PROJECT NO. 88-2 YELLOW PINE STREET
NOTICE IS HEREBY GIVEN that the City Council of the city of Andover,
Anoka County, Minnesota will meet at the Andover City Hall, 1685
Crosstown Boulevard N.W., in the City of Andover, on september 27,
1988 at 7:30 P.M. to pass upon the proposed assessment for the
improvement of Street Construction in the following described area:
Property abutting Yellow pine Street north
of ward Lake Drive
The amount to be specially assessed against your particular lot,
or parcel of land is $2,650.00. You may at anytime prior to
certification of the assessment to the County Auditor, pay the entire
assessment on such property, with interest accrued to the date of
payment to the City Treasurer. No interest shall be charged if the
entire assessment is paid within 30 days from the adoption of this
assessment. You may at any time thereafter, pay to the City
Treasurer the entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such payment is
made. Such payment must be made before October 15 or interest will
be charged through December 31 of the succeeding year. If you decide
not to prepay the assessment before the date given above the
assessment shall be payable in equal annual installments extending
over a period of 10 years and shall bear interest at the rate of 7.44
percent per year. The right to partially prepay the assessment is
not available.
The proposed assessment roll is on file for public inspection at
the City Clerk's Office. The total amount of the proposed assessment
is $15,876.00. Written or oral objections will be considered at the
meeting. No appeal may be taken as to the amount unless a signed,
written objection is filed with the Clerk prior to the hearing or
presented to the presiding officer at the hearing. The Council may
upon such notice consider any objection to the amount of a proposed
individual assessment at an adjourned meeting upon such further
notice to the affected property owners as it deems advisable.
An owner may appeal an assessment to District Court pursuant to
Minnesota Statutes Section 429.081 by serving notice of the appeal
upon the Mayor or Clerk of the City within 30 days after the adoption
of the assessment and filing such notice with the District Court
within ten days after service upon the Mayor or Clerk.

to adopt the following:
A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR THE IMPROVEMENT OF
BITUMINOUS STREET CONSTRUCTION (YELLOW PINE STREET) FOR
IMPROVEMENT PROJECT 88-2 FOR CERTIFICATION.
WHEREAS, pursuant to proper notice duly given as required by law,
the Council has met and heard and passed upon all objections to the
proposed assessment for the improvement of bituminous street construction.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ANDOVER, MN:
1. Such proposed assessment, a copy of which is attached hereto
and made part hereof, is hereby accepted and shall constitute the special
assessment against the lands named therein, and each tract of land therein
included is hereby found to be benefited by the proposed improvement
in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of 10 years, the first of the installments
to be payable on or before the first Monday in January, and shall
bear interest at the rate of 7.44 percent per annum from the date
of the adoption of this assessment resolution. To the first installment
shall be added interest on the entire assessment from the date of this
resolution until December 31, 1988 To each subsequent installment
when due shall be added interest for one year on all unpaid installments.
3. The owners of any property so assessed may, at any time prior
to certification of the assessment to the County Auditor, pay the whole
of the assessment on such property, with interest accrued to the date
of payment, to the City Treasurer, except that no interest shall be
charged if the entire assessment is paid within 30 days from the adoption
of this resolution; and he may at any time thereafter pay'to the City
Treasurer the entire amount of the assessment remaining unpaid, with
interest accrued to december 31 of the year in which such payment is
made. Such payment must be made before October 15 or interest will be
charged through December 31 of the next succeeding year.

certification of the assessment to the County Auditor, pay the entire
assessment on such property, with interest accrued to the date of
payment to the City Treasurer. No interest shall be charged if the
entire assessment is paid within 30 days from the adoption of this
assessment. You may at any time thereafter, pay to the City
Treasurer the entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such payment is
made. Such payment must be made before October 15 or interest will
be charged through December 31 of the succeeding year. If you decide
not to prepay the assessment before the date given above the
assessment shall be payable in equal annual installments extending
over a period of 15 years and shall bear interest at the rate of
7.44 percent per year. The right to partially prepay the assessment
is not available.
The proposed assessment roll is on file for public inspection at
the city Clerk's Office. The total amount of the proposed assessment

WHEREAS, pursuant to proper notice duly given as required by law,
the Council has met and heard and passed upon all objections to the
proposed assessment for the improvement of watermain and sanitary
sewer.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ANDOVER, MN:
1. Such proposed assessment, a copy of which is attached hereto
and made part hereof, is hereby accepted and shall constitute the special
assessment against the lands named therein, and each tract of land therein
included is hereby found to be benefited by the proposed improvement
in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of 15 years, the first of the installments
to be payable on or before the first Monday in January, and shall
bear interest at the rate of 7.44 percent per annum from the date
of the adoption of this assessment resolution. To the first installment
shall be added interest on the entire assessment from the date of this
resolution until December 31, 1988 To each subsequent installment

Attached is a complete budget for your review along with the
resolution, Form 280 and form to be submitted to Anoka County with
Andover's 1989 levy. I have adjusted some figures in the revenue;
the total revenue remained the same.
The City levy limit is $906,259 with an over levy of $100,009.
The over levy is down from last year because the Fire Department
and Public Works building is off the levy which was about $55,000.
A levy that we canceled last year brought down the mil rate in the
amount of about $25,000 and is back on. Therefore, it still
reduces the over levy available to the City by about $30,000 (or
from about $134,000 to approximately $100,000). The other $4,000
is the reduction in the individual levy that makes up the
$100,009.
For 1989, the state placed the City on a new

system (see attached chapter 719, article 5).

The County Auditor's office told me Andover tax capacity for 1989
is $10,430,861. Andover's share of the 1988 mil rate was about
13% in District 11. (14.168 of 109.048) and 13.9% in District 15
(14.168 of 101.814) 13% of $10,430,861 is $1,356,012. Andover's
proposed 1989 is $1,006,268 which is about 75% of the City's tax
capacity.

an Ameridata employee moonlighting from his "regular" job.
This support is of marginal value. The cost of this support
is minimal.
o The moonlighter is not a reliable source for long term
comprehensive support on the NMS software.
o The NMS fund accounting, cash disbursements, purchase order
and payroll software is not being used.
o The ASI office automation software is not being used.
o Both the word processing and spreadsheeting software are being
used and are adequately supported.
o The hardware is performing in an acceptable fashion.

downstream lands and wate~s in the City of Andover and adjacent
communities du~lng and after development.

Engineer. Said plans and specifications will be a part of the
development contract and compliance will be assured by the
development bond. No development shall be permitted until said
plan is approved by the City Engineer.
17.02 Required Control Measures. The following control
measures are required for an erosion and sediment control plan:
a. The plan shall be suited to the topogragraphy and soils
so as to create least erosion potential.
b. The land shall be developed in increments of workable
size on which adequate controls of erosion and siltation can be
provided and maintained during the construction period.
Operation shall be staged so that the area being developed is not
exposed for long periods of time without stabilization.
c. Temporary vegetation and/or mulching shall be used to
protect the areas exposed during the development. No area shall
be left denuded for a period longer .the S days on critical
erosion areas from initial grading. Such period may be exte~ded
if satisfactory control measures are established and remain in
place. This determination will be made by the City Engineer.
d. Sediment basins (debris basins, desilting basins, or silt
traps) shall be installed and maintained to remove sediment from
runoff waters from the land undergoing development. Storm sewer
inlets shall be provided with debris guards and microsilt basins
to trap sediment and avoid possible damage from blockage. The
silt shall be removed when necessary.
e. Permanent vegetation and structures shall be installed
within 30 days after completion of initial grading.
f. Xf the control measures required by items 3.a, 3.b, 3.c,
3.d and 3.e are not installed or maintained by the developer, no
additional building permits shall be issued within the
development until the necessary measures are placed in control.
g. Erosion control practices shall follow the design
criteria as shown in u.S. Department of Agriculture Soil
Conservation Serivices Urban Runoff, Erosion and Sediment Control
Handbooks.

17.03 Financial Guarantee. Before any grading is started on
any site, appropriate control measures as shown on the plan shall
be installed. A $2,000 per acre financial guarantee shall be
provided to the City to insure compliance during construction.
$1,000 of this amount shall be by cash deposit. The remaining
amount shall be by an exclusive letter of credit providing for
withdrawal of the funds by the City within one work day. this
financial guarantee will not be returned until all the disturbed
area has permanent vegetation re-established. The City will use
the guarantee for the penalty included in Item Sa and if any
invoice for work performed by the City is not paid within 30
days.
17.04 Enforcement Measures.
a. Developers will be given a 48 hour notice by telephone
when an unsatisfactory condition exists that is determined to be

THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS:
Ordinance No. 10 is hereby amended as follows:
SECTION 7. PRELIMINARY PLAT.
7.02 Procedure.
f. The Planning Commission shall conduct the hearing on 'the
preliminary plat and shall make its report to the Council within

If the Council shall disapprove said plat, the grounds for
any such disapproval shall be set forth in the proceedings of the
Council and reported to the subdivider within seven (7) days
thereafter.
SECTION 17. EROSION AND SILTATION CONTROL

17.01 Erosion and Sediment Control Plan. For the purpose of
alleviating harmful or damaging effects of on-site erosion and
siltation on neighboring lands and waters in the City of Andover
and adjacent communities during and after development adequate
controls of erosion and sedimentation of both a temporary and
permanent nature shall be provided by the developer during all
phases of land-disturbing activities. Plans and specifications
for such controls shall be submitted to and approved by the City

a developer's responsibility. After said 48 hour notice, the
city will proceed to do the work and invoice the developer.
b. In addition to the actual cost incurred by the City, the
developer will be charged an additional 100% as a penalty for not
having adequate erosion control. If a timely payment is not
received, the City will proceed to draw on the financial
guarantee.
c. Builders will be given a notice at the time of building
permit issuance that erosion control on the lot being built upon,
and street cleanup of any and all materials originating from the
lot being built upon, are their responsibility. No inspections
will be approved if the street is not clean and erosion control
in place. In the event the City is required to clean the street,
the builder will be billed and payment received prior to any
further inspection or occupancy permit.
17.05 street Cleaning. Included within the Development
contract shall be the requirement for street cleaning if
needed, as determined by the Public Works Director.

It was felt that some of the contr-ol measur-es such as

MOTION by Bosell, Seconded by Jacobson, r-ecommend Planning and
Zoning Commission r-ecommend to the City Council adoption of an
amendment to Or-dinance 10 as pr-esented by the City Planner-. It was
the Intent of the Planning Commission to clar-ify some pr-ocedur-es, add
some definitions, and most impor-tantly, to add a a new section to
Or-dinance 10 which would deal with er-osion and siltation contr-ol, as
the development over- the last two year-s has shown that our- or-dinance
is lackIng In r-egar-d to e~osion control. We have not r-eceived any
negative r-esponse fr-om developer-s at this point in time, and would
r-ecommend the adoption of this ordinance amendment by the City

The CommIssIon felt the CouncIl should address whether SectIon 17 can
specIfIcally apply to plats that are already In place and are In the
process of constructIon.

Street Light Policy

The City Council is requested to discuss the method we will be
using to assess/bill/etc. for street lighting.
We have three types of installation now:
1. Anoka Electric installs; bills Andover monthly for facility
(cost of light installation and interest), energy and
maintenance.
2. Anoka Electric installs; bills Andover for cost of the
lights and installation; and bills monthly for energy
and maintenance.
3. Anoka Electric installs; bills the developer for cost of
the lights and installation; and bills the City monthly
for energy and maintenance.
The attorney has advised us that the cost of the lights and
installation should be assessed.
I am not sure, at this writing, if the costs need to be certified
or can be billed quarterly.
Oh yes the City will bill quarterly for street lights similar to
water and sewer. The billing will be on the water and sewer bills
in the water and/or sewer area.
The Council has scheduled a public hearing on street lights for
the October 4th regular meeting. I am not sure that I know
exactly what the process is. I will talk to Bill Hawkins.
