Dear Jim:
The 100 year storm detention pond in the above mentioned lot and
block was revised as shown on the drawing. The location of the
ponding area was changed as shown by the contours and the limits of
the drainage and utility easement. The volume of storage remains
as originally proposed at 2.8 acre-feet with the high water level
at 905.5 feet.

The City Council is requested to adopt the attached amend-
ment to Ordinance 8 which will combine the General Industrial
and Limited Industrial Districts into one Industrial District.
A public hearing was held and much comment was made as to why
things should be added or not included.
It is the concensus of the Planning Commission that this
Industrial District would best serve the City of Andover and
would be in conformance with the Comprehensive Plan.

Ordinance 8 Amendment to LI and GI Districts
At the September 8, 1987 joint meeting of the Planning Commission
and the City Council, I was directed to combine the LI and GI
zoning districts into one industrial district with a lighter use.
Enclosed is my proposal for amending Ordinance 8 concerning our
industrial districts.
My proposal calls for the elimination of the General Industrial
(GI) and Limited Industrial (LI) zoning districts and the
creation of a new Industrial (I) zoning district. This
Industrial zoning classification will take over the
headings/classifications of what used to be the Limited
Indistrial district, with some modifications. In other words, GI
references in Ordinance 8 are being eliminated and the LI
references are being replaced with the title (I) Industrial with
some modifications to the permitted and special uses.

RE: Commercial Park/TIF District
Due to the amount of confusion at the October 6 regular meeting
of the City Council concerning the Commercial Park/Tax Increment
Financing District, I am attempting, in this memorandum, to help
clarify the situation.
First I must clarify two terms, Commercial Park-Phase I and
Commercial park-TIF Project Area. Some people have come to think
of the two terms synonymously. However, the Commercial park-
Phase I is just the Sonterre (or the City-owned) property.
The Commercial park-TIF Project Area is the area within the TIF
District where the City is encouraging re-development and where
there is an overall plan for this re-development.
The following actions have occurred concerning the Commercial
Park and TIF District since I started working here on July 27,
1987:
August 4 Special Planning and Zoning Commission Meeting
The purpose of this meeting was to discuss the zoning for
the entire Andover Commercial Park (the TIF Project Area).
August 4 Regular City Council Meeting
Council discussed the status of the plat for the
Commercial Park-Phase I (Sonterre property). Council was
informed of the zoning discussion by the Planning and Zoning
Commission earlier in the evening.
I presented information on the Tax Increment Financing
Policies of other cities. One zoning was mentioned as
desirable for the entire district.

other objectionable influences. Generally, these include
wholesale, service and light industries which are dependent upon
raw materials refined elsewhere. An industrial "park" which
maintains high development standards would be zoned "~I".

Robert Brunswick Variance
On May 5, 1987 our Building Official, Dave Almgren, approved
building plans, permit number 5233, for Robert Brunswick's single
family home. On the front of the plans Dave marked in red that a
minimum one foot (1') overhang was required on all sides. Mr.
Brunswick proceeded to construct the house apparently unaware of
this requirement. Now the house is almost complete and Mr.
Brunswick is requesting a variance to reduce the minimum overhang
to less than the required one foot.
On August 4, 1987 the City Council amended Ordinance 8 so that
the one foot overhang would not be required if the style of the
house dictates otherwise and if the plans are approved by the
Building Official. The Ordinance amendment does not pertain in
this case due to the fact that it was passed after-the plans were
approved.

A RESOLUTION DENYING A VARIANCE REQUESTED BY ROBERT BRUNSWICK TO
VARY FROM THE REQUIREMENT OF ORDINANCE 8, SECTION 8.23 FOR A ONE
FOOT OVERHANG ON A SINGLE FAMILY DWELLING.
WHEREAS, the Planning and zoning Commission has reviewed the
variance request of Robert Brunswick; and
WHEREAS, as a result of such review, the Planning and Zoning
Commission recommends denial of the variance request citing the
following: 1) that although the variance will not be detrimental to
the health, safety or general welfare of the occupants of the surround-
ing properties; 2) that although the variancw will not have an adverse
effect on the scenic and/or property values of the surrounding properties;
3) that although the variance will not have an adverse effect on the
traffic affecting this. property; 4) the variance is not in conflict
with the spirit and intent of the Ordinances of the City of Andover
nor in conflict with the Comprehensive Plan, but it does not meet the
criteria as set out in Section 5.04 of Ordinance 8 a) in that the hard-
ship created must have to do with the chaacteristics of the land and
not the property owner; b) the denial of said variance request does not
deny the applicant reasonable use of the land; c) the variance is
requested because the applicant did not have an approved set of plans
on the site and the request is caused by the oversight; and
WHEREAS, the City Council is in agreement with the reasons as
set forth by the Planning and zoning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover to hereby deny the request of Robert Brunswick to vary
from the requirement of Ordinance 9, Section 8.23 for a one foot
overhang on a single family dwelling on the property at 15421 Silverod
Street N.W.

The City Council is requested to review the water connection
policy. The water Ordinance 155 Section 21 page 1 states;
AWater billing shall start at the time of installation of
the water meter, or in the event the meter is not installed,
seven (7) days after completion of outside piping, and shall
be calculated upon minimum quarterly rate, prorated on a
semi-monthly basis.A (On the special case on Crosstown
Boulevard we required a meter be installed and are reading
the meter but we are not billing the property owner, this is
the only case I know of where someone was connected to the
curb stop and not used the water) Most cities encourage
property owners to connect to the water system...as the user.
charges pay for the maintenance of the water system which
includes fire hydrants."
We are concerned about the security of the water system and the
meter indicates when someone has tampered with the meter.
If we allow the connection to the curb box and no meter we will
have to record this so as to keep track of these and require
another permit and inspection when the meter is installed.

Planning
The City Council is requested to discuss the proposed plan by
John Bergh of Merila & Associates to develop the Melvin Roth
property immediately north and west of the UPA substation (map
enclosed) .
They are proposing to build a single-family development on the
west half of the property (adjacent to Red Oaks Manor 4th
Addition) and a mixed multiple-family (duplex and apartment or
townhottse) development on the east forty (40) acre parcel
(adjacent to Hanson Boulevard). The latter would require a
rezoning because that parcel is currently zoned (GB) General
Business.
They are currently in the process of doing a market study of
multiple-family development potential in Andover and Blaine.
Merila & Associates is also interested in developing a shopping
center at the SW corner of Hanson and Bunker Lake Boulevards.

Gentlemen:
'fhe fOllowing are our recommendations for a second funding of
improvement projects that are being undertaken by the City of
Andover in 1987. Based upon the information we have received
from John Davidson of Toltz, King, Duvall, Anderson &
Associates, and James E. Schrantz, City Engineer, we have
determined the following projects need funding:

In reviewing the cash flow necessary to service the debt on this
bond issue there are sources of revenue outside of special
assessments and connection charges which must be considered.
The City Engineer has advised that approximately 40% of the cost
for the commercial park improvements includes Verdin Street
which will be reimbursed by the County of Anoka. Based upon a
total project cost including overhead of $844,480.00, we have
estimated the County's share to be $337,792.00. It is our
understanding that the City is in the process of negotiating a
Joint Powers Agreement with the County to ensure the payment of
these funds. Since this Agreement has not been finalized we
have estimated that the County will not make this payment until
1990. If negotiations with the County do not include interest
on this amount, the City would be required to bear the cost of
financing the County's share. This could be funded by tax
increment revenues. Also the remaining portion of the
commercial park improvement, not financed by the County, is
projected to be paid by the tax increment generated from the
Good Value housing development. Since the original tax
increment plan was drafted Good Value Homes has delayed any
development on their preliminary plat of Hidden Creek East
pending resolution of the potential hazardous waste problem. We
have prepared a revised projected revenue stream from the Good
Value developments of Hidden Creek 1, 2, and 3 based upon
information provided by Good Value Homes and Darrell Morey. The
projected revenue stream clearly is more than sufficient to
service the debt for that portion of the commercial park
improvements to be funded by the City. The excess tax
increments can be used toward the acquisition costs of the park
which will be funded by another general obligation taxable tax
increment bond sale. We have been informed that the remainder
of the projects shown as 86-05, 86-19, 87-12, 87-22, 87-25,
87-28 and 87-29 have been assessed in 1987 for collections in
1988. TOltz, King, Duvall, Anderson & Associates has assured us
that their calculations indicate that the assessment income and
connection charges for these projects is sufficient to meet the
debt service obliga- tions for that part of this bond issue not
funded by County contributions or tax increment revenues.

Under the City of Andover Public Improvement Financing Policy
adopted by the City Council, public improvements for new
subdivisions and undeveloped areas provide that the developer
shall deposit with the City a cash escrow or a letter of credit
of not less than fifteen (15%) percent of the estimated project
costs as determined by the engineer. Pursuant to the Public

Improvement Financing Policy in effect at the time that the
developments were contemplated, the total project costs shall be
assessed in equal installments over a period not to exceed
fifteen (15) years. All projects in the future, however, will
be assessed over ten (10) years pursuant to the amendment to the
Policy adopted on June 9, 1987. The cash escrow shall remain
intact until the outstanding pr incipal and assessments aga inst
the property is equal to or less than the cash escrow deposit.
At such time, the cash escrow depos it may be used to pay the
balance of the pr incipal outstanding. The Policy further
provides that the assessments shall be paid in full when a
certificate of occupancy is issued. Since nearly all of the
proposed local improvements are being constructed to serve new
subdivisions, therefore, the entire costs as set out above would
be assessed over a fifteen (15) year period.
Since Andover is undergoing a rapid development, it is likely
that a substantial portion of the assessments which are a part
of this project will be prepaid. As we recommended for the
$5,000,000.00 Bond Issue, we are again recommending that you
issue $1,550,000.00 of General Obligation Temporary Improvements
Bonds to finance the construction of these projects. The reason
for such recommendation is that the average interest rate on the
temporary bond issue will be substantially less than on the
permanent bond issue. We believe that at the end of the three
(3) year period, the City will have a definitive idea of the
prepayments and will be in a better position to determine its
capital needs to finance these improvements. At that time the
City would have the following three (3) options:
1. To pay the entire bond issue from the collected assessments
and any additional excess funds the City may have on hand.
2. If development continues to grow at a rapid pace and the
City anticipates that the balance of the areas to be served
by the improvements will be developed shortly thereafter, it
may sell a second three (3) year temporary bond issue.
3. The City may issue permanent long term financing to cover
the costs of funding the temporary obligations.

These decisions can be made at the time of the maturity of the
temporary improvement bonds. We feel that provisions should be
included in the temporary bonds that allows the City to call the
bonds at the end of the first two (2) years thereof. We believe
that this will provide additional flexibility in timing the
refunding of the temporary obligations to correspond with
changes in market conditions as they relate to interest rates.
The major disadvantage to temporary bonds is that the City may
be required to refinance the bonds pr ior to their matur ity in
the bond market whose condi tion cannot be ascertained at the

time. We believe, however, that the call future set out does
provide sufficient flexibility and that the overall reduction in
the costs associated with a temporary bond issue does warrant
their issuance at this time.
A second problem that will arise is the determination as to the
interest rate to charge on the assessment prior to the issuance
of permanent general obligation financing. Normally the City
assesses at approximately one (1%) percent above the rate on the
bonds. However, if the City is required to issue permanent
financing after the maturity of the temporary bonds, this bond
issue will not have been sold at the time of levying the assess-
ments. Therefore, the City will have to make the judgment as to
what interest rate to charge on the unpaid assessments. We
believe that the City should charge interest on the unpaid
assessments at a rate sufficient to cover any upswing in market-
ing conditions from the long-term rates that would be in effect
presently. If, for some reason, the rates were substantially
higher at the time of financing the permanent financing and your
interest rate on the assessments was less than the financing
rate, it would be necessary for the City to ei ther fund the
shortfall out of any excess proceeds or to hold a supplemental
assessment hear ing to increase the rate. The Ci ty Council
should be aware of a potential adverse reaction of such a rate
increase.
The City is currently rated "Baa-In by Moody's and we do not
anticipate an improvement in that rating. The City has over the
past several years issued a large number of improvement bonds
for a city the size of Andover. While we do not anticipate a
decrease in your rating, we nevertheless caution you that there
is a slight chance that Moody's Investors Service may downgrade
the City's rating slightly due to the large amount of debt that
is outstanding in the City.

We recommend that the City obtain another rating from 1I100dy's
Investors Services as such will be necessary for the marketing
of the temporary improvement bonds. The bonds would be dated
December 1, 1987, and the first interest payment would be due on
June 1, 1988. Provision has been made for capitalized interest
to make the June 1, 1988 bond issue payment since we do not
expect sufficient amount of prepayments would be made prior to
that date to fund this interest payment. We are anticipating
that the City will assess this project and levy the same on or
before October 10, 1987. We are providing that the entire
temporary bond issue mature and be refinanced on or before
December 1, 1990, unless called earlier as set out above. We
are recommending that the City authorize the seeking of bids at
their meeting on November 3, 1987. The sale of the bonds would
be held on November 17, 1987. If the award of bids is made on
that date, proceeds would be available approximately thirty (30)
days thereafter.

Dear Mr. Schrantz:
This letter is a follow up to our telephone conversation of Thursday, October 22, 1987
: wherein I once again requested payment of $100,000.00 pursuant to Andover's
agreement with the City of Anoka. As you recall, Andover had agreed to pay to the
City of Anoka the sum of $100,000.00 by August 18,1987 for a connection fee. You
indicated to me that the check had been prepared but Andover was not willin~ to
forward it to Anoka until an agreement has been reached. It remains the pOSItion of
the City of Anoka that drainage area 9 will not be included in the agreement as no
consideration has been made to Anoka for inclusion of this district. Once again, we
hereby request immediate payment of the sum of $100,000.00 plus interest from August
18,1987. If you have any questions regarding this, please call me directly.

WHAT'S HAPPENING

**The trees were removed from the "CLEAR ZONE" in front of Ken
Orr's House on Hanson Boulevard; the clear zone is required by
Highway requirements for traffic safety.

**Creek Ridge Estates erosion control - there is a major problem
with this plat and existing homes and needs our attention - cover
st. dr. as a possible means to improve the back yards for the
interior lots.
**We have appeals from Menkveld and Sonsteby on assessments.
**Hay has us in court on November 9, 1987.
**Tom Anderson has applied for the Park Board Vacancy. Does the
Council want to set up an interview?
**Karen Sowada has taken a different job - Frank is taking
applications for a hourly person to replace Karen or a cleaning
service. We will have this ready for November 17th.

At the city Council Meeting of October 40, 1987, the ction by
the Council to revoke the Special Use Permit of Tonson, Inc.
failed on a vote of 2 yes and 2 no. There was no further action
taken by the Council, and therefore, this item was incorrectly
placed on the agenda for November 2, 1987.
There was discussion about holding the matter over until there
was a full Council, however, no motion was introduced and thus
the status of the Special Use Permit is that it is in full force
and effect since no action was taken on the Revocation by virtue
of the tie vote.
Attached is a memorandum from d'Arcy Bosell detailing the events
of the Waste Management Board's meeting in Monticello on October
22, 1987. If it is the desire of the Council to discuss this
matter in more detail, please advise so that the apropriate
parties can be notified.

Waste Management Board meeting at Monticello

Yesterday I attended the Waste Management Board meeting in regard
to the compliance of Tonson, Inc. with the clean-up schedules and
general information on the operation.
Cecil Heidelberger, Bruce Johnson, Milton LaPanta and myself were
there beside the staff of the Waste Management Board.
Andy Ronchak reviewed his observations at the site, noted that
Tonson was in a position to request reimbursement on Site 1 right
now and Site 2 by the end of October; that the wetlands were also
very close to completion, etc. He further recommended no action
be taken in regard to any time extensions and that, in fact,
Tonson work toward bringing themselves into compliance all the
time.
Cecil Heidelberger had to share with the Board the history of
events on the site including the lawsuits, etc. Basically, he
wants Tonson off the site so he can have the tires back and do
all the recycling himself ...
I presented to the Board a brief summary of my activities since I
was last before them including surprise inspections,
conversations with employees, etc. I also concurred with Andy in
his perception of the clean-up progress that has taken place. I
also requested that the Board not grant any time extensions on
the completion date but instead, encourage Tonson to work toward
coming into compliance at all times.
Milton LaPanta on behalf of Tonson did request again a time
extension, however, neither this one nor the one in August was in
written form and what clout it then has is questionable.
Two things to be aware of:
1. Cecil assumes that he would be issued a SUP to operate a
tire recycling facility if Tonson were out of the
picture
2. If the Revocation of the SUP is made by the City, they
will be gone from the site within 30 days as they are
not willing to fight with anyone anymore.
