of the property (see map)
The City Council has agreed to sell Mrs. Conroy the east 80
feet for about $2,647.00.
The fire station is planned for this area - between Mrs. Conroy's
80 feet and proposed relocation of Crosstown Boulevard.
We asked the County to keep the price low - it is cheaper than
what we could by the land from a private individual.
The cost to Andover is $10,162 minus the $2,647.00 from Mrs. Conroy
for assessments or $7,515.00.
This doesn't include the old unpaid assessments that are on the rest
of the lot - I recommend that the assessments be left "Canceled"
as they are through the tax forfeiture process.

AN ORDINANCE CHANGING STREET NAME OF WARD LAKE DRIVE TO HANSON
BOULEVARD BETWEEN l77TH AVENUE AND 18lST AVENUE.
THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS:
SECTION 1. The street now shown as Ward Lake Drive from l77th
Avenue to l81st Avenue in Sections 02, Township 32,
Range 24 and Section 03, Township 32, Range 24, City
of Andover, is hereby renamed Hanson Boulevard.
SECTION 2. All ordinances or parts of ordinances of the City of
Andover in conflict with this provision are hereby
repealed.
